BOARD MEMBERS ABSENT: None. y" MINUTES: The Minutes of September 29, 1965, and October 6, 1965 were accepted as transcribed. AREA VARIANCE NO. 65-76 Applicant - Robert I. Blau, M. D. To allow a wall to encroach to within 13.5 ft. of the front property line in deviation to the required 15 ft. front yard setback; and, to allow said dwelling to encroach to within 15 ft. of the.rear property line in deviation to the required 20 ft. rear yard setback in the R-1 Single Family Residence District. Located at 16822 Edgewater Lane. Legally described as Lot 281 of Tract No. 5360. The hearing was opened to the audience, there being no comment, the hearing was closed.. It was noted that the house itself was constructed, but proposed additions made this variance necessary. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE AV NO. 65-76 FOR THE FOLLOWING REASONS: 1. There is sufficient sight clearance at the driveway, thus no traffic hazards is created. 2. There will be adequate rear yard remaining. 3. The property is question in an irregular shaped lot. 4. Similar requests in the area have been approved. ROLL CALL VOTE: AYES: MANDRELL, FERGUSON, HARLOW NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 65-77 Applicant - J. T. Hyepock To allow a 4 ft. 10 in reduction of,the-required 15 ft.-between main buildings -in the R-2 Two Family Residence District. Located on the east side of Cameron Street, 248 ft. south of Slater Avenue. Legally described as the N16 of Lot 13 in Tract No. 405. The hearing was opened to the audience; there being no comment, the hearing was closed. -1- 10/13/65 Page No. 2 Minutes: Board of Zoning Adjustments Wednesday, October 13, 1965 Board discussion followed. It was noted that the applicant: based his future plans on the old restrictions and allowed only 10 ft. 4 in. between dwellings. He then built the first and last houses thereby, limiting the area in which the remaining houses were to 'be built. It was also noted that if the applicant knew the changes were going to be made he could have conformed to them by reducing the rear yard area. It was the consensus of the Board that Mr. Hyepock was the victim -of circumstances. John Mandrell, Chairman, requested the installation of street improvements on Cameron Street. A MOTION WAS MADE BY FERGUSON AND SECONDED BY MANDRELL TO APPROVE AV NO. 65-77 BASED ON THE AFOREMENTIONED REASONS AND SUBJECT TO THE FOLLOWING CONDITIONS: 1. Cameron Street shall be dedicated and fully improved to City Standards. 2. Street sections shall be determined by soil "R" value, and traffic index. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. Drainage of the property shall be approved by the Department of Public Works. 5. The property shall participate in the local drainage assessment district. 6. Retaining walls shall be provided where there is a difference in elevation of one (1) foot between ad- joining lots or lots abutting City right-of-way. 7. The water, and fire hydrant system shall be approved by the Fire Department. 8. Off-street parking facilities including number, arrangement, access, paving and striping of all parking spaces shall meet all adopted ordinances and the latest adopted Planning Commission Standards. 9. No structures, other than those shown on the approved plot plan, shall be constructed within the ROLL CALL VOTE: AYES: Mandrell, Verguson- 'Marlow. NOES: None . 1. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 65-78 Applicant - Doyle Development Co. To allow a dwelling to encroach to within 10 ft. of the front property line in deviation to the required 15 ft. front yard setback i_n the R-1 Single Family Residence District. Located on the north side of Shields Drive, 300 ft. from the intersection of Lovell Drive. Legally described as Lot 23 of Tract 4882. -2- 10/13/65 Page No. 3 Minutes: H. B. Board of Zoning Adjustments Wednesday, October 13, 1965 The hearing was opened to the audience; there being no comment, the hearing was closed. Board discussion followed. It was noted that similar requests have been approved in the past. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE AV NO. 65-78 SUBJECT TO THE FOLLOWING CONDITION: 1. A record of survey shall be filed with the County Recorder's Office on lots 23, 34, and 35, to guarantee a 20 ft. rear yard setback for the subject lot. FOR THE FOLLOWING REASONS: 1. The request will onlF involve a corner of the house: 2. The lot is -setback from the other houses on the block. 3. The lot is situated -at the widest portion of the cul-de-sac thereby causing a setback further than'most of the other lots on the block. ROLL CALL VOTE: AYES: MandrellI Fergus -ni -Harlow. NOES: None ;3 ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO. 65-25 Applicant - Do711e Development Co. To allow the adjustment of lot lines on 3 separate parcels. Located on the north side of Shields Drive, 300 ft. from the intersection of Lovell Drive. Legally described as Lots 23, 34, and 35 of Tract 4882. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE DV NO. 65-25 SUBJECT TO THE FOLLOWING CONDITION: 1. AREA VARIANCE NO. 65-79 Applicant - Fred ?. Mayer To allow a roof to extend 6 ft. into the 10 ft. rear yard setback in the R71 Single Family Residence District. Located at-16721 Bolero Lane. Legally described as Lot 43 of Tract 5050. -3- 10/13/65 Page No. 4 Minutes: H. B. Board of Zoning Adjustments Wednesday, October 13, 1965 The hearing wam opened to the audience. Mr. Mayer, the applicant, explained his request. Board discussion followed pertaining to the overhang. Mr. Mayer stated?that he was facing in a southwesterly direction and that the rain and sun were creating hardships on the property. John Mandrell, Chairman, stated that the other houses in the area were in the same circumstance and that he found no hardship on the property. Sam Ferguson stated that the rear yards had been reduced from 20 ft. down to 10 ft. and that a 5 ft. overhang was allowed by ordinance. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO DENY AV NO. 65-79 FOR THE FOLLOWING REASON: 1. The applicant failed to show sufficient justification for the request. ROLL CALL VOTE: AYES: Mandrell, Ferguson; Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT NO. 65-19 Applicant - Rhea Mae Sayre To allow the construction of an 8 unit apartment building and attached garages in the R-3 Limited Multiple Family Residence District. Located on the south side of Stark Street, -approximately 200 ft. west of Beach Boulevard. Legally described as Lot 88 of Tract 417! The hearing was opened to the audience. Stan Sher, representing the applicant, explained the request. It was noted that a 25 ft. drive with a 40-ft.'turn-around was needed due to the fact that they are setback 150 ft. from the street. Mr. Sher stated that the changes would cause a change in the basic design. He further added that the project was started before the ordinance had changed. Board of Zoning Adjustments Wednesday, October 13, 1965 Mr. Sher, representing the applicant found that a continuation of the request to October 20, 1965 was acceptable so that he could revise his plot plans.
