MINUTES: The Minutes of the December 22, 1965,
_and December 29, 1965, meetings were
accepted as transcribed.
AREA VARIANCE NO. 65-93
Applicant - Deane Brothers
To permit the following: 1) Con-
struction of maximum 8 ft. high masonry wall at the 10 ft.
front yard setback line on Lot 4, Tract No. 6105. 2) Con-
struction of fireplace chimneys on maximum of 10 lots in
Tract No. 6104, on maximum of 10 lots in Tract No. 6105
.and on maximum of 10 lots in Tract No. 6028. Also to allow
the subject fireplaces to encroach 18 inches into the 36 in.
(3' - 0") side yards of said lots. 3) Roof overhangs (roof
rakes) to project 12 in. maximum into 3 ft. side yards on
all lots in said Tracts No. 6104, 6105, and 6028. 4) Portion
of roof overhangs (eaves on garages only) to project into
side yards. Subject modified overhangs to occur on approxi-
mately 55% of lots in Tracts 6104, 6105, and 6028. Located
on the northwest corner of Atlanta Avenue and Newland Street.
It was noted that Use Variance No.
846 has already been issued on the subject property to allow
various reductions to the Ordinance Code dealing with yards,
setbacks, and lot -areas, etc.

Richard Harlow stated that the
Asst. City Attorney indicated that this could not be done
because the request had public notification for the garages only.
Mr. Bloom answered various questions
asked by the Board and showed typical examples of the
requests.
John Mandrell stated that when the
original' variance was granted,.there was a misunderstanding
of the interpertation by the Planning Commission and Deane
Brothers as to whether or not architectural features could
extend in to the 3 ft. side yards.
Richard Harlow stated that the
Commission indicated at their January 4, 1966 meeting, that
3 ft. side yards will no longer be allowed in R-1 Subdivisions.

It was noted that the
roof overhangs (roof rakes) extending 12 inches into the 3 ft.
side yards occurred on most of the lots in the tract and that
the request.involved a 6 in.deviation.
Further discussion
followed pertaining to eave overhang, construction of the
8 ft. high masonry wall and fire places in the 3 ft. side
yard setbacks.
It was noted that the
fire places in Tract 6104 involved 6 lots.
There being no further
comment; the hearing was closed.
Lengthy Board discussion
followed.
A MOTION WAS MADE BY HARLOW
AND SECONDED BY MANDRELL TO:
1) Approve the request for construction of the 8 ft. high.masonry
wall at the 10 ft. front yard setback line on Lot 4, Tract
6105 for the following reasons:
a) The Lot is irregular in shape.
b) Only one corner of the wall encroaches in the setback
and if the request were on a regular shaped lot the 15
ft.- front yard setback would be maintained.
c) The intent.of the Code is being maintained by allowing
for a variation in setbacks.
2) Deny the request for construction of fireplace chimneys to
encroach 18 in. into the 3 ft. side yard setback on maximum
of 10 lots in Tract No. 6104, on maximum of 10 lots in Tract
No. 6105, and on maximum of 10 lots in Tract 6028, for the
following reason:`
a) The request is not within the intent of Division 9 of
the Huntington Beach Ordinance Code.
3) Approve the request for roof overhangs (roof rakes) to
project 12 in. maximum into 3 ft. side yard setback on all
lots in Tracts No. 6104, 6105, and 6028 and a portion of
roof overhangs (eaves on garages only) to project into the
side yards, on approximately 55% of the Lots in Tracts
No. 6104, 6105, and 6028 subject to the -following condition:
a) That portion of the eave encroaching into the required
30 in. setback for architectural features shall be for
a 7 ft. return only, except roof rakes not exceeding
12 in. in width may extend the length of the building.
b) There shall be a minimum of 4 ft. between facias.
FOR THE FOLLOWING REASONS:
a) There was a misunderstanding when the original Use
Variance was approved by the Planning Commission as to
whether or not architectural features were included.
b) The request will improve the aesthetic value of
the tract.
