Tuesday, July 5, 1966
Mayor Stewart called the regular meeting of the City Council of the
City of Huntington Beach to order at 7:30 P.M.
The Pledge of Allegiance was given by all present in the Council Chamber.
The invocation was given by Reverend Richard E. LeGros, Minister of
First Christian. Church.
ROLL CALL

,; PRESENTATION OF RESOLUTION 2412 - COMMENDING JR CHAMBER OF COMMERCE
The Clerk read Resolution No. 2412 in full - "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF HUNTINGTON BEACH THANKING AND COMMENDING THE
JUNIOR CHAMBER OF COMMERCE.FOR THEIR PRESENTATION OF THE 1966 - 4th OF
JULY PARADE."
On motion by Coen, second Bartlett, Council passed and adopted Resolution
No. 2412 by the following roll call vote:
AYES: Councilmen: Caen, Bartlett, Kaufman, Shipley, Green, Stewart
NOES: Councilmen: None
ABSENT: Councilmen: Gisler
MINUTES _
On motion by Kaufman, second Gisler, Council approved the minutes of
the regular meeting of June 20, and the regular adjourned meeting of
June 27, 1966, as prepared by the Clerk and mailed.. Motion carried.
CIVIL DEFENSE SIREN - DUAL USE PROTEST
The Clerk presented a letter from Henry H. Duke, 16422 Fairway Lane,
City, protesting the use of the Civil Defense sirens for calling
volunteer firemen when needed.
On motion by Coen, second Stewart, Council stated its intent to maintain
the dual use of the Civil Defense siren systems until such time as
such us.e is proven inadequate. Motion carried.
RELOCATION REQUEST - SAYRE
AL
The Clerk presented a letter from Rhea Mae Sayre, City, requesting
permission to relocate buildings on Lot 88, Stark Avenue, City.
Fallowing discussion on the matter, a motion was made by Kaufman and
seconded by Coen to refer the matter to the Planning Commission.
Councilman Coen withdrew his second and Mayor Stewart then seconded.
the original motion to refer the matter to the Planning Commission.
Motion carried.
UV 66--21 - APPEAL - COUNCILMAN KAUFMAN - DENIED

Mayor Stewart announced that this was the day and. hour set for a public
hearing on an appeal to the granting by the City Planning Commission
of Use Variance No. 66-21, and directed the Clerk to read the ,legal
notice.

The Clerk read notice of public hearing on an appeal to the granting
by the Planning Commission of UV 66-21, as published in the Huntington
Beach News on June 23, 1966, setting the hour of 7:30 P.M., or as soon
thereafter as possible, on Tuesday the 5th day of July, 1966, in the
Council Chamber of the Civic Center, Huntington Beach, California,
as the time and place for a public hearing for the purpose of consider-
ing an appeal to the granting of UV 66-21 to allow the construction of
a professional office building and hospital in the RA-0 Residential
Agricultural District, combined. with oil production.
The Clerk read the letter of appeal from Councilman Henry S. Kaufman,
and. informed the Council that notices of hearing had been mailed to
residents within 300 feet of the property involved.
Mayor Stewart declared the hearing open.
There being no one present to speak on the matter, and there being
no further protests filed, either oral or written, the hearing was
closed by the Mayor,
Air. Kaufman gage his reasons for appealing UV 66-21, stating that no
hardship had been proven. He felt that a Certificate of Need and.
Necessity should be required for any new hospital or Convalescent Home
in the City.
On motion by Kaufman, second Green, Council overruled. the Planning
Commission and denied UV 66-21. Motion carried.
UV 66-22 - APPEAL - ALVIN COEN - DENIED
Mayor Stewart announced that this was the day and hour set for a public
hearing on an appeal to the granting by the City Planning Commission
of Use Vari.nace No. 66-22, and directed the Clerk to read the legal
notice.
The Clerk read notice of public hearing on an appeal to. the granting
by the Planning Commission of UV 66-22, as published in the Huntington
Beach News on June 23, 1966, setting the hour of 7:30 P.M,, or as soon
thereafter as possible, on Tuesday the 5th day of July, 1966, in the
Council Chamber of the Civic Center, Huntington Beach, California, as
the time and place for a public hearing for the purpose of considering
an appeal to the granting of UV 66-22 to allow mobile beach concessions
for beach rentals and food catering trucks in the El Single Family
Residence District.
The Clerk read the letter of appeal from Councilman Alvin Coen, and
informed the Council that notices of hearing had been mailed to res=
idents within 300 feet of the property involved.
Mayor Stewart declared. the hearing open.
Mr. Richard Sinclair, Fountain Valley, addressed the Council and gave
a report of local rentals, and his proposal for establishing mobile
concessions on Bolsa Chica Beach.
Mr. Brian Lucas, Long Beach, concession operator for Mr. Sinclair,
addressed the Council and requested Council consideration.of their
Use Variance.
The Clerk read a letter from Mr. George Shibata, Assistant City Attorney
of Huntington Beach, pertaining to the Southern Pacific Railroad pro-
perty adjacent to Bolsa Chica State Beach. Discussion followed.
Lois Naylor', City, addressed the Council and gave a resume' of the
Catering Trailers she proposed to use on the beach.
There being no one further to speak on the matter, and there being no
further protests filed, either oral or written, the hearing was closed
by the Mayor.
The Planning'Di.rector gave a resume' of the Planning Commission's
reasons for granting Use Varinace 66-22.

