MINUTES: On motion by Kaufman and seconded by Crabb, the Minutes of the Huntington Beach Planning Commission Meeting of February 1st and 15th, 1966, were accepted as transcribed and mailed by the Secretary. COMMISSIONERS WORTHY AND MILLER: Commissioners Worthy and Miller arrived at 7:35 PM and assumed their duties. ZONE CASE NO. 543 - Continued Applicant - Shields Development Co. Change of Zone from R-A Residential Agri- cultural District to R-1 Single Family Residence District and C-1 Neighborhood Commercial District with setback provisions. Located at the northwest corner of Brookhurst Street and Yorktown Avenue and legally described as follows: Parcel 1: From R-A to R-1: The W. 260 ft. of the S. 264 ft. of the SE4, SE4, NE4 of Section 6-6-10. Parcel II: From R-A to C-1: The E. 400 ft. of the S. 264 ft. of the SE4, SE4, NE-4 of Section 6-6-10. The Secretary read a letter submitted by Randall Paull, Vice -President of Shields Development Co., requesting a withdrawal of Zone Case No. 543. Located north and south of Indianapolis Avenue'"and east of Cannery Street and legally described as being a proposed subdivision of a portion of the W2, Section 7-6-10. 3/15/66 Page No. 2 Minutes: H.B. Planning Commission Tuesday, March 15, 1966 The Secretary informed the Commission that Tentative Map No. 6188, Use Variance No. 66-9 and Zone Case No. 66-12 pertain to the same parcel of land and the public hearing should be opened to all three items. The Subdivision Committee Report and the Staff Report were read by the Secretary. The hearing was opened to the audience. Robert Galloway, engineer for the developer, addressed the Commission and asked clarification of condition #6 and requesting that condition #8 be deleted. Gene Rosenfeld, Capistrano Land Co., ad- dressed the Commission and objected to condition #7 pertaining to the installation of a concrete driveway from Indianapolis Avenue to the pump station site. Mark Porter,19842 Providence Lane, addressed the Commission and questioned the number of lots in the subdivision. There being no other comments pertaining to Tentative Tract Map No. 6188, Use Variance No. 66-9 and Zone Case No. 66-12 the hearing was closed. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 6188 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received March 9, 1966, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless UV #66-9 is approved by the City Council. 3. All streets shall comply with City Standards. 4. "D" Street shall be 54 ft. wide. "A" Circle shall be 54 ft. wide south of the east -west street that connects to Harbor Isle Lane. 5. An 18 inch easement shall be provided along all streets that have a parkway of 6 ft. or less. 6. The slope easement for the flood control channel shall be part of the street right-of-way. 7. A masonry wall to Department of Public Works Standards shall be constructed along Lot 31 and 32 to completely enclose the existing pump station. The existing chain link gate shall be relocated to the south side of the pump station site and a concrete driveway shall be constructed to provide access from Indianapolis Avenue. -2- 3/15/66 Page No. 3 Minutes: H.B. In addition,- the- blue border -shall include all property between the tract and the church site. This condition may be waived if the land owner submits a division of land application to the -Board of Zoning Adjustments. Said division of land ap- plication shall include provisions for dedication and im- provement of these "hold -out" parcels. 9. All utilities shall be installed underground. 10. ABSENT: None. THE MOTION CARRIED. USE VARIANCE NO. 66-9 Applicant - Capistrano Land Co. To permit the following: 1) 6000 sq. ft. average lot area with 60 ft. average frontage per block but not less than 5000 sq. ft. area or 50 ft. frontage per lot; 2) Re- duction of street rights -of -way as shown on Tentative Map No. 6188, in accordance with the Standards recommended by the Director of Public Works for 46 ft., 50 ft., and 52 ft. right-of-way; 3) A 10 ft. minimum front yard setback for fences not over 6 ft. and for garages with a side approach may be permitted, however, for garages entered directly from the street a minimum 22 ft. front yard setback shall be provided. 4) 'A 15 ft. minimum rear yard setback on irregular shaped lots and other lots only where front patio is provided, patio is defined as a paved area enclosed with a fence. 5) A minimum 3 ft. side yard on one side of lot pro- vided the abutting side yard of the adjoining lot is not less than 5 ft. The subject property is abutting the south side of Indiana- polis Avenue, between Cannery Street and the Orange County Flood Control Channel and abutting the north side of Indianapolis Ave., from the Orange County Flood Control Channel to approximately 500 ft. west. A MOTION WAS MADE BY LAWSON AND SECONDED BY KAUFMAN TO AMEND THE PREVIOUS MOTION AND TO RECOMMEND APPROVAL OF USE VARIANCE N0. 