Monday, August 30, 1965
Mayor Pro Tem Stewart called the regular adjourned meeting of the
City Council of the City of Huntington Beach to order at 7:50 P.M.
in the Council Chamber.
The Pledge of Allegiance was given by all present in the Council
Chamber.
ROLL CALL
Councilmen Present: Welch, Gisler, Stewart, Lambert
Councilmen Absent: Shipley
,0 M. J. MAJOR - REQUEST REDUCTION OF DANCE FEE
The Clerk presented a request from Michael J. Mayor for elimination
or reduction of the $50.00 per night feet for dances at the Pavalon.
On motion by Welch, seconded by Lambert, Council took the request of
Mr. Major under consideration and directed the City Clerk to place
the matter on the Agenda for the meeting of September 7th, 1965.
Motion carried.
;L ,MEADOWLARK VOLUNTEER. FIREMEN - SOLICITATION
On motion by Welch, seconded by Gisler, Council granted the Meadowlark
Volunteer Firemen's Association permission to sell tickets for a
Pancake Breakfast to be held on Saturday, September 11, 1965. Motion
carried.
fJ HB CO NOTICE TO TERMINATE AGREEMENT - GOLF COURSE
On motion by Lambert, seconded by Gisler, a letter from the Huntington
Beach Company giving three year notice to terminate an Agreement dated
March 1, 1959 which allows use by the City of the property being used
as a Municipal Golf Course, was received and ordered filed. Motion
carried.
.3/ COMMUNITY BUILDERS COUNCIL MEETING - HUNTINGTON HARBOUR
The Clerk presented a letter from Huntington Harbour Corporation in-
forming Council that they had been invited,to make a presentation to
the Urban Land Institute at the next Community Builders' Council
Meeting in Boston, September 29th through October 1, 1965, and
inviting any or all members of the City Council or City Planning
Commission to attend and review and offer criticism of several
specific planning exercises to be presented by Huntington Harbour.
On motion by Welch, seconded by Gisler, Council directed the Mayor
to take the matter under advisement with the possibility of designat-
ing Councilmen and Planning Commissioners to attend the Community
Builders Council Meeting in Boston. Motion carried.
/o C.T.C. SALE 975 -- TRACT 281 - BLOCK E - LOT 115
The Clerk presented a request from the County Tax Collector for the
City's consent or objection to the sale of a parcel of property legally
described as Tract 281, Lot 115, Block E, stating that the minimum
bid by the City must be $300.00
On motion by Lambert, seconded by Gisler, Council objected to the sale
of Lot 115, Block E, Tract 281, known as Tax Collector Sale No. 975,
and directed the City Clerk to notify the County Tax Collector, and
further directed the Mayor and City Clerk to execute the agreement
therefor. Motion carried.

RECREATION COMMISSION -PARK SITE ACQUISITION
On motion by Lambert, seconded by Welch, a communication from the
City Recreation Commission recommending that the City acquire the
thirty acre site at Taylor and Edwards Street for a park, was received
and ordered filed, Motion carried.
q0 HB CO. EXCHANGE OF PROPERTY - EXTENSION OF TIME
The Clerk presented a letter from the Huntington Beach Company and
the Southern Pacific Company, extending the time limit for acceptance
of the offer of exchange of real property, as per letter dated
June 3, 1965, from thirty (30) days to one hundred eighty (180) days
from said date,.
On motion by Welch, seconded by Gisler, the letter
extension of time from the Huntington Beach Company
Pacific Company, from thirty to one hundred eighty
and ordered filed, Motion carried.

Clapp commending the Chief of Police and Police Department for their
handling of situations arising on the beach, was received and ordered
filed. Motion carried.
IfARCHITECT CONTRACT - PARKS
q The Assistant City Administrator reported that the contract between
Richard and Associates and the City, would be ready for consideration
at the meeting of September 7, 1965.
On motion by Welch, seconded by Lambert, Council deferred action on
acceptance of the contract between Richard & Associates and the City,
until the meeting of September 7, 1965. Motion carried.
RESOLUTION NO. 2230 - FIXING TAX RATE

TAX RATE FOR SAID CITY OF HUNTINGTON BEACH FOR THE FISCAL YEAR

On motion by Lambert, seconded by Welch, Resolution No. 2230 was
passed and adopted by the following roll call vote:
AYES: Councilmen: Welch:, Gisler, Lambert, Stewart
NOES: Councilmen: None
ABSENT: Councilmen: Shipley
PUBLIC HEARING - USE VARIANCE //780 - LAMB
Mayor Pro Tem Stewart announced that the public hearing which was
opened at the meeting of August 2, 1965 and continued to August 30,
1965, would be heard at this time.,
Mr. Bruce W. Sumner, Attorney for Mrs. Walter Lamb, addressed the
Council and questioned whether or not the action being taken was on
an appeal, He was informed by the City Attorney that the hearing
was proceeding under Section 9837 of the Huntington Beach Ordinance
Code - revocation from delay.
Mr. Jerry Madney, 19846 Leighton Lane, City, President of the
Huntington Continental Homeowners' Association No. 2, addressed the
Council and objected to spot zoning in the area and requested
revocation of Use Variance #780.