Following additional discussion on the matter, a motion was made by
Green, second Coen, to overrule the Planning Commission and deny UV 66-22.
Motion carried,
PUBLIC ''HEARING' MASTER PLAN AMENDMENT 66-2 REF TO PC
Mayor Stewart announced that this was the day and hour set for a public
hearing on Master Plan Amendment 66-2, on property covering an area
bounded by Slater Avenue on the south, 'Pacific Electric Railway right-
of-way on the west, Heil Avenue on the north and Newland Street on_the
east, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on Master Plan Amendment 66-2,
as published in the Huntington Beach News on June 23, 1966, setting
the hour of 7:30 P.M., or as soon thereafter as possible, on Tuesday,
the 5th day of July, 1966, in the 'Council Chamber of the Civic -Center,
Huntington Beach, California, as the time and place.for a public hearing
for the purpose,of considering an amendment to the Master Plan of Land
Use by adopting an dmendment entitled "Master Plan of Land Use, Study
Area II."
The Clerk informed the Council that they had been provided. with copies
of the Planning Director's transmittal and the Resolution of the
Planning Commission, recommending approval of the Master Plan Amendment
66-2, and stated that he had received no communications or written protests
to the Master Plan Amendment or to the recommendation of the Planning
Commission.
Mayor Stewart declared the hearing open.
There being no one present to .speak on the matte, -and there being no
protests filed, either oral .or written, --the hearing was closed by the
Mayor.
The Planning Director gave a resume' of the Planning Commission's reasons
for recommending approval of Master Plan Amendment 66-2.
Mayor Stewart requested and was granted permission to abstain from action
on Master Plan .Amendment 66-2 due'to conflict of interest, and vacated
Lis place at the'Council table:. Mayor pro-tem Shipley then took the
Mayor s chair.
John Horner, Anaheim, addressed the Council and stated he had arrived
too late for the public hearing, and requested permission to make an
ingquirey concerning the Master Plan Amendment.
Jake R. Stewart, 7901 Rhine Drive, City, addressed the Council and
requested information pertaining to his property.
On motion by .Kaufman, second Coen, Council referred the Master Plan
Amendment 66-2 back to the Planning Commission for reconsideration.
Motion carried.
Mayor Stewart resumed his place at the Council table.
PUBLIC HEARING - ZONE.CASE 66-4 APPROVED
Mayor Stewart announced that this was the day and hour set for a public
hearing on Zone Case 66-4,.on property located on the south side of Halt
Street, approximately 150 feet west of Beach Boulevard, and directed
the Clerk to read the legal notice..
The Clerk read notice of public hearing on Zone Case 66-4, as published
in the Huntington Beach News on June 23, 1966, setting the hour of
7:30 P.M., or as soon thereafter as possible; on Tuesday, the 5th day of
July, 1966, in the Council Chamber of the Civic -Center.., Huntington Beach,
California, as the time and place for a public hearing for the purpose
of considering a petition for a change of zone to regulations of the
Districting Ordinance from R3 Limited Multiple Family Residence District,
to C4 Highway Commercial District, with setback provisions.

