Mayor Shipley called the regular meeting of the City Council of the
City of Huntington Heath to € rder at 7 o 30 P MM-
The Pledge of Allegiance was given by all present in the Council
Chamber.
The Invocation was given by Rev. dames Doli , Valley Baptist Church.

MINUTES
On motion by Lambert, seconded by Stewart, the minutes of the Regular
Meeting of October 4, 1965, were approved as transcribed and mailed.

DEPARTMENTAL REPORTS

On motion by Lambert, seconded by Gisler, the monthly reports of the
Chief of Felice, Collector, Treasurer rer and Chamber of Commerce Manager,
were approved and ordered filed. Motion carried.
PROPOSED CITY CHARTER
y= The Clerk presented a copy of the proposed City Charter which liar]
been submitted to the Council by the Citizens' Charter Revision
Committee, together with a recommendation that if be submitted to
-the electorate at a Special Election, as soon as possible.
Mr. Kenneth Lawson, Chairman of the Charter Revision Conun ttee,
addressed the Council and elaborated on the work of the Committee
and the recommendation for Special Election of the earliest possible
date
Can motion by Welch, seconded by Gisler, Council set a public hearing
for Wednesday, November 3, 1965 at 7 o 36 o'clock P.M., or as soon
thereafter as possiblefor the purpose of considering the proposed
City Charter as submi.ti ed by the Charter Revision Committee. Motion
carried.
The Clerk presented a request from the Newport Wiest. Homeowners
Association for a 4-way stop at bushard. Street and Hamilton A -venue,
inasmuch as the southwest corner of the intersection is a blind corner.
On motion b-v Lambert, seconded by Welch, Council referred the request
for a 4-wad ,stop at pushard Street and Banning Avenue to the Traffic
fic:
Engineer and the Director of Public Works- for study and report.
Motion carried.
The Clerk presented a letter from the Neu -port West Homed rner--& Associa-
tion, drawing attention to the danger to school children attending
John H. Ead r School_ who use the narrow flood control bridge for
pedestrian traffic.
Can motion by Stewart, seconded by Welch, Council referred the
communication front the Newport east Homeowners Association regarding
the Fanning Street Flood Control Bridge, to the Traffic Engineer and
Director of Public Works for study and report. Motion carried.

SUPPORT REUESTED _ CITY OF LONG BEACH
The Clerk presented a request from the City of tong Beach, for
Council to notify Go-vernor Brown of its support € f Assemblyman
. ford f s request to make it a felony to possess, throw or otherwise
use a "Molotov Cocktail"; and further, requesting that the matter
be considered as a, s-pac-i_al item in this Legislative ass -ion,
On motion by Lambert, seconded by Welch, Council directed the City
Attorney to prepare a Resolution in support of Assemblyman Mulford e s
request, and directed that copies of the Resolution be forwarded to
the City of Long Beach, .Assemblyman Mulford and Governor Brown.
Notion. carried.
CLAIM AGAINST THE CITY ® JOHN SHEA
The Clerk presented a claim from John W. Shea for damages sustained
when his car struck a crosswalk sign which was lying on its §i€le
between two wes-tbs imd traffic lanes on the Coast Highway, cast of
First Street
On Laotian by Lambert, seconded by Welch, Council denied the claim
for damages filed by John W. Shea for property damage, and :n.e erred
the matter to the City Attorney and the City's insurance carrier.
Motion carried.
ORAL COMM- UNI C A`t` I ON
Mayor Shipley* announced that this was the time when any person
having a matter to bring before the Council could address that Body
in regard thereto.
Mae Hangoy, 6942 Canterbury Circle, City, addressed the Council and
read a letter which had been mailed by the Mayor to various residents
in the City, concerning the Huntington Beach Community Concerts
Association. Mr. Bangoy then read an open .letter to the Editor of
the Huntington Beach Independent Newspaper concerning the promotion
by the City of Huntington Beach Community Concerts Association,
and requested that said letter be made a matter of record in the
€ mutes. Mr. Hangoyns letter is attached hereto.
The City Administrator explained the Music and Promotion Tax Fund
which had been established by an Ordinance of the people in 1914.
Mayor hipl ey explained his position in the matter and stated that
he had reimbursed the City for cast of materials and postage used.
Councilman Welch went on record as supporting Mayor Shipley in his
endeavors in promoting the Huntington Beach Community Concert
Association..
Councilman Stewart stated that he felt that any future endeavors
involving the City should have Council approval. first.
Councilman Lambert addressed the Council and stated that he felt
clearance should first be obtained through the City Administrator
to eliminate misunderst,andi_ gs.
Jerry Matnny, 19846 Leighton Avenue, City, addressed the Council on
behalf of the people of the City, in support of the Mayor in his
efforts to promote the Huntington Beach Community Concerts
Association.
PUBLIC HEARING ® ZONE CASE NO. 531 m APPROVED
+4,1 Mayor Shipley announced that this was the day and hour set for a
public hearing on Resolution No. 531 of the City Planning Commission,
recommending denial of Zama Case No. 531, on --property located on
the northwest corner of Atlanta .Avenue and Newland Street, and
directed the Clerk to read the legal notice.

