ION OF TIME - TENTATIVE TRACT MAP NO The Secretary informed the Commission that because there are no ,provisions in the code for an extension of time on use variances, the developer has chosen to let agenda items 2 and 3 expire. It was the consensus of the Commission that a denial of the extension of time for Tentative Tract 5963 would allow both items to expire. The hearing was opened to the Gene Rosenfeld, applicant,addressed the Commission and gave his reasons for requesting a reduction of the amount of commercial zoning shown on the subject parcels. He also submitted a real estate report regarding the need for commercial property in the area. Charles Palmer, representing the Huntington Beach Elementary School District, addressed the Commission and stated that the school district supports the Staffs recommendation to retain the commercial zoning as shown on the Master Plan of Land Use. Robert Galloway, engineer for the developer, addressed the Commission and questioned condition #5 requiring that "A" and "B" Streets have a 54 ft. R/W. There being no other comment, the hearing was closed. It was the consensus of the Commission thJt the Zone Case should be considered first inasmuch as the decision will influence the decision on the Tentative Tract and Use Variance. John Bartlett, architect, addressed the Commission and questioned condition #2 requiring construction of a 42 inch high block wall along Orlando Drive and Springdale Street. The Planning Director informed Mr. Bartlett, that the block wall is a requirement of Article 979. He also stated that the intersection of Warner Avenue and :Beach Blvd. is a valuable commercial corner. Dr. -Robinson, 17281 Beach Blvd., addressed the Commission and also objected to the office-professicma use proposed on the west side of Beach Blvd. Julius Gomes, 904 loth Street, addressed the Commission and stated that a client of his was in the process of acqutring an additional 75 ft. of P,toperty located west of the existing C-4 zone on the north side of Warner Avenue. He asked the Commission to consider this when establishing the westerly boundary of the commercial property on Warner Avenue. The Secretary informed the Commission that the City Council adopt the Oil Ordinance on May 18, 1966. George Shibata, Assistant City Attorney, addressed the Commission and stated that he felt steaming was permitted. Planning Commtssioxt Tuesday, May 17, 1966 PLANNING DIRECTOR: The Planning Director informed the Chairman that a deadline should be established for amending the Planning Commission By -Laws by Commissioner Lawson and the Assis- tant City Attorney Shibata. It was the consensus of the Commission that the By -Laws be submitted by June 7, 1966. COMMUNICATION: The Secretary read a letter submitted by Bill Hartge, Deputy Director of Public 'Works, requesting that the local street between Shasta Land and McFadden Avenue be renamed to Sugar Drive. Mr. Hartge stated that since the com- pletion of the McFadden Avenue overpass of the San Diego Freeway, there has been a confusion of street names. He stated that the name McFadden Avenue also appears on the street leading into the tract known as Fashion Homes. A MOTION WAS MADE BY CRABB AND SECONDED BY WORTHY TO RECOMMEND APPROVAL OF A STREET NAME CHANGE TO SUGAR DRIVE FOR THAT PORTION OF MCFADDEN AVENUE LEADING INTO THE TRACT KNOWN AS FASHION HOMES. RICHARD HARLOW: , Richard Harlow, Associate Planner, informed the Commission that the condition of approval for Use Variance No 813 requiring installation of street improvements along Warner Avenue has presented a financial problem to the applicant. -18- 15/17/66 Page No. 19 Minutes: H.B. Planning Commission Tuesday, May 17, 1966 He stated that the applicant has filed a division of -land application with the Board of Zoning Adjustments to separate the lot into two parcels. Mr. Harlow then stated that divisions of land are normally approved with the condition that improvements be installed at the time each parcel is developed. In this case that would cause a conflict with the conditions of the Use Variance inasmuch as the variance required improving that portion of Warner Avenue abutting the applicants property. Mr. Harlow suggested that the Planning Commission modify the requirement for improving Warner Avenue to conform to the policy requiring installation of street improvements at the time each parcel is developed. A MOTION WAS MADE BY LAWSON AND SECONDED BY WORTHY THAT THIS REQUIREMENT BE POSTPONED UNTIL THE DEVELOPMENT TAKES PLACE AND A DIVISION OF LAND BE PROCESSED BY THE BOARD OF ZONING ADJUSTMENTS. ROLL. It was the consensus to continue the request to enable the City Attorney to determine whether or not the Commission can recommend a change of zone which was originally established by initiative.
