COMMISSIONERS ABSENT: Worthy, Miller. MINUTES: On motion by Crabb and seconded by Bazil, the Minutes of the Huntington Beach Planning Commission of September 21 and 28, 1965, were accepted. as transcribed and mailed by toe Secretary. COMMISSIONER MILLER: Commissioner Miller arrived at 7:35 P.M., and assumed his duties. USE VARIANCE NO. 861 Applicant - Gray Miller To allow the construction of a two -,car carport in deviation to the required 2 fully enclosed off- street parking spaces in the R-1 Single Family Residence District. Located approximately 130 feet east of Gregory Lane, fronting on Laura Circle and legally described as Lot 3, Tract No. 3534. Also known as 8352 Laura Circle, Huntington Beach, California. The Secretary informed the Commission that he received a telephone call from Mr. Miller requesting that this item be placed at the beginning of the agenda because he has to attend another meeting at -8:30 P.M. The hearing was opened to the audience. Chairman Kaufman asked if Mr. Miller was present. There being no comment, the hearing was closed. Planning Commission Tuesday, October 19, 1965 USE PERMIT NO. 65-15 - Continued Applicant - Huntington Pacific Corporation To permit the construction of a planned development containing 107 apartment units and extending more than 150 ft. from a public street in, the C-1 Neighborhood Commercial District and 0-1-0 Neighborhood Commercial District combined with oil production. Located on the south side of Highway #1 between 6tn Street and 9th Street. Lengthy legal description on file in the Planning Department Office. The Planning Director informed the Commission that the State Lands Commission is waiting for a consultant's report on the question of accretion along the beach. He suggested that the hearing be continued to November 16, 1965 meeting. A MOTION WAS MADE BY BAZIL AND SECONDED BY LARKIN TO CONTINUE THE HEARING ON USE PERMIT NO. 65-15 TO NOVEMBER 16, 1965, FOR THE AFOREMENTIONED REASON. To allow a commercial building to have a 56 ft. height ii, deviation to the 50 ft. height ' , limitation in the'C-2 Community Business District. Located on the north side of Edinger Avenue, approximately 2,000 feet west of Beach Boulevard, and legally described as being a portion of the SW/4, SEy4, Section 14-5-11, Further legal description on file in the Planning Department Office. The hearing was opened to the audience, there being no comment it was closed. The Secretary informed the Commission that this area variance is before the Commission because the applicants want to construct a two story building plus a roof -top equipment room that will have a total height of 56 feet. Planning Commission Tuesday, October 19, 1965 It was noted that two similar requests were recently approved for -adjacent buildings and the reasons given were that 'the property is adjacent to a freeway, it is suited for high-rise plus the center is isolated from adjacent properties. To,allow the construction of a church and Sunday School in the R-1 Single Family Residence District. Located at the northwest corner of Garfield Avenue and Gregory Lane and legally described as being a portion of the SE/u-1� of the SW/�+, of Section 36-5-11. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. Robert Schwerdtfeger, representing the applicant, explained the request and various problems encountered while preparing the plans. Mr.. Rubin Dobkin, owner of the subject property addressed the 'Commission and spoke in favor .of the variance. Gray Miller, 8352 Laura Circle, Huntington Beach, expressed opposition to the suggestion of parking on Gregory Lane. Lyndon A. Wells., Sr., addressed the Commission and requested that the records show that his statements are made without prejudice or malice and that all statements made are the opinion of the speaker. Dolan, representing the Calvary Baptist Church, addressed the Commission and stated that he would prefer to take access from both Gregory Lane and Garfield Street. Bill Hartge, Deputy Director of Public Works, addressed the Commission and discussed the possibility of providing driveway access at a point of tangeneyj with the curve in Gregory Lane4 There being no further comment, the hearing was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 852 UPON THE FOLLOWING CONDITIONS: 1. Garfield Avenue shall be dedicated and fully improved to City Standards. Improvements shall include street trees, street lights, and street signs. 2. The property shall participate in the local drainage assessment district. 3. The watery sewer, and firehydrant system shall be approved by the Department of Public Works and Fire Department. 4. Off-street parking facilities including landscaping, arrangement, access, paving and striping of all parking spaces shall meet all privisions of the proposed Article 979. The number of parking spaces shall conform to S. 9201.3.5 of the Huntington Beach Ordinance Code. 5. A plan of grading, bank protection and drainage shall be submitted -to the Department of Public Works and the Department of'Building and Safety for approval. 6. A 6 ft. high concrete block wall shall be constructed along the west property line and along the north property line except within the east 15 ft. thereof. The existing block wall along Gregory Lane shall remain, except at the point of ingress and egress. The hearings were opened The Subdivision Committee Report was read by the Secretary. Jack Carlson, engineer for the subdivider, addressed the Commission and offered to answer any questions. There being no other comment, the hearing was closed. Planning Commission Tuesday, October 19, 1965 USE VARIANCE NO. 862 Applicant - Fred M. Swenson To allow the construction of a muffler shop in the C-1 Neighborhood Commercial District. Located on the west side of Beach Boulevard, 534 feet north of Warner Avenue and legally described as Lots 21 through 32 inclusive, Block A, Tract No. 194. The Secretary read a letter of protest submitted by Harry Brockman, 119 Palm Avenue, Corona, California. The Staff Report was read by the Secretary. The hearing was opened to the audience. M. W. Haifley, addressed the Commission and asked ,for a continuance and questinned the applicants right to file the request because he has surface rights to all property in question. Richard LaRue, representing the applicant, addressed the Commission and gave his reasons for the request. He further stated that he had no knowledge of Mr. Haifley's surface rights to the property. There being no other comment, the hearing was closed. A MOTION WAS11DE BY MILLER AND SECONDED BY CRABB TO APPROVE USE VARIANCE NO. 862 WITH THE FOLLOWING CONDITIONS: 1. -Beach Blvd. shall'be fully improved to State and City Standards. Improvements shall include street trees and street lights. 