COMMISSIONERS ABSENT: Crabb, Lawson. MINUTES: On motion by Miller and seconded by Worthy, the Minutes of the Huntington Beach Planning Commission of October 5, 1965, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO. 5424 - Continued Number of Lots: 190 Subdivider: Dutch Haven Homes Total Acreage: 40 Engineer: Millet, King and Assoc. Located on the northeast corner of Bushard Street and Banning Avenue and legally described as being a proposed subidivision of a portion of the SW4, SE4, Section 18-6-10. The Deputy Secretary read a letter submitted by Millet, King and Associates, representing the subdivider, requesting that Tentative Tract Map No. 5424 be withdrawn. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO GRANT THE APPLICANT'S REQUEST. ROLL CALL VOTE: AYES: Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Crabb, Lawson. THE MOTION CARRIED. TENTATIVE TRACT MAP NO. 6084. Number of Lots: 155 Total Acreage: 30.5 Subdivider: Deane Brothers Engineer: Voorbeis-Trindle & Nelson, Inca Located on the south side of Adams Avenue, west of Cannery Street and legally described as being a proposed subdivision of a portion of the NE4, NE4, Section 12-6-11. The Deputy Secretary informed the Com- mission that Tentative Tract Map No. 6084 and Use Variance No. 863 pertain to the same parcel of land and the public hearing should be opened on both items. The Subidivision Committee Report and the Staff Report were read by the Deputy Secretary. on both items. The hearing was opened to the audience 11/2/65 Page No. 2 Minutes: H. B. Planning Commission Tuesday, November 2, 1965 Ron Wells, engineer for the developer, addressed the Commission and stated that there were no objections to the conditions suggested in the Subdivision Committee Report and the Staff Report There being no other comment the hearing was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 6083 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received October 28, 1965, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless Use Variance No. 863 is approved by the City Council. 3. All public streets shall comply with City Standards. 4. The property line radius of all corner lots shall be approved by the Department of Public Works. 5. A full grown tree shall be planted in the front -yard of each lot and the exterior side yard of each corner lot. Said tree shall be approved by the Park Supervisor. 6. The blue border of the tract shall extend to centerline on both Adams Avenue and Cannery Street. The parcel labeled, "Existing C-2 Zone" shall receive a lot number. In lieu of the foregoing, a Division of Land application shall be filed with the Board of Zoning Adjustments and provisions shall be made for the dedication and improvements of both Adams Avenue and Cannery Street. Said division of land shall be recorded prior to recordation of the final map. 7. All utilities shall be installed underground. 8. USE VARIANCE NO. 863 Applicant: Deane Brothers To permit the following: 1) 46 foot, 50 foot, and 54 foot right of way streets as indicated on accompanying map of Tentative Tract No. 6084. Minimum lot will not be less than 50 ft. in width, with 5,000 sq. ft. of lot area. 6) 45 ft. property line radius on cul- de-sacs, with 40 ft. curb return radius on cul-de-sacs. Located at the southwest corner of Adams Avenue and Cannery Street in the R-2 Two Family Residence District and legally described as being a portion of the NE4, NE4, Section 12-6-11; Except the East 740 ft. of the North 560 ft. of said NE4. A MOTION WAS MADE BY MILLER AND SECONDED BY WORTHY TO RECOMMEND APPROVAL OF UV #863 TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS AND'MODIFICATIONS: 1. All streets shall comply with standards proposed by the Department of Public Works and approved by both the Planning Commission (August 3, 1965) and City Council (September 7, 1965). 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 f t . 3. The minimum side yard shall be 3 ft., provided the abutting side yard of the adjoining lot is not less than 5 ft. and further pro- vided no architectural l eature shall be located closer than 30 inches to the property line. 4. A 15 ft. minimum rear yard setback on irregular shaped lots and on other lots only where a front patio is provided may be per- mitted. Patio shall be defined as a paved area enclosed with a fence. 5. Lots within each block shall average 60 ft. in width with 6000 sq. ft. of lot area and the minimum lot shall not be less than 50 ft. wide with 5000 sq. ft. of lot area. The Deputy Secretary informed the Com- mission that this agenda item is routine and merely changes the zone on Tentative Map No. 6083 to conform to the intended use of property. COMMISSIONER LAWSON: Commissioner Lawson arrived at 7:45 P.M., and assumed his duties. RESOLUTION NO. 540: A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 540 to the City Council. A MOTION WAS MADE BY WORTHY AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO. 540 RECOMMENDING APPROVAL OF ZONE CASE NO. 540 TO THE CITY COUNCIL FOR THE FOLLOWING REASON.: 1. This is a reduction of the density as proposed in the Master Plan of Land Use. ROLL CALL VOTE: AYES: Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Crabb. ABSTAINED: Lawson. THE RESOLUTION WAS ADOPTED. USE VARIANCE NO. 849 - Continued Applicant : Roman Catholic Church of Los Angeles To allow the construction of a church, school, and related structures in the MI -A Restricted Manufacturing District. Located on the south side of Atlanta Avenue, approximately 990 ft. west of Cannery Street and legally described as the W2, W2, NE'k, NEk, Section 13-6-11. The Deputy Secretary read a telegram from Roger M. Sullivan, Attorney, representing the Roman Catholic Archbishop, requesting that the subject variance be withdrawn since the applicant does not wish to continue the matter further. The Deputy Secretary read a letter submitted by Herbert N. Kirk endorsing the proposed medical building. The Staff Report was read by the Deputy Secretary. The hearing was opened to the audience. Warner Avenue shall be dedicated and fully improved to City Standards. Leslie Drive shall be dedicated 30 ft. from center- line and improved to City Standards. Improvements shall include street trees, street lights and street signs. 