Monday, August 15, 1966
Mayor Stewart called the regular meeting of the City Council of the
City of Huntington Beach to order at.4:30 P.M.
The Pledge of Allegiance was.given by all present in the Council
Chamber.
The invocation was given by Rabbi Gershon Fisher, Rabbi of the Temple
Beth David in Westminster, California_.
ROLL CALL
Councilmen Present: Coen, Bartlett, Kaufman, Green, Stewart
Councilmen Absent: Gisler, Shipley
�'}DEANE BROS MERGER WITH OCCIDENTAL PETROLEUM CO
`Mr. James Deane, of Deane Brothers Construction -Company, addressed
the Council and informed them of Deane Brothers merger with Occidental
Petroleum Company, and that Deane Brothers office facilities are
being moved to the Orange County Airport for additional space and the
availability of a heliport. He expressed his appreciation to Council
for theirsupport and cooperation with his company in the past..
MINUTES
On motion by Kaufman, the minutes of the regular meeting of August 1,
1966, and the regular adjourned meeting of August 4, 1966, were
approved as prepared by the Clerk. Motion carried.
0 UV 66-34 - CONDITIONAL EXCEPTION - ESSEX LAND COMPANY
The Clerk presented Conditional Exception - UV 66-34 - Essex Land
Company - on property located 613 feet south of Atlanta Avenue, east
of Brookhurst Street to allow diviations to the Huntington Beach
Ordinance Code. The Planning Commission had recommended approval,
with conditions.
On motion by Green, Council sustained the Planning Commission and
directed the City Attorney to prepare .a Resolution approving UV 66-34,
with conditions as stipulated by the Planning Commission. Motion
carried..
FINAL TRACT MAP NO 5193 - CRAIG DEVELOPMENT CORP
The Clerk presented a transmittal from the Planning Director, sub-
mitting final form of Tract Map 5193, Craig Development Corporation,
adoption: Subdivider: Craig Development Corporation, Tustin, Calif-
ornia; Location: East of Brookhursi Street, 935.00 feet south of
Adams Avenue; Number of Lots: 108; Total Acreage: 28.830; that the
map has been certified by the City Engineer and the Secretary to the
Planning Commission to be true and correct in accordance with pro-
visions of the City Subdivision Code..
The City Council may accept dedication as shown on the map and in'
addition approve the Final Map, subject to the following conditions:
The City: Clerk's signature shall be withheld pending the submittal
and completion of the enumerated requirements:
1. Deposit of:fees for water, sewer, drainage, engineering and
inspections.
2. Bond for improvements.
3. Signature of agreement.
4. Certificate -of insurance.
S. Approval from the County Surveyor.
6. Bond.for monuments.
7. Deed for underground water rights.

On motion by Coen, Council accepted offers of dedication as shown
on Final Tract Map 5193, and adopted the map subject to conditions
stipulated by the Planning Commission. Motion carried.
,�iPUBLIC HEARINGS SET - 9/6/66
On motion by Kaufman, Council ordered a public hearing for Tuesday,
September 19,1966, at 7:30 P.M. or as soon thereafter as possible,
on an appeal on Zone Case 66-39, and directed the City Clerk to
publish notice of same. Motion carried.
+�On motion by Coen, Council ordered a public hearing for Tuesday,
September 6, 1966, at 7:30 P.M., or as soon thereafter as possible,
on Master Plan Amendment No. 66-2 - Study area II, and on Zone Cases
66-40 and 66-42, and directed the City Clerk to publish notice of
same. Motion carried..
�G'-�-CC-034 - R J NOBLE - NOTICE OF COMPLETION - STREET IMPROVEMENT
On motion by Coen, Council accepted the work as completed on. Project
CC-034 - Improvements of Warner, Bolsa Chica, and Edinger, and directed
the City Clerk to file a Notice of Completion with the Orange County
Recorder. Motion carried.
IG 7CC-042 V R DENNIS CONST CO - NOTICE OF COMPLETION - STREET IMPROVEMENT
On motion by Coen, Council accepted the work as completed on Project
CC-042 - Slurry Seal of Acacia Avenue, Huntington Avenue, Geneva Street,
and Magnolia Avenue, and directed the City Clerk to file a Notice of
Completion with the Orange County Recorder. Motion carried.

