Monday, July 18, 1966
The regular meeting of the City Council of the 'Ckty of Huntington
Beach was called to order at 4:'30 P.M. by Mayor Sty. .
The Pledge of Allegiance was given by all present in the Council
Chamber.
ROLL CALL
Councilmen Present: Coen, Bartlett, Kaufman., Green, Shipley, Stewart
Councilmen Absent: Gisler
MINUTES
On motion by Kaufman, the minutes of the regular meeting of July 5,
1966, and the regular -adjourned meeting of July 11, 1966,.were .
approved as amended with corrections noted, as prepared by the Clerk
and mailed. Motion carried.
PUBLIC HEARINGS SET - S/ l.66
On motion by Green, Council ordered public hearings for Monday,
August 1, 1966, at 7:30 P.M., or -as soon thereafter as possible, on
Zone Cases 66-31 and 66-35, and directed the.City Clerk to publish
notice of .same. Motion carried.
UV 66-30 - UV 66-24 - CONDITIONAL EXCJPTION
The Clerk presented transmittals from the Planning Director of
Conditional Exceptions UV 66-30 (Flallon Corporation) and UV 66-24
(Oakhurst Land Company) for Council consideration.
On motion by Green, Council deferred action on Conditional Exception
UV-66-24 until after the public hearing on Zohe Case 66-31, and on
Conditional Exception UV 66-30 until after .the public hearing on
Zone Case 66-35. Motion carried.
INTERIM HOLDING ZONE —BEACH AREA
The Clerk presented for consideration by the Council, a recommendation
of the Planning Commission for the adoption of an interim holding
zone for the beach and adjacent areas until a master plan can be
developed.
Following some discussion by the Council, and a ruling from the City
Attorney that adoption of the proposed plan would require a four -
fifths vote of the Council, a motion was made by Shipley that the
plan for an interim holding zone on the beach front be adopted with
the exclusion of that portion proposed to be developed immediately
by the Huntington Beach Company, .and directed; the City Attorney to
prepare an Ordinance effecting such change of zone with the area to
be excluded being delineated by the Planning Department.
When put to vote the motion failed on a vote of four ayes and two
nays.
After further discussion by the Council, a motion was made by Coen
to reconsider the motion of Councilman Shipley. Motion carried
On motion by Coen, Council approved the planrecommended by the
Planning Commission, for an interim holding zone to be established
on the beach front with the exclusion, of that portion proposed to be
developed immediately by the Huntington Beach Company, and directed:
the City Attorney.to prepare an Ordinance effecting such change,of
zone, with the area.to be .excluded being delineated by the Planning
Department.

When put to vote, the motion passed on a vote of five ayes and one
nay.
)n TRACT 6183 - SUBDIVISION AGMT - DUTCH HAVEN HOMES
The Clerk presented a transmittal from the Director of Public Works
of a Monument Bond, Improvement Bond, and Subdivision Agreement
for Tract 6183 - Dutch Haven Homes (William Lyons).
On motion by Coen, Council accepted Monument Bond No. 15-3-7080 and
Improvement Bond No. 15=3-7079 - Continental, National Insurance
Group; approved the Subdivision Agreement; and authorized the Mayor
and City Clerk to execute same on behalf of the City. Motion carried.
`(REIMBURSEMENT - STORM DRAIN ESSEX LAND CO
The Clerk presented a communication A-om the Director of Public
Works covering reimbursement for storm drains installed by the
developer on Drainage District 7G in the amount of $44,673.40, and
transmitting Resolution No. 2414 - "A RESOLUTION OF THE CITY COUNCIL
OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE
DRAINAGE DISTRICT 7G FUND."
On motion by Coen, Council waived further reading of Resolution
No. 2414, and adopted same by the following roll call vote:

NOES: Councilmen: None

GACQ OF PROPERTY - ALGONQUIN & WARNER
On motion by Bartlett, Council accepted the recommendation of the
Director of Public Works on,the acquisition of property at Algonquin
and Warner Avenues; declared further acquisition unnecessary, and
the matter closed. Motion carried.
9 DEEDS ACCEPTED
The Clerk presented transmittals from the Director of Public Works
of deeds to the City for acceptance and recording, as follows:

The Clerk presented a transmittal from the City Attorney of deeds
for acceptance, recording and payment authorization in the Edwards -

DEED FOR ACCEPTANCE - PERRY SCHOOL PARK SITE
The Clerk presented a transmittal from Title Insurance and Trust Company
of a deed from Star Dust Lands, Incorporated to the City in accordance
with instructions in Escrow 431340--RB Park Site Tract 6123.
On motion by Kaufman, Council accepted the deed from Star Dust Lands,
Incorporated to the City, and directed the City Clerk to record same
with the Orange County Recorder. Motion carried.
'bEED FOR ACCEPTANCE - EDWARDS-SLATER CONDEMNATION
The Clerk presented a transmittal from the City Attorney of a deed
for acceptance, recording and payment authorization in the Edwards -
Slater Condemnation, as follows:
A. E. & Katherine Arnold and REMond & Jessie E. Suess -
Tract 281, Lots E-104 & E-106 $885.00
On motion by Kaufman, Council accepted the deed as listed, directed
that it be returned to Land Acquisition Service for recording, and
authorized payment to the grantors in the sum of $885.00 total, when
notified by Land Acquisition Service, by the following roll call vote:

I WINDSCREEN-'- TRACT 5050 - HUNTINGTON HARBOUR
The City Clerk presented a communication from the Building Director,
transmitting a letter from Leland A. Parker, A I A, requesting per-
mission to build a windscreen on Lot 19, Tract 5050, in Huntington
Harbour, and recommending approval of the request.
On motion by Green, Council authorized the -,erection of the windscreen
on Lot 19, Tract 5050, in Huntington Harbour, subject to approval of
the Building Department. Motion carried,
ZONE CASE 66-25 - APPROVED
The Clerk at the request of the Council, presented Zone Case 66-25,
recommended for denial by the Planning Commission, on which a public
hearing had been held at the -meeting of June 20, 1966, with action
deferred.
Planning Director explained to the Council the reasons for the Planning
Commission's recommendation of denial, and suggested modifications for
possible approval of the zone case.
On motion by Green, Council approved the modifications of the Planning
Commission, and approved the Zone Case as modified, and directed the
City Attorney to prepare an Ordinance effecting the.:.change in Zone
Case 66-25. Motion carried.
y�REQUEST - DEFERMENT ON PAYMENT OF FEES - ST. BONAVENTURE CHURCH
The Clerk presented a letter from Reverend Michael Duffy, on behalf
of the Roman Catholic Archbishop of Los Angeles, requesting that
Council allow payment of water, sewer and drainage fees on a 4.6
portion of an 8.6 acre parcel of property on which they propose
development.
On motion by Kaufman, Council allowed payment by St. Bonaventure
Church of partial water, sewer and drainage fees, with fees on the
4.0 acre portion to be deferred until development of that portion.
Motion carried.
jCLAIM - JOHN C SALYER, , ATTY ON BEHALF OF SYLVIA B HOOD
The Clerk presented a,clam for alleged injuries and,property damage,
filed by John C. Salyer, Attorney, on behalf of Sylvia B. Hood,
incurred on July 6, 1966.
On motion by Coen, Council denied the claim filed by Attorney
Salyer on behalf of Sylvia B. Hood, and referred same to the City
Attorney and the City.'s Insurance Carrier. Motion carried.

s=STATE PERSONNEL BOARD AGREEMENT
The City Administrator informed the Council that the State Personnel
Board had requested the execution by the City of a new agreement for
the conduct of written and oral personnel examinations, which
incorporates a new rate schedule; and recommended that the Council
approve the new agreement.
On motion by Kaufman, Council approved the new agreement with the
State Personnel Board for the conduct of written and oral ,personnel
examinations, and directed the Mayor and City Clerk to execute same
on behalf of the City.. Motion carried.
I�;�JREVISED PLAN FOR AND TRANSFERS
The City Administrator presented to the Couneil a proposers revised
plan for transfers from special funds to the general fund, with a
recommendation from the Finance Director that it be considered and
adopted.
On motion by Kaufman, Council approved the revised plan for fund
transfers, and directed the City Attorney to prepare a Resolution
setting forth the new policy. Motion carried.
qv LISTING OF CITY OWNED LOTS
The City Administrator informed the Council that, at their direction,
he had prepared a list of approximately 70 parcels of City owned
property, and requested authorization to procure title reports thereon.
On motion by Shipley, Council directed the Administrator to study
the list from the standpoint of the desireability of putting.some
property up for public sale; proceed with the procuring of title
reports on said property, and report back to the Council when ready.
Motion carried.
f� NEW SIGN FOR THE PAVALON BUILDING
The City Administrator,kfiformed the Council that Mr. John T. French,
the new lessee of the Pavalon Building, had requested permission to
install a new sign on the building, and that Council authorization
was required since it is City property.
Following some discussion by the Council and the Building Director,
a motion was made by Green, approving a new sign on the Pavalon
Building, subject to the lights being immobile, and the cost being
borne by the lessee.
Councilman Green's motion was withdrawn prior to vote on same.
On motion by Green, Council approved and authorized installation of
the proposed sign on the Pavalon Building, subject to further approval
by the Council following installation, and subject to the cost of
installation berg borne by the lessee. Motion carried.
-I/WASTE WATER VISPOSAL -- OMITTED FROM NEW OIL ORDINANCE
The City Administrator informed the Council, that, in the preparation
and adop*t6w1*f the new Oil Qrdinance, provisions covering the dis-
posal of waste water had inadvertant-l)r been omitted. Mr.'Killer
suggested that the Council might direct the City Attorney to prepare
an Ordinance amending Chapter 23 of the Huntington Beach Ordinance
Code to include the control operation for wastef�water from oil wells.
On motion by Bartlett, Council directed the City Attorney to prepare
an Ordinance amending Chapter 23 of the Huntington Beach Ordinance
Code to include provisions for the control of the waste water .disposal
in the drilling and operation of oil wells. Motion carried.

MURDY PARK -- NOTICE INVITING SEALED BIDS
The City Administrator informed the Council that the plans and
specifications for the development of Murdy Park had been received
and approved by the City Planning Commission and the Staff, per
direction from the Council at the regular meeting of July 5, 1966.
Mr. Miller recommended that Council take action to approve the plans
and specifications, advertising for bids, and adopt the resolution
establishing the general prevailing wage scale for such project.
On motion by Green, Council approved the plans and specifications
for development of the Murdy Park, and directed the City Clerk to
advertise for bids when notified by the Director of Public Works.
Motion carried.
The Clerk read Resolution No. 2407 by title - "A RESOLUTION OF THE
CITY OF HUNTINGTON BEACH ESTABLISHING THE GENERAL PREVAILING RATE OF
HOURLY WAGES FOR EACH CRAFT OR TYPE OF WORKMAN OR MECHANIC NEEDED
FOR THE GRADING, IMPROVEMENT, AND DEVELOPMENT OF MURDY PARK IN THE
CITY OF HUNTINGTON BEACH, CALIFORNIA."
On motion by Kaufman, Council waived further reading of Resolution
No. 2407, and passed and adopted same by the following roll call vote:

FOUR WAY STOPS - DOWNTOWN AREA OF CITY
Councilman Coen presented the matter of the need for 4-way stop signs
at the intersections of Fifth and Main Streets and Olive and.Main
Streets.
The Director of Public Works informed the Council that all main corners
in the old town area of the City are under study from a traffic
standpoint, and suggested that Council withhold any action or direction
until such study is completed.
No action was taken by the Council on this matter.
1967 FOURTH OF JULY PARADE
Councilman Coen made a motion that the City contract with the Junior
Chamber of Commerce to handle the July 4th parade in 1967.
The Assistant City Administrator informed Mr. Coen and the Council
that he had been in contact with the Junior Chamber of Commerce, and
would be meeting with them the next day, and that they were consider-
ing a plan for the Christmas parade to be handled by the Jaycees also.
Mr. Castle suggested that the Council defer action in this matter
until such meeting had been held.
Councilman Coen withdrew his motion before vote.
POLICY ON MOVE -IN HOUSES
On motion by Coen, Council directed the City Attorney to prepare an
amendment to the Ordinance Code to strengthen the control of move -in
houses. Motion carried.
On motion by Kaufman, Council rescinded their action of July 5, 1966,
referring the matter of the relocation request from Rhea Mae Sayre
for buildings on Lot 88, Stark Avenue, City, to the Planning Commission.

ANNEXATION PROPOSAL
Following discussion by members of the Council of the advisability
of arranging a meeting with the Sunset Beach Chamber •of Commerce to
discuss a proposed annexation of beach and ocean area adjacent to
Sunset Beach and Surfside Colony, Mayor Stewart appointed Councilmap,
Shipley and Green, together with members of the City Staff, as a
Committee to arrange such meeting.
RECESS
Mayor Stewart called a recess of the Council at 6:00 P.M.
RECONVENE
Council was reconvened at 7:30 P.M. by the Mayor.
COMMUNITY METHODIST CHURCH - BELLS
The City Administrator read a letter from Reverend Roger Betsworth of
the Community Methodist Church requesting a variance to requirements
of the Huntington Beach Ordinance Code covering noise, to permit
them to ring the church bell and carillon at 9:00 A.M., 12 noon,
3:00 P.M. and 6:00 P.M. each day, and to play a vesper hymn at
7:00 P.M. during daylight savings hours and at 6:00 P.M. during hours
of standard time.
A motion was made by Green that Council grant the requested variance
to the requirements of the*noise ordinance at the decible rating in
effect on July 3, 1966.
After further discussion of the matter by the Council, the motion
was withdrawn by Councilman Green.
Mr. Leo Vortouni, Occupational Health Consultant with the Orange
County Health Department, addressed the Council and stated that the
Huntington Beach Ordinance specifying a maximum noise level of ten
decibles was completely out of line. Mr. Vortouni stated that ordinary
traffic noise levels reach eighty decibles. He informed the Council
that he had conducted tests near the church and that noise from the
chimes and carillon did not increase the noise level from traffic
and other causes.
Mr. C. H. Hargreaves, 9331 Leilani Drive, City, addressed the Council
and stated that he had made tests of the same kind as Mr. Vortouni.
He stated that the chimes and carillon could be heard above all other
noises, and protested that they were a nuisance to adults and children
trying to sleep in the daytime.
After further discussion of the matter, a motion.was made by Green that
the variance for using the chimes and carillon be granted, with the
Church adhering to the schedule which they had set in the letter of
request, and using the level which was in effect on July 8, 1966,
and that such variance would be subject to review by the City Council.
Motion carried.
q,IOn motion by Coen, the Council directed the City Attorney to investi-
gate the noise Ordinance as it is now on the books, and report back
on the matter. Motion carried.
PUBLIC HEARING - ZONE CASE 66-32 - APPROVED
Mayor Stewart announced that this was the day and hour set for a
public hearing on Zone Case 66-32, on property located at the south-
west corner of Garfield Avenue and Cannery Street,;and directed the
Clerk to read the legal notice.