2. Drainage fees shall be paid. 3. Drainage of the property shall be approved by the Department of Public Works. 4. A 30 ft. property line radius shall be provided and location of the driveways shall be approved by the Department of Public Works. 5. All provisions for off-street parking shall comply with the proposed Article 979. 6. A 10 ft. exterior side yard shall be provided. 7. A 6 ft. concrete block wall shall be provided along the south and west property line, except said wall shall be 42 inches in the front 50 f t . of Warner Avenue and within the 10 ft. exterior side yard on Leslie Drive. Planningg Commission Tuesday, November 2, 1965 USE VARIANCE NO. 865 Applicant: George.C. Williams Jr. To allow the construction of a single family residence and a 4 - 3 unit apartments in the M-1 Light Indus- trial District. Located on the east side of Gothard Street, approx- imately 107 ft. south of Cedar Avenue and legally described as the South 197 ft. of the West 285 ft., being a portion of Block G, Town of Wintersburg. Also known as 17222 Gothard Street, Huntington Beach, California. Deputy Secretary. The Staff Report was read by the The hearing was opened to the audience. George Williams, applicant, addressed the Commission and gave his reasons for the request. Mrs. Vance, 17132 Palmdale Street, Huntington Beach, addressed the Commission and opposed the subject variance, stating that the general area is master planned for indus- trial development and it should remain as such. Mr. Vance, 17132 Palmdale Street, Huntington Beach, addressed the Commission and stated that there were drainage problems in the general area and asked questions about sewage facilities on said property. Bill Hartge, Deputy Director of Public Works, addressed the Commission and stated that there is a drainage problem and further it would be questionable as to whether or not septic tanks could be used. The applicant stated that he would prefer to use sewers and not septic tanks. Mrs. Vance, addressed the Commission and stated that the proposed development is generally of good design but if the Commission determines that the request should be granted, they should proceed with rezoning of the general area to residential use and not create spot zoning in the existing industrial zone. There being no other comment the hearing was closed. Commission held a lengthy discussion. It was noted that the subject property is located adjacent to a paper plant and just north of a tank farm. The Deputy Secretary informed the Commission that there are various mixed uses in the general, area, however, a definite trend toward industrial development has been established on the Master Plan of Land Use. -6- 11/2/65 Page No. 7 Minutes: H. Located on the north side of Warner Avenue, approximately 235 ft. east of Bolsa Chica Street and legally described as being a portion of Lot 3, Block 5, Tract No. 86; Excepting therefrom the Wily 195 ft. of the SIly 205 ft. thereof. He stated that it would be im- possible to develop said property on an R-1 basis. Marvin Haney, representing Dougmar Builders, addressed the Commission and opposed the subject variance, Naomi Miller, 5181 Heil Avenue, Huntington Beach, addressed the Commission and spoke in favor of the development. There being no other comment the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY BAZIL TO APPROVE USE VARIANCE NO. 867 UPON THE FOLLOWING CONDITIONS: 1. Graham Street and Heil Avenue shall be dedicated and improved to City Standards, Improvements shall include street trees, street lights and street signs, 2, The "Private Road" shall be dedicated 30 ft. from centerline and fully improved to City Standards. Spaces 8 through 23 shall be shifted north, creating a drive along the south line. 5. Planningg Commission Tuesday, November 2, 1965 ZONE CASE NO. 541 - AMENDMENT TO THE MASTER PLAN OF -LAND USE - STUDY AREA V AND AN AMENDMENT TO THE MASTER PLAN OF ARTERIAL STREETS AND HIGHWAYS. The Deputy Secretary informed the Commission'that discussions have been held with the Huntington Beach Company in an attempt to resolve major problems prior to the Planning Commission hearing. Inasmuch as -there are a few points which need further consideration, the staff requested a two week continuance. A MOTION WAS MADE BY LAWSON AND SECONDED BY WORTHY TO CONTINUE THE PUBLIC HEARING ON SAID AMENDMENTS TO NOVEMBER 16, 1965. ROLL CALL VOTE: AYES: Bazil, Kaufman, Worthy, Miller, Larkin, Lawson. NOES: None. ABSENT: Crabb. THE MOTION CARRIED. PUBLIC HEARING CAPITAL IMPROVEMENTS PROGRAM The hearing was opened to the audience. Floyd G. Belsito, Associate Planner, explained the Capital Improvements Program to the Commission. He reviewed the history of the program and explained additional revisions to the Parks and Recreation and Department of Public Works programs. Ben Arguello, Finance Director, explained the various means of financing available. Norman Worthy, Director of Recreation, addressed the Commission and stated that acquisition of a golf course should be through a revenue bond. There being no other comment the hearing was closed.' A MOTION WAS MADE BY KAUFMAN AND SECONDED BY.BAZIL TO RECOMMEND THE ADOPTION OF THE CAPITAL IMPROVEMENTS PROGRAM AS AMENDED TO THE CITY COUNCIL.
