PUBLIC HEARING
The Acting Secretary informed the
commission that this amendment pertains to the R-A Zone and
generally proposes to increase the minimum lot size to one acre,
increase the minimum lot frontage to 150 feet, lower the maximum
density to one dwelling unit per lot and amends the setbacks for
accessory buildings.

Public Works, addressed the Commission and stated that the require-
ment for improving Delaware Street to City Standards is not
necessary at this time since the variance is only for 3 years.
He stated that Delaware Street will be widened in the near future
and the applicant has already dedicated his share for future
right-of,way.

USE VARIANCE NO 66-21
Applicant - Norman K. Beals. Jr.
To allow the construction of a
professional office building and hospital in the R-A-O District.
The Staff Report was read by the
Acting Secretary.
The hearing was opened to the audience,
there being no comment the hearing was closed.
The Acting Secretary informed the
Commission that the property included in this application is
zoned R-A and Master Planned for -high depsity and medium density
residential use. Mr. Harlow stated that basically, the proposal
is an R-5 use that would make an ideal transition between com-
mercial and church uses on the north and multiple family on the
South.
A MOTION WAS MADE BY MILLER AND
SECONDED BY WORTHY TO APPROVE USE VARIANCE NO 66-21 UPON THE
FOLLOWING CONDITIONS:
1. Brookhurst Street shall be dedicated and fully improved to
City Standards. Improvements shall include street trees,
street signs, and street lights.
2. The property shall participate in the local drainage assess-
ment district.
3. Preliminary and final soil reports shall be submitted by an
approved private soils engineer to the City prior to issuance
of building permits.
4. A plan conforming to the grading ordinance shall be submitted
- to the Department of Public Works for approval prior to
issuance of a building permit.
5. All utilities shall be installed underground.
6. The water, sewer, and fire hydrant system shall be through
the City system and they shall be approved by the Department
of Public Works and Fire Department.'
7. Off-street parking facilities including landscaping, arrange-
ment, access, paving and striping shall conform to Article 979.

8. A 6 inch wide masonry wall shall be constructed along all
interior property lines. The height of said wall shall be
such, that the top will be 6 feet above the highest ground
surface within 20 feet of the common property line, except
the front 50 feet it shall be reduced to 42 inches.
9.• A change of zone application to R-5 shall be filed with
the Planning Commission prior to final inspection of any
structure.
10. A fully detailed plot -plan shall be submitted for approval
by both the Fire and Planning Departments. Said plan shall
depict all conditions of approval.
USE VARIANCE NO. 66-22
Applicant - Naylor and Sinclair Co.
To allow beach concessions for beach
rentals and food catering trucks in the R-1 Single Family
Residence District.
The Staff Report was read by the
Acting Secretary.
The hearing was opened to the audience.
Richard Sinclair, applicant, addressed
the Commission and gave his reasons for the request. He stated
that there is a need for concessions. Mr. Sinclair agreed to
a temporary variance and that he will vacate the premises if
the City or State acquires the subject property.
Lois Naylor, applicant, addressed the
Commission and requested approval of the proposed concessions.
Romeo Brown, Fire Marshall, addressed
the Commission and stated that he felt there would be problems
with fire protection.
There being no other comment, the
hearing was closed.

BY MILLER TO APPROVE USE VARIANCE NO. 66-22 WITH THE FOLLOWING
CONDITIONS:
1. Approval shall be limited to the location as indicated on

2. The variance shall be subject to cancellation for any reason
with 7 days notice.

To allow the use of a public parking lot
to be used in deviation to the off-street parking requirements
in the C-3 District.
The Staff Report was read by the Acting
Secretary.
The hearing was opened to the audience.
Richard Bernard, attorney, representing
the applicant, addressed the Commission and stated that off-
street parking facilities are not available in the area but
public parking across the street from the proposed facility
can take care of their needs. He also stated that the property
owner has spent several thousand dollars to improve the building
which will provide entertainment for young people.
Tim Talbert, owner of the subject property,
addressed the Commission and stated that he spent a considerable
amount of money improving the building and that young people need
this type of entertainment.
There being no other comment, the -'hearing
was closed. .

It was determined that the required

It was the consensus of the Commission

to enable the applicant to provide the required parking.

Applicant - Roman Catholic Church
The Acting Secretary informed the Commission
that one of the conditions of approval for UV #885 was that a
revised plot plan and landscaping plan would be submitted to the
Commission for approval prior to issuance of a building Termit.
The Commission reviewed the revised plot
plan and it was their consensus to approve said plan for the
school only because the development will be done in stages.