to the Zone Case or to the recommendation of the Planning Commission.
Mayor Stewart declared the. hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral..or written, the hearing was closed by the
Mayor.
On motion by Green, Council sustained the recommendation of the
Planning Commission and directed the City Attorney to prepare an
Ordinance effecting the change of zone in Tone Case 66-32. Motion
carried.
PUBLIC HEARING ZONE CASE 66-34 APPROVED
Mayor Stewart announced that this was the day and hour set for.a.
public hearing on.Zone Case 66-34, o.n-property located at the north-
east corner of Magnolia Street {Cannery) and Atlanta Avenue, and
directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on Zone Case 66-34, as pub-
lished in the Huntington Beach News on July 7, 1966, setting the
hour of 7:30 P.M or as soon thereafter as possible, on Monday, the
18th day of July, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the -time and place for public
hearing for the purpose of considering a petition for a change of
zone to regulations of the Districting Ordinance; from RA-0 Residential
Agricultural District,, combined with oil production, to Rl Single
Family Residence District and Cl Neighborhood Commercial District,
with setback provisions.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal and the Resolution of the
Planning Commission, recommending approval of Zone Case 66-34, and
stated that he had received no communi.cat.ions or written protests to
the Zone Case or to the recommendation of the Planning Commission.
Mayor Stewart declared the hearing open..

Mayor Stewart announced that this was the day and hour set for a public
hearing on Code Amendment 66-6,: and directed the Clerk to read the
legal notice.

Article 979 -- Off -Street Parking, as follows:

Ordinance amending the Huntington Beach Ordinance Code as recommended

�OPUBLIC HEARING - CODE AMENDMENT 66-10 - APPROVED
Mayor Stewart announced that this was the day and hour set for a public
hearing on Code Amendment 66-10, and directed the Clerk to read the
legal notice.
The Clerk read notice of public hearing on Code Amendment 66-10, as
published in the Huntington Beach News on July 7, 1966, setting the
hour of 7:30 P.M., or as soon thereafter as possible, on Monday,
the 18th day of July, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering an amendment to Division 9
of the Huntington Beach Ordinance Code, pertaining to storage yards,
subject to the following conditions:
1. Approval of use permit;
2. Enclosure of the yard with a six foot masonry wall;
3. Setback of the wall five feet from an abutting street;
4. Landscaping;
5. No stacking of vehicles.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal, and stated that he had
received no communications or written protests to Code Amendment.

Mayor Stewart announced that this was the day.and hour set for a public
hearing on Code Amendment 66-11, and directed the Clerk to read the
legal notice.
The Clerk read notice of public hearing on Code Amendment 66-11, as
published in the Huntington Beach News on July 7, 1966, setting the
hour of 7:30 P.M., or as soon thereafter as possible, on Monday, the
18th day of July, 1966, in the'Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering an amendment.to Division 9 of
the Huntington Beach Ordinance Code, repealing Article 977 and changing
the wording in Article 980 from Parcel Map.to Division of Land.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal, and stated that he had received
no communications or written protests to Code Amendment 66-11, or to
the recommendation of the Planning Commission.
Mayor Stewart declared the hearing open.
On motion by.Bartlett, Council sustained the recommendation of the
Planning Commission and directed the City Attorney to prepare an
Ordinance amending the'Huntington:Beach Ordinance Code as recommended
by the Planning Commission. Motion carried.

Mayor Stewart announced that this was the day and hour set for a
public hearing on Code Amendment 66-12, and directed the Clerk to
read the legal notice.

published in the Huntington Beach News on July 7, 1966, setting the
hour of 7-:30 P.M., or as soon thereafter as possible, on Monday, the
18th day of July, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering an amendment to. Division 9 of
the Huntington Beach Ordinance,Code, r.equirifig right-of-way dedication

ing criteria for the type of recreation, site location and, -space
required.

proposed Ordinance would set fees :in Huntington Beach far in excess
of those of other -Orange County cities.
John Horner, representing Dutch Haven Homes, addressed the Council to
protest the increased fees:.which would be charged under the new Code
Amendments.
Henry Duke, 16422 Fairway'Lane, City, addressed the Council and pro-
tested the use of school recreational facilities as part of the parks
program.