66-9 TO THE CITY COUNCIL UPON THE FOLLOWING COND IT IONS AND TO DENY ALL OTHER REQUESTS. 1. All streets shall comply with standards proposed by the Department of Public Works and approved by both the Planning Commission (August 3, 1965) and City Council (September 7, 1965). Conditions of Tentative Tract No. 6188 shall prevail. 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature anda precise plan shall be submitted to the Planning Department for approval prior to issuance of any building permits. Said plan shall delineate the house location on each lot. 3. A full-grown tree, as approved by the Park Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. 4. The minimum lot frontage shall not be less than 50 ft. wide with 5000 sq. ft. of lot area. An average lot width of 60 'ft. of frontage with 6000 sq. ft. of lot area shall be pro- vided for each six contiguous lots in a block. 5. A 15 ft. rear yard may be permitted, provided an open space of 900 sq. ft. with a minimum dimension of 20 ft. is main- tained. Said open space shall not include any type of roofed structure, enclosed structure, driveway, driveway easement or open parking area. Located on the south side of Indianapolis Avenue between Cannery Street and the Orange County Flood Control Channel, and abutting the north side of Indianapolis Avenue from Bushard Street to approximately 700 feet east of Cannery Street and legally described as: Parcel No. 1: A parcel of land being a part of the SWk of Section 7, T6S, RIOW, SBB&M, described as: All that portion of the SW4 of said Section 7 lying northerly of the South 50 acres of the north half of said southwest quarter of Section 7, and westerly of the westerly line of the Orange County Flood Control District Right of Way. A MOTION WAS MADE BY CRABB AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO. 66-12 RECOMMENDING APPROVAL OF ZONE CASE NO. 66-12 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. ZONE CASE NO. 66-13 Applicant - Hathcock and Bennett Change of Zone from A-1-X General Agricultural District to R-5 Office -Professional District. Located at the south- west corner of Warner Avenue andAsh Street, and legally described as Lots 2 and 4, Block B, Tract No. 368. The Secretary informed the Commission that this zone case and the next zone case application pertain to ad- jacent parcels of land and suggested that the hearing be opened on both items. The Staff Report pertaining to both cases was read by the Secretary. The Chairman opened the hearing on Zone Case No. 66-13 and Zone Case No. 66-14 to the audience. Mr. Moscrip, purchaser of the subject property addressed the Commission and requested that the subject property be rezoned to R-5. He outlined the advantages of a pro- fessional use stating that the subject property is in a good location having quick acce-s.s to all parts of the city. He also stated that the subject property is well suited for professional office buildings. There being no other comment the hearing was closed. The Commission held a lengthy discussion. It was noted that these applications do not comply with the Master Plan of Land Use, but the Commission -6- 3j15j66 Page No. 7 Minutes: H.B. Planning Commission Tuesday, March 15, 1966 has indicated a desire to review the Master Plan in this general vicinity. It was the consensus to continue Zone Case No. 66-13 and Zone Case No. 66-14 until May 17, 1966, and have the Planning Department prepare a land use study in the vicinity of Beach Blvd and Warner Avenue for Commission consideration. Located be- tween Knoxville and Memphis Avenues between Beach Blvd., and Florida Street and legally described as Blocks 1107 A and B, 1207 A and B, 1108 A and B and 1208 A and B. Vista Del Mar Tract. The Secretary read two letters of protest and a letter endorsing the request. The Staff Report was read by the Secre- tary. Planningg Commission Tuesday, March 15, 1966 The following property owners addressed the Commission and objected to the proposed zone change: Mr. and Mrs. Jack Weide, 708 Knoxville St., J. Hackworth, 1014 Georgia St., Lester Cooper, 1019 Florida St., F. Hepp,1213 Florida, Georgia Landers, 1107 Florida Ave., John Teeter, 9560 Rhea, Fountain Valley, Cecil Miller, 11042 Florida and Jack Wetzler,617 Vista Alta, Los Angeles, California. Mr. Lemlie, representing Standard Oil Co., addressed the Commission and explained the sound proofing system. Kenneth Smith, Standard Oil Company, ad- dressed the Commission and stated the reasons for their request. There being no other comment the hearing was closed. It was the consensus of the Commission to continue the hearing on Zone Case No. 66-15 to April 19, 1966, with the understanding that Standard Oil Company will submit a report on the amount of vibration, emanating from the steaming unit and that a report would be submitted by the Assistant City Attorney on the maximum drilling island size required in the 1101" District. The slump stone wall shall be constructed with a 10 ft. by 10 ft. corner cut-off to City Standards at the northeast corner. Said corner cut-off shall be improved with irriga- tion facilities, landscaped and permanently maintained. 