MINUTES: On motion by Miller and seconded by Larkin, the Minutes of the Huntington Beach Planning Commission of August 17 and August 24, 1965, were accepted as transcribed and mailed by the Secretary. The Planning Director informed the Commission that on Friday, September 17, 1965,a joint meeting was held between the State Lands Commission, Huntington Beach Company, and the City. He stated that as a result of this meeting the State Lands Commission has agreed to investigate the question of State Tidelands and that they should be prepared to present their position within two weeks. USE VARIANCE NO. 847 - Continued Applicant - The Central Baptist Church of Orange County To allow the construction of a church and elementary Christis n School and to allow the church to immediately erect two Modular relocatable classroom buildings for Sunday School and temporary chapel use for a five year period while the permanent facilities are being constructed. Located on the north side of Warner Avenue, 150 feet east of Nichols Street in the R-A Residential Agricultural District and legally described as Lots 1, 4, 71 20 to 29 inclusive, 31, 32, 46 and 59 inclusive, 72 to 75 inclusive, 78 to 85 inclusive, 98 to 111 inclusive, 124 to 137 inclusive, 150 to 163 inclusive, all in Block "B" of Tract 196. The Secretary read a letter and a telegram both submitted by Mr. Dolph Anderson, 2403 N. 25t Street, Idaho, objecting to the subject variance. The Secretary ,informed the Commission that the public hearing was continued from their last meeting bec- .se of a legal question on easements and that the Assistant City Attorney was to have a report for the Commission. George Shibata, Assistant City Attorney, addressed the Commission and stated that as long as the property owner had access to his lot the application could be approved. The hearing was opened to the audience. Mr. Leifell, Coordinator for The Central Baptist Church, addressed the Commission and requested that condition #2 be changed to allow all temporary structures to remain until permanent structures are completed. He further requested that the Commission postpone requiring construction of a 6 ft. high masonry fence, because the church is in the process of acquiring additional land to the east. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 847 UPON THE FOLLOWING CONDITIONS: 1. A change of,zone application from RA to R-3 shall be filed prior to final inspection of any structure. 2, All temporary uses and/or structures shall be completely removed by September 8, 1970. 3. Warner Avenue shall be dedicated and improved to City Standards. Improvements shall include street trees and street lights. 4. Drainage fees shall be paid. 5. A grading plan and drainage of the property shall be approved by the Department of Public Works. A drainage easement may be required by the Department of Public Works. 6. A water system shall be installed to Department of Public Works and Fire Department Standards. 7. All facilities shall cic�ply with Title 19 of the Health and Safety Code. 8.; The flood control channel shall be fenced to Flood Control District Standards. 9. There shall be a six foot high masonry wall constructed along the east and west property line, except said wall shall not exceed 42 inches in the front 10 feet. Said wall shall be constructed by September 8, 1967. 10. All required parking shall conform to Section 9201.3.5 of the Huntington Beach Ordinance Code. 11. The Secretary informed the Com- mission that this application cannot be heard because there was an error made in the mailing out of public notices and that the Planning Department has set it for hearing on October 5, 1965. ZONE CASE _N.0, 533 or Precise Plan 65-1 ALIGHNMENT OF CANNERY STREET BETWEEN BANNING AVENUE AND COAST HIGHWAY. The Secretary informed the Commis- sion that a recent purchase of land by the City at Cannery Street and Banning Avenue, plus negotiations for street right-of-way with Edison'Company has brought about this public hearing to establish a precise plan for the alignment of Cannery_ Street between Highway 1 and Banning Avenue. He stated that the Department of Public Works has requested that this matter be set for public hearing. The hearing was opened to the audience, there being no comment it was closed. RESOLUTION NO. 533 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 533 - Precise Plan 65-1 to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO. 533 - PRECISE PLAN 65-1 RECOMMENDING APPROVAL OF SAID PLAN TO THE CITY COUNCIL. ROLL CALL VOTE. AYES. Lawson, Crabb, Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT. None. THE RESOLUTION WAS ADOPTED, ZONE CASE NO. 534 - AMENDMENT TO MASTER PLAN OF LAND USESTUDYAREA II AND STUDY AREA 111. The Planning Director informed the Commission that this master plan amendment was initiated for two basic reasons. First, to determine an ultimate need for commercial acreage and, secondly, to modify the master plan and reflect current land use and zoning. Richard Harlow, Associate Planner, addressed the Commission and presented results of the study. He. stated that the total amount of commercial master planned for this area is approximately 24 acres plus 4.13 acres for Post Office use and that the amount of commercial acreage required is In -balance with the amount provided for by the master plan. -6- 9/21/65 Page No. 7 --Minutes e H. . He stated that the following people will be -present: Ron Foell, Cedric Sanders, Wally MitchelT*Martin Denton and one of the Huntington Harbour's Attorneys, The Planning Director informed the Commission that he would not be present at the September 28, 1965, study session and that Richard Harlow§ Associate Planner, will sub- stitute, RICHARD HARLOW Richard Harlowt Associate Planner informed the Commission that the Board of Zoning Adjustments is considering a request 'to allow eaves within 6 inches of the side property line on lots with 3 ft., side yard. He stated the condition would only occur on garages and within the front 7 feet, He asked if the Planning Commission had considered the possibility of eaves encroaching into the required yards when they approved the original variance for 3 ft, side yards, -9- 9/21/65 Page No. 10 Minutes: H. B.,Planning Commission Wednesday, September 21, 1965 Kermit Dorius, architect for Hercules Construction explained the reaons for their request which is before the Board of Zoning Adjustments. Ralph Jensen, representing Hercules Construction, also explained the proposal and their problem. The Commission reviewed the request and it was the consensus that this situation was not considered when the original variance was Iapproved. Zasper, Civil Engineer, re- questing an interpretation on whether or not a mexican restaurant including incidental. sale of beer and wine would be a permitted use in the C-1 Neighborhood Commercial District. The subject property being located at the northeast corner of Adams Avenue and Cannery Street.