The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal and the Resolution of the
Planning Commission, recommending approval of Zone Case 66-4, and
stated that he had received no communications or written protests to
the Zone Case or to the recommendation of the Planning Commission.
Mayor Stewart declared the hearing open.
Mr. Roger Watson, 17252 Beach Boulevard, City, addressed the Council
and displayed a drawing of his proposed use of the area.
There being no one further to speak on the matter, and there being
no protests filed, either oral or written, the hearing was closed by
the Mayor.
On motion by Kaufman, second Shipley, Council directed the City
Attorney to prepare an Ordinance effecting the change of zone in Zone
Case 66-4. Motion carried.
PUBLIC HERRING: ZONE .GASE;;6'6-13 - APPROVED
Mayor Stewart announced that this was the day and hour set for a
public hearing on Zone Case 66-13, on property located. at the south-
west corner of Warner Avenue and Ash Street, and directed the Clerk
to read. the legal .notice.
The Clerk read. notice of public hearing on Zone Case 66-13, as pub-
lised. in the Huntington Beach News on June 23, 1966, seating the hour
of 7:30 P.M., or as soon thereafter as possible, on Tuesday, the 5th
day of July, 1966, in the Council Chamber of the Civic Center, Hunt-
ington Beach, California, as the time and place for a public hearing
for the purpose of considering a petition for a change of zone to
regulations of the Districting Ordinance, from Al-X General Agricul-
tural -District to R5 Office -Professional District.
The Clerk informed the Council that they hadbeen provided with copies
of the Planning Director's transmittal and the Resolution of the
Planning Commission, recommending approval of Zone Case 66-13, and
stated that he had received no communications or written protests to
the zone case or to the recommendation of the Planning Commission.
Mayor Stewart declared the hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by
the Mayor.
Councilman Kaufman made a motion to defer the matter until. Master Plan
66-2 for the area was approved. Motion was withdrawn.
On motion by Coen, second Bartlett, Council sustained the recommenda-
tion of the Planning Commission and directed the City Attorney to
prepare an Ordinance effecting the change of zone in Zone Case 66-13.
Motion carried.
PUBLIC HEARING - ZON2 CASE 66-14 —APPROVED
Mayor Stewart announced that this was the day and hour set for a public
hearing on Zone Case 66-14, on property located on the south side of
Warner Avenue, 100 feet west of .Ash Street, and directed the Clerk to
read the legal notice.

Mayor Stewart announced that this was the day and hour set for a public
hearing on Zone Case 66-17, on property located on -the west side of
Brookhurst Street, approximately 792 feet south of Garfield Avenue,
and directed the Clerk to read the legal notice.

hour of 1:30 P.M., or as soon thereafter as possible, on Tuesday,

hearing for the purpose of considering a petition for a change of zone
to regulations of the Districting Ordinance, from RA Residential
Agricultural District to C4 Highway Commercial District, with setback
provisions.

hearing on Zone Case 66=29, on property located north of Warner Avenue,
505 feet west of Beach Boulevard, and directed the Clerk to read the
legal notice.

lished in the Huntington Beach News on June .23, 1966, setting the hour
of 7:30 P.M., or as.soon thereafter as possible, on Tuesday, the 5th

