COMMISSIONERS ABSENT: Kaufman MINUTES: On motion by Worthy and ss''conded by Cr , the Minutes of the Huntington'Beach Planning Commission of March 1, 1966 were accepted as transcribed; and mailed by the Secretary. USE VARIANCE NO. 66-7 - Continued Applicant - Deane Brothers To permit a helicopter "Heli- Stop" landing.for pick-up and discharge of persons or freight -only. -..(No gasoline tanks and,/or rental or service of helicopters). Located on'the east side of Beach Blvd., approximately-1090 feet north of Atlanta Avenue. The Secretary read a letter of protest signed by 93 homeowners. A communication submitted by the Huntington Beach Union High School District requesting a continuance in order to secure a recommendation from the California Aeronautics Commission.was read. The Secretary read the Staff Report. The hearing was opened to the audience. The following property owners addressed the Commission and objected to the heli-stop. Harold Alpert, 8042 Sunset Circle, Gene Evans,,8011 Sunset Circle,'W. T. Giltner, 20881 Cata- maran Lane, Mr. Williams, 8062 Driftwood Drive and Hubert Sanchez, 8062 Mermaid Circle. Ben Deane, applicant addressed the Commission and gave his reasons for the request. He stated that it is not the applicants intent to permit a commercial heliport. He stated that the'firm-needs a helicopter for transportation to various jobs in Southern California. He informed the Commission that the approach for landing can be made from the west and there would be no need to fly over schools or housing. There being no other comment, the hearing was closed. The Commission held a lengthy discussion. Mr. Deane again addressed the Commission and requested a withdrawal of Use Variance 66-7. 1. 4/5/66 H. B. Total Acreage: 13.0 Engineer: Williamson and Schmid Located south of Bushard and west of Brookhurst Street and legally described as being a pro- posed subdivision of a portion of the S34, NWA, of Section 19-6-10. The Secretary informed the Commission that Tentative Tract Map No. 5664 and Use Variance No, 66-13 pertain to the same parcel of land and the public hearing should be opened on Use Variance No. 66-13 in conjunction with the tentative tract. The Subdivision Committee Report and the Staff Report were read by the Secretary. The }gearing was opened to the audience on Use Variance 66-13. Alex Bowie, Attorney for the developer, addressed the Commission and described the physical characteristics of the property. He stated that the' shape of the parcel is unique thereby causing a hard- ship. He also stated that the property is zoned for R-2 and R-3. 'He pointed out that a map for a planned residential development had previously been approved by the City and gave a brief history of the events that occurred on the pro- perty in recent years„ Richard Zchmido engineer for the developer, addressed the Commission and presented several maps depicting the roadway access to public streets and the distance to the dwelling units from the guest parking area. Mr. Schmid requested that the maps be included in the permanent record. Bill,Hartge, Deputy Director of Public Works, addressed the Commission and explained �vhy the street connection between Bushard and Brookhurst was undesirable. Kenneth Parkman, 9372 Leilani Drive, addressed the Commission and stated that street widths within the proposed development should be greater because people going to the beach would no doubt park within the subdivision. 4. 4/5/66 H. It was the consensus to continue the decision to allow the developer time to submit a re- vised plot plan. Located at the westerly corner of Brookhurst and Bushard Streets. RECESS CALLED CHAIRMAN BAZIL CALLED A RECESS AT 9:20 PM COMMISSION RECONVENED: COMMISSION RECONVENED AT 9:35 FM USE VARIANCE NO. 66-11 Applicant - James Montgomery To allow 85 units in deviation to the permitted 64 units and to allow carports to be used in deviation to the required garages in the R-2 Two Family Residence District. Located on the east side of Huntington Street, approximately 660 feet south of Garfield Avenue and legally described as Blocks 3003, 3004, East Side Villa Tract. The Secretary read --a letter of pro- test signed by 21 homeowners of the adt-acent area. The Staff Report was read by the, Secretary. The hearing was opened to the audience. Commissioner Lawson disqualified himself because he represents the applicant on other matters. 5.' 4/5/66 H. B. Planning Commission Page No. 6 Tuesday, April 5, 1966 Everett Herndon, 7652 Garfield Ave., addressed the Commission and opposed the subject variance. James Montgomery, applicant, addressed the Commission and gave his reasons for the request stating that the subject property is adjacent to a trailer park on the north, a refinery and an R-3 Zone across the street. He stated that he is unable to use his property as his neighbors; therefore, hardship has been demonstrated. There being no other comment, the hearing was closed. The Commission noted that density is the prime issue, because the developer wants to add 21 dwelling units to the maximum permitted. The Planning Director informed the Commission that the move -in buildings now have a total of 85 units and .the applicant's original plan, which was approved by the Board of Zoning Adjustments, called for a conversion to 64 units. It was further noted that the applicant wants to provide carports