HB UNION HIGH SCHOOL DISTRICT - PROTEST
of'TheClerk presented a letter and Resolution from the Board of Directors
of the Huntington Beach Union High School Board of Trustees, protesting
an application by Pizza'Specialty Corporation, to sell beer and wine
at 5894 Edinger Avenue - Von's Shopping Centex, as the premises are
located within 600' of Marina High School.
On motion -by Green, second Gisler, Council referred the protest from
Huntington Beach Union High School. District to the City Administrator
to handle. Motion carried,
LEASE REQUEST - PAVALON DANCE HALL
The Clerk presented a letter from Carroll H. Simon, Attorney for
John T. French, offering to lease the Pavalon Dame Hall and concession
for an annual fee of $1.0,000, on a three year basis with a yearly
option thereafter.
On motion by Coen, second Green, Council referred the Pavalon Lease
offer to the City Administrator and a committee of the Council for
study and report at the meeting of June 20, 1966. Motion carried.
Mayor Stewart appointed Councilman Coen and Councilman Bartlett as a
Committee of the Council to work with the City Administrator on the
Pavalon lease offer study.
CLAIM - IVAN B STEWART - SAFECO
The Clerk presented a claim for property damage filed by Safeco
Insurance Company for alleged damages incurred by Ivan B. Stewart,
16812 Ross Lane, City, when a City boom lift struck a power line
causing the wires to lay on his home and damage the roof.
On motion by Bartlett, second Gisler, Council denied the claim for
damages filed by Safeco Insurance Company and referred same to the
City Attorney and the City's Insurance Carrier. Motion carried.
CLAIM - DONALD J MC KNIGHT
The Clerk presented a claim for personal injuries submitted by Robert
J. Findley on behalf of Donald J. Me Knight, for alleged damages
incurred on March 2, 1966, for unlawful arrest.
Councilman Coen requested and was granted permission to abstain from
action on the following claim due to a conflict of interest :and vacated
his place at the Council table.
On motion by Green, -second Bartlett, Council denied the claim filed
by Donald J. Me Knight and referred same to .the City Attorney and the
City's Insurance Carrier. Motion carried.
Councilman Coen resumed his place at the Council table.
PUBLIC HEARING -- ZONE CASE 66-23
Mayor Stewart announced that this was the day and hour set for a public
hearing on Zone Case 66-23, on property located at the.northeast corner
of Huntington Street and Atlanta Avenue, and directed the Clerk to
read the legal notice.
The Clerk read notice of public hearing on Zone Case 66-23, as published
in the Huntington Beach News on May 19, 1966, setting the hour of 7:30
P.M., or as soon thereafter as'possible, on Monday the 6th day of June,
1966, in the Council Chamber of the Civic Center, Huntington Beach,
California, as the time and place for a public hearing for the purpose
of considering a petition for a change of zone to regulations of the
Districting Ordinance, from R2-0 Two Family Residence District, combined
with oil production, and R5-0 Office -Professional District, combined
with oil production, to R-3 Limited Multiple Family Residence Districts

The Clerk informed the Council that they had been provided with
copies of the Planning Direct r''s transmittal and the Resolution of
the Planning Commission, recommending approval of Zone Case No. 66-23,
and stated that he had received no communications or written protests
to the Zone Case or to the recommendation of the Planning Commission.
Mayor Stewart declared the hearing open.
There being no one prr.esent to speak on the matter; and there being
no protests filed, either oral or written, the hearing was closed by
the Mayor.
On motion by Kaufman;.second Shipley, Council sustained. the recommenda-
tion of the Planning.C6m ission and directed the City Attorney to pre-
pare an Ordinance effecting the change in Zone Case 66-23. Motion
carried.

hearing on Code Amendipent 66-7i amending Section 9730.17 of the
Huntington Beach Ordinance Code to require a. six foot separation wall.

Residential District, and directed the 'Clerk to read the legal notice.
The Clerk read notice of public hearing on Code Amendment 66-7, as
published in the Huntington Beach News on May 19., 1966,.setting the
hour of.7:30 P.M., or as soon thereafter as possible, on Monday, the
6th day of June, 1966, in the Council Chamber of the Civic Center,
Huntington Beach,, California, as the time andplace fora public hearing

