BOARD MEMBERS ABSENT: None. AREA VARIANCE NO. 65-75 Applicant - Richard Kent Ashby To allow a dwelling to encroach to within 5 ft. of the rear;)property line in deviation to the required 20 ft. rear yard setback; and, to allow said dwelling to encroach to within 10 ft. of the front property line in deviation to the required 15 ft. front yard setback in the R-1 Single Family Residence District. Located on the northeast corner of Finisterre Drive and Sea Witch Lane. Legally described as Lot 69 of Tract 5132. The hearing was opened to the audience. It was noted that the Planning Department received phone calls from Dr. Marvin Beitner of 3942 Finesterre Drive and James K. Gibson of 3932 Finesterre Drive. Dr. Beitner's objection was that the buioding would look like an apartment rather than a single family home. Mr. Gibson objected because he didn't feel there was a need for an area variance due to the large lot. A letter from Huntington Harbour was read by the Chairman recommending approval of the request. Mr. Ashby, the applicant, stated his reasons for the request. Mr. Ray Oliphant, representing Huntington Harbour, spoke in favor of the request. Herbert Day displayed a plot plan of the houses in the vicinity of the lot in question. Mr. Ashby pointed out his lot and various examples of his request to the Board. John Mandrell stated that all the houses in the area were conforming to the Huntington Beach Ordinance Code. Mr. Oliphant stated that Huntington Harbour Corporation would develop the abutting empty lots in approximately one year. He further added that the proposed structure was an asset to the area. Mr. Ashby displayed his plans to the Board. Herbert Day pointed out that -the wing wall extending into the front yard was illegal. -1- 10/6/65 Page No. 2 Minutes: H. B. Board of Zoning Adjustments Wednesday, October 6, 1965 Further discussion followed pertaining to the setbacks and location of the proposed structure. It was noted that several lots in the area are undeveloped and the plans of development have not been established. Mr_ Ashby felt that his house plans could not be altered but_ that the size of the garage could be reduced. Mr. Oliphant stated that it was the wish of Huntington Harbour that the house face on Finesterre Drive for aesthetic reasons. Further discussion followed. It was noted that a variance was in effect for all water front houses in Huntington Harbour to have 10 ft. front yard setbacks. There being no further comment the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO APPROVE AV 65-75 WITH THE FOLLOWING CONDITIONS: . 1. There shall be a 10 ft. rear yard setback. 2. The owner of the adjoining lots on Sea Witch Lane shall apply for a variance for 10 ft. front yards on one third of the lots in said block. FOR�LTHE FOLLOWING REASONS: 1. The property is being treated as a reverse corner lot. 2. The request is aesthetically beneficial to the area. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None.
