BOARD MEMBERS ABSENT: None. 10CEPTANCE OF MINUTES: The minutes of August 24, 1966 were accepted as transcribed. DIVISION OF LAND NO 66-22 Applicant: Ray Mercado To allow, a division of land into 3 separate parcels located on the northwest corner of Warner Avenue and Goldenwest Street and legally described as being a portion of the '.SEA/4, SPA, Section 22-5-11. The hearing was opened to the audience. Ray Mercado, the applicant, stated the reasons for the request. The suggested conditions of approval were given to the applicant. Mr. Mercado stated that there were no objections to the conditions. There being no.further comment, the hearing was closed. A MOTION WAS MADE BY FERGUSON AND SECONDED BY HARLOW TO APPROVE DIVISION OF LAND NO 66-22 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Warner Ave and Goldenwest St shall be dedicated and fully improved to City Standards at the time each parcel is developed. Improvements shall include street.trees, street signs and street lights. 2. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 6. A plan conforming to the grading ordinance shall be submitted to the Department of Public Works for ,approval -prior to =i"ssuance of .a building permit. 7. All utilities shall be installed underground at the time each parcel is developed. 9. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Departtent. 10. A masonry wall shall be constructed along west property line of Parcel 1 at the time said parcel is developed. The height of said wall shall be such, that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 11. The 150' x 150' parcel located at the intersections of Warner Ave. and Goldenwest St. shall be included within the Division of Land. 12. A parcel map shall be filed with the City and recorded. 13. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. ROLL CALL VOTE: AYES: Mandrell, Harlow, Ferguson. NOES: None. ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO 66-23 Applicant: Carl Steverson, et al To allow a division of land into 2 separate parcels located on the east side of Beach Blvd., 174 feet south of Garfield Avenue. Legally described as being a portion of the NW/4 of Section 1-6-11. The hearing was opