.REQUEST,- ADDED FENCE HEIGHT
The Clerk k presented a communication from Mrs. Juanita Carr, 6252
Priscilla Drive, City, requesting Council permission to add two feet
to the height of her six foot fence, to prevent school children from
throwing objects into their special pool 'built for her paraplegic
husband.

Agency Formation Commission setting the dad.e of April .13, 1966, at
200 P.M. as time for hearing on the proposed de -annexation of certain
City areas from the Midway City Sanitary District, was received and

motion by Stewart, second Welch, Council. authorized the City
Council, City Administrator and Legal Staff to attend a meeting
with the Local. Agency Formation Commission on April 173, 1966
concerning the deletion of the City of Huntington Beach from the
Orange County Harbor District. Motion carried.
On motion by Stewart, second Welch, Council offered their assistance
to any other City in Orange County attempting to be deleted from the
Orange County Harbor District. Motion carried.

The Clerk read a letter from the Huntington Beach Host Lionw., Club
requesting permission to use Lake Park Clubhouse and cooking facil-
ities Saturday, May 7, 1.966 from 6zOO A.M. to 100 P.M. for their
annual break -fast, and further requested permission to solicit funds
from ticket sales and hang their banner over Main Street at the
entrance to Lak.e Park.
On motion by-Lambprt, second Gisler, Council granted permission to
the Huntington Beach Host Lions Club to use the Lake Park Clubhouse
on Saturday, May 7, 1966 from 6:00 AbMto 1:00 PgMfor their
annual. breakfast, and further granted them permission to solicit

Following discussion on the matter, a motion was made by Stewart,
second Lambert, authorizing the formation of a committee to study
the airport problems, and directing the City Administrator to arrange
a meeting with Councilmen Gisler, and Shipley, a representative of
the Home Council, a representative of the Meadowlark Flyers Associ-
ation, William ADrum - State Division of Aeronautics, Mr. Hobbs -
Manager of the Orange County Airport, and Jerry Price of the Airport
Commission, with said meeting to be 'held at the earliest possible
convenience. Motion carried.
PROTEST - CITY ORDINANCE
ikr. Harry G. Worthington, Ocean Avenue, City, addressed the Council
and protested the City Ordinance - Article 555, on ballyhoo and
speeches, alleging said ordinance to be unconstitutional. The Mayor
assured Mr. Worthington that the Council intended to repeal the
Ordinance.

Douglas Aircraft Corporate Manager of Properties, and stated that
Douglas was aware of the proposed change said that: it would not
adversely affect Douglas, but might in some ways be beneficial.
Mr. Carlton Thomas, Industrial 3roer for 1e A. Roane Company, work-
ing with the Industrial. I -lark development, addressed the Counci.l and
slated that 12,000 industrial. brochures had h;aan distributed to
industries throughout the country. and that, although much adver-
tising had been done, they have failed in their attempts to bring
industry into the area, Mr. `l`horgaa stated t,hat if the zone case
is granted, there would still. he sufficient, MI land for future
industrial growth.

Dean Evans, Orange, Land Planner, addressed the Council. and gave
comparisons of Peck properties with ether° Countyproperty, Stating
that theta was an oversupply € f industrial land in Orange County.
Attorney Rodger Howell gave a a€aumati.en of the zone case, and stated
that the area had been previously € verzonad MI. and requested
approval. of Zone Case 66-9,a
Planning Director Reynolds gave: a. resume' of the Planning Commis-
sion's reasons for denial of Zane Case 66- x

being no protests lilacs, either oral or written, the hearing was
closed by the Mayor.
Can motion by Stewart, second Welch, Council suds a finding that
in as much as said property had never been offered for male for
industrial use, and share was evidence that the property could have
been sari and developed if € ffered for sale, it was therefore
determined -that- said property could have been developed for indus-
trial purposes, and denied Zane Case 66- 9. Motion carried.
PUBLIC HEARING - ZOO CASE 6-10 - APPROVED
Mayor Shipley announced that this was the day and hour set for a
public hearing on Zone Case 66-10, on property .located can the south

Clerk to read the legal notice,

The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal and the Resolution of the
Planning Commission recommending approval of Zone Case 66-10, and read
a copy of a letter- of protest filed by John R. Blake and stated that
he had received no further communicatiolls or written protests to the
Zone Case or to the recommendations of the Planning Commission.
Mayor Shipley declared the hearing open.
There being no one present to speak on the matter, and there being no
further protests filed, either, oral or written, the hearing was
closed by the Mayor.
On motion by Welch, second Lambert, Council sustained the, recoymaenda-
tion of the Planning Commission and directed the City Attorney to
prepare an Ordinance effecting the change of zone in Zone Case 66-10.
Motion carried.

Mayor Shipley announced that this was the day and hour set for a
public hearing on Zone Case 66-11, on property located on the east
side of Goldenwest Street between Edinger and Heil Avenues, ,lid directed
the Clerk to read the legal notice.
The Clerk read notice of public hearing on one Case 66-11, as pub-
lished in the Huntington Beach News on March 24. 1966, setting the
hour of 7 t 30 P.M. , or- as soon thereafter as possible � on Monday, the
4th of April, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public hear-
ing for the purpose of consiaering a petition for a change of zone
to regulations of the Districting Ordinance, from RA Residential
Agricultural District, to RI Single Family Residence District, R3
Limited Multiple Family Residence District and C2 Community Business
District, with setback provisions.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal and the Resolution of the
Planning Commission, recommending denial of Zone Case 66-11, and read
a letter of protest from H. Rodger Howell, Attorney for the petitioner.
The Clerk informed the Council that the hearing on Zone Case 66-11
could be held in conjunction with the public hearing on an appeal to
Tentative Tract Map 61.81, on the suggestion of the Attorney for the
petitioner.
Mayor Shipley declared the hearing open on Zone Case 66-11. and the
appeal to the denial by the Planning Commission of Tentative Tract
Map 6181.
Rodger Howell, Attorney for William Miles and Doyle Development Company
addressed the Council and cited points of code relativ-ee -to the Sub-
division Map Act of the State, and thereon alleging unlawful denial
of an Rl use of RA zoned property.
Mr. John Horner addressed the Council as. an impartial observer and
stated that the zoning requested was reasonable, and that industrial
usage would not be compatible with the college south of Edinger.
Planning Director Reynolds addressed the Council and gave a resume' of
the Planning Commissions' reasons for denying Zone Case 66-11 and
Tentative Tract Map 6181. He then read Sections 9600 and 9941.12 of
the Huntington Beach Ordinance Code relied upon by the Planning Commis-
sion in making their decision for denial, and stated that the proposed
freeway plan would bisect said property. fie further stated that there
is existing indu8trial uses across the street from the college site
and the two are compatible.
There being no one furtherpresent to speak on the matter and there
being no further protests filed, either oral or written, the hearing
was closed by the Mayor.

On motion by Lambert, second Gisler, Council overruled ed the Planning
Commission and granted Zone Case 66®11 and directed the Attorney to
prepare a n Ordinance effecting the change; and further overruled the
Planning Commission and approved Tentative Tract Map 6181, subject
to conditions stipulated by the Planning Commission. Motion carried.

ASSET�MLY BILL 1-28
The City Administrator informed the Council of a legislative bulletin
of the California League of Cities regarding AB 128 involving cities
contracting with the State Employees Retirement System which would
amend provisions of SFRS to reduce the minimum r-etirement age of
policemen to age 50, and thereby increase the city 's cost for police-
men electing to take early retirement by 35 per cent.
On motion by Welch, second Gisler, Council directed the City
Administrator to contact the Assembly Committee, well as our
Assemblyman, to request support in preventing the adoption of AB 128
into law. Motion carried.
DPW - HYDROLOGY COURSE - VC IRVINE-1
On motion by Lambert, second Gisler, Council granted the Director
of Public Works permission to send two of his staff to a Hydrology
course at the University of California at Irvine, on two successive
weekends in April, with tuition of $15.00 each and transportation by
City vehicles allowed. Motion carried.