rather than garages. A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO DENY USE VARIANCE NO. 66-11 FOR THE FOLLOWING REASON: 1. The applicant has failed to extablish a hardship on the property. ROLL CALL VOTE: AYES: BAZIL, CRABB, MILLER LARKIN, WORTHY. NOES: NONE. ABSENT: KAUFMAN. ABSTAINED: LAWSON. THE MOTION CARRIED. ZONE CASE NO. 66-16 Applicant - Kachickas, Eisner, Clendenen Change of Zone from R-1 Single Family Ressdence District to R-3 Limited Multiple Family Residence District. Located east of Bolsa Chica Street approximately 1000 feet south of Warner Avenue. Complete legal on file. The Planning Director explained the maps depicting the location of the subject property and how it relates to surrounding uses.,, The proposal included a strip of R-2 Zone separating the R-3 from the existing R-1 Subdivision to the east. The hearing was opened to the audience. George Kachickas applicant addressed the Commission and stated that he was in accord with the Staff's proposal. Bill Eisner, 15604 Gaymont Drive, La Mirada, Calif., addressed the Commission and also agreed to the Staff's proposal. 6. 4/5/66 H. B. It was noted that the proposed zone change is in conformance with the Master Plan of Land Use andthe R-2, zone will serve as a transition between the R-1 and R-3 zones. RESOLUTION NO. 66-16 A Resolution of the City Planning Commission Recommending approval of Zone Case;No. 66-16 as amended to the City Council. A MOTION WAS MADE BY LARKIN AND SECONDED BY LAWSON TO ADOPT-' RESOLUTION NO. 66-16 RECOMMEND- ING'APPROVAL OF ZONE CASE NO. 66-16 FOR AN R-2 and R-3 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. This is a higher zone than planned for the area, but other land nearby, master planned for medium density, is being used for low density. Hence,the overall result is medium density and in conformance with the Master Plan of Land Use. 2. An R-2 zone will serve as a transition between the R-1 and R-3 zones. ROLL CALL VOTE: AYES: BAZIL, CRABB, MILLER, WORTHY, LARKIN, LAWSON. NOES: NONE. ABSENT: KAUFMAN. THE RESOLUTION WAS.ADOPTED. ZONE CASE NO. 66-17 Applicant - Laura I. Located on the west side of Brookhurst Street, approximately 792 feet south.! of Garfield Avenue. The Secretary read a letter sub- mitted by Harold I. Harper, requesting a continuance to May 3, 1966. The hearing was opened to the audience, there being no comment the hearing was closed. The Commission reviewed the request and it was their unanimous recommendation that this variance should be denied because the project would result in excessive lot coverage. INFORMATION: The Secretary read a communication submitted by the State Department of Public Works, Sac- rament6,.California,,regarding'the',City's intention to seek the designation of Highway #1 as an Official State Scenic Highway. The Communication was received by the Commission and ordered filed. COMMUNICATION: The Secretary read a communication submitted by the Street naming Committee of Orange County requesting that the Planning Commission consider changing the name of Cannery Street;to Magnolia Street for that portion of the street lying within Huntington Beach, between Heil Avenue and Warner Avenue. It was the consensus of the Commission that all of Cannery Street located within Huntington Beach should be changed to Magnolia Street and that Magnolia Avenue in the "old town" area be changed to a more suitable name to avoid a conflict in street names. A MOTION WAS MADE BY CRABB AND SECONDED BY LARKIN TO RECOMMEND TO THE CITY COUNCIL THAT ALL OF CANNERY STREET LOCATED WITHIN HUNTINGTON BEACH BE CHANGED TO MAGNOLIA STREET AND, FURTHER, THAT MAGNOLIA AVENUE IN THE "OLD'TOWN" AREA BE CHANGED TO A MORE SUITABLE NAME TO AVOID A CONFLICT IN STREET NAMES. PROPOSED CODE AMENDMENT 66-7 Separation Walls The Commission reviewed the proposed amendment to Division 9 pertaining to separation walls between property zoned or used for residential purposes and property zoned or used for professional, commercial and industrial purposes. A'MOTION WAS MADE BY LAWSON AND SECONDED BY CRABB TO INSTRUCT THE SECRETARY TO SET A PUBLIC HEARING ON CODE AMENDMENT 66-7 FOR MAY 37 1966. PROPOSED CODE AMENDMENT 66-8 Setback for Carports and Garages The Commission reviewed the proposed amendment pertaining to setback for carports and garages entered directly from a street. A MOTION WAS MADE BY LAWSON AND SECONDED BY CRABB TO INSTRUCT THE SECRETARY TO SET A PUBLIC HEARING ON CODE AMENDMENT NO. 66-8 FOR MAY 3, 1966. ROLL CALL VOTE: AYES: BAZIL, CRABB, MILLER, WORTHY, LARKIN, LAWSON. NOES: NONE. ABSENT: KAUFMAN. THE MOTION CARRIED. COMMUNICATION: The Secretary read a letter sub- mitted by the Assistant City Attorney, pertaining to a draft of the proposed Parks and Recreation Ordinance pre- pared by the California League of Cities which in his opinion resolves the objections of the Home Builders Council. It was the consensus of the Commission to request the City Council to refer the pro- posed Ordinance back to the Planning Commission for further study. DISCUSSION: The Commission held a discussion pertaining to the possibility of revising the R-A zone to make sure that it is a transition zone rather than a residential zone. A MOTION WAS MADE BY CRABB AND SECONDED BY LAWSON TO INSTRUCT THE STAFF TO MODIFY THE R-A ZONE TO ASSURE ITS STATED INTENT AND SET THE AMEND- MENT FOR PUBLIC HEARING.