PUBLIC HEARING - TRACT MAP 5791 - APPEAL BY OCEAN VIEW SCHOOL DIST
0Mayor Stewart announced that this was the day and hour set for a
public hearing on an appeal to a condition deleted by the Planning
Commission in approving Tentative Tract Map 5791, and directed the
Clerk to read the legal notice.
The Clerk read notice of public hearing on the appeal to the deletion
of a condition in the approval of Tentative..Tract Map 5791 by the
Planning Commission, as published in the Huntington Beach News on
May 19, 1966, setting the hour of 7:30 P.M., or as soon thereafter as
possible, on Monday, the 6th day of June, 1966, in the Council Chamber
of the Civic Center, Huntington Beach, California, as the time and
place for a public hearing for the purpose of considering an appeal,
to the deletion of the condition requiring the construction of a foot
bridge across the flood control channel, in the approval of Tentative
Tract Map 5791 by the Planning Commission, to provide access to
School Site #26.
The Clerk presented the letter of appeal filed by the Ocean View
School District, and informed the Council that he had received no
further communications or written protests to the condition deleted
from Tentative Tract Map 5791.
Mayor Stewart declared the hearing open.
Dale Heinly, Attorney for Dutch Haven Homes, developer of Tract 5791,
addressed the Council and requested a legal opinion from the City
!'attorney relative to time limits for appeal in this matter and stated
that he felt the School District was not an interested party according
to the Code.
City Attorney Bush stated that in his opinion, the City was within
the time limit•permi.tted under the State Professions Code in receiving
the appeal and setting the public hearing, and further informed Mr.
Heinly that it was his opinion that the School District was an
:interested body.
Mr. Heinly addressed the Council and read portions of the State Code
on the Subdivision Map Act; questioned the City Attorney's interpreta-
tion of the Code, and requested City cooperation in settling the
matter.
Mr. Richard Hollingshead, Coordinator of -State Aid Building Progiram
for the Ocean View School District, addressed the Council on behalf
of the School District and gave a resume' of the original tract plans
and a review of the action in the deletion by the Planning Commission.

reiterated the need for the access bridge to the Lyons Tract, and
requested City cooperation in reinstating the footbridge requirement
on Tentative Tract Map 5791,
Mr. John Horner addressed the Council in reply to questions by
Councilor p Coen relative to bridge costs and presented the developers
problems -in dealing with the Ocean View School District. Mr. Horner
stated that the developer was willing to negotiate. He presented a
map and pointed out the sites in the area owned by the school for
future development.

On motion by Stewart, second Shipley,, Council directed the City Staff
to meet as a committee with representat:ve:s.o.f the developer and the,
School District to endeavor to negotiate a settlement in the matter,
and continued the Public Hearing on the appeal to.Tentative Tract Map
5791 to an Adjourned Meeting of the Co.un-cil.on. June 27, 196.6. Motion
carried.

Mayor Stewart announced that this was the day -and hour set for a public
hearing on an appeal to conditions imposed by the Planning Commission
in approving Tentative Tract Map 5664, and directed the Clerk to read
the legal notice.

the appeal to conditions of Tentative Tract Map 56.64 and consideration
of Use Variance 66-15, to the regular meeting of June 20, 1966. Motion
carried.

the Clerk to publish notice of same. Motion carried.

Following discussion of a compatible time for a field trip with Mr.
Lemly, Field Superintendent of Standard 0i1Company relative to Zone
Case 66-15, Council.agreedto meet informally on Saturday, June 11,.

On motion by Coen, second Shipley, Council deferred action on UV 6-17
until the meeting of June.2O, 1966, as the Revised Tentative Tract
Map would go to the Planning Commission June 7, 1966. Motion carried.
UV 66--19 - CONDITIONAL EXCEPTION - HELEN INVESTMENT CO
r17The Clerk presented a transmittal from the Planning Director of a
recommendation of approval of Conditional Exception:- UV 66-19 - Helen
Investment Company - on property located north of Yorktown Avenue and
west of Brookhurst Street, involving deviations to the RA Residential
Agricultural District requirements and the Subdivision Ordipance Code
for Tentative Tract Map 4806.

On motion by Bartlett, second Gisler, Council concurred with the
recommendation of the Planning Commission and directed the City
Attorney to prepare a Resolution approving Use Variance 66-19, with
conditions as stipulated by the Planning Commission. Motion carried.
TRACT MAP 5193 - EXTENSION OF TIME - MEREDITH CO
`8n motion by Kaufman, second Bartlett, Council .granted an extension
of time on Tentative Tract Map 5193, Meredith Company, with conditions
as stipulated by the Planning Commission. Motion carried.
STREET NAME CHANGE - MAGNOLIA AVE TO PECAN AVE
'The Clerk presented a recommendation from the Planning Commission
for the change of name of Magnolia Avenue to Pecan Avenue, in conjunc-
tion with changing Cannery Street to Magnolia Street.
On motion by Shipley, second Coen, Council approved the street name
change of Magnolia Avenue to Pecan Avenue and directed the City
Attorney to prepare Resolutions necessary to effect the change of
Magnolia Avenue to Pecan Avenue and Cannery Street to Magnolia Avenue.