OPEN LETTER:
CONCERNING THE HUNTING" BEACH COMMUNITY CCNCERTS A330CIATION
On October 13, 1965, 1 received an invitation to attend a no -host brunch
to be held October 16, 10:00 AN at the Sheraton Beach Inn. The purpose
is to organize and conduct a membership drive during the week beginning
October 18, 1965. This letter, on City letterhead stationery and envelope
with a City postal meter stamp and signed by the "Mayor, City of Huntington
Beach", has caused me to ask one question:

HUNTINGTON BEACH COWMTY CCNCERTS ASSOCIATION." ? ? ? ? ? ? ? ? ? ? ? ? ?
If the answer_ to the auestign i=
(1)e then obviously the City Clerk has record of the council action
which authorized the expenditure of funds and requested or
permitted the Recreation and Parks Department to participate
in the membership drive. It's too bad the newspapers didn't
know about it because it would certainly help the membership
drive.
(2). Then why didn'tt the City Council appropriate any money requirid
to promote the Community Concerts Association from the special
property tax fund collected for "Music and Promotion" which on
June 30, 1964 contained $185,994.17? This would eliminate the
need to solicitate 1000 memberships at a fee of $7.00 each for
the purpose of importing culture to Huntington Beach.
(3). Should not the City Council have considered the services of the
Huntington Beach Chamber of Commerce which already receives
financial support from the City for conduction of promotional
events within the city? Again, to eliminate or reduce the
amount of money and minimise the effort to have concerts within
the city.
(4) Could not the City Attorney have assisted in the organisation
of this group to insure that the group is incorporated as a
non-profit corporation for the protection of the membership
and city with regard to taxes and liabilities and to further
reduce the cost to organise such a group?
(1) Then the City Council should clarify their position by some
formal action since solicitation for memberships have been
mailed -out using city letter -head stationery, envelopes and
the city postage meter, and is signed by the "Mayor , City
of Huntington Beach! This misleads the receipients to beleive
the City fathere are organising this group at taxpayers expense.
(2) The 8ouncil should review the role of the Recreation and Parks
Department in the use of city employees and city telephone
service to particlpaste in the membership drive for this group
if it is not endorsed by the city.
(3) The Council should direct Dr. Donald Shipley, to be more discreet
in the use of his title of "Mayor, Huntington Beach", if he is
not acting in behalf of the council or city government in
promoting this group, (i.e., he could signature as President
of the cultural association Ad Nm#or of Huntington Beach).
(4) The council should ask the City Attorneys opinion about the
continued use of city letterhead stationery, envelopes,
postage meter and employees for large scale mailings when the
matter is not official city business.
I sincerely hope that appropriate answers are available to the above
questions because at the best it appears to involve:
1. A misuse of city funds for stationery and postage,
2. Abuse of the office by the Mayor to promote a self -defined
need to import vulture,
3. Raises a big question of why this group must solicits paid
memberships when the city has for many, muW years imposed
a "Music w4 Promotion Tax" upon all businesses and residential
property within the city.
In conclusion... YES, I will "mist the formation and.solicitation of
membership for such a group... just as soon as somebody can tell me Why
there is a sic and Promotion A& on m4 propwVI

