MINUTES: On motion by Worthy and seconded -by Miller, the Minutes 'of the Huntington 'Beach Planning �7 Commission of January 4, .1966, were accepted as transcribed and mailed by the Secretary. USE PERMIT NO. 65-15 - Continued &p2licant - Huntington Pacific Corte. The Planning Director informed the Commission that representatives from the City, Huntington Beach Company and State Lands Commission met -on January 31, 1966, to discuss location of the °.: 1938 high tide line. He stated that a position has been taken and the next step is to bring the issue before the State Lands Commission for final decision. The Planning Director suggested that this item should be continued to the May 3, 1966, meeting. Located at the northwest corner of Brookhurst Street and Yorktown/Avenue. The Staff Report was read by the Secretary. The hearing Was opened to the audience. Planning Commission Tuesday, February 1, 1966 TENTATIVE TRACT MAP NO. 6123 Number of ''Lots: 186 Subdivider: Stardust Lands, Inc. Total Acreage: , 39 Engineer: Voorheis-Trindle-Nelson, Inc. Located 530 ft. east of Beach Blvd., and north of Yorktown Avenue and legally'described as being a proposed sub'divis ion of a portion of the 'NW14, Section 1-6-11: The Secretary informed the Commission 14 that Tentative Tract No. 6123, Use Variance No. 66-1 and Zone Case Nol , pertain to the same parcel of land and the public hearing should be opened on all items. The ,Subdivis ion Committee Report and the Staff Report were read by the Secretary. The hearing was opened to the audience. Robert Kay, representing the developer, addressed the Commission and stated that there were no objections to 11) the conditions suggested in the Subdivision Committee Report. lie questioned the suggested condition on Use Variance No. 66-1 pertaining to the requirement for a 20 ft. rear yard and the condition pertaining r to a requirement for an average lot of 60 ft. of frontage with 6000 sq. ft. of lot area to be provided for each size contiguous lots in a block. He pointed out that the 15 ft. rear yard setback would provide more than 1200 sq. ft. in the rear yard area. There being no further comment, the hearing was closed. Commission discussion followed. It was the consensus to allow the requested 15 ft. rear yard setback provided a yard area of 1200 sq. ft. with a minimum dimension of 20 ft. is maintained. This condition will be limited to 20% of the lots in the entire development and no two contiguous rear yards that are back to back will have a setback of 15 f t . A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP NO. 6123 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received January 27, 1966, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless UV #66-1 is approved by the City Council. 3. All public streets shall comply with City Standards. 4. A 6 ft. concrete block wall shall be constructed along the westerly side of the subdivision. 5. To permit the following: 1) 46 ft., 52. and 54 ft. right-of-way streets as indicated on accompanying map of Tentative Tract No. 6123. Subject streets to be in compliance with Standards delineated on a memorandum from the Deputy Director of Public Works, dated August 3, 1965. 2) 10 ft, minimum front yard setbacks for fences not over six feet in height and for garages with a side approach. 3) A minimum three foot side yard on one side of a lot provided the abutting side yard of the adjoining lot is not less than five feet. 4) 15 ft. minimum rear yard setback on irregular shaped lots and on other lots only where a front patio is provided. (For the purposes of this variance a patio shall be defined as an area adjoining the dwelling unit which is enclosed with a fence.) 5) The lots within each block to average 60 ft, in width (at a 20 ft, setback from f ront,property line) with an average 6600 sq: ft: of lot area per block. (The minimum lot shall not be less than 50 ft. in width with 5000 sq. ft. of lot area including corner lots.) NWT of Section 1-6-11. A MOTION WAS MADE BY KAUFMAN AMID SECONDED BY MILLER TO RECOMMEND APPROVAL OF USE VARIANCE NO., 66-1 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS AS MODIFIED: 1. All streets shall comply with st-andards' proposed by the Department of Public Works and approved by both the Planning -Commission (August 3, 1965) and City Council (Se'ptember 7, 1965). 2. The minimum front yard shall be 10 ft.. except the minimum f ron t yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature and a precise plan shall be submitted to the Planning Department for approval prior to issuance of any building permits. Located between Garfield and Yorktown Avenues and 530 ft. east of Beach Blvd., and legally described as the east 790 ft. of the W2, NWk of Section 1-6-11; Except the N. 790 ft. of the W2, NW'k of Section 1-6-11; Also except the E. 132 ft., more or less, of the SW'k, NW-1-4 of Section 1-6-11. It was noted that the subject zone change is routine and it was . filed in conjunction with Tentative Tract No. 6123. The Planning Director informed the Commission that this zone change applies to �9 acres of land master planned for medium density residential use. RESOLUTION NO. 66-3 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 66-3 to the City Council. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO. 66-3 RECOMMENDING APPROVAL OF ZONE CASE NO. 66-3 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. The change of zone is a reduction of the intensity of the use as proposed on the Master Plan of Land Use. ROLL CALL VOTE: AYES: Lawson,-Crabb, Kaufman, Bazil, Worthy, Miller, Larkin. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. -4- Page No. 5 MINUTES: H.B. Planning Commission Tuesday, February 1, 1966 ZONE. -CASE NO. 543 The Chairman re -opened the public hearing to the audience. Robert Gullino, representing the applicant, addressed the Commission and made a presentation on the proposed zone change. He stated that the property is not suitable for an R-1 development because of soil conditions. He stated that there is a need for commercial development in this area. Mr. Gullino further pointed out that the lots as proposed by the Staff for single residences will not accommodate the homes Shields Development Company plans to build. Mark Porter, 19842 Providence Lane, Huntington Beach, addressed the Commission and read an excerpt from a soil report pertaining to the trailer park on adjacent property. He further opposed the requested- C-1 zone. There being no other comment, the hearing was closed. Bill Hartge, Deputy Director of Public Works, informed the Commission that soil borings were submitted on this property and the soils report indicated that single family homes could be built if the subject property is surcharged properly. He suggested that a third soils report be submitted because the report for,the tract differs from the report submitted on the Lamb Trailer Park. It was the consensus of the Commission to continue the hearing on Zone Ease No. 543 in order -to obtain a third soils report. The Planning Director informed the Commission that there is an existing single family residence on a lot to` the .south which is oriented toward."lot .10.. It was the consensus that if 'the alley remained at its present location there would'be a greater separation between the house and the apartments and -if the owner of the house wanted greater separation -he could build the fence,or wall. He asked the Commission if the Planning Department could review and approve a modified plot plan. It was the consensus of the Commission that the Planning Staff should review the variance and approve any required modifications. There being no other comment, the hearing was closed. The Planning Director stated that this zone change will effect 40 acres of land that was approved for subdivision at the January 4, 1966, Commission meeting. He stated that the tentative map called for a service station "holdout" at the intersection of Brook- hurst and Atlanta and that the Commission unanimously approved the tract for single family homes only, which would omit the service station site. He pointed out'that the basis for this position was established by the recommendations of U.L.I. RESOLUTION NO. 66-2 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 66-2 for an R-1 for the entire parcel to the City Council. Page No. 10 Minutes: H.B. A condition of approval for Tract 5841 required the developer to file for a change of zone to R-1 Single Family Residence District to bring the zoning into line with the proposed use of the property. 2. The Secretary read a letter submitted by Rhea Mae Sayre, endorsing the proposed change of zone to C-4. The Staff Report was read by the Secretary. The hearing was opened to the audience. Don Alexander, 16351 Anita Drive, Huntington Beach, addressed the Commission and stated that the depth of the existing commercial property is not good for development. Roger Watson, representing Scottco, Inc., addressed the Commission and explained the proposal. He further stated that he would dedicate an alley immediately to the City if the zone change is granted. Luther Vail, owner of Lot 271 addressed the Commission and spoke in favor of the request. Ralph Allen, 17612 Beach Blvd., addressed the Commission and also endorsed the zone change. There being no other comment, the hearing was closed. The Commission noted that the subject property is under one ownership and it is adjacent to commercially zoned -10- Page. No. 11 Minutes: H.B. It was the consensus to continue Zone Case No. 66-4 to April'5, 1966, in order for the applicant to file for a reversion to acreage to cause the property to,be one lot and thereby eliminate the possibility of multiple ownership. The Secretary read a letter submitted by Everett C. Griffin, endorsingthesubject zone change. The Staff Report was read by the Secretary. The hearing was opened to the audience. Phillip Peoples, representing the applicant, ,addressed the Commission and offered to answer questions. He informed the Commission that the applicants intend to use the property for a pine tree farm and that there, will be no structures connected with their operation. There, being no other comment, the hearing was closed. The Planning Director pointed out that this application pertains to a parcel of land 200 ft. wide by 21,355 ft. long and it is the Southern California Edison Company right-of-way and that there are single family homes backed -up to both sides of the parcel for practically its entire length. He further informed the Commission that in addition, there is provision for a pedestrian walkway across the right-of-way near the east end. It .was the consensus that this request appears to be reasonable; however, it was felt that ' the pedestrian access across the right-of-way must be preserved. Robert Morris, applicant, addressed the Commission and stated that the request will allow him to expand and clean up his wrecking yard. He requested that the variance be approved subject to previous conditions as approved by the City Council on October 4, 1965. He stated that their policy is to allow all existing sign structures to remain on the property purchased for freeway purposes, but they will not allow new structures or roadside vending. The Planning Director suggested that the City deal directly with the State Highway Commission and that ,the City Council should adopt a resolution and send a delegate to Sacramento when the item comes up for action. It was the consensus of the Commission to recommend to the City Council that a resolution be adopted and sent to the State Highway Commission asking them to consider removal of signs on State property along Highway #1.
