COMMISSIONERS ABSENT: Crabb. TENTATIVE TRACT MAP NO. 5791 Number of Lots: 199 Subdivider: Doyle Development Total Acreage: 43.5 Engineer: Voorheis-Trindle-Nelson,Inc. - Located at the southeast corner of Warner Avenue and Graham Street. The Subdivision Committee Report was read by the Acting Secretary. John Horner, representing the developer, addressed the Commission and objected to the condition requiring construction of a pedestrian bridge across the flood control channel. He stated that it will put an unnecessary burden on the subdivider, because of additional expenses for improvements outside the tract boundary. He stated that a permanent structure will be constructed when Graham Street is extended south of the subdivision which will cause removal of the temporary bridge. He also informed the Com- mission that there is an existing school within walking distance. Richard Hollingshead, representing 'the Ocean View School District, addressed the Commission and stated that the developer is causing the problem as to pedestrian access to the school and that the subject school site was planned prior to the tentative tract map being filed. He also pointed that that there will be approximately 240 children from the tract and the cost to bus the children will be approximately $6,000 per year. Mr. Hollingshead stated that it is customary for the school dis- trict to request construction of a pedestrian bridge and that the developer should be required to do so. He also added that the Planning Commission has, in the past, required construction of pedestrian bridges. He pointed out that it would be unsafe for children to walk along Warner Avenue to attend school. Bill Hartge, Deputy Director of Public Works, informed the Commission that there is a possibility of split- ting the cost of the -temporary bridge three ways; the subdivider, school district and the City. 5/3/66 Page No. 2 Minutes: H.B. COMMISSIONER CRABB Commissioner Crabb arrived at 7:45 P.M. and assumed his duties. Commission discussion was held at length. It was the consensus of the Commission to delete the condition re- quiring installation of the temporary pedestrian bridge across the flood control channel at Graham Street. A MOTION WAS MADE BY LAWSON AND SECONDED BY LARKIN TO APPROVE TENTATIVE TRACT MAP NO. 5791 WITH THE FOLLOW- ING CONDITIONS: 1. The Tentative Map received April 8, 1966, shall be the approved layout. 2. The tract shall be approved for construction of single family homes only. 3'. A petition for rezoning to R-1 shall be filed approximately at the time the final map is recorded. 4. All utilities shall be installed underground. 5. The flood control channel shall be fenced to Flood Control District Standards. 6. A pedestrian walkway and drainage facility shall be provided between Lots 31 and 32. Said facility shall be called Lot "A" and it shall be improved to Department of Public Works Standards. 7. Wally Nickel, representing the appli- cant, addressed the Commission and objected to the requirement of underground utilities. TENTATIVE TRACT MAP NO. 5664 Number of Lots: 146 Subdivider: Arlo Development Total Acreage: 13 Engineer: Williamson^ and Schmid Located southwest of Bushard and Brookhurst Streets. The Acting Secretary informed the Commission that Tentative Tract No. 5664 and Use Variance No. 66-13 pertain to the same parcel of land and the public hearing should be opened on UV #66-13. The Subdivision Committee Report and the Staff Report were read by the Acting Secretary. The hearing was opened to the audience. Alex Bowie, attorney for the applicant, addressed the Commission and stated that the applicant is provid- ing more than the required parking within the required distance; that the roadways have been increased in width and acce-ssthas,been provided to the landlocked parcel. He also informed the Commission that the density is 11.4 units per acre which -is less.than the Master Plan of Land Use indicates for the area and all standard require- ments have been complied with. Richard Schmid, engineer for the developer, addressed the Commission and stated that the Staff knew the proposal was to be a planned residential development and did not inform them that the Commission had adopted a policy to require planned developments to be statutory condominiums. -3- 5/ 3/66 Page No. 4 Minutes: H.B. Oscar Liff, architect for the developer, addressed the Commission and commented on the street widths and the design of the development. H. D. Getch, 9382 L eilani Drive, Hunt- ington Beach, addressed the Commission and stated that the proposed development will be an asset to the community. There being no other comment, the hear- ing was closed. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 5664 WITH THE FOLLOW- ING CONDITIONS: 1. The Tentative Map received May 2, 1966, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless Use Variance No. 66-13 is approved by the City Council. 3. The water, sewer and fire hydrant systems shall be approved by the Department of Public Works and the Fire Department. 4. A lighting system shall be installed on all private streets and common areas with illumination at least equal to lighting on public streets and said lighting shall be approved by the Department of Public Works. 5. All private street widths and corner radii shall comply with adopted Planning Commission -Standards. 6. VehicVlar access rights along all arterial highways, except at st eet intersections, shall be dedicated to the City of Huntington Beach. 12. Sewer and water systems shall be constructed by the developer and dedicated to the City of Huntington Veach 13'.. Water-:6upply shall be through the City of Huntington Beach's water system. 14. $dwage disposal ihall be through the City of Huntington Beach's sewage system. 15. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 16. Trees shall be provided to City Standards on all arterial highways. 17. Street lighting shall be provided to City Standards on all public streets. 18. Sub -surface water rights shall be deeded to the City of Huntington Beach. 19. Drainage of the subdivision shall be approved by the Director of Public Works prior to final recordation of any part of the approved tentative subdivision. 20. Block walls shall be constructed to City Specifications along all lots siding or backing onto all arterial highways. Said wall shall be six (6) feet high and measured from whichever side is higher at finished grade. 21. Said property shall participate in the local drainage assess- ment district. 22. All buildings on lots abutting a.City easement shall be set back 5 feet from the edge of such easement. 23. Preliminary and final soil report shall be submitted by an ap- -proved_ private soils engineer to the City prior to issuance of building permits. 24. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to -specifications provided by the Fire Department.!, 25. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF USE VARIANCE NO. 66-13 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. The development plan received May 2, 1966, shall be the approved layout. 2. Off-street parking facilities shall conform to Article 979. 3. The CC&R's Articles of Incorporation, By -Laws and Management Contract shall be submitted to the Planning Director and City Attorney for approval. 4. The CC&R's shall contain at least the following provisions: a. Recreation areas within the development shall be reserved for the exclusive use of residents within the project and their non-paying guests. b. Owners and/or tenants shall be required to abide by associ- ation rules and there shall be penalties for violation of said rules. C. Any interest in the common area (including private streets) held by the individual parcel or condominium unit owners cannot be devised, conveyed or dedicated separate and part from the devise conveyance, and/or dedication of the individual parcel or condominium unit for a life in being plus 21 years, excepting this may be accomplished under the same conditions or grounds as are available under judicial partition. d — If the development is'constructed in -increments or several final maps reciprocal management agreement shall be estab- lished that will cause a merging of increments as they are completed. The end result shall be one homes association with common areas common to all and one management for the entire project. 5. All rights for development and construction of any structures within the common area not included in the approved develop- ment plan shall be dedicated to the City. 6. All streets within the development shall be private streets. 7. A complete plan of landscaping, screening, recreational facil- ities, and trash pick-up shall be filed for approval by the Planning Department. MASTER PLAN OF LAND USE WARNER AVENUE AND BEACH BLVD Floyd Belsito, Associate Planner, gave a presentation of the existing land use, existing zoning, existing master plan of land use, proposed master plan of land use and proposed zoning of the property bounded by Heil Avenue on the north, Newland Street on the east, Slater Avenue on the south and the P. E. Railroad R/W on the west. He stated that this situation existed because the City does not allow temporary stands. It was the consensus of the Commission to have -the Staff prepare a code amendment to permit certain temporary stands within the City. ASSISTANT CITY ATTORNEY Assistant City Attorney, George Shibata, distributed copies of a proposed ordi- nance requiring dedication of land, payment of fees, or both for park and recreation purposes. The Commission reviewed the proposed ordinance and it was their consensus to set the ordinance for a public hearing.