STREET NAME CHANGE - MC FADDEN AVE TO SUGAR DRIVE
The Clerk presented a recommendation from the Planning Commission for
a. street name change of a portion of McFadden Avenue to Sugar Drive,
on that portion leading into the tract known as Fashion Homes.
On motion by Green, second Gisler, Council approved the street name
change and directed the City Attorney to prepare a resolution effect-
ing the change of a portion of McFadden Avenue.to Sugar Drive in the
City. Motion carried.
STREET NAMING PROCEDURE —RESOLUTION TO ESTABLISH

Attorney to prepare a Resolution relating to the.procedure to be
established for street naming in the City by the Fire Department.

On motion by Bartlett, second Gisler, Council accepted the work on
4 pa.rksites - Project CC-033; authorized final payment in the amount
of $11,586.13 to W. J. Shirley; and directed the Clerk to file a
Notice of Completion. Motion carried.
TRACT 5557 - DEDICATION OF IMPROVEMENTS - C MICHAEL
The Clerk: presented a communication from the Director of Public Works
recommending acceptance of dedicated improvements and authorization
to release the Improvement Bond and terminate the Subdivision
Agreement on Tract 5557 - C. Michael, Incorporated.

On motion by Green, second Bartlett, Council accepted improvements
dedicated for public use in Tract 5557; authorized release of the
Monument Bond apd termination of the Subdivision Agreement; and
directed that the developer be notified by the City Clerk and the
bonding company by the City Treasurer. Motion carried.
OIL CLEAN-UP BOND - ESTES-CROSS COMPANY
The Clerk presented a communication from the Director of Public Works
recommending termination of..the clean-up bond on well Jan #1, located
on Lots.17-19-21-23 in Block 515� Seventeenth Street Section.
On motion by Stewart, second Bartlett, Council authorized termination
of clean-up bond #812010 Breat American Insurance Company, on well
Jan #1 owned by Estes-Cross'Company,=and directed that the owner be
notified. Motion carried.
TRACT 6080 - SUBDI VISION ACREEMWW, - MACCO

The Clerk presented a communication from the Director of Public Works
transmitting Monument Bond, Improvement Bond and Subdivision Agreement
for Tract 6080 - Macco,
On motion by Stewart, second Bartlett, Council accepted Monument Bond
#495088 and Improvement Bond #495987 -.American CAsualty Company,
approved the Subdivision Agreement, and authorized the Mayor and City
Clerk to execute same on behal.f of the City. Motion carried.
TRACT 6239 - SUBDIVIUON AGREEMENT - STAR DUST LAND
The Clerk presented a communication from the Director of Public Works
transmitting Monument Bond, Three -Party Agreement and Subdivision
Agreement for Tract 6239 - Star Dust Lands.
On motion by Bartlett, second Shipley, Council accepted Monument Bond
#15-3-7318 - Continental National Insurance Group, approved the Three -
Party Agreement and the Subdivision Agreement, and authorized the
Mayor and City Clerk to execute same on behalf of the City. Motion
carried.
QUITCLAIM DEED - 0 C .FLOOD CONTROL DIST
The Clerk presented a transmittal from. the Director of Public Works
of a Quitclaim Deed from the City to the Orange County Flood Control
District, whereby the City quitclaims the right-of-way necessary for
the C07 Channel at Bolsa Chica Street.
On motion by Shipley, second Bartlett, Council authorized the Mayor
and City Clerk to execute the Quitclaim Deed to the Orange County
Flood Control District. Motion carried:
STATE RELINQUISHMENT DEVILLE - .S.AY CIRCLES

The Clerk presented a letter from the State Division of Highways,
requesting a Resolution from the City to enable them to relinquish
the Deville and Savoy Circle cul-de-sacs, which were modified by
freeway construction.
The Clerk read Resolution No. 2381 by title - "A RESOLUTION OF THE
CITY COUNCIL . OF ' THE CITY -OF HUNTINGTON BEACH '. RELAT1NG' T.0: PROPOSED
DESIGN. ,CHANGES..FRAM THE,EXECUTED FREEWAY AGREEMENT."
On motion by Kaufman, second Coen, Council waived further reading of
Resolution 2381 by unanimous consent and passed and adopted same by
the following roll call vote:

