Monday, August 1, 1966
Mayor Stewart called the regular meeting of the City Council of the
City of Huntington Beach to order at 4:30 P.M.
The Pledge of Allegiance was given by all present in the Council
Chamber.
The invocation was given by Reverend Thomas W. Overton, Minister of
the First Christian Church.
Mayor Stewart called for a moment of silence in respect to the memory
of the late Dr. Lawrence Whittaker. Reverend Thomas Overton, Minister
of the First Christian Church, spoke a few words in honor of Dr.
Whittaker, commenting on Dr. Whittaker's love for people of every
race and creed.

MINUTES
On motion by Bartlett, the minutes of the regular meeting of July 18,
1966, and the regular adjourned meeting of July 26, 1966, were approved
as prepared by the Clerk and mailed.. Motion carried..
TENTATIVE TRACT MAP 6028 - EXTENSION OF TIME
The Clerk presented a transmittal from the Planning Director of a
request from Deane Brothers, 20800 Beach Boulevard, Huntington Beach,
California, for a one year extension of time in which to record
Tentative Tract Map 6.028. The Planning Commission had recommended
approval, with a stipulated condition.
On motion by Kaufman, Council granted an extension of time to Deane
Brothers, on the recording of Tentative Tract Map 6028, with condition
stipulated by the Planning Commission. Motion carried.
PLANNING COMMISSION BY-LAWS
The Clerk presented a transmittal from the Planning Commission sub,
mitting By -Laws adopted by the Planning Commission on July 19, 1966,
for Council consideration and approval.
On motion by Green, Council approved .the By -Laws submitted to the
Council by the Planning Commission and directed the By -Laws be filed
in the Office of the City Clerk. Motion carried.

FINAL TRACT MAP 5894 - COVINGTON BROTHERS
The Clerk presented a transmittal from the Planning Director, sub-
mitting final form of Tract Map 5894, Covington Brothers, for adoption:
Subdivider: Covington Brothers, Huntington Beach, California; Loca-
tion: 660 feet south of Edinger Avenue, west of Sher Lane; Legal
Description: Being a subdivision of a portion of the NW% of the NEY4
of Section'23-5-11; Number of Lots: 16; Total Acreage: 5.088; that
the.map has been certified by the City Engineer and the Secretary ;to
the Planning'Commission to.be true and correct in.accordance with
provisions of the City Subdivision Code.

The City Council may accept dedication as shown on the map and in
addition approve the Final Map, subject to the following conditions:
The City Clerk's signature shall be withheld pending the submittal
and completion of the enumerated requirements:

2. Bond for improvements.
3. Signature of agreement.
4. Certificate of insurance.

On motion by Bartlett, Council accepted offers of dedication as
shown on Final Tract Map 5894, and adopted the map subject to condi-
tions stipulated by the Planning Commission. Motion carried.
PUBLIC HEARINGS SET -.8/15 66
On motion by Kaufman, Council ordered a public hearing for Monday,
August 15, 1966, at 7:30 P.M., or as soon thereafter as possible, on
an appeal on Zone Case 66-38, and directed the City Clerk to publish
notice of same. Motion carried.
On motion by Kaufman, Council ordered a.public hearing for Monday,
August 15, 1966, at 7:30 P.M., or as soon thereafter as possible, on
Zone Case 66-37, and directed the City Clerk to publish notice of
same. Motion carried.
TRACTS 5637 & 5638 - DEDICATION OF IMPROVEMENTS - ALCO-PACIFIC CONST. CO.
The Clerk presented a communication from the Director of Public Works
recommending acceptance of dedicated improvements and authorization
to release the Monument Bond and terminate the Three -Party Agreement
and the Subdivision Agreement - Tracts //5637 and 5638.
On motion by Kaufman, Council accepted improvements dedicated for
public use in Tracts 5637 and 5638; authorized the release of the
Monument Bond and termination of the Three -Party Agreerrient and Sub-
division Agreement, and directed that the developer be notified by
the City Clerk and the bonding company notified by the City Treasurer.

