Cleveland, Richard Harlow. BOARD MEMBERS ABSENT: None. AREA VARIANCE NO. 65-92 Applicant - James M. Murray To allow one wing of the main dwelling 10 ft. x 24 ft. to encroach to within 10 ft. of the rear -property line in deviation to the required 20 ft. rear yard setback in the R-1 Single Family Residence District. Located at 9402 Leilani Drive. Legally described as Lot 130 of Tract 3903. The hearing was opened to the audience, there being no comment,.the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HA.RLOW AND SECONDED BY MANDRELL TO APPROVE AV NO. 65-92 FOR THE FOLLOWING REASONS: 1. The rear yard area which is being encroached upon is being substituted in the side yard. 2. The request is in -substantial conformance to the Code. 3. The rear yard setback will be 10 ft. ROLL CALL VOTE: AYES: Mandrell, Cleveland, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO. 65-33 Applicant - Holm, Tait, & Assoc, Inc. To allow a division of land into 2 separate parcels. Located on the southwest corner of Beach Boulevard and Adams Avenue. Legally described as Parcel I: the N'ly 200.00 ft. of the E'ly 200.00 ft. of the N/6, NE/4, NEX, NE/4 of Section 11-6-11. Parcel II: N�6, NE/4, NE/4, NE/4 of Section 11-6-11; excepting therefrom the N'ly 200.00 ft. of the E'ly 200.00 ft. John Henricksen, owner of the subject property explained the reasons for the requested division of land. He stated that Parcel II will eventually be utilized for freeway purposes. Board discussion was held. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE DIVISION OF LAND NO. 65-33 SUBJECT TO THE FOLLOWING CONDITIONS: 1.- Adams Avenue shall -be dedicated to City Standards. 2. Adams Avenue and Beach Blvd. shall be fully improved.to City and/or State Standards at the time each parcel is developed. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street Sections shall be determined by soil "R" value and traffic index. 4. Water supply shall be through the City of Huntington Beach's water system. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system. 6. A plan conforming to the grading ordinance shall be submitted to the Department of Public Works for approval prior to issuance of a building permit. 7. Retaining walls shall be provided where there is a difference in elevation -of one (1) foot between adjoining lots or lots abutting City right-of-way. 8. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 9. The Division of.Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. ROLL CALL VOTE: AYES: Mandrell, Cleveland, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT NO. 65-23 Applicant - Roger D. Slates To permit the construction of commercial buildings in the C-4 Highway Commercial District. Located on the east side of Beach Boulevard, 330 feet south of Ellis Avenue. Legally described as being a portion of the Sj�, NW/4, NW/4, SEA, Section 36-5-11. The hearing was opened to the audience. Roger Slates, applicant, explained the request and answered various questions asked by the Board.. There being no other comment, the hearing was -closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY CLEVELAND TO APPROVE USE PERMIT NO. 65-23 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Beach Blvd. shall be fully improved to State -Standards. Improvements shall include -street lights and street trees. 2. All streets shall conform to City of Huntington -Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections shall be -determined by soil "R"-value and traffic index. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by -the -Department of POiGlic Works and Fire Department. 6. All utilities shall be installed underground. 7. A plan conforming to the grading ordinance shall be sub- mitted to the Department of Public Works for approval prior to issuance of a building permit. 8. The property shall participate in the local drainage asses- sment district. 9. Retaining walls shall•be provided where there is a difference in elevation of one (1) foot between adjoining lots or lots abutting City right-of-way. 10. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 11. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 12. Off-street parking facilities including -landscaping, arrangement, access, paving and striping shall comply with proposed Article 979- 13. A 6 ft. high masonry wall shall be constructed along the rear property line to City Standards. 14. An easement allowing for a minimum 25 ft. driveway shall be provided along the north property line or the building backing on to the north property line shall be constructed on said property line. 15. A 20 ft. driveway shall be provided along the south property line. 16. Parking shall be provided at the following ratio: lst floor - 1 space per 200 sq. ft. of gross floor area. 2nd floor - 1 space per 300-sq. ft. of gross floor area. 17. The plot plan shall be submitted to the Fire Dept. for approval. 18. A copy of the recorded 40 ft. easement providing ingress and egress to the subject property, shall be submitted to the Building Dept. prior to issuance of. a building permit. 19. A revised plot plan conforming to the above conditions shall be submitted to the Planning Department prior to issuance of a building permit. ROLL CALL VOTE: - AYES: Mandrell, Cleveland, Harlow.
