COMMISSIONERS ABSENT: Lawson. MINUTES: On motion by Miller and seconded by Worthy, the Minutes of the Huntington Beach Planning Commission of August 37 1965, were accepted as transcribed and mailed by the Secretary. USE PERMIT NO. 65-15 - Continued Applicant: Huntington Pacific Corporation To permit the construction of a planned development containing 107 apartment units and extending more than 150 ft. from a public street in the C-1 Neighborhood Commercial District and C-1-0 Neighborhood Commercial District combined With oil production. Located on the south side of Highway #1 between 6b Street and 9tb Street. Lengthy legal description on file in the Planning Department Office. The Secretary read a letter submitted by the State Lands Commission stating that Mr. Davidson, Senior- Civil Engineer of the State Lands Commission will contact:the Planning Department in the near future to discuss the problem of locating the ordinary high water mark, The Secretary informed the Commission that a meeting has been scheduled for September 17, 1965, with the State Lands Commission, H. B. Company, and the City -and suggested that Use Permit No. 65-15 be continued to September 21, 1965. Kachickas Change of Zone from R-3 Limited Multiple Family Residence District to M-1 Light Industrial District. Located on the northwest corner of Warner Avenue and Gothard Street. Legally described as the south 210.00 ft. of the east 190.00 ft. of the west half of the southeast quarter of the southwest quarter of Section 23, Township 5 South, Range 11 West, in the Rancho La Bolsa Chica, City of Huntington Beach,County of Orange, State of Califdrnia, as said section is shown on a map recorded in book 51, page 13', of M�sdellaneous Maps, in the office of the County Recorder of said county. Commissioner Worthy abstained from any discussion because of a possible conflict in interest. The Staff Report was read by the Secretary. The hearing was opened to the audience. Carlos Revees, 213 Main Street, Huntington Beach, addressed the Commission and spoke in favor of the subject zone change. Ralph Shannon, Yorba Linda,,Calif., addressed the Commission and gave a detailed presentation favoring the proposal. Ed Goodsman, representing the Pacific Drive -In Theatres,, addressed the Commission and expressed concern over lighting from an industrial use reflecting into the Drive -In Theatre. hearing was closed. There being no other comment, the ;, 15It Gommission discussion was held. The Planning Director pointed out that the Master Plan of Land Use for this area is somewhat vague because a freeway interchange is indicated at the intersection of Gothard Street and Warner Avenue. -2- 9/8/65 Page No. 3 Minutes: H. RESOLUTION NO. 523 A Resolution of the City Planning Commission Recommending Denial of Zone Case No. 523 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY KAUFMAN TO ADOPT RESOLUTION NO. 523 RECOMMENDING DENIAL OF ZONE CASE NO. 523 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The applicant intends to establish a commercial use at the half -mile intersection which is contrary to the Planning Commission Policy. 2.. Planning Commission interpretation of the Master Plan of Land Use indicated an R-3 Zone for the subject parcel. ROLL CALL VOTE: AYES: Basil, Kaufman, Crabb. NOES:, Miller; Larkin. ABSENT: Lawson. ABSTAINED: Worthy. THE RESOLUTION WAS ADOPTED. ZONE CASE NO. 530 Applicant: Huntington Harbour Corporation Change of Zone from R-1 Single, Family Residence District to R-3 Limited Multiple Family Residence District. Located on the north side of Morningstar Drive, 317 feet from its intersection with Saybrook Lane and legally described as a portion of the W16 of Section 20-5-11. Further legal description on file in the Planning Department Office. The hearing was opened to the audience; there being no comment, the hearing was closed. The Secretary informed the Commission that this zone change is a minor adjustment and the parcel being rezoned is part of Tentative Tract No. 5963. RESOLUTION NO. 530 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 530 to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO. 530 RECOMMENDING APPROVAL OF ZONE CASE NO. 530 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. This zone change is a minor adjustment which will establish the proper zone boundaries. ROLL CALL VOTE: AYES: Crabb, Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Lawson. THE RESOLUTION WAS ADOPTED. ZONE CASE NO. 531 Applicant: Deane Brothers Change of Zone from R-1 Single" Family Residence District to C-1 Neighborhood Commercial District with setback provisions. Located at the northwest corner of Atlanta Avenue and Newland Street and legally de8crib6d as the E'ly 195 ft. of the S' ly 187 ft. of the SWy4, Section 12 -6-11. The Staff Report was read by the Secretary. The hearing was opened to the audience. Jim Deane, applicant, addressed the Commission and gave his reasons for the request. There being no other comment, the hearing was closed. It was noted that the Master Plan of Land Use designates the subject property as low density residential. The property is outlined for low density development on the Master Plan of Land Use* 2. A condition,,of approval on Tract 6028 was that the subject property be included as a residential lot(s). 3. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. Elias Miller, 6303 Wilshire Blvd., Los Angeles, addressed the Commission and explained the reasons for his request. Ted Douglas, Northridge Lanes Huntington Beach, addressed the Commission and opposed the zone change. the hearing was closed. There being no other comment, -5- 9/8/65 Page No. 6 Minutes: H. B6 Planning Commission Wednesday, September 8, 1965 The Secretary pointed out to the the Commission that a study was previously conducted to determine commercial acreage needs for the area situated between Westminster Avenue, Edinger Avenue, Bolsa Chica Street and Goldenwest Street. He further pointed out that the Planning Department re-evaluated that study and a balance between property zoned for commercial use and the ultimate demand for commercial acreage has been reached. RESOLUTION NO. 532 A Resolution of the City Planning Commission Recommending Denial of Zone Case No. 532 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO. 532 RECOMMENDING DENIAL OF ZONE CASE NO. 532 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Rezoning this property would create an imbalance between property zoned for commercial use and the ultimate needs for commercial acreage. 2. A subdivision at this location would cause extreme traffic problems. ROLL CALL VOTE: AYES: Crabb, Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Lawson. Planning Commission Wednesday, September 8, 1965 1. The business shall be restricted to one room only in the dwelling and all material, equipment or facilities shall be kept therein. 2. No garage shall be used in connection with such business, except for parking of business vehicles. 3. Only persons residing on the premises may be employed. 4. There shall be no display of merchandise, products, operation, signs or nameplates of any kind visible from outside the dwelling. 5. In no way shall the appearance of the dwelling be altered or the operation of the business within the dwelling be such that the dwelling may be reasonably recognized as serving a non-residential use, whether by colors, materials, construction, lighting, windows, signs, sounds or any other means. 6. There shall be no storage of materials, supplies, equipment or products outside of the one room of the dwelling used for a home occupation. 7. The occupation shall not generate pedestrian or vehicular traffic beyond that normal to the neighborhood in which it is located. 8. The occupation shall not involve the use of commercial vehicles for delivery of materials to or from the -premises. 9. Any commercial vehicle or equipment used in conjuTiction with the occupation shall not be parked on the street or in the front yard of the premises. 10. The occupation shall not create noise, odor, dust, vibration, fumes, or smoke readily discernible at the boundaries of the parcel on which it is situated,. nor create any electrical disturbances adversely affecting the operation of any appliance: or equipment not on the same parcel. 11. If any complaints have been registered regarding the conduct of such business during the period for which it has been licensed, a review and determination on the renewal of said license shall be made by the City Council. 13. An affidavit shall be signed by the applicant at the time he takes out a business license. He shall certify that he understands all conditions of approval. USE VARIANCE NO. 847 Applicant: The Central Baptist Church of Orange County To allow the construction of a church and elementary Christian School and to allow the church to immediately erect two Modular relocatable classroom buildings for Sunday School and temporary chapel use for a five year period while the permanent facilities are being constructed.. Located on the north side of Warner Avenue, 150 feet east of Nichols Street in the R-A Residential Agricultural District and legally described as Lots 1, 4, 77 20 to 29 inclusive, 31, 32, 46 to 59 inclusive, 72 to 75 inclusive, 78 to 85 inclusive, 98 to 111 inclusive, 124 to 137 inclusive, 150 to 163 inclusive, all in Block "B" of Tract 196. The Staff Report was read by the Secretary. The hearing was opened to the audience. Mr. Leifell, Coordinator for The Central Baptist Church, addressed the Commission and requested that Condition #2 be changed to allow all temporary structures to remain until -permanent structures are completed. He further requested that the Commission postpone requiring construction of a 6 ft. high masonry fence, because the church is in the process of acquiring additional land. Murdock, 10061 East Edgewood; Garden Grove, addressed the Commission and asked about access to the lots which are surrounded by the proposed church, George Shibata, Assistant City Attorney, addressed the Commissioni and suggested-l-that Use Variance No. 847 be continued -to enable Mr.,Murdock-and representatives from the church to get together and agree on -access to -the land locked lots. Morris To permit the renewal