REIMBURSEMEN7 - SEWER - V H QUINETT
The Clerk presented a communication from the Director of Public Works
c�ovePing reimbursement from the Sewer Fund in the amount of $160.00,
for a Sewer connection by the owner of the property, and transmitting
.Resolution No. 2418 - "A RESOLUTION OF THE CITY COUNCIL OF HUNTINGTON
BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM TFJE SEWER FUND."
On motion by Bartlett., Council.waived further reading of Resolution
No. 2418, and adopted same by the following roll call vote:

DRAINAGE AGREEMENT - CENTRAL .BAPTIST CHURCH
The Clerk presented a transmittal from the Director of Public Works
of an Agreement for installment payments of drainage fees in conjunc-
tion with the Central Baptist Church development at 7661 Warner Avenue.
On motion by Kaufman, Council approved the Agreement between the City
and Central Baptist Oiurch for installment payment of drainage fees, -
and authorized the Mayor and.the City Clerk to execute same on
behalf of the City. Motion carried.

CC-032 C E HURLEY - NOTICE OF COMPLETION - STREET IMPROVEMENT
On motion by Kaufman, Council accepted the work as completed on Pro-
ject CC-032.- Improvements of Warner, Yorktown, Beach Boulevard, and
Indianapolis - and directed the City Clerk to file a Notice of Comple-
tion with the.Orange County Recorder. Motion carried.

On motion by Kaufman, Council accepted the work as completed on Pro-
ject CC-035 - Improvement of Main Street - and directed the City Clerk
to file a Notice of Completion with the Orange County Recorder. Motion
carried.
CC-045 - SIGNALIZATION & IMPROVEMENT
The Clerk presented a transmittal from the Director of Public Works
of Plans and Specifications, Resolution and Notice Inviting Sealed.
Bids for the signalization and improvements of various intersections
in the City, Project CC-045.
On motion by Kaufman, Council approved the Plans and Specifications
and Notice Inviting Sealed Bids, for Project CC--045 and ordered same
filed, and directed the City Clerk to advertise for bids when notified
by the Director of Public Works. Motion carried.
The Clerk read Resolution No. 2420 by title - "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING THE GENERAL
PREVAILING RATE OF HOURLY WAGES FOR EACH CRAFT OR TYPE OF WORKMEN OR
MECHANIC NEEDED FOR THE CONSTRUCTION OF STREET IMPROVEMENTS,.CHANNEL-
IZATION, AND SIGNALIZATION OF THE FOLLOWING INTERSECTIONS: BOLSA
AVENUE AT GRAHAM STREET, AND GOLDENWEST STREET AT MCFADDEN AVENUE,
PARTIALLY IN THE CITY OF WESTMINSTER AND PARTIALLY IN THE CITY OF
HUNTINGTON BEACH, CALIFORNIA."
On motion by Green, Council waived further reading of Resolution No.
2420, and passed and adopted same by the following roll call vote:

QUITCLAIM DEED - TO DONALD M.SMITH
The Clerk presented a transmittal from the Director of Public Works
of a quitclaim deed from City to Donald M. Smith, a drainage easement
previously deeded to City in conjunction with proposed Assessment
District No. 6402,
On motion by Coen, Council approved the quitclaim deed from the City
to Donald M. Smith in conjunction with proposed Assessment District
No. 6402, and authorized the Mayor and City Clerk to execute same on
behalf of the City. Motion carried.

