Wednesday, August 18, 1965 BOARD MEMBERS PRESENT: John Mandrell, Herbert Day, Richard Harlow. BOARD MEMBERS ABSENT: None. AREA VARIANCE NO. 65-62 Applicant: Doyle & Shields Developgent;'.Co._.-".Inc. To allow the construction of a wall in a tract to exceed the maximum height limit in the front and side yard setbacks as per plot plan submitted. Located on the southwest corner of Edinger Avenue and Ballantine Lane and on the southwest corner of Edwards -Street and Flint Drive., Legally described as Lots 77 and 18 of Tract 5929.'•. John Mandrell stated that he had.received a call from the applicant's representative requesting that they be heard last or. continued until August 25, 1965. Board discussion followed. A MOTION.WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO CONTINUE AV NO. 65-62 UNTIL LATER IN THE AGENDA AT THE APPLICANTIS REQUEST. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 65-63 Applicant: Thomas C. Buck To allow one wing of the main dwelling to encroach to within 10 ft. of the rear property line in deviation to the required 20 ft. rear yard setback in the R-1 Single Family Residence District. Located at 18321 Roberta Circle. Legally described as Lot 22 of Tract No. 2558. the audience. explained the proposal. comment, the hearing was closed. The hearing was opened to Mr. Buck the applicant, There being no further Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY,HARLOW TO APPROVE AV NO. 65-63 FOR THE FOLLOWING REASONS: 1. The lot isc€ an irregular shape. -1- 8/18/65 Page No. 2 Minutes: H. B. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO.'65-64 Applicant: The Meredith Co. To allow certain lots in a residential subdivision to have less than 60 ft. frontage at the setback line in the R-1 Single,Family Residence District. Located east of Brookhurst Street between Adams and Indianapolis Avenues. Lengthy legal description on file in the Planning Department Office. The.hearing was opened to the audience; there being no comment, the hearing was closed. Board discussion followed. It was noted that on August 17, 1965 the Planning Commission established a policy to measure the lot frontage at a point 20 ft. back from the front property line. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE AV NO. 65-64 FOR THE FOLLOWING REASONS: 1. The subdivision was designed prior to the change of the ordinance in September_'1964, requiring lot widths to be measured at the 15 ft. front setback line. 2. The Planning Commission has initiated a change in the Ordinance to allow lots to be measured at a point 20 ft. from the front property line. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 65-62 Applicant: Doyle & Shields Development Co.. Inc. The hearing was reopened on Area Variance No. 65-62. John Sullivan, representing the applicant, explained the reasons for the request. It was noted that previous cases of this nature were approved for aesthetic reasons. John Mandrell stated that the wall would have to be constructed on private property. Further discussion followed. Mr. Sullivan stated that his architect would prepare a proposal to submit to the Board for their consideration at their next regular meeting. �2- 8/18/65 Page No. 3 Minutes: H. B.
