BOARD MEMBERS PRESENT: John Mandrell, Herbert Day, Richard Harlow.
BOARD MEMBERS ABSENT: None.
MINUTES: The minutes of April 13, 1966 meeting
were accepted as transcribed.
USE PERMIT NO. 66-9
Applicant - G & G Company
To allow a home occupation
for a mailing address in conjunction with the operation of a
business. Located at 4612 Suite Drive and legally described
as Lot 209 of Tract 3670.
The hearing was opened to
the audience.
Mr. Toohill stated that the
business would be limited to mail and telephone only and that
his business wa-a leasing stress relieving equipment.
Board discussion -followed.
Mr. Toohill was asked if he
was able to comply with all the conditions, regulating home
occupations because any violation of the requirements would
be grounds for revoking his business license. Mr. Toohill
stated that he could comply with the conditions as stated.
A MOTION WAS MADE BY HARLOW AND
SECONDED BY MANDRELL TO APPROVE USE PERMIT NO. 66-9.

Applicant - Cliff and Fay Truxel
To allow a home occupation
for the sale of paintings, artist supplies, picture frames,
and art -crafts. Located at 715 Huntington Avenue and legally
described as Lots 8 and 9, and the north 19 feet of Lot 7, of
Block 702, Vista Del Mar.Tract.

Mrs. Truxel, applicant stated
that they would be using a hobby room for the sale of their
paintings and that the paintings will be their own.
There being no further comment,
the hearing was closed.

Applicant - Phillip R. Barton
To allow a home occupation for the operation
of a rubber stamp making business, located at 19162 Hamden
Lane and legally described as Lot 87 of Tract 3908.
The hearing was opened to the audience.
Mrs. Cunningham, property owner, explained
the request for the applicant and stated that it would not
inconvenience her because the business would be limited to
one room.
There being no further comment, the
hearing was closed.
Board discussion followed.
Mrs. Cunningham was informed that any
violation of the requirements regulating home occupations
would be grounds for revoking the business license.

AREA VARIANCE NO. 66-22
Applicant - Doyle Development
To allow a portion of the main dwelling
to encroach to within 10 feet of the front property line
in deviation to the required 15 foot front yard setback.
Located on the north side of Glenroy Drive, 185' west of
Newquist Lane and legally described as Lot 135,-Tract 5792-
The hearing was opened to the audience,
there being no further comment, the hearing was closed.

A MOTION WAS MADE BY HARLOW, AND SECONDED
BY DAY TO APPROVE AREA VARIANCE NO. 66-22 FOR THE FOLLOWING
REASONS:
1. The street has an unusual shape in front of this lot,
therefore reducing the front yard area.
2. It has been the policy of the City to allow variations
in the front yard setback for houses in new subdivisions.

Applicant - Billy Duvallis
To allow a room 20' in width
to encroach to within 13' of the rear property line in
deviation to the required 20' rear yard setback. Located
at 15381 La Salle -Drive and legally -described as Lot 236,
Tract 3846.
The hearing was opened to the
audience, there being no comment the hearing was closed.
Board discussion followed.
It was noted that the request
conforms to the proposed revision to the Code regarding
rear yard setbacks.
A MOTION WAS MADE BY HARLOW AND
SECONDED -BY DAY TO APPROVE AREA VRRIANUEENO. 66-23 FOR THE
FOLLOWING REASON:
1. The Ordinance which will allow this type request to occur
will be in effect in a short period of time.

AREA VARIANCE NO. 66-24
Applicant - James F. Tyler
To allow a patio roof to over-
hang to within 2'6" of the rear property line in deviation to
the required 5' setback. Located at 5110 Partridge CirclLlaand
legally described as Lot 12 of Tract 3469.
The hearing was opened to the
audience.
Mr. Tyler applicant explained his
request and stated that there is an alley to the rear of his lot.
He stated that the patio slab and fire place were built and
preferred to have the patio roof cover them.
Board discussion followed.
A MOTION WAS MADE BY DAY AND
SECONDED BY HARLOW TO APPROVE AREA VARIANCE NO. 66-24 WITH
THE FOLLOWING CONDITIONS:
1. The supporting poles shall be setback on the house side of
the planters which shall be a minimum of 5' from the property.
2. The patio shall remain unenclosed.
FOR THE FOLLOWING REASONS:
1. The lot backs up to an alley.
2. The rear yard is smaller on a cul-de-sac, than on standard lots.
3. This same situation can occur on the side yard.
4. There is Sufficient rear yard remaining which will comply
with the proposed ordinance regarding rear yard area.

Applicant - Forbeck-Montgomery
To allow a canopy, over a walking deck, to
project 4' into the rear yard setback. Located on the east side
of Nalu Circle ll@ feet north of Baruna Lane and legally described
as Lot 27, of Tract 5050.
The hearing was opened to the azdience.
Ronald SMontgomery applicant and William
Ashby abuilder showed plot plans and explained the request.
There being no further r,-ommeht the hearing
was closed.

A MOTION WAS MADE BY DAY AND SECONDED BY
MANDRELL TO APPROVE AREA VARIANCE NO. 66-25 FOR THE FOLLOWING
REASONS:
1. The lot is backed up to waterways.
2. The campy is a continuation of the eaves.
3.tt The posts are not necessary as a structural part of the
house but are used to attach the safety rails.
4. The request will add to the aesthetic value of the house and
area.
ROLL CALL VOTE:

Applicant - D. Everett Lee
To allow a sundeck to project 6' into the
required 10' rear yard setback, located at 16787 Bolero Lane
and legally described as Lot 54 of Tract 5050.
The hearing was opened to the audience. -
Hr. Lee applicant explained reasons for the
request and showed plot plans.
There being no furthercomment, the hearing
was closed.

A MOTION 'WAS MADE BY MANDRELL AND SECONDED
BY HARLOW TO APPROVE AREA VARIANCE NO. 66-26 FOR THE FOLLOWING
REASONS:
1. The extension is not detrimental to adjoining property owners,
inasmuch as the sundeck is setback from the side of the house.
2. It will be esthetically beneficial to the house and the area.
3. It assists in eliminating thesttreotype pattern along the rear
of the houses backing on the channel.
4. The lot abutt.. a 400' wide channel.