REIMBURSEMENT - DRAINAGE - FRANK AYERS & SON
The Clerk presented a communication from the Director of Public Works
covering reimbursement for storm drains installed by'the developer
on Drainage District 6B in the amount of $495.03, and transmitting
Resolution.No. 2421 - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE
DRAINAGE DISTRICT 6B FUND."
On motion by Green, Council waived further reading of Resolution No.
2421, and adopted same by the following roll call vote:

The Clerk presented'a communication from the Director of Public Works
covering reimbursement for the Sher Lane Storm Drain installed by the
developer on Drainage District 5 in the amount of $287.50, and
transmitting Resolution No. 2422 - "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY
FROM THE DRAINAGE DISTRICT 5 FUND."
On motion by Green, Council waived further reading of Resolution
No. 2422, and adopted same by the following roll call vote:

The Clerk presented a transmittal from the City Attorney of deeds
for acceptance, recording and payment authorization in the Edwards -
Slater Condemnation, as follows:

On motion by Green, Council accepted the deeds as listed, directed
that they be returned to Land Acquisition Service for recording,
and authorized payment'to the grantors in the amounts as listed when
notified by Land Acquisition Service, by the following roll call vote:

MOVE -IN BUILDINGS - PROTEST - NORBERT R MURPHY
The Clerk presented a letter from Norbert R. Murphy, property owner
of 7871 Stark Street, City, protesting the application of Rhea Mae
Sayre to move -in units on property located at 7922 Stark Street,
together with a report from the Building Director.
After discussion by the Council, on motion .by Kaufman, Council denied
the protest and directed that the Sayre application be allowed, Motion
carried.
On motion by Coen, Council directed the Attorney to amend Ordinance
No. 1224, before presentation later in the meeting, to include the
requirement of a cash bond for move -in units. Motion carried.
On motion by Kaufman, Council directed the City Administrator and
staff to study and report on the controlling of aesthetics in further
construction in the City, either through architectural review or by
Ordinance amendment. Motion carried.

CHAMBER OF COMMERCE - FR'F AY AGREFNENT
The Clerk presented a transmittal from the Huntington Beach Chamber of
Commerce requesting an explanation as to the delay in the signing of
the Freeway Agreement of Legislative Route 171 on the segment .between
Atlanta .and Adams Street, City of Huntington Beach. Discussion
followed.
Mr. W. M. Elliott, 805 13th Street, City, addressed the Council and.
asked for the City to consider making a change in the freeway route
to avoid the destruction of apartment units.
No action was taken on this matter at this time.
CITY PARKS - RULES OF CONDUCT
The City Administrator deported to the Council on the completion of
the Proposed Rules and regulations "Conduct within Public Parks,"
amending Chapter 77 of the Huntington Beach Ordinance Code, which he
was instructed to prepare at the Council meeting of July 5, 1966.
On motion by Green, Council approved the Proposed Rules and Regulations
for "Conduct within Public Parks" in the City, and directed the City
Attorney to prepare an. Ordinance amending Chapter 77 of the Huntington
Beach Ordinance Code. Motion carried.
OFF STREET PARING - MAIN &,OLIVE
The City Administrator presented a transmittal of a Lease Agreement
for an Off -Street Parking Facility on the Corner of Main and Olive
Streets.
On motion by Coen, Council approved the terms of the Lease.Agr.eement
between the City and -Sylvia Shandrtek for an Off -Street Parking Facility
on the Corner of Main and Olive, and authorized the mayor and City
Clerk to execute same on behalf of the City. Motion carried.
USE OF PUBLIC BUILDINGS - FIXING FEES
The City Administrator presented a transmittal of proposed Resolution
regulating and fixing fees for use of the Recreation Center and the
Lake Park Clubhouse.
On motion by Bartlett, Council approved the proposed Resolution and
directed the City Attorney to prepare a final Resolution for Council
consideration. Motion carried.

ART DISPLAYS ON BEACH
The City Administrator presented a transmittal of the Police Report
and recommendation of the City Administrator that display and sale of
local artwork not be allowed at the Amphitheater on the Beach.
Following discussion, Council deferred action on this matter until
the next regular meeting.
SIGN ORDINANCE REVISION AND ENFORCEMENT
The City Administrator presented a recommendation for consolidation of
several sign,regulations now existing in the Huntington Beach Ordinance
Code and for recruitment of additional personnel for adequate enforce-
ment of same.
On.motion by Green, Council approved consolidation of several sign
regulations now existing in the Ordinance Code, and directed the City
Attorney to prepare the necessary Ordinance to amend the Huntington
Beach Ordinance Code, and authorize the City Administrator to recruit
the required personnel for enforcement of same. Motion carried.