2. The water and fire hydrant system shall be, approved by the Department of Public Works and Fire Department. 3. Off-street parking facilities including landscaping, number, arrangement, access, paving and striping of all parking spaces shall meet all adopted ordinances and the latest Planning Commission Standards. 4. A masonry wall shall be constructed along the west property line to City Standards. 5. USE VARIANCE NO. 861 Applicant - Gray W. Miller The Staff Report was read by the Secretary. The hearing was reopened to the audience. Gray Miller, applicant, addressed the Commission and gave his reasons for the request. Lyndon A. Wells, Sr., addressed the Commission and spoke in favor of the subject variance. There being no further comment, the hearing was closed. The Commission held a lengthy discussion. The:Secretary informed the Commission that the applicant wants to convert his existing garage into a living area and construct a carport to replace the garage. He stated that the Huntington Beach Ordinance Code provides -the following: "Any parking space in the front one- half of the lot shall be in fully enclosed building equipped with a,door to provide for its complete enclosure:" It was the consensus of the Commission to continue UV,#861 for 30 days in order to study possible revision to the Huntington Beach Ordinance Code pert - wining to carports in the R-1 District. Planning Commission Tuesday, October 19, 1965 INFORMAL�DISCUSSION George Shibata,.A.ssistant City Attorney, advised the Commission that the lessee of Meadowlark Airport contacted him and stated that there might be some legal problems surrounding the approval of UV #813. In view of this, he contacted Mr. Drum from the State Division of Aeronautics and asked that he appear before the Commission and explain various state and federal statuses concerning the subject variance. Mr. Drum addressed the Commission and explained various state and federal controls over new construction within the vicinity of airports. James Benson, Attorney for Mr. William Ogden, applicant of UV #813, addressed the Commission and stated that Mr, Ogden has submitted his building plans to the F. A. A. for review. He also stated that any decision made by the F. A. A. would be a recommendation only and not a determination as to whether or not Mr. Ogden could build the school. He further stated that Mr. Ogden has agreed to wait for any recommendations from the F. A. A. prior to taking out his building permits, as long as the decision would not effect his right to build the school. Mr. Turner, lessee of the airport, appeared before the Commission and explained how he would be effected by construction of the school. It was the consensus of the Planning Commission that they were not in a position to take further action on the subject variance. AMENDMENT TO MASTER PLAN OF LAND USE - STUDY AREA V - AND AMENDMT�NT TO MASTER PLAN OF ARTERIAL STREETS AND HIGHWAYS.'. The Secretary distributed copies of a proposed amendment to the Master Plan of Land Use - Study Area V and Master Plan of Arterial Streets and Highways. The Commission reviewed the proposed amendments and it was their consensus to set the matter for public hearing. -10- 10/19/65 Page No. 11 Minutes: H. B. CAPITAL IMPROVEMENTS PROGRAM: The Secretary informed the Commission that the Capital Improvements Program is in its final stage and recommended that a public hearing be set for November 2, 1965. A MOTION WAS MADE BY KA.UFMAN AND SECONDED BY LAWSON TO INSTRUCT THE SECRETARY TO SET A PUBLIC HEARING ON THE CAPITAL IMPROVEMENTS PROGRAM FOR NOVEMBER 21 1965, ROLL CALL VOTE: AYES: Crabb, Lawson, Bazi1, Kaufman, Miller, Larkin. NOES: None. ABSENT: Worthy. THE MOTION CARRIED. USE VARIANCE NO. 727 Applicant - Huntington Inter -Community Hospital Mr. Powers addressed the Com= mission and submitted a revised plot plan of the Huntington Inter -Community Hospital. The Commission reviewed the modified plot plan and it was their consensus that there was no substantial change. A MOTION WAS MADE BY LAWSON AND SECONDED -BY MILLER TO APPROVE USE VARIANCE NO. 727 AS REVISED UPON THE -FOLLOWING CONDITIONS: 1. The plot plan received October 18, 1965, shall be the approved layout. 2. Beach Boulevard and Newman Avenue shall be dedicated and improved to City and/or State Standards during the initial stage of development. Improvements shall'include street trees, street lights., and street signs. Newman Avenue shall be improved with 30 ft. of paving. 3. The main entrance shall be shifted south to line up with Ronald Road or the State Division of Highways shall approve the existing location prior to issuance of any building permit. 5. A 30 ft. curb radius shall be provided onto Beach Boulevard and a 20 ft. curb radius shall be provided onto Newman Avenue. 6. Parking lot "E" shall be redesigned to provide only two access points onto the main entrance. 7. Off-street parking facilities including landscaping, number, arrangement, access, paving and striping shall meet all adopted ordinances and all provisions of the proposed Article 979- 8. The structural street section of all private drives shall be approved by the . Department of Public Works. 9. A lighting system shall be installed within the project and it shall be equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval,: 10. A plan specifying trash pickup areas shall be submitted to the Department of Public Works for approval. 11. The water, sewer and fire hydrant system shall'be approved by the Department of Public Works and Fire Department., 12. A soil report by an approved soils, engineer shall be approved by the Department of Public Works prior to issuance of a building permit. 13. A plan of grading, bank protection, and drainage shall be submitted to the Department of Public Works and the Department of Building and Safety for approval. 14. Easements for utilities or walkways may be required. 15. Approval of this plot plan shall nabinclude approval of the convalescent hospital. 16. A new plot plan reflecting all the foregoing conditions shall be submitted to the Planning Department for approval prior to issuance of any building permit.