2. All applicable provisions of the Huntington Beach Ordinance Code shall be complied with. USE VARIANCE NO. 66-12 Applicant - Eldridge Corporation To allow reduction in lot area. Lot No. 29 from 6500 sq. ft. to 6424 sq. ft. and Lot No. 33 from 6500 sq. ft. to 6109 sq. ft. Located north of Bolsa Avenue and west of Saber Lane in Tract No. 5526. The hearing was opened to the audience. Jack King, engineer for the applicant, addressed the Commission and gave his reasons for the request. There being no other comment the hearing was closed. The Secretary informed the Commission that this use variance represents the last step in a long series taken by the engineer to adjust property lines and clarify owner- ship of several property fragments in and along both Springdale Street and Bolsa Avenue. Edinger Avenue shall be improved to City Standards. Improve- ments shall include street trees and street lights. 2. A 6 ft. high chain link fence shall be constructed to Depart- ment of Public Works Standards along the drainage easement prior to occupancy of a building on Parcel "B". 3. All buildings on -lots abutting a City easement shall be set back 5 ft. from the edge of such easement. 4. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 5. A plan conforming to the grading ordinance shall be submitted to the Department of Public Works for approval prior to issuance of a building permit. 6. All utilities shall be installed underground. 7. The division of land or Use Variance 66-10 shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. CODE AMENDMENT NO. 66-4 ARTICLE-993 PARKS AND RECREATION FEES The Secretary read a.letter submitted by Home Builders Association, expressing their opposition to the proposed city ordinance implementing AB.1150. The hearing was opened to the audience. George Shibata, Assistant City Attorney explained the City's position on the matter. Royce Coln, Executive Director of the Orange County Division of Home Builders Association, addressed the Commission and objected to the proposed park and recreation fees. He stated that a model ordinance is being prepared by the League of Cities and asked that the City of Huntington Beach delay any action until the League of Cities has a chance to take formal action on their proposed ordinance. -11- 3/15/66 Page No. 12 Minutes! Planning Commission Tuesday, March 15, 1966 Dick Harlow, Associate Planner, addressed the Commission and presented photographs of the walls located on Ardsley Circle, 400 ft. southeast of Humboldt Drive. He stated that when this matter was reviewed by the Board of Zoning Adjustments they felt the request would not have a detrimental effect on the surrounding area, but could be a precedent setting decision which should be reviewed by the Planning Commission The Commission reviewed the request and it was their consensus that it would not be detrimental to the City or surrounding property. A MOTION WAS MADE BY MILLER AND SECONDED BY LARKIN TO APPROVE AREA VARIANCE NO. 66-10 FOR THE FOLLOWING REASONS: 1. They are designed as an integral part of the subdivision. 2. The walls are not detrimental to the general area. 3. Architecturally, they tie the lots together and beautify the street. ROLL CALL VOTE: AYES: Lawson, Kaufman, Bazil, Worthy, Miller, Larkin. COMMUNICATION: ORANGE COUNTY PLANNING COMMISSION The Secretary read a communication submitted by the Orange County Planning Commission regarding Use Variance No. 5699, which would allow the construction of a single family dwelling having a covered off-street parking space with less than the required width. The Commission reviewed the request and it was their unanimous recommendation that this variance should be denied because the project will result in excessive lot coverage. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY LARKIN TO INSTRUCT THE SECRETARY TO WRITE A LETTER TO THE ORANGE COUNTY PLANNING COMMISSION RECOMMENDING DENIAL OF UV #5699 FOR THE AFOREMENTIONED REASON. He pointed out that the Ordinance gives the Planning Commission this flexibility and the Planning Department has not received a single complaint; plus, it saves at least two man days per month.