ENFORCEMENT OF ORDINANCE CODES

On motion by Kaufman, Council directed the City Administrator and
staff to make a study of the enforcement of all codes within the
Huntington Beach Ordinance Codes Motion carried.
ATTEND SEMINAR - SERL WATSON
On motion by Green, Council approved the attendance of Mr. Serl Watson
at a seminar offered by the Public Personnel Section of the Inter --
national ManagersAssociation in Palo Alto, California, November 11-16,
1966, and with reimbursement for reasonable expenses allowed. Motion
carried.
EXPENSE ACCOUNT - SEMINARS AND CONVENTIONS
On motion by Coen, Council directed the Finance Director to make a
study of the expense accounts granted employees of the City in
conjunction with attendance at seminars and conventions. Motion
carriedm
CITY OWNED LOTS - ASSESSED VALUATION
The City Administrator presented a report on certain lots on which
it has been ascertained the City would be able to furnish a policy
of insurance in event they were sold.
On motion by Kaufman, Council directed the City Administrator to obtain
descriptions and maps showing the properties owned by the City and
to obtain approximate valuations. Motion carried.
WOODEN OIL DERRICK PRESERVATION
The City Administrator presented a recommendation that "Preservation
of a Wooden Oil Derrick as a Museum Piece" be assigned to the Urban
Land Institute Sub -Committee for Cultural Development for research
as soon as the Committee is formed.
On motion by Kaufman, Council directed the subject of a wooden oil
derrick preservation as a museum piece to be assigned to the ULI
Sub -Committee for Cultural Development for research at such time as

�_'Sb`NSET BEACH ROADWAY AND OCEAN ANNEXATION
The City Administrator presented a communication reporting on a study
made with the Public Works Department, Finance Department, and Planning
Department, on the proposed Sunset Beach Roadway and Ocean Annexation,
and recommending that no further action betaken in this matter.
On.motion by Green, Council directed that no further action be taken
with the Sunset Beach Roadway and Ocean Annexation, and that the
report be filed. Motion carried.
SUNSET BEACH SANITATION DISTRICT STUDY
The City Administrator. presented a recommendation that Council appoint
a two -man committee to meet with the Staff, Sunset Beach Sanitation
District, and the Huntington Harbour Property Owners Association
Committee to attempt to chart a course of action in regard to the
sewage problem in the area..
On motion by Bartlett, Council appointed a two -man committee, consis-
ting of Councilmen Stewart and Bartlett, to meet with the Staff,
Sunset Beach Sanitation District, and the Huntingtbn.Harbour Property
Owners Association Committee to study the sewage and odor problem.
Motion carried.,

ASSESSMENT PRACTICES IN CITY
The City Administrator presented a report showing figures submitted
by Robert Dingwall in regard to property assessments in the City, to
be -correct, and informed the Council that Mr. Hinshaw, the County
Assessor, could meet with the Council the 8th or 22nd of August to
discuss assessment practices. Council directed the Administrator
to invite Mr. Hinshaw to meet with them on August 22nd.

RECESS
Mayor Stewart called for a recess at 5:55 P.M., at which time the
Council would have an executive session with the City Attorney, and
stated the City Council meeting would reconvene at 7:30 P.M.
RECONVENE
Council was reconvened at 7:30 P.M. by the Mayor.
AGREEMENT - CITY ATTORNEY
The Mayor reported on the.conference of the Council and the City
Attorney. He stated that an agreement would be ready for approval
at the next meeting.