CIVIL DEFENSE SIREN - DUAL USE PROTEST
Mr. Henry Duke, 16442 Eagle Lane, City, addressed the Council regard-
ing the use of the Civil Defense siren on the Doyle & Shields Fire
Station as a means of calling volunteer firemen. Mr. Duke protested
such use, stating that it defeated the purpose of having such a siren.
Mr. William Martin, 16421 Eagle Lane, City, addressed the Council and
also protested the use of the Civil Defense siren for this purpose.
Mr.'rJohn J. Mangano, 5661 Clark Drive, City, addressed the Council
and discussed such use of the siren. Mr. Mangano stated that he
believed such use provided a feasible and economical way to reach
volunteer firemen -,.and felt that such use was reasonable.

regarding the odor emanating from the sewage plant of the Sunset
Beach Sanitary District located at the corner of Warner Avenue and

DEED FOR SUNSET -`BEACH - SURFSIDE `WATER 'CO
Councilman -Coen asked..whether a.deed.for the Sunset Beach-Surfside
Water Company, which.had been recently acquired`by the'.City through
condemnation action,.had-ever been received.
Following some discussion on the matter, the City Attorney and City
Clerk were directed to investigate the matter and record the deed
when procured.

ARCHITECTURAL REVIEW BOARD
Council discussed the proposed Architectural Review Board, and directed
the City Administrator to request resumes from applicants for the Board.
RESERVATIONS - CITY PARKING LOT
Councilman Green suggested that the City set aside a portion of the
City Parking Lot along the beach to be reserved for residents of the
City of Huntington'Beach at a nominal season fee of $1.00 or $2.00.
The Director of Public Works discussed the matter with the Council,
informing them of some -of the problems which would be involved in
establishing such procedure.
A motion was made by Green'that.the City -Attorney be directed to pre-
pare an amendment to the Huntington Beach Ordinance Code to provide
for the issuance of :parking passes for the City Parking Lot, with a
windshield sticker of a certain color to permit parking in a restricted
area based on space available, on weekdays only at a rate of $3.00
for the season, and.a sticker of another color to permit such parking
on any day,.including Sundays and Holidays, at a rate of $5.00 for the
season.
Councilman Green withdrew his motion before vote.
SIGNS ON CITY AND.STATE:PROPERTY
The City Administrator reported to the Council that he had sent a
letter to Mr. Telford of.the State Debartment of Highways concerning
highway signs which are located on State property within the City,
but had not received an answer -to date.
Following some discussion by the Council, a motion was made by Green
directing the City Administrator and the City Attorney to study the
City's sign ordinance to see if it could be enforced. Motion carried.

INFORMAL MEETING - ULI CITIZENS STEERING COMMITTEE AND-OTHER-S
The City Administrator .informed the Council that the U L I Citizens
Steering Committee would like to have an opportunity to meet with
the Council on July 26, 1966, pertaining to beach area development
stating that the State of California, the Bolsa Corporation, the
Huntington Beach Company, and the Southern Pacific Railroad would
be represented, together with members of the City Staff.
Mayor Stewart called a meeting of the Council as an informal
Committee -of -the -Whole for Tuesday, July 26, 1966 at 11:00 A.M. at
the Sheraton Beach Inn, for a discussion meeting on beach front
development problems, with the various other interested entities.
SHIPLEY REQUEST TO BE ABSENT FROM COUNTRY
Councilman Shipley requested that the Council grant him permission
to be out of the country from July 27th through September 1st, 1966.
On motion by Green, Councilman Shipley was granted permission to be
out of the country from July 27th through September lst, 1966.
