HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: John Mandrell, Herbert Day,
Kenneth Reynolds.
BOARD MEMBERS ABSENT: None.
DIVISION OF LAND NO. 66-16 To allow a division of
Applicant - Essex Land Company land into two separate
parcels located at the
southeast corner of Atlanta Avenue and Brookhurst Street.
Legally described as a portion of the NW/4, Section
17-6-10. Further legal description on file in the
Planning Department Office.
The hearing was opened to the
audience. There being no comment, the hearing was
closed.
Board discussion followed.
A MOTION WAS MADE BY HARLOW
AND SECONDED BY DAY TO APPROVE DIVISION OF LAND NO.
66-16 SUBJECT TO THE FOLLOWING CONDITIONS:
Z. Atlanta Avenue and Brookhurst Street shall be
dedicated to City Standards.
2. Atlanta Avenue and Brookhurst Street shall be fully
improved to City Standards at the time each parcel
is developed. Improvements shall include street
trees, street signs, and street lights.
3. All streets shall conform to City of Huntington
Beach Standards. Master Plan of Arterial Street
and Highways Standards shall apply where applicable.
Street sections shall be determined by soil "R"
value and traffic index.
4. Water supply shall be through the City of Huntington
Beach's water system.
5. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
6. The property shall participate in the local drainage
assessment district at the time each parcel is
developed.
7. Preliminary and final soil reports shall be submitted
by an approved private soils engineer to the City
prior to issuance of building permits.
8. A plan conforming to the grading ordinance shall
be submitted to the Department of Public Works for
approval prior to issuance of a building permit.
9. The Edison Company property shall be fenced to City
Standards at the time Parcel #2 is developed.
10. All utilities shall be installed underground at the
time each parcel is developed.
11. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire
Department.

12. The Division of Land shall not be effective until an
agreement is signed and recorded agreeing to the
conditions listed above.

THE MOTION CARRIED.
DIVISION OF LAND NO. 66-17 To allow a division of
Applicant - Lands and Buildings, Inc. land into two separate
parcels located at the
northeast corner of Brookhurst Street and Adams Avenue.
Legally described as being a portion of the SWA of Section
5-6-10. Further legal description on file in the Planning
Department Office.
The hearing was opened
to the audience.
Al Kelly, representing
the applicant, addressed the Board and offered to answer any
questions.
There being no other
comment, the hearing was closed.
John Mandrell, re-
commended that a parcel map,be filed with the City and recorded.

NO. 66-17 SUBJECT TO THE FOLLOWING CONDITION:
1. A Parcel Map shall be filed with the City of Huntington
Beach and recorded.

USE PERMIT NO. 66-19 To permit a home occupa-

conducting an interior
decorating service in the R-1 Single Family Residence District.
Located on the west side of Lexington Lane, approximately 70
feet south of Cutty Sark Drive, also known as 19781 Lexington
Lane, Huntington Beach, California, and legally described
as Lot 68, Tract No. 5033.
The hearing was opened
to the audience.
Eugene Andrew, applicant,
addressed the Board and stated that he will be using the
family room, with a drawing board as an office for his
interior decorating businesss
There being no other
comment, the hearing was closed.
It was noted that the
applicant would be required to comply with the ordinance
regulating home occupations.

AREA VARIANCE NO. 66-40 To permit a 5 ft. exterior
Applicant - Philip Titolo side yard setback for a garage
in deviation to the required
10 ft. exterior side yard setback in the R-2 Two Family
Residence District. Located at the northwest corner
of Hartford Avenue and Delaware Street and legally
described as Lots 1 and 2, Block 804, Vista Del Mar
Tract.
The hearing was opened to
the audience.
Mrs. Titolo, applicant,
addressed the Commission and gave her reasons for the
request.
There being no other comment,
the hearing was closed.
Board discussion followed.
It was noted that other buildings in the area have the
same side yard setback and '.thd.,'garag6_:will ,'be in line
with the house which was built just prior to the
ordinance change requiring a wider exterior side yard.
It was also noted that the garage would be setback far
enough from the alley to eliminate any traffic or
pedestrian hazards.
A MOTION WAS MADE BY DAY AND
SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO. 66-40
FOR THE FOLLOWING REASONS:
1. The existing house was built with a 5 ft setback
prior to the effective date of the present ordinance
requiring a.1O ft exterior side yard setback.
2. There will be sufficient sight clearance.
3. Houses in the area have the same setback.
ROLL CALL VOTE:
AYES: Mandrell, Day, Harlow.
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
AREA VARIANCE NO. 66-41 To allow a 25 ft.
Applicant - Huntington Harbour Corp. front yard setback
on Admiralty Drive
and Highway //1 in deviation to the required 50 ft. front
yard setback in the•C-4 Highway 'Commercial District.
Located -at the southeast corner of Highway #1 and
Admiralty Drive. Legal description on file in the
Planning Department Office.
The hearing was opened to the
audience.
Richard Maihtland,,representing
Huntington Harbour Corp., addressed the Board and gave
his reasons for the request. He stated that the
proposed buildings along the channel will be apartments
rather than a commercial development as shown on the
plot plan.
There being no other comment,
the hearing was closed.
Board discussion was held at
length. It was noted that property easterly of the subject
parcel has an extremely shallow depth. It was also
noted that the area in front of and on the sides of the
building will be landscaped and free from parking
creating more of an open area that there would be if
parking were provided.

A MOTION WAS MADE
BY MANDRELL AND SECONDED -BY HARLOWTO APPROVE AREA
VARIANCE NO. 66-14 SUBJECT TO THE FOLLOWING CONDITIONS:
1. Landscaping shall be provided in the front yard
area and shall be substantially the same as
indicated on the submitted plot plan.
2. The parking lot shall be located in the rear of
the building and shall be substantially the same
as indicated on the suhm.itted plot plan.
AND FOR THE FOLLOWING
REASONS:
1. Property across Highway #1 and easterly of the
subject property has shallow depths, therefore,
existing setbacks and probably future setbacks on
these lots are minimum.
2. This lot, triangular in shape, will provide a
transition in setback from the existing property
to the east and the vacant property to the west.
ROLL CALL VOTE:
AYES: Mandrell, Harlow.
NOES: Day.
ABSENT: None.
THE MOTION CARRIED.
AREA VARIANCE NO. 66-39 - Continued To allow a 6' high
Applicant - Richard T. Kumashiro block wall to be
constructed 12'
from the front property line in deviation to the required
15' front yard setback located -at 16721-Phelps Lane and
legally described as Lot 261 of Tract No. 5360.
The hearing was
opened to the audience.
Richard Maintland,
representing the applicant, addressed the Board and stated
that there are other lots in the area with fences closer
than the applicant is requesting.
There being no
other comment, the hearing was closed.
Board discussion
Followed. It was noted that investigation of the property
indicated that the wall would not cause any hardship to
surrounding property anq would benefit the area aesthetically.
A MOTION WAS MADE
BY MANDRELL AND SECONDED BY HARLOW TO APPROVE AREA VARIANCE
NO. 66-39 SUBJECT TO THE FOLLOWING CONDITION:
1. The 6 ft. block wall shall be approved by the
Huntington Harbour Architectural Committee.
ARB DOE THE FOLLOWING
REASONS:
1. Similar variances have been granted.
2. The setback does not apply to the front entry of the
garage.
3. The proposed block wall will not be detrimental to
the surrounding area.
