BOARD MEMBERS PRESENT: John Mandrell; Herbert Day,
Richard Harlow.
BOARD MEMBERS ABSENT: None.
AREA VARIANCE NO. 65-83
Applicant - William R. Hardcastle
To allow a 6 ft. high wall to
encroach to within 7.5 ft. of the front property line
in deviation to the required 10 ft. front
yard setback in the R-1 Single Family Residence District.
Located at 16512 Somerset Lane. Legally described as
Lot 42 of Tract 4677.
The hearing was opened to the
audience.
Mr. Hardcastle, the applicant,
explained his request to the Board.
Herbert Day stated that Huntington
Harbour had obtained a "blanket variance" to allow
10 ft. front yards for water front lots in deviation
to the required 15 ft. front yard setback required
in all other areas of the City.
Mr. Hardcastle stated that
the wall would not obstruct anyones view. He further
added that the request would be aesthetically beneficial
to the home.
Further discussion followed.
Richard Harlow stated that he
could not find any hardship on the property that
could justify the request. He added that this was
a precident setting request since the front yard
setback had already been reduced -to 10 ft. for
water front lots in the Huntington Harbour..
There being no further
comment, the hearing was closed.
Board discussion followed.
A MOTION WAS MADE BY HARLOW
AND SECONDED BY DAY TO DENY AV NO. 65-83 FOR THE FOLLOWING
REASON:
1. The applicant failed to show sufficient justification
for his request.

AREA VARIANCE NO. 65-82 - Continued
Applicant - L. R. Peterson
To allow a 6 ft. high
block wall and a dwelling to encroach 10 ft. into the required
25 ft. front yard setback; and to encroach to within 4 ft. of
the exterior side property line in deviation to the required
10 ft. side yard setback in the R-2-0 Two Family Residence
District combined with oil production. Located on the
southwest corner of Indianapolis Avenue and Florida Street.
Legally described as the west 85 ft. of the east 115 ft. of
a portion of the NEA of the SEA of Section 11-6-11. Further
legal description on file in the Planning Department Office.
It was noted that
this variance was continued from the October 27, 1965 meeting.
The hearing was opened
to the audience.
Richard Harlow stated
that the Planning Commission and the Staff in general, were of
the opinion that the highway alignment proposed for Indianapolis
Avenue in October 1964 is a more practical alignment. He
further added that it was the opinion of the Commission at
the November 2fl4,1965 meeting that since the variance
had already been passed once, there was no reason why this
"renewal" variance -could not be approved.

A MOTION WAS MADE BY
DAY AND SECONDED BY HARLOW TO APPROVE AV NO. 65-82 FOR THE
FOLLOWING REASONS:
1. This request is within the limits of AV 709 which wash
previously approved by the Planning Commission but has
expired.
2. The applicants only deviation from what he was previously
granted is a reduction in density.
3. The request creates no special priveledge because the other
houses in the area have the same setback or are closer.
4. The project has already been started.
5. From the Staff point of view the alighment of Indianapolis
Avenue will probably be changed.
6. If the allignment is not changed the street can still bet
built according to the Master Plan without interference
from the structure.

ABSENT:: None.
