HomeMy WebLinkAbout1965-08-25MINUTES Council Chamber, Civic Center Huntington Beach, California Wednesday, August 25, 1965 Mayor Pro Tem Stewart called the Special Adjourned Meeting of the City Council of the City of Huntington Beach to order at 5:30 P.M. The Pledge of Allegiance was given by all present in the Council Chamber. ROLL CALL Councilmen Present: Stewart, Lambert, Welch, Gisler Councilmen Absent: Shipley On motion by Lambert, seconded .by Welch, the meeting was adjourned to an Executive Session in'the Administrative office. 46Before a vote was taken on the motion, Mr. William Reed of the Huntington Beach Independent, a weekly newspaper circulated in Huntington Beach, filed official protest to the holding of an Executive Session on the subject under consideration, as follows: "Since last Friday's Special Council meeting, legal counsel has advised us that the motion stated for the purpose of this Special Meeting tonight does not permit an Executive Session, as none of the exclusion privileges under the Ralph M. Brown Act apply. On behalf of the West Orange Publishing Corporation, an official protest to the calling of an Executive Session is hereby made. To prevent a delay in resolving the current issue facing your honorable body beyond asking that this protest be entered in the minutes, no further action will be taken at this time." Attorney Milford Dahl of the law firm of Rutan and Tucker of Santa Ana, who have been employed by the Assistant Administrator with the approval of the City Council to represent them in all matters re- lating to the subject of this Special Meeting, addressed the Council and advised them that they do have the right to adjourn to Executive Session on this matter. Following the ruling set down by Attorney Dahl, a vote was taken on the motion to adjourn to Executive Session, and the motion carried. The members of the Council then left the Council Chamber to go to the Administrative office. On the return of the Council to the Council Chamber, Mayor Pro Tem Stewart called the Special Adjourned Meeting of the Council again to order. Mayor Pro Tem Stewart requested Attorney Dahl to comment on discussion held in the Executive Session of the Council for the benefit of the Press. Attorney Dahl stated that the City Council feels that it is essential that the Assistant City Attorney, Legal Secretary, and Law Library facilities be moved to the Civic Center, and that they further will provide an office in the Civic Center for the use of the City Attorney when he is acting as such, if he so desires. Mr. James D. Plunkett, City Attorney, addressed the Council and informed them that he believed the Assistant City Attorney, Legal Secretary, and the Law Library should remain in the Attorney's office. 336 Page #2 - Minutes, August 25, 1965 Following the discussion on the matter, a motion was made by Lambert, seconded by Welch, that proper litigation and proceedings necessary to establish the City Attorney facilities and office at the City Hall be undertaken, and that the firm of Rutan and Tucker be instructed to accomplish this. Motion carried. On motion by Lambert, seconded by Gisler, the Special Adjourned Meeting of the City Council of the City of Huntington Beach adjourned at 7:13 P.M. Motion carried.