The Clerk presented a transmittal from the City Attorney of deeds
for acceptance, recording and payment authorization in the Edwards/
Slater Condemnation, as follows:
Cora E. Schooler - 2 deeds - Tract 281, Block B, Lots 35 $ 450.00
Block E, Lots 24, 26, 27 $1,350.00
Della Maude White - Tract 281, Block A, Lot 74 S 425.00
On motion by Green, Council accepted the deeds as listed, directed
that they be returned to Land Acquisition Service for recording, and
authorized payment to the grantors in the amounts as listed, when
notified by Land Acquisition Service, by the following roll call vote:

,�ISEMI-ANNUAL PAYMENT - IRVINE RANCH WATER DISTRICT
On motion by Bartlett, Council authorized the payment due per Reservoir,.
Lease Agreement between Irvine Ranch Water District and City of Hunt-
ington Beach dated August 7, 1963, to the Irvine Ranch Water District
in the amount of $50,000.00 by the -following roll call vote:

NOES: Councilmen: None

11� PUBLIC UTILITIES COMMISSION - SUNSET BEACH-SURFSIDE WATER
The Assistant City Attorney informed the Council that litigation had
been brought against the City by the California Public Utilities
Commission to have the purchase -sale of the Sunset Beach-Surfside
Water Company set aside.
On motion by Kaufman, Council instructed the City Attorney and the
City Administrator to negotiate with the law firm of Rutan & Tucker
regarding the legal fees, and report to Council. Motion carried.

DELETION 4F WEED CHARGES - CITY OWNED PROPERTY
The Director of Public Works transmitted a list of weed charges on
City owned property, to be deleted from the 1966 tax rolls.
On motion by Bartlett, Council authorized cancellation of weed
cleaning charges on City owned property, as requested by the Director
of Public Works. Motion carried.
HELIPORT ZONING STUDY
Council directed the City Administrator to make a study relative to
zoning for heliports in the City.

USE OF TRAILER - SS SIMON & JUDE CHURCH
The Clerk presented a letter from the SS Simon & Jude Church requesting
permission to use a trailer for office space adjacent to the Church
Hall on Eleventh Street until such time as construction is completed
on their facilities on Magnolia Street.
On motion by Kaufman, Council granted permission for the use of a
trailer for office space at SS Simon & Jude Church for the period of
six months, ' subject - to the usual conditions:' in4bluding the posting of
a $1000 performance bond. Motion carried.
CERTIFICATE OF NEED AND NECESSITY - PRIVATE PATROL
The Clerk presented an application from the William J.. Burns Interna-
tional Detective Agency, Incorporated, for a Certificate of Public
Need and Necessity to operate a Private Patrol Service within the
City,
On motion by Bartlett, Council approved the application and granted
the Ceritficate of Public Need and .Necessity and directed the Clerk to
issue a Business License.. Motion carried.

CERTIFICATES OF PUBLIC NEED & NECESSITY - STUDY
On motion by Kaufman, Council directed the City Attorney to study the
legal background for Certificates of Public Need and Necessity and
report back to Council. Motion carried..
WALKWAY REgUEST - WARNER AVENUE
The Clerk presented a petition with twenty-four signatures requesting
a walkway on Warner Avenue, between Palmdale Street and Beach Boule-
vard, for the safety of children walking to Ocean View School.
On motion by Green, Council authorized the Director of Public Works
to proceed with temporary walkway paving on Warner Avenue from
Palmdale Street to Beach Boulevard, and further authorized an expend-
iture not to exceed $1500 for same by the following roll call vote:

04CLAIM - MRS FRANK POUND
The Clerk presented a claim from Mrs. Frank Pound for alleged personal
injuries and medical expenses incurred as a result of a fall at 210
Main Street on July 18, 1966.
On motion by Coen, Council denied the claim filer] by Mrs. Frank Pound,
and referred same to the City Attorney and the City's Insurance `
Carrier. Motion carried.