S&F1NG CONTEST BANNERS
The City Administrator presented a request from the United States
Surfing Championship Committee for the placing of banners across
Highway 1, across the pier, and possibly across Highway 39 in the
vicinity of Five Points, announcing the National Surfing Championships.
On motion by Coen, Council approved the placing of banners on the pier,
bu denied any banners to be hung on City streets. Motion carried.
MOSQUITO ABATEMENT BOARD & POLICE PHYSICIAN APPOINTMENT
The City Administrator informed the Council that because of the death
of the late Dr. Whittaker, it would be necessary for the Council to
appoint a replacement to the Mosquito Abatement Board. Dr. Whittaker's
two year term would have expired December 31, 1967. The Council
decided to withhold action until a study had been made.

On Notion by Bartlett, Council appointed Dr. Robert Q. Shupe, Huntington
Beach physician, to act as the police physician to administer blood
alcohol tests to determine the degree of intoxication, when required
by the Police Department. Motion carried.

PROPOSED CIGARETTE TAX ORDINANCE
On motion by Coen, Council directed the City Attorney to prepare a
rough draft of a Cigarette Tax Ordinance for consideration at the next
meeting. Motion carried.

ANIMAL CONTROL ORDINANCE - SUGGESTED REVISION
The City Administrator presented a transmittal of a letter .from a
Huntington Beach citizen suggesting that it might be timely for Council.
to consider amendment of the City's ordinance which authorizes the
keeping.of five dogs at any residence in the City. Over five dogs
requires licensing and constitutes the operation of a kennel. The
applicant suggests that the harboring of three dogs be defined as a
kennel.
Mr. W. M. Elliott, 805 13th Street, City, addressed the Council and
expressed his views on the subject. He suggested raising the license
fee to $10 per dog and allowing only one dog per lot. He also told
Councilmen that dogs should be banned from motels and other places
of human habitation for guests.
On motion by Coen, Council directed the City Administrator to make a
stddy of the Animal Control Ordinance. Motion carried.
FOURTH OF JULY PARADE
The City Administrator reported that a final accounting of all costs
incurred by the Junior Chamber of Commerce in staging the Fourth of
July parade amounted to $8,383.56.
On motion by Coen, Council offered the staging of the 1967 Fourth of
July Parade to the Junior Chamber of Commerce. Motion carried.

PROPOSED VACATION OF WESLEY DRIVE
Council continued its discussion of the proposed vacation of Wesley
Drive in the vicinity of the Huntington Beach Golf Course. However,
action was deferred until a future meeting.
PLANNING COMMISSION COMPE1iSATION
The City Administrator informed the Council that in order for the new
budget to be put into effect, Section 9007 of the Huntington Beach
Ordinance Code should be amended to change the present limit of two
paid meetings for the Planning Commission to the proposed -.limitation
of three paid meetings per .month.
On motion by Kaufman, Council directed the City Attorney to prepare
the necessary Ordinance for amending Section 9007 of the Huntington
Beach Ordinance Code. Motion carried.

The Clerk presented Conditional Exception - UV 66-24 - Oakhurst Land
Company - on property located north of Talbert Avenue (extended) and
crest of Edwards Street, to allow the staggering of setbacks and better
utilization of open spaces for a more pleasing and.aesthetic envi-
ronment. The Planning Commission recommended approval, with conditions,

Mayor Stewart announced that this was the day and hour set for a pub-
lic hearing on Zone Case 66-35, on property located at the south-
east corner of Bolsa Avenue and Springdale Street, and directed the
Clerk to read the legal notice.
The Clerk read notice of public hearing on Zone Case 66-35, as pub-
lished in the Huntington Beach News on July 21, 1966, setting the
hour of 7:30 P.M., or as noon thereafter -as possible, on Monday, the
lst day of August, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering a petition for a change of
zone to regulations of the Districting Ordinance, from C2 Community
Business District, to RI Single Family Residence District.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal, recommending approval of Zone
Case 66-35, and stated that he had received no communications or
written protests to the Zone Case or to the recommendation of the
Planning Commission.
Mayor Stewart declared the hearing open.
There being no one present to speak on the matter, and there being

