HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: John Mandrell, Herbert Day, Richard Harlow.
BOARD MEMBERS ABSENT: None.
DIVISION OF LAND NO 66-4 To allow a division of land
Applicant - Nelson B Reames into 4 separate parcels.
Located at the northwest
corner of Yorktown Avenue and Newland Street and legally
described as the southerly 300 feet of the easterly 200 feet
of the E2, E29 NVI- of Section 1-6-11.
The hearing was opened to the
audience.
Ben Cheek, representative
for the applicant, showed a plot plan depicting the houses
on the lot and explained the request.
Board discussion followed.
There being no further comment,
the hearing was closed.
A MOTION WAS MADE BY HARLOW
AND SECONDED BY DAY TO APPROVE DIVISION OF LAND NO 66-4
WITH THE FOLLOWING CONDITIONS:
1. Yorktown Avenue, Newland Street and the alley shall be
dedicated and fully improved to City Standards. Im-
provements shall include street trees, street signs, and
street lights.
2. All streets shall conform to City of Huntington Beach
Standards. Master plan of Arterial Street and Highways
Standards shall apply where applicable. Street sections
shall be determined by soil "R" value and traffic index.
3. Water supply shall be through the City of Huntington
Beach's water system.
4. Sewage disposal shall be through the City of Huntington
Beach's sewaage system.
5. The property shall participate in the local drainage
assessment district.
6. Preliminary and final soil reports shall be submitted
by an approved private soils engineer to the City prior
to issuance of building permits.

7. A plan conforming to the grading ordinance shall
be submitted to the Department of Public Works for
approval prior to issuance of a building permit.
8. The flood control -channel shall be fenced to City
Standards.
9. The Division of Land shall not be effective until
an agreement is signed and recorded agreeing to
the conditions listed above.

THE MOTION CARRIED.
AREA VARIANCE NO 66-9
Applicant - Charles-S. Geers
To allow a commercial building
to be constructed on the side and rear property lines
in deviation to the required 10 ft. setback and to allow
a 10 ft. front yard setback in deviation to the required
50 feet. Located on the southwest corner of Adams Avenue
and Huntington Street and legally described as the N_,
of Lot 14, Tract No 73 and Lots 23 and-25, Tract No 73.
The hearing was opened to the
audience.
Mr. Geers stated the reasons
for the request.
There being no other comment,
the hearing was closed.
Richard Harlow stated that the
building could be setback 10 feet from the rear property
line.
Board discussion followed.
A MOTION WAS MADE BY HARLOW TO
APPROVE AREA VARIANCE NO 66-9 SUBJECT TO THE FOLLO1ING
CONDITION:
1. A 10-foot rear yard setback shall be provided.
FOR THE FOLLOWING REASONS:
1. The encroachment into the 50 ft. front yard setback
is necessary to enable the applicant to have ex-
posure from eastbound traffic because the building
to the east is encroaching to within 10 ft. of the
ultimate front property line. Also the encroachment
will not have any detrimental effect on adjoining
property.

2. The encroachment into the side yard is justified
inasmuch as the use of the abutting property is
commercial.'
THE MOTION FAILED FOR LACK OF SECOND.
A MOTION WAS MADE BY MANDRELL
AND SECONDED BY DAY TO APPROVE AREA VARIANCE NO 66-9 FOR
THE FOLLOWING REASONS: ,
1. The encroachment into the 50 ft. front yard set-
back is necessary to enable the applicant to have
exposure from eastbound traffic because the building
to the east is encroaching to within'10 ft. of the
ultimate front property line. Also the encroachment
will not have any detrimental effect on adjoining
property.
2. The encroachment into the side_yard is justified
inasmuch as the use of the abutting property is
commercial.
3. The elimination of the rear yard setback is justified
inasmuch as the commercial building on the adjoining
lot does not have a rear yard setback and the 10 ft.
setback would serve no useful--- purpose other than a
trash collector.
4. The property to the rear is being considered for
commercial zoning.

THE MOTION CARRIED.
USE PERMIT NO 66-5
Applicant - Charles S. Geers
To allow the construction of
a plumbing shop in the C-4 Highway Commercial District.
Located on the southwest corner of Adams Avenue and Hunt-
ington Street and legally described as the N2, of Lot'14,
Tract No 73; Lot 23 and 25, Tract No 73.
The hearing was opened to the\
audience.
Charles Geers, applicant,
addressed the Board and explained the reasons for the
request. He objected to the condition requiring sewage
disposal be through the City of Huntington Beach's sewage_
system because the sewer system is a considerable distance
from his project.
Board discussion followed.

It was noted that the applicant
would have to enter into an agreement with the City
for improvements of the frontage across Adams Avenue
and Huntington Street. It was also the consensus
that the Building Department could determine whether
or not the building should connect to sewers.
There being no further comment,
the hearing was closed.

APPROVE USE PERMIT NO 66-5 SUBJECT TO THE FOLLOWING
CONDITIONS:
