COMMISSIONERS ABSENT: None. MINUS: On motion by Worthy and seconded by Lawson, the Minutes of the Huntington Beach Planning Commission of October 26, and November 2, 1965, were accepted as transcribed and mailed by the Secretary. USE PERMIT NO. 65--15 -- Continued Applicant -� Huntington _Pacific Corp_. To permit the construction of a planned development containing 107 apartment units and extending more than 150 ft. from a public street in the 0-1 Neighborhood Commercial District and 0-1--0 Neighborhood Commercial District combined with oil production. Located on the south side of Highway #1 between Gt Street and 9t Street. Lengthy legal des- cription on file in the Planning Department Office. The Planning Director informed the Commission that this item was continued from the November 16, 1965, meeting. He stated that the State Lands Commission is still waiting for the consultants report on accretion along the beach. The Planning Director suggested that this item, should be continued to the February 1, 1966 meeting. The Secretary informed the commission that Tentative Tract Map No. 5813 and Use Variance No. 870 pertain to the same parcel of land and the public hearing should be opened on both items. The Subdivision Committee Report and the Staff Report were read by the Secretary. The hearing was opened to the audience on Tentative Tract 5813 and Use Variance 870. Bob Hooke, engineer for the developer, addressed the Commission and stated that there were no objections to the conditions suggested in the Subdivision Committee Report and the Staff Report. Mr. Hooke offered to answer any questions. There being no further comment, the hearing was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE TENTATIVE TRACT MAP NO. 5813 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received November 2, 1965, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless Use Variance No. 870 is approved by the City Council. 3. Drainage, water, and sewer plans shall be approved by the Department,of Public Works. A fire alarm system shall be installed by the developer at locations and to specifications provided by the Fire Department. 7. All utilities shall be installed underground. 8. All streets within the project shall be private streets. 9. All private street widths and corner radii shall comply with: adopted Planning Commission Standards. This condition shall include a 30 ft. property line radius at the intersection of the "Private Streets" and Highway #1. 10.. Private street structural sections shall comply with Department of Public Works Standards. 11. The business license fee shall be based on the number of dwelling units: 12. Located on the north side of Highway #1 and west of Anderson Street and legally described as being a portion of Section 24-5-12, A MOTION WAS MADE BY CRABB AND SECONDED BY.MILLER TO RECOMMEND APPROVAL OF USE VARIANCE . NO. 870 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. The development plan received November 24, 1965, shall be the approved layout. 2. The CC&R's Articles of Incorporation, By-laws and Management Contract shall be submitted -to the City Attorney for approval. 3. The CC&R's shall contain at least the following provisions: a. All rights for development and construction of any structures within the common area not included in the approved development plan shall be dedicated to the City. 5. All streets within the development shall be private streets. 6. A complete -plan of trash pick-up shall be filed for approval by the Department of Public Works. 7. A plan of grading shall be submitted to the Department of Public Works and the Department of Building and Safety for approval, 8. A soil report by an"approved soils engineer shall be submitted to the Department of Public Works prior to issuance of any building permits. 9. A new plot plan shall be submitted for approval by the Planning Department. Said plot plan shall include height of the wall, location of all on -street parking and assignment of parking spaces. Warner, representing the developer, addressed the Commission and explained the proposal. He objected to condition #4 pertaining to the dedication of -.Orange Avenue, 40 feet from centerline. He informed the Commission that if the dedication is required, it would result in further reduction of the lot widths. He also objected to'the installation' of underground utilities and the improvement of the abutting streets to city standards. Mrs. L. Jenkins, 320 - 14th Street, Huntington Beach, addressed the Commission and spoke in favor of the subject request." There being no other comment, the hearing was closed. Commission discussion was held at length. It was noted that the general area is subdivided into 25 ft and 50 ft lots. The Secretary informed the Commis- sion that the applicants are requesting a 20 ft. wide driveway,' 445 ft long that will permit access to Adams Avenue. The Commission noted that the driveway is too long and narrow and the driveway entrance and exit at this location creates a four -legged intersection with the frontage road on the north side -of Adams,, -Avenue. -10- 12/7/65 Page No. 11 Minutes: H.B. Planning Commission Tuesday, December 7, 1965 The Planning Director pointed out that as a practical matter, access should be restricted to Cannery Street and that a simple easement over the parking lot, without a driveway cut and without fee ownership is the proper solution. He further pointed out that commercial buildings could abut the 20 ft. driveway and responsibility for construction and maintenance of wall separating R-1 and C-2 is not clearly defined. Located at the southeast corner of Robidoux Drive and Beach Blvd., and legally described as Lot 19, including portion of an abandoned alley adjacent to Beach Blvd., all of Lots 21 and 23, including portion of an abandoned alley adjacent to Beach Blvd., and all of Lots 20, 22 and 24, including portion of an abandoned alley all in Block A, Tract No. 528. The Secretary read a letter of protest submitted by R. D. Slates. The Staff Report was read by the Secretary. The hearing was opened to the audience. A representative from McDonald's Corporation, addressed the Commission and explained the reasons for the sign. Dr. Robert Shupe, applicant addressed the Commission and questioned the dedication of Robidoux Drive. Bill Hartge, Deputy Director of Public Works, addressed the Commission and stated that at present Robidoux Drive has a 20 ft R/W. It was noted that the general area within a triangle established by Main Street, Garfield Avenue and Stang Lane is gradually developing into a medical -office convalescent hospital center. A portion of the subject property has an R-5 use on it, and the remainder of the property has an approved Use Variance that will permit expansion of the existing R-5 uses. 2. Located north of Clay Avenue between Delaware and 17th Streets and legally described as Lot A, Blocks 2906, 2905, 3003, 3006, East Side Villa Tract and also known as Tentative Tract No. 5494. The Staff'Report was read by the Secretary. The hearing was opened to.the audience. , Roger Watson, representing Scottco Inc., addressed the Commission and explained the proposal. The following property owners in the adjacent area addressed the Commission and spoke in favor: Jack Morris, Newport Beach, James Montgomery, 1802 Brush Drive, Huntington Beach, Mr. James Shuller, architect and Mr. Al Ramblie. There being no further comment, the hearing was closed. The Commission held a lengthy discussion. It was noted that the application is requesting an R-3 use on R-2 property. The Commission reviewed the pro- posed amendment and it was their unanimous opinion to recommend adoption,of said amendment to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY LAWSON TO RECOMMEND ADOPTION OF CODE AMENDMENT NO. 65-8, ARTICLE 953 TO THE CITY COUNCIL. COMMUNICATION: The Secretary read a letter submitted by Millet, King & Associates, requesting that the Commission omit the requirement of underground utilities in Tract No. 5526, because there are existing power poles surround- ing the subdivision. A MOTION WAS MADE BY MILLER AND SECONDED BY WORTHY TO APPROVE SAID REQUEST. ROLL CALL VOTE: AYES: Miller, Worthy, Bazil. NOES: Crabb, Lawson, Kaufman, Larkin. ABSENT: None. THE MOTION FOR DENIAL CARRIED. DISCUSSION: The Secretary informed the Commission that the Planning Department is working on the Park and Recreation element to the General Plan. He stated that direction from the Commission is needed on whether the City should provide community or neighborhood parks. He reminded the Commission that the ULI recommended acquisition of neighborhood parks rather than com- munity parks. This recommendation was based on the fact that several regional park facilities such as "mile square" in Fountain Valley, the County Marina in Sunset Beach and the eight miles of beach in the city will provide regional park and,recreational facilities.