PROPOSED UNIFORM FOOD SANITATION ORDINANCE
The City Administrator presented a recommendation that the revised
version of the Uniform Food Sanitation Ordinance adopted by the
Orange County Board of Supervisors, be referred to the City Attorney.
On motion by Kaufman, Council referred this matter to the City
Attorney for study and to report back to the Council. Motion carried.

PIER TRAM LEASE - CLARA B WARNER
The City Administrator presented a recommendation that a clause be
inserted in the renewal of the lease for the pier tram concession
requiring the owner to comply with the City's need architecturally
and structurally when proposed beach development goes forward.
On motion by Green, Council referred this matter to the City
Administrator for study and to report back to the Council at their
next regular meeting, Motion carried.
PEDESTRIAN -BRIDGE -AGREEMENT - TRACT 5791
The City Administrator presented an agreement for the construction of
a pedestrian bridge across the Wintersburg Flood Control Channel at
Graham Street for children who will be attending the Ocean View School.
On motion by Kaufman, Council approved the agreement between the
City of Huntington Beach, Dutch Haven Homes, and the Ocean View School
District, for the construction of a pedestrian bridge across the
Wintersburg Flood Control Channel, and authorized the Mayor and the
City Clerk to execute the Agreement on behalf of the City. Motion
carried.
ARCHITECTURAL REVIEW BOARD
On motion by Coen, Council directed the Administrator to advertise
for applicants with experience in architectural design and related
fields, for the Architectural Review Board, with the deadline being
set for September 6, 1966. Motion carried.
SUNSET BEACH SANITARY DISTRICT - COMPLAINT
Council directed the City Administrator to establish a meeting
between the Huntington Harbour Property Owners Association, Council-
man Bartlett and Mayor Stewart, and the Staff, to study the problems
created by the Sunset Beach Sanitation Disposal Plant, with a tentative
date set for September .13th at 8:00 P.M.

BANNING AVENUE PUMPING STATION
On motion by Kaufman, Council authorized the Director of Public Works
to prepare the Plans and Specifications for increasing the capacity
of the Banning Avenue Pump Station. Motion carried„

WARDLOW PARK
Councilman Coen discussed the matter of fencing and park equipment
for Wardlow Park. On motion by Coen, Council referred this matter
to the City Administrator and Recreation Commission for study. Motion
carried.
7RESOLUTION NO 2429_-4 ADOPTED - OCEAN VIEW LITTLE LEAGUE
The Clerk read Resolution No. 2429 by title -- "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CONGRADULATING AND
COMMENDING THE OCEAN VIEW LITTLE LEAGUE ALL STARS BASEBALL TEAM
IN WINNING THE WESTERN REGION DIVISION III LITTLE LEAGUE TOURNAMENT."

OCEAN VIEW LITTLE LEAGUE - FINANCIAL ASSISTANCE
Councilman Green discussed the possibility of the City helping the
Ocean View Little League in their travel expenses to Pennsylvania
if they win the final two games on the West Coast this week. This
matter was deferred until the meeting of August 22nd.
ALCHOLIC BEVERAGE CONTROL BOARD
Council discussed the necessity of having the City represented at the
Alcholic Beverage:Control hearing in San Diego, California, on
September 6 and 7, 1966, to give testimony on the problems of the City
has experienced in this regard.
On motion by Kaufman, Council referred this matter to the City
Administrator for representation at said meeting. Motion carried.
DESALINATION PLANT
Council directed the City Attorney and the City Administrator to look
into the City°s position concerning the Desalination Plant to be
constructed off the Orange County coast. No further action was taken
on this matter.
RECESS
Mayor Stewart called a recess of the Council at 5:40 P.M. Council
was reconvened at 7:30 P.M. by the Mayor.
'PUBLIC HEARING ZONE CASE 66-37 - DENIED
Mayor Steuart announced that this was the day and hour set for a
public hearing on Zone Case 66-57, on property located on the south
side of Garfield Avenue, approximately 530 feet east of Beach Boule-
vard, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on Zone Case 66-37, as pub-
lished in the Huntington Beach News on August 4, 1966, setting the
hour of 7:30 P.M., or as soon thereafter as possible, on Monday,
the 15th day of August, 1966, in the Council Chamber of the Civic
Center, Huntington Beach, California, as the time and place for a
public hearing for the purpose of reconsidering a petition for a
change of zone to regulations of the Districting Ordinance, from C4
Highway Commercial. District, to Ml Light Industrial District.