UV 66-30 - CONDITIONAL EXCEPTION - FLALLON CORPORATION
The Clerk presented Conditional Exception -- UV 66-30 - Flallon
Corporation on property located south of Bolsa Avenue, east of Spring-
dale Street, to allow property to be subdivided into lots with a
yield equivalent to other subdivisions in the City. The Planning
Commission recommended approval, with conditions.
On motion by Kaufman, Council sustained the Planning Commission and
directed the City Attorney to prepare a Resolution approving UV 66-30,
with conditions as stipulated by the Planning Commission. Motion
carried.

PUBLIC HEARING - WEED ABATEMENT CHARGES CERTIFIED
Mayor Stewart opened the hearing for the City Council to hear objections
of the property owners shown on the list of!Weed and Rubbish Abatement
Charges for the year 1966,.as posted at the outside entrance to the
Council Chamber, in accordance with Government Code, Chapter 13, Article
3, State of California, to the charges listed thereon.
The Clerk presented the Affidavit of Posting Notices of Weed Abatement
Charges, as sworn to by James R. Wheeler, Street Superintendent.
There being no objections voiced, the Mayor declared the hearing
closed.
A motion was made by Green that the' Weed Abatement Charges covering
the year 1966, as posted at the entrance to the Council Chamber, be
confirmed, and any charges listed thereon not paid by August 1, 1966,
be certified to the County offices for inclusion on the 1966-67 Tax
Roll. Motion carried.

RESIGNATION OF DAVID CRABB
The Clerk presented a transmittal from David 0. Crabb submitting
his resignation from the Planning Commission due to a transfer in
his work.
On motion by Coen, Council accepted David 0. Crabb's resignation
from the Planning Commission, with regret, and directed that a
plaque be prepared for his work with the City. Motion carried.
NEWSPAPER. TAX
Mr. W. M. Elliott, 805 13th Street, City, addressed the Council and
suggested that a tax be put on all newspapers delivered that are
not mailed. This, he stated, should be done instead of putting a
tax on cigarettes. No action was taken at this time.
ULI STEERING COMMITTEE APPOINTMENT
Mr. John Costello, Administrative Assistant, addressed the Council
and informed them of the appointment of Mark Porter, to the ULI
Steering Committee's Sub -Committee on Transportation.
Mr. Costello also called the Council's attention to a meeting with
Walter T. Slattery, Field Representative for the Department of Housing
and Urban Development, to be held in the Council Chamber in Memorial
Hall on Wednesday, August 3r.d, at 7:30 P.M., and invited all interested
persons to attend.
BOUNDARIES FOR INTERIUM HOLDING ZONE
Following discussion and a resume' by the Planning Director, and on
motion by Kaufman, Council approved the boundaries for the interium
holding zone as prepared by the Planning Commission. Motion carried.

HERBERT A DAY - OIL FIELD SUPERINTENDENT
The City Administrator informed the Council of his recommendation
of Herbert A. PUy for appointment to the position of Oil Field
Superintendent.
On motion by Green, Council appointed Herbert A. Day as Oil Field
Superintendent, effective August 16, 1966. Motion carried.
JUNIOR CHAMBER -OF COMMERCE - PARK EQUIPMENT
Councilman Coen discussed the Junior Chamber of Commerce's park
equipment project and informed the Junior Chamber of Commerce.the
City would offer any help they could.

CLEAN UP OF BEACH AREA
Councilman Bartlett discussed the situation of the litter in the
downtown area stating that it was much improved, but suggested that
the lifeguard's loudspeaker be used to remind the people to pick
up their litter on the beaches in an effort to keep that area clean.
EAST -SIDE RIGHT-OF-WAY
Councilman Green discussed the sidewalk right-of-way situation of
the east side of town. The Director of Public Works informed the
Council that there has been no serious accidents in that area
because of the lack of sidewalks, and stated that his office would
look into the problem,
