BOARD MEMBERS ABSENT: None. MINUTES: The Minutes of October 13, 1965 and October 20, 1965 were accepted as transcribed. AREA VARIANCE NO. 65-82 Applicant - L. R. Peterson To allow a 6 ft. high block wall and a dwelling to encroach 10 ft. into the requiredtn 25 ft. front yard setback; and to encroach to within 4 ft. of the exterior side property line in deviation to the required 10 ft. side yard'setback in the R-2-0 Two Family Residence District combined with oil production. Located on the southwest corner of Indianapolis Avenue and Florida Street. Legally described as the west 85 ft. of the east 115 ft. of a portion of the NE/4 of the SEA of Section 11-6-11. Further legal description on file in the Planning Department Office. The hearing was opened to the audience. Mr. Peterson, the applicant, explained his request to the Board. It was noted that the applicant had previously obtained a variance from the Planning Commission to construct a triplex on the property but the vat?lance has expired,/ The applicant now proposes to construct a single family residence rather than a triplex. It was noted that a portion of the block wall has already been constructed in compliance with the conditims of the previous variance, Area Variance 709. It was -also noted that although Indianapolis Avenue is shown on the Master Planoof Arterial Streets and Highways, some of the Staff now feels that a more practical alignment would be down Geneva Avenue to Hartford Avenue. Further discussion followed. It was noted that even if Indianapolis Avenue remains on the Master Plan of Arterial Streets and Highways the proposed dwelling will setback 5 ft. from future right-of-way which is further - back than most of the eklsting_lhoussa bhctheistreet. There being no further comment, the hearing was closed. A MOTION WAS MADE BY DAY TO APPROVE AV NO. 65-82 FOR THE FOLLOWING REASONS: 1.• This request is within the limits of AV 709 which was previously approved by the Planning Commission butt has expired. -1- 10/27/65 Page No. 2 Minutes: H. B. Board of Zoning Adjustments Wednesday, October 27, 1965 2. The applicants only deviation from what he was previously granted is a reduction in density. 3. The request creates no special priveledge because the other houses in the area have the same setback or are closer. 4. The project has already been started. 5. From the Staff point of view the alignment of Indianapolis Avenue will probably be changed. 6. If the allggnment is not changed the street can still be built according to the Master Plan without interference from the structure. THE MOTION DIED FOR LACK OF SECOND. Richard Harlow pointed out that an amendment to the Master Plan of Arterial Streets and Highways was det for public hearing on November 2, 1985 before the Planning Commission which includes re-routing Indianapolis Avenue from its existing alignment. It was the consensusoof the Board to continue the matter until November 3, 1965. A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO CONTINUE AV NO. 65-83 UNTIL NOVEMBER 2, 1965. ROLL CALL VOTE: AYES: Mandrell, Day, -Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED.