Mr. Mark Porter, 19842 Providence Lane, City, addressed the Council
and protested the construction of a trailer park in the area adjacent
to Rl zoning, and further protested allowing construction which had
not been started within the six month period.
Mr. Warren Hall, 9381 Nantucket, City, Vice -President of the Glen
Mar Homeowners' Association, addressed the Council and protested the
proposed trailer park and the granting of Use Variance No. 780,
stating that he felt it may have possibly been granted in.error. He
then read excerpts from the Ordinance Code relative to RA Zoning.
Mr. Robert Dingwall, 19791 Estuary Lane, City, President of the Sea
Haven Homeowners' Association, addressed the Council and requested
a report by the Planning Director on the hardship involved in the
subject variance, and submitted a comparative data sheet of mobile
homes as against standard homes.
Mr. Mark Porter addressed the Council and read page two of the soil
report relative to the locations of the test holes, and gave his
reasons why Council should revoke Use Variance #780.
The Public Works Director addressed the Council and gave a resume'
of the soil conditions existing in the area.
Following discussion by the Council of soil conditions, Mr. A. G.
McConnell, 10112 Forrestal Drive, City, addressed the Council and
protested the proposed trailer park in the residential area.
Mr. Jack Fabian, 9432 Blain Circle, City, President of the Huntington
East Homeowners' Association, addressed the Council and requested
Council to consider the revocation of Use Variance #780.
Mr. Bruce Sumner, Attorney for the proponent of UV e?80,again
addressed the Council and presented a list of conditions of the Use
Variance to the Councilmen and read same, and reviewed the cronology
of action taken to date by the Planning Commission, Council and Mrs.
Lamb.
Mr. William T. Corum,Santa Ana, Engineer who prepared the soil test
experiments on said property, addressed the Council and presented
a visual soil test example, showing the layers of peat and soil in
all the test holes on said property, and stated that he felt the.use
for development of standard homes was not feasible.
Mr. Donald Ayres, Newport Beach, addressed the Council, and stated
that the development proposed would be a high type mobile home
development and a credit to the area and the City.
Rebuttal statements were given by Home Owners Association represen-
tatives Warren Hall, Jerry Ma.dney, John Knapp and Robert Dingwall;
and closing statementson behalf of the proponent of UV #780 were given
by Attorney Bruce Sumner,
There being no one further present to speak on the matter, and their.:
being no further protests filed, the hearing was closed.
On motion by Gisler, seconded by Lambert, Council sustained their
previous decision on Use Variance #780,and ordered that the Use
Variance continue in effect. Motion carried,
PERSONNEL - SYLVIA WAITE - INTE€tMEDIATE TYPIST CLERK
4n motion by Lambert, seconded by Gisler, Council.authorized the
employment of Sylvia R. Waite as intermediate Typist Clerk, Range 29-A,
in the City Clerk's Office, effective September 1, 1965. Motion
carried.

PERSONNEL - ENGINEERING AIDE - RUDY ROSALIO
On motion by Lambert, seconded by Gisler, Council authorized the
employment of Rudy La.hep Rosalio as an Engineering Aide in the Public
Works Department, Range 36-A, effective September 1, 1965. Motion
carried,
V PERSONNEL - MECHANIC FOREMAN - WALTER PITTILLO
The City Administrator presented a recommendation from the Director
of Public Works for the employment of Walter A. Pittillo as Mechanic
Foreman in Range 40-C, effective September 1, 1965.
The Clerk read Resolution No. 2251 in full - "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE
APPOINTMENT OF MECHANIC FOREMAN WALTER A. PITTILLO AT COMPENSATION
GREATER THAN THE MINIMUM COMPENSATION FIXED AND DETERMINED BY ORDINANCE.
On motion by Gisler, seconded by Lambert, Resolution No. 2231 was
passed and adopted by the following roll call vote:
AYES: Councilmen: Welch, Gisler, Lambert, Stewart
NOES: Councilmen: None
ABSENT: Councilmen: Shipley
PERSONNEL - POLICEMAN - BRIAN MOORE
The City Administrator presented a recommendation from the Chief
of Police for the employment of Brian F. Moore as a Policeman in
Range 39-B, effective September 1, 1965.
The Clerk read Resolution No. 2229 in full - "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE
APPOINTMENT OF POLICEMAN BRIAN F. MOORE AT COMPENSATION GREATER
THAN THE MINIMUM COMPENSATION FIXED AND DETERMINED BY ORDINANCE."
On motion by Welch, seconded by Gisler, Resolution No. 2229 was
passed and adopted by the following roll call vote:
AYES: Councilmen: Welch, Gisler, Lambert, Stewart
NOES: Councilmen: None
ABSENT: Councilmen: Shipley
PERSONNEL - POLICEMAN - JIM LAIL
On motion by Lambert, seconded by Gisler, Council authorized the
employment of Jim K. Lail as a Policeman in Range 39-A, effective
September 1, 1965, Motion carried.
POLICE CHIEF TO ATTEND CONFERENCE
On motion by Welch, seconded by Lambert, Council authorized the
Chief of Police to attend the Ninth Annual Treasury Enforcement
Agencies Coordinating Conference Catalina on September 2nd and 3rd,
1965, with reasonable expenses allowed. Motion carried.
ASST CIVIL DEFENSE DIRECTOR TO ATTEND CONFERENCE
On motion by Welch, seconded by Lambert, Council authorized the
Assistant Director of Civil Defense to attend a two day conference
at the Disneyland Hotel on September 16, 17, 1965, with reasonable
expenses allowed, not to exceed $30.00. Motion carried.

INFORMAL MEETING - 9 7 65
Mayor Pro Tem Stewart called a meeting of the Council as an informal
Committee -of -the -Whole for Tuesday, September 7, 1965, at 7:00 A.M.,
for a study session.
ADJOURNMENT
On motion by Welch, seconded by Lambert, the regular adjourned meeting
of the City Council of the City of Huntington Beach, adjourned.
Motion carried.
