HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: Kenneth Reynolds, John. Mandrell,
Sam Ferguson
BOARD MEMBERS ABSENT: None.
AREA VARIANCE NO. 66-46
Applicant - Barmakian-Norman
To allow 24 off-street parking
spaces in deviation to the required 42 spaces required
for commercial uses in the C2 zone. Located on the
south side of Edinger Avenue, approximately 5341 west
of Beach Boulevard and legally described as Lots 21,
225 23 of Tract No. 417.
The hearing was opened to the
audience.
The chairman read a letter of
protest submitted by four property owners living within
the adjacent area.
Jaun Estrada, representing the
property owners, stated that the reduction in parking
spaces would necessitate parking on Aldrich Street, thus
creating a traffic hazard since the streets are narrow
and without sidewalks.
It was noted by the Board that
since this business will be fronting Edinger Avenue,
there will be a complete separation from the lots on
Aldrich Avenue.
John Mandrell also pointed out
that there will be no access provided from Aldrich St.
to the business premises.
Mr. Barmakian, the applicant,
explained the reasons for their request. He stated that
there is 2,000 sq. ft. of the store devoted to retail
sales, the remainder of which is devoted to storage and
servicing of motor vehicles.
Mrs. Noami Bales also spoke
against the request explaining that another business
fronting on Beach Boulevard presented a parking problem
on Aldtich Street. She Stated that it would be best
to have ample parking to prevent this from happening
again.
Mr. Barmakian explained that
there are 10 extra parking spaces inside the building
and 5 on the outside, in addition to what was stated
on the request.
Mr. Saul Sher, owner of the
property involved, stated that there are more than
enough parking spaces needed for this type of business.
Further Board discussion followed.

It was noted that this plan should be
reviewed by the Traffic Engineer.
A MOTION WAS MADE BY FERGUSON AND SECONDED
BY REYNOLDS TO APPROVE AV NO. 66-46- UPON THE FOLLOWING CON -
DI TI ONS :
1. A precise plan showing the layout of the floor, wall locations,
and the required landscaping shall be submitted to the Plan-
ning Department Office for approval prior to issuance of a
building permit.
2. All utilities shall be installed underground.
3. The plot plan shall be approved by the Traffic Engineer.
FOR THE FOLLOWING REASONS:
1. Off-street parking spaces for this type of use are not
specifically stated in the Ordinance.
2. This type of use does not require off-street parking at
the same ratio as a business devoted entirely to retail
sales.

AREA VARIANCE NO. 66-47
Applicant - J. W. McMichael
To allow roof overhangs and porch stoops to
encroach into the required 10' side and front yards. Located
between Orange Avenue and Magnolia Avenue and 12th and 13th
Streets and legally described as Lots 1, 4, 5, 7, 8, 10, 11
and 14 of Tract 6119.
The hearing was opened to the audience.
The applicant explained his reasons for the
request.
It was noted by the Board that they could
take action on the porch stoops, but would not have the author-
ity to act on the encroachment of -roof overhang on public property.
Board discussion followed.
A MOTION WAS MADE BY MANDRELL AND SECONDED
BY REYNOLDS TO APPROVE THAT PORTION OF THE REQUEST REGARDING
THE ENCROACHMENT OF PORCH STOOPS INTO THE REQUIRED SIDE YARD
ON LOTS 1, 7, 8, and 14 FOR THE FOLLOWING REASON:
1. Encroachment into the side yard occurs on lots adjacent to
a street and will not obstruct accessability to any portion
of the building.
2. It will add to the aesthetic value of the building and
surrounding area.

A FURTHER MOTION WAS MADE BY MANDRELL
AND SECONDED BY FERGUSON TO APPROVE THAT PORTION OF THE
REQUEST REGARDING THE SEPARATION OF BUILDINGS BETWEEN
LOTS 45 5, 10 AND 11 FOR THE FOLLOWING REASONS:
1. The Fire Department has indicated in the past that
a 4 foot separation between buildings is sufficient.
2. The encroachment concerns only architectural features
which will add to the aesthetic value of the building.

NOES: None.
ABSENT: None.
THE MOTION CARRIED.
A FURTHER MOTION WAS MADE BY REYNOLDS
AND SECONDED BY MANDRELL NOT TO TAKE ACTION ON THE REQUEST
TO ALLOW CORNER OVERHANGS TO EXTEND OVER PUBLIC PROPERTY
ON LOTS 7 AND 8 FOR THE FOLLOWING REASON:
1. This request is beyond the responsibility of the
Board's.
ROLL CALL VOTE:
AYES: Reynolds, Ferguson, Mandrell
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
USE PERMIT NO. 66-25
Applicant - Mobil Oil Corporation
To allow the construction of a service
station in the C-4 zone. Located at the southwest
corner of Beach Boulevard and Edinger Avenue and legally
described as Lots 1, 25 3, and 4 of Tract 417.
The hearing was opened to the audience.
Mr. Tom Turner, representing the appli-
cant, explained the reasons for the request.
The Board reviewed the suggested conditions
of approval with the applicant.
Further Board discussion followed.
A MOTION WAS MADE BY REYNOLDS AND SECONDED
BY MANDRELL TO APPROVE USE PERMIT NO. 66-25 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. Edinger Avenue and Beach Boulevard shall be fully
improved to City and/or State Standards at the time
of development. Improvements shall include street
trees, street signs, and street lights.
2. All streets shall conform to City of Huntington
Beach Standards. Master Plan of Arterial Streets
and Highways Standards shall apply where applicable.
Street sections shall be determined by Department of
Public Works.

3. The property shall participate in the local drainage
assessment district.
4. A plan showing on -site drainage shall be submitted to
the Department of PublicWorks for approval prior to
issuance of a building permit.
5. All utilities shall be installed underground.
6. Off-street parking facilities including landscaping,
arrangement,access, paving and striping shall con-
form to Article 979.
FOR THE FOLLOWING REASONS:
1. This is a permitted use in the C-4 zone.
2. It is the responsibility of the Board to renew these
requests to assure compliance with the ordinance.

ABSENT: None.
THE MOTION CARRIED.
MISCELLANEOUS - Use Permit No. 66-6
Frank Richmond asked if there were any pro-
visions for eliminating one of the conditions of Use Permit
No. 66-6 regarding the installation of underground utilities.
The Board advised him to re -file an applica-
tion for a plot plan amendment.