CC-040 - WARNER AVE IMPROVEMENT - PLANS & SPECS
The Clerk presented a transmittal from the Director of Public Works
of Plans and Specifications, Resolution and Notice Inviting Sealed
Bids for improvement of Warner Avenue from Pacific Coast Highway to
3150 feet easterly.
On motion by Coen, second Green, the Plans and Specifications.for
Project CC-040 were approved and ordered filed. Motion carried.
The Clerk read Resolution No. 2382 by title - "A RESOLUTION OF THE
CITY OF HUNTINGTON BEACH ESTABLISHING THE GENERAL PREVAILING RATE
OF HOURLY WAGES FOR EACH CRAFT OR TYPE OF WORKMAN OR MECHANIC NEEDED
FOR THE RECONSTRUCTION, SURFACING, AND IMPROVEMENT OF WARNER. AVENUE
FROM PACIFIC COAST HIGHWAY TO 3150 FEET EASTERLY, PARTIALLY IN THE CITY

On motion by Shipley, second Bartlett, Council waived further reading

QUITCLAIM DEED - TRACT 5523
+The Clerk presented a transmittal from the Director of Public Works
of a quitclaim deed from the City to the Owner of Record, releasing
a ten foot easement in Tract 5523, which was originally acquired
for storm drain purposes and is no longer needed.
On motion by Bartlett, second Shipley, Council authorized the Mayor
and City Clerk to execute the Quitclaim Deed from the City to the
Owner of Record® Motion carried.
STORM DRAIN REIMBURSEMENT - COVINGTON BROS
;-PThe Clerk presented a recommendation from the Director of Public
Works for reimbursement to Covington Brothers' -Construction in the
amount of $21,059.00, for the installation of Sher Lane Storm Drain.
The Clerk read Resolution No. 2383 by title - "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE EXPEND-
ITURE OF MONEY FROM THE DRAINAGE DISTRICT<NO.'5 FUND."
On motion by Green, second Bartlett, Council waived further reading
of Resolution No. 2383 by unanimous vote, and'passed.and adopted

The Clerk presented a.communication from the Director of Public Works
recommending acceptance of dedicated 'improvements and authorization
to release the Improvement Bond and Monument Bond and terminate the
Subdivision Agreement.

dedicated for public use in Tract 5882; authorized release of the

IRVINE RESERVOIR AGMT - ADDENDUM
The Clerk presented an addendum .agreement between the City and the
Irvine Company, et a1, transferring 4 acre feet of storage capacity
in the San Joaquin Reservoir from the Irvine Company to the City of
NeuTort Beach,
On motion by Kaufman, second Gisler, Council approved the addendum
agreement with the Irvine Company, et al, and authorized the Mayor
and City Clerk to execute said addendum agreement on behalf of the.

STREET RE -NUMBERING "OLD TOWN"
The Clerk presented a communication from the City Attorney requesting
direction by the Council regarding information to be included in the

men killed from Huntington Beach, to date, be brought up to date by

Wirtz that the request was already being studied by his Department.

APPEAL REFUND APPROVED - TRACT 5791 - 0 V SCHOOL DIST
The Administrator presented a request from the Ocean View School
District for waiver of'fee and refund of the filing fee paid on their
appeal to deletion of a pedestrian bridge in Tract 5791.
On motion by Kaufman, second Gisler, Council granted waiver of fee
and directed the City Administrator to return the Ocean View School
District check in the amount of $75.00, inasmuch as they are a
public agency. Motion carried.
SPECIAL FEDERAL CENSUS - OCTOBER
On motion by Gisler, second Bartlett, Council author`_ized the filing
of an application to the Federal Bureau of Census for a target date
of October 1, 1966 fora Special Federal Census. Motion carried.
MAYORS' MEETING WITH SUPERVISOR BAKER
Mayor Stewart presented a report of the meeting of several Orange
County Mayors with Supervisor Baker to discuss the following problems
which concern several cities.
1. Study of Beach Boulevard development into a six lane highway.
2. Support for establishing another Judicial District within
the Huntington Beach -Seal Beach Judicial District.
3e Meeting with cities affected by the Beach Freeway and the State
Division of Highways to inform new Councils of planning to date.

license application filed�Py the Huntington Beach Visitor - Welcoming
Service, on recommendation of the Chief of Police. Motion carried.

