BOARD'MEMBERS ABSENT: None. MINUTES: The Minutes of November 10, 1965, November 15, 1965, November 17, 1965, and November 24, 1965-were accepted as transcribed. AREA VARIANCE NO. 65-88 Applicant - Gary Katsaris To allow one wing of the main dwelling to encroach to within 13.9 ft. of the rear property line in deviation to the required 15 ft. rear yard setback in the R-1 Single Family Residence District. Located at 6751 Melbourne"Drive and legally described as Lot 2 of Tract No. 3890. The hearing was opened to the audience. Gary Katsaris explained his request and answerecl=various questions asked by the Board. It was noted that the plot, plan showed two different measurements to the rear property line. Mr. Katsaris stated that the 13.9 ft. dimension was the correct figure. Richard Harlow stated that this is only a 1 ft. 3 in -reduction of the requirements in the R-1 District., f6r property abutting open land. And the subject property is abutting a school. Mr. Frank Niccoli, Cheif Building Inspector for the Building and Safety Department, stated that all living;rdbms;Fkitchens;ran4 other rooms used for living, dining, or sleeping purposes shall be provided with windows with an area not less than twelve square feet nor one -eighth of the floor area of such rooms. He further added that one half of these windows must be openable. It was noted that the planned addition will be partially screened all around the outside walls. This will conform to Building Department Standards, but the structure must remain to these stated standards for the life of the dwelling. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO APPROVE AV NO. 65-88 FOR THE FOLLOWING REASONS: -1- 12/1/65 M Page No. 2 Minutes: H. B. Board of Zoning Adjustments Wednesday, December 1, 1965 1. There will be sufficient rear yard area remaining. 2. The applicant requests only a 1 ft. 3 in. reduction to the Code. 3. The structure will not impair the required light and ventilation required for the main dwelling. ROLL CALL - VOTE 1 _ AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED.