There being no one further present to speak on the matter � and there
being no protests filed, either oral on written, the hearing was
classed by the Mayor.
The Planning Director addressed the Council and gave a resume' o
the planning Commission's reasons for recommending denial. of Zone
Case No. 531.
On motion by Gisler, seconded. by Welch, Council overruled the
decision of the Planning Commission and directed the City Attorney
to prepare an Ordinance effecting the change in Zama Case No. 531..
Motion carried.

Mayor Shipley announced that this was the day and hour set for a
public hearing on an application for a Certificate of Need and
Necessity to operate an Ambulance Service in the City, and -directed
the Clerk to read the legal notice,

as possible, on Monday, the 18t day of October, 1965, in the Council
Chamber of the Civic Center, Huntington Beach, California, as the time
and place for a public hearing for the.purposenof considering an
application of Need & Necessity to opera .e a n ambulance service
within the City of Huntington Beach, submitted by the Coast
Ambulance Service.
The Clerk informed the Council that he had not received the application
of Need & Necessity from Mr. George Goodwin of Coast Ambulance
Service, and therefore there was no reason for the hearing,

re'vie'ured and that because of questionable compliance with
specifications, recommended that he be authorized to select the
bidder of the three ;how bids who most closely complied with the

Can motion by Stewart, seconded by Lambert, Council authorized the
Purchasing Agent to purchase two 1966 Dump Trucks for the Public
Works Department, less trade-ins, from the bidder of the low three
bids who most closely comply with the specifications, and rejected
all either bids. Motion carried.

of a recommendation for termination of Cleanup Bond and Drilling
Bond on Oil Well Copeland #9, located at the southeast corner of
Ed arils Street and Schleicher Avenue.
On motion by Lambert, seconded by Gisler, Council authorized
termination of United Pacific Insurance Company Drilling Bond
No. B-423372 and Cleanup Bond Noy B-423373, and directed that the
owner be notified. Motion carried.

The Clerk presented a transmittal from -the Director of Public

requesting a cro.ssing guard at Edwards Street and Claire Drive,
for children attending Circle View School. This item had been

The Clerk presented the application for business license for

The Clerk presented the request -rom the Gol.denwest Homeowners
Association for "Children at Play" signs at each entrance to the
tract, which had been referred to the Traffic Engineer, and Director
of Public Works at the meeting of October 4, 1965. The Clerk then
read a letter from the Goldenwest Homeowners Association infor°a ing
Council that ,they had studied the matter more thoroughly with the
Auto Club, and requesting withdrawal of their request.
SIGN REMOVAL APPROVED - CHILDREN AT PLJAY
On motion by Lambert, seconded by Stewart, Council directed the
Public Works Director to remove the "Children at Play" signs along
tire streets near the, Lake Pare. Clubhouse and the Recreation Center.

municipal pier. The Cameron's have an option to buy from the present
Lessee, Lonnie T. Davis, if Council approves the assignment or
authorizes-- the issuance of a. how lease.
On motion by Welch, seconded by Gisler, Council approved the
assignment of the lease between. the City and Lonnie T. Davis for
the bait stand on the pier, to Earl and Maybell.e Cameron9 for the

The Clerk presented petitions submitted by proponents.pf the Boltsa
Chita #5 Annexation, together with the Glerk's affidavit certifying
that the signatures are those of registered voters in the area and,
that the number of signatures arr e in excess of one-fourth of the
number of all qualified electors in the area.. He also submitted
the County Clerk's affidavit of sufficiency -of petitions, and road