The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal, recommending approval of Zone
Case 66-37, and stated that he had received no communications or
written protests to the Zone Case or to the recommendation of the
Planning Commission.
Mayor Stewart declared the hearing open.
Mr. Melvin W. Root, 18781 Gregory Lane, City, addressed the Council
and submitted a petition with twenty --six signatures of residents in
Harper Estates requesting the Council's consideration for denial of
Zone Case 66-37.
Mr. Ralph Kiser, General Manager of Southern California Edison Company,
addressed the Council and presented the Edison Company's proposed
use of the land.
There being no one -further present to speak on the matter, and there
being no further protests, the hearing was closed by the Mayor.
On motion by Green, Council denied Zone Case 66-37. Motion carried.

PUBLIC HEARING - ZONE CASE 66-38 - APPEAL - DENIED
Mayor Stewart announced that this was the day and hour set for a
public hearing on Zone Case 66-38, on property located at the north-
west -corner of Brookhurst Street and Yorktown Avexiue, and directed
the Clerk to read the legal notice.
The Clerk read notice of public hearing on Zone Case 66-38, as
published in the Huntington Beach News on August 4, 1966, setting the
hour of 7:30 P.M., or as soon thereafter as possible, on Monday, the
15th day of August, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering an appeal to the denial by the
City Planning Commission of Zone Case No. 66-38 for change of zone to
regulations of the Districting Ordinance, from RA Residential
Agricultural District, to Cl Neighborhood Commercial District, with
setback .provisions.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal, recommending denial of Zone
Case 66-38, and stated that he had received no other communications
or written protests to the appeal, or to the recommendation of the
Planning Commission, except the letter of appeal.
Mayor Stewart declared the hearing open.
Mr. John McShane, public relations man for Sh,i-blds Development Company,
addressed the Council and stated that he had been given this case very
recently and in order that he could prepare for the appeal, he requested
that this hearing either be closed and referred back to the Planning
Commission, or that the hearing be continued to a later meeting.
Mr. Jerry Matney, 19846 Leighton Lane, City, addressed the Council
and called attention to the school being constructed a short distance
from the property in question..
Mr. Randall Paul, Vice President of Shields Development Company,
addressed the Council and discussed the lots and improvement of the
property.
Mr. Fred Jefferson, Secretary of Shields Development Company, addressed
the Council and requested Council's approval of the Zone Case.
Mr. John McShane presented his client's, Shields Development Company,
appeal for the approval of Zone Case 66-38.
Mr. Mark Porter, 19842 Providence Lane, City, addressed the Council
and stated that peat soil conditions in the area could be overcome
for eventual residential housing, and requested denial of Zone Case
66-38.