for the purpose of considering a petition for a change of zone to

CODE AMENDMENT 66-9 - DIVISION 9 - APPROVED

Mayor Stewart announced that this was the day and hour set for a public
hearing on Code Amendment 66-9, and directed the Clerk to read the
legal notice.
The Clerk read notice of public hearing on Code Amendment 66-9, as
published in the Huntington Beach News on June 23, 1966, setting the
hour of 7:30 P.M.., or as soon thereafter as possible, on Tuesday, the
5th day of July, 1966, in the -Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering an amendment to Division 9 of
the Huntington Beach Ordinance Code, pertaining to the RA Residential
Agricultural District and generally proposing to increase the minimum
;lot size to one acre; increase the minimum lot frontage to 150 feet;
lower the maximum density to one dwelling unit per -lot, and amend the
setback for accessory buildings.
The Clerk informed the Council that they and been provided with copies
of the Planning Director's transmittal, and stated that he had received
no communications or written protests to Code Amendment 66-9, or to
the recommendation of the Planning Commission.
Mayor Stewart declared the hearing open.
There being no one present to speak on the matter, and there being
no protests filed, either oral or written, the hearing was closed
by the Mayor.
On motion by Green, second Shipley, Council sustained the recommenda-
tion of the Planning Commission and directed the City Attorney to
prepare an Emergency Ordinance amending the Huntington Beach Ordinance
Code as recommended by the Planning Commission. Motion carried.
PUBLIC HEARINGS SET --7/ /66
On motion by Green, second Coen, Council ordered public hearings for
Monday, July 18, 1966, at 7:30 P.M., or as soon thereafter as possible,
on Zone Cases 66-32 and 6�6-34,�rtode or
66-6, 66-101 66-11,
66-125 66-13, 66-4 and 5,��nd Master Plan Amendment 66-1, and directed
the City Clerk to publish notice of same. Motion carried.
fl UV 6-28 - CONDITIONAL EXCEPTION - BARKLEY DEV CO
The Clerk presented Conditional Exception - UV 66-28 - Barkley Develop-
ment Comppany, on property located at the northeast corner of Magnolia
(Cannery) Street and Atlanta Avenue, involving deviations to the RA-0
Residential Agricultural District (With application for Rl being
processed),.to construct a single family development with various
-exceptions to the Subdivision Ordinance Code and the Huntington Beach
Ordinance Code for Tentative Tract Map 6283. The Planning Commission
recommended approval, with conditions.
On motion by Bartlett, second Kaufman, Council sustained the Planning
Commission and directed the City Attorney to prepare a Resolution
approving UV 66-28, with conditions as stipulated by the Planning
Commission. Motion carried.

TENTATIVE TRACT MAP 5965 - EXTENSION OF TIME
The Planning Director pres-ent.ed a request by Harry Kelso, Incorporated,
P. 0. Box 1455, Newport Beach, California, for a one year -extension
of time in which to record Tentative Tract Map 5965, The Planning
Commission recommended approval, with a stipulated condition.
On motion by Bartlett, second Kaufman, Council granted an extension
of time on Tentative Tract Map 5965 to Harry Kelso, Incorporated, with
.condition stipulated by the Planning Commission® Motion carried.
FINAL.TRACT MAP 6183 - SLATER DEV
The Clerk presented a transmittal from the Planning Director, sub-
mitting final form of Tract Map 6183, a portion of Tentative Tract
Map No. 5855 - Slater Development, for adoption: Subdivider: Slater
Development, Anaheim, California; Engineer: Voorheis-Trindle-Nelson,
Incorporated, Westminster, California; Location: East of Edwards
Street, south of Slater Avenue; Legal Description: Being a subdivision
of a portion of the WY2, SE% of Section 27-5-11; Number of Lots: 102;.
Total Acreage: 24.820; that the map has been certified by the City
Engineer and the Secretary to the Planning Commission to be true and
correct in accordance with provisions of the City Subdivision Code.
The City Council may accept dedication as shown on the map and in
addition approve the Final Map, subject to the following conditions:
The City Clerk's signature shall be withheld pending the submittal
and completion on the enumerated requirements:
1. Deposit of fees for water, sewer, drainage, engineering and
inspections.
2. Bond for improvements.
3. Signature of agreement.
4. Certificate of Insurance.
5. Approval from County Surveyor.
6m Bond for monuments.
7. Deed for Underground Water Rights.
On motion by Bartlett, second Kaufman, Council accepted offers of
dedication as shown on Final Tract Map 6185, and adopted the map
subject .to conditions stipulated by the Planning Commission. Motion
carried
`1 CC-043 - EASTSIDE STORM DRAIN SYSTEM - CONSTRUCTION - BIDS
The Clerk presented bids for the construction of an asbestos cement
pipe storm drain system and appurtenances within alleys in Blocks
605 and 705 of Vista Del Liar Tract and within alleys in Block 606
of Valley View Tract, within Hartford Street, Geneva Street and
Frankfort Street in the City. The bids had been opened at 9:00 A.M.
on Tuesday, July 5, 1966, in the Council Chamber of the Civic Center
by the City Clerk, City Attorney and Director of Public Works, as
follows:

Fontana Steel - Long Beach 18,311.80

The Director of Public Works presented a letter informing Council
that the bids had been reviewed and found to be in order, and
recommended that the contract for Project CC-043 bertawarded to M. L.
Garten, Anaheim, for the low bid in the amount of $16,738,20.
On motion by Coen, second Shipley, Council awarded the contract for
Project CC-043 to M. L. Garten, Anaheim, for the low bid in the
amount of $16,738,20, and rejected all other bids. Motion carried.