The City Administrator presented a report regarding Use Variance 66-3
which had been deferred from the meeting of March 7, 1966, in order
to negotiate conditions protested by Robert 0. Morris, the applicant.
As a result of the negotiation, the conditions were amended as follows
l-, Delete requirements for installation of improvements.
3, Waive requirement for payment of drainage fees.
6. Waive requirement that all utilities be installed underground
until September 8, 1967.
7. Waive requirement that temporary off-street parking facilities
including landscaping, arrangement, access, paving and striping
shall conform to Article 979; and provide that limited parking
be provided by the applicant.
11. Waive requirement for submission to the Planning Commission of a
plan depicting dedication and improvement of Gothard Street,
off-street parking, fencing and landscaping.

UV 66-1 - STARDUST`LAND CO
The City Administrator presented Use Variance 66-1 relating to Tenta-
tive Tract Map 6163. The Council at the meeting of March 3, 1966,
approver that portion of UV 66-1 involving Lots 1-13, Lots 116-164
and Lots 181-186 in Tract 6123, and delayed action on the remainder
of the variance until requested by the City or the developer. Mr.
Miller reported that negotiations between the City and the developer
had been reached concerning a parksite, and recommended that the
remainder of the variance be approved.
On motion by Kaufman, second Shipley, Council approved that portion
of Use Variance 66-1 which"Was not approved at the meeting of March 7,
1966, with conditions as stipulated by the Planning Commission. Motion
carried.
PUBLIC HEARING - `BUDGET 6/20/66
On motion by Bartlett, second Gisler, Council ordered a public hearing
for Monday, June 20., 1966, at 7:30 P.M., or as soon thereafter as
possible, on the 1966-67 Proposed Budget. Motion carried.
DATA PROCESSING SCHOOL
On motion by Shipley, second Gisler, Council authorized the.Director
of Finance to attend the Date Processing School in San Francisco
from July 24-29, 1966, with reasonable expenses allowed. Motion carried
CITY OF LONG BEACH - PARADE FLOAT
On motion by Kaufman, second Bartlett, Council waived the reading of
a communication from the City of Long Beach requesting the City to
enter a float in their parade. Motion carried.
MOVE -INS - BLDG DIR RECOMMENDATION
The City Administrator read a letter from the Building Director
recommending that Council direct.the preparation of an Ordinance
prohibiting move -in houses, stating that several other cities had
similar Ordinances.
On motion by Coen, second Shipley, Council directed the City Attorney
to prepare an Ordinance prohibiting move -in houses. Motion carried.
HARBOR DISTRICT"ORDINANCE
The City Administrator presented a- report.of a meeting of City Officials
with representatives of the Harbor District.and Board of Supervisors,
and further presented a revised Harbor Control Ordinance, with a
recommendation for Council approval.
On motion by Gisler, second Coen, Council unanimously approved the
revised Harbor Control Ordinance as presented, and directed that a
certified excerpt be forwarded to the Orange County Board of Supervisors
prior to June 14, 1966. Motion carried.
SALARY ADJUSTMENT STUDY SESSION
On motion by Green, second Gisler, Council directed the City Attorney
to prepare a Resolution covering proposed salary adjustments for certain
City employees for the meeting of June 20, 1966. Motion carried.
PROPOSED 0iWINANCE: STANDING WATER FENCING
The Building Director reported to Council. of the need for an Ordinance
relative -.to the fencing of standing water in the City.
On motion by Green, second Coen., Council directed the City Attorney
to:, -prepare an Ordinance.relative to the fencing of standing water in
the City. Motion carried.

Maypr Stewart reported that Council will interview applicants for the
appointments to the Library Board and Planning - Commission at an
adjourned meeting of the City Council on June 27, 1966. Four applicants
will be interviewed for the appointment to the 'Planning- Commission
at 6:00 P.M., though all applications will be considered before appoint-
ment is made. All applicants for the appointment to the Library Board
will be interviewed at 6;45 P.M.
COUNCILMAN GISLER - OUT OF COUNTRY
On motion by Green, second Bartlett, Council granted Councilman Gisler
permission to be out of the Country for six weeks after June 20, 1966.
Motion carried.
STEWART & KAUFMAN - OUT OF STATE.
On motion by Gisler, second Bartlett, Council granted permission to
Mayor Stewart and Councilman Kaufman to be out of`ttate for two weeks.
Motion carried.
INFORMAL MEETINGS - 6/11/66 & 6/20/66
Mayor Stewart called an informal meeting of the Council and a
Committee -of -the -Whole for Saturday, June 11, 1966 at 8:30 A.M. at
the Standard Oil Company 23rd Street Office, for field trip.
Mayor Stewart called an informal meeting of the Council as a
Committee -of -the -Whole for Monday, June 20, 1066 at 4:30 P.M., for
a study session.