Mr. Robert Dingwall, 19791 Estuary Lane, City, addressed the Council
and called attention to the many stores in neighborhood commercial
centers that are now vacant and requested that the Zone Case 66-38
be denied®
There being no one further present to speak on the matter, and there
being no further protests filed, either oral or written, the hearing
was closed by the Mayor.
On motion by Green, Council sustained the recommendation of the
Planning Commission and denied Zone Case 66-38. Motion carried.
PUBLIC HEARING - RESOLUTION NO 2408 - WESLEY AVENUE VACATION
Mayor Stewart announced that this was the day and hour set for a
public hearing on Resolution of Intention No. 2408 of the City Council
covering the vacation of Wesley Avenue and alley in Block 1804 in
the City, and directed the Clerk to read the legal notice®
The Clerk read notice of public hearing on Resolution of Intention
of the City Council of the City of Huntington Beach to vacate Wesley
Avenue and alley in Block 1804 in said Cityland giving notice of
hearing on said vacation, as published in the Huntington Beach News
on July 7, 1966, setting the hour of 7.30 P.M,, or as soon thereafter
as possible, on Monday, the 15th day -of August, 1966, in the Council
Chamber of the Civic Center, Huntington Beach, California, as the time
and place for a public hearing on said vacation.
The Clerk informed the Council that-'rthey had been provided with copies
of the Resolution of Intention; presented the Affidavit of Posting
Notice of Vacation of Street executed by the Street Superintendent,
and stated that he had received no communications or written protests
to the proposed vacation or to Resolution No. 2408 of the City Council.
Mayor Stewart declared the hearing open.
There being no one present to speak on the matter, and there being
no protests filed, either oral or written, the hearing was closed by
the May -or.
On motion by Bartlett, Council directed the City Attorney to prepare
a Resolution ordering the vacation of Wesley Avenue and alley in
Block 1804 in said City® Motion carried.

PUBLIC HEARING - ADDENDUM TO LIST OF WEED ABATEMENT CHARGES
Mayor Stewart opened the hearing for the City Council to hear objections
of the property owners .shown on the addendum to the list of Weed
and Rubbish Abatement Charges for the year 1966, as posted at the
outside entrance to the Council Chamber, in accordance with Government
Code, Chapter 1.3, Article 3, State of California, to the charges
listed thereon,
The Clerk presented the Affidavit of Posting Notices of Weed Abate-
ment Charges, as sworn to.by Jades R. Wheeler, Street Superintendent.
There being no objections voiced, the Mayor declared the hearing
closedm
A motion was made by Coen, that the Addendum to the List of Weed
Abatement Charges covering the year 1966, as posted at the entrance
to the Council Chamber, be .confirmed, and any charges listed thereon
not paid by August 15, 1966, be certified to the County Offices for
nelusion on the 1966-67 Tax Roll. Motion carried.

AWARDS PRESENTATIONS - JR C OF C - DAVID CRABB
Mayor Stewart presented a Resolution to Robert Walker, President of
the Junior Chamberof Commerce, commending the Jaycees for their
staging of the 1966 July 4th Parade,-_celebration,
«� Mayor Stewart presented a service plaque to David 0. Crabb for his

Councilman Green requested the City Administrator to instruct the
Planning Commission to check industrial zoning relative to the possible
prohibition of storage of sanitary equipment on construction sites.
TREE FARM STUDY
On motion by Green, Council directed the Public Works Director to
make a study and report on the establishment of a tree farm in the
City for beautification purposes. Motion .carried.

LAKE HUNTINGTON
On motion by Green, Council directed the City Administrator to confer
with the Police Department and take steps necessary to increase safety
by prohibiting diving from the cliffs at Lake Huntington_ Motion
carried.
DOWNTOWN IMPROVEMENT
On motion by Green, Council directed the City Administrator to work
with Chief of Police in studying improvements of the first block on
Main Street. Motion carried.
ULI REPLACEMENT
On motion by Coen, Council directed the Urban Land Institute to submit
three names to Council for the replacement of Martin Fenton, Jr.
Motion carried.
ZONE CASE 66•-37 - RECONSIDERATION
Mr. Ralph Kiser, Manager of the Edison Company, addressed the Council
and appealed for Council's consideration for re -hearing Zone Case No.
66-37. Mr. Kiser was informed that an appeal fee of $75.00 for pub-
lication and notification would be required to reset Zone Case 66-37
for hearing.
On motion by Kaufman, Council set a public hearing for Tuesday,
September 6, 1966, at 7:30 P.M., or as soon thereafter as possible,
for re -consideration of Zone Case No. 66--37. Motion carried.
ADJOURNMENT
On motion by Bartlett, the regular meeting of the City Council of
the City of Huntington Beach adjourned to Monday, the 22nd of August,
1966, at 7:30 P.M. Motion carried.