CC-042 - SLURRY SEAL OF STREETS - BIDS
The Clerk presented bids for the slurry seal of Acacia Avenue from llth
to 6th Streets, Huntington Street from Joliet to Memphis Avenues,
Geneva Avenue from Alabama to Delaware Streets and Magnolia (Pecan)
Avenue from llth to 6th Street in the City.. The bids had been opened
at 9:00 A.M., Tuesday, July 5, 1966, in the Council Chamber of the .
Civic Center by the City Clerk, City Attorney and Director of Public
Works, as follows:

The Director of Public Works presented a letter informing Council that
the bids had been reviewed and found to be in order, and recommended

BOLSA CHICA BEACH PARK - PROPOSED AGREEMENT

ment of Beaches and Parks for the operation of Bolsa Chica State

SOUTHERN PACIFIC PROPERTY NEAR PIER
The City Administrator presented a request from the Southern Pacific
Company for a meeting to further discuss disposition or use of the
railway property east of the pier, and recommended that a Committee
of the Council be appointed to meet with the Staff to study the matter,
prior to meeting with the Southern Pacific Company.
Mayor Stewart then_ appointed Councilman Kaufman, Councilman Coen
and himself to serve as a Committee -of -the -Council to meet with the
City Staff for study of the disposition or use of the railway property
east of the pier.
HUNTINGTON BEACH CO TOUR
The City Administrator informed Council of a tour of the Huntington
Beach Company properties development by the Council, in connection
with their beach area planning;: and recommended that the Mayor call

LIFEGUARD AGREEMENT -- E/0 PIER -- HB CO

On motion by Bartlett, second Stewart, Council authorized the Mayor
and City Clerk to execute a renewal agreement between the City and
the Huntington Beach Company for lifeguard services west of the
Municipal Pier. Motion carried.
RECREATION - RULES FOR CONDUCT IN PARKS
`aOn motion by Green, second Shipley, Council directed the Recreation
and Parks Commission to prepare rules for conduct in City parks, for
Council consideration. Motion carried.
PLASTIC PIPE LAW SUIT - PARTICIPATION
On motion by Shipley, second Green, Council authorized payment of
$200.00 to the State Department of Justice, for the City's participa-
tion in the cost of the plastic pipe suit against various western
pipe companies. Motion carried.
ULI INDUSTRIAL COUNCIL - PORTLAND

The Mayor presented information relative to the Fall Meeting of the
Industrial Council of the Urban Land Institute in --.Portland, Oregon,
October 25 and 26, 1966, and directed the Planning staff to prepare
an industrial development study project for presentation.
On motion -by Stewart, second Shipley, Council authorized one member
of the Urban Land Institute Steering Committee, the City Planning
Director, and' -any Councilman to attend said U.L.I. Industrial Council
Meeting on October 25, 261 1966, in Portland Oregon, with travel and
r,easonabie expenses allowed. Motion carried.
BEACH AREA USE
Councilman Coen discussed the possible use of the beach area for
display of art, and requested the Administrative staff to study such
possibility and report on same.
CAPT HENGOED RETIREMENT - RECOGNITION
John Mangano, 5661 Clark Drive, City, addressed the Council and re-
quested Council to consider the preparation of a Resolution and plaque
for presentation to William Hengoed, as he is retiring from the Fire
Department after 26 years of service.
On motion by Shipley, Council directed the City Attorney to prepare
a Resolution of Recognition for presentation to Captain Hengoed.
Motion carried.
INFORMAL MEETING 7/7/66
Mayor Stewart called an informal meeting of the Council as a Committee -
of -the -Whale for Thursday, July 7, 1966, at 5:30 P.M. for a tour of
the Huntington Beach Company residential development.
ADJOURNMENT
On motion by Shipley, the regular meeting of the City Council of the
City of Huntington Beach adjourned to Monday, July 11, 1966 at 7:00
P.M. Motion carried.