and continued use of property for automobile wrecking and dismantling purposes for a period of 5 years in the M-1 Light Industrial District, Located approximately 500 feet north of Talbert Avenue on -the east side of Gothard Street, also known as 17852 Gothard Street, and legally described as a portion of the E16, SE/4, SW/4, Section 26-5-11, Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. Robert Morris, applicants addressed the Commission and gave his reasons for the request. He further queotioned the'.requirement of dedication and improvement I f Gothard Street, Bill Hartge, Deputy Director of Public Works, addressed the Commission and stated that the dedication of Gothard Street will have to be made, improvements installed within 2 years and a bond shall be posted guaranteeing said improvements. George Burnett, previous owner of said property addressed the Commission and spoke in favor of the request. Lawrence Richards, accountant for the applicant, addressed the Commission and also spoke in favor of said variance. the hearing was closed. There being no other comment, -10 9/8/65'. A MOTION WAS MADE BY MILLER AND SECONDED BY CRABB TO APPROVE USE VARIANCE NO. 848 UPON THE FOLLOWING CONDITIONS: 1. Gothard Street shall be dedicated to City Standards. Improvements :shall be installed within two years and a bond shall be posted guaranteeizig said improvements. 2. A water system shall be installed to Department of Public Works and Fire Department Standards. 3. Drainage fees shall be paid. 4. Access roads shall be provided within the wrecking yard for fire protection. Said roads shall remain free and accessible at all times and said roads shall be approved by the Fire Department. 5. A 40 ft. front yard setback from existing right-of-way shall be provided. Off-street parking shall be provided within said setback to City Standards. The existing 8'ft. fence shall - be replaced. 6. A plan which depicts dedication, off-street parking, and relocation,of the fence shall be submitted for approval by the Planning Department. -7. Guy To allow the storage, purchase and sales of new and used boats, a mobile home to be used as an office and the construction of a 6 ft. fence in the front yard setback. Located at the northeast corner of Highway 1 and Beach Blvd., and legally described as a portion of the NW/4, SWA, Section 13-6-11. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. Raymond Guy, applicant, addressed the Commission and explained the proposal. He requested that the Commission grant the subject variance for more than one year. There being no other comment the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 850 UPON THE FOLLOWING CONDITIONS: 1. Use Variance 850 shall become null and void September 81 1966. 2. There shall be a 50 ft. building setback line on both Highway 1 and Beach Boulevard. Within said setback there shall be no structure or fence over 42 inches in height and there shall be no display of merchandise. 3. To allow the construction of a room addition and the waiver of parking requirements in the R-2 Two Family Residence District. Located at the northeast corner of Ill Street and Magnolia Avenue and legally described as the W'ly 58.75 ft. of Lots 2 and 4, Block 510, Main Street Section. Also known as 502 - llth Street, Huntington Beach, California. The Staff Report was read by the Secretary. The hearing was opened to the audience. Ted Way, representing the applicant, addressed the Commission and spoke in favor of the request. the hearing was closed. There being no other comment, Commission held a lengthy discussion. It was noted that the garage is connected to another garage on an adjacent lot. If the garage were allowed to be attached to the house it would perpetuate a r' non=conforming situation and create serious construction problems. He stated that the parcel was purchased under the assumption that it could be improved and resold; 4owever$ the City will not issue a building permit on any parcel unless it has been created through proper subdivision procedures. The Oommig8ion reviewed the request and It was their unanimous recoffiV116ation that UV //5607 be denied because the applicant's proposAl has an inadeqUat6 turning radius and the carport should have a net dimension, of IS ft% by 19 ft. Planning Commission Wednesday, September 81 1965 PLANNING DIRECTOR The Planning Director,ask the Commission to consider eliminating the policy of posting property involving zone changes inasmuch as all property owners within 300 feet of the change are notified by mail. The Commission considered the Planning Director,'s request and it was their unanimous opinion that property should n9t be posted and this policy would continue for a period of 6 months at which,time it would be re-evaluated. COMMUNICATION The Secretary read a communication submitted by the Assistant Building Director regarding town houses, row houses and small lot or common green projects. It was the consensus to continue said communication, hold a special study meeting on October 26 and invite various interested people to participate in a discussion on statutory condominiums.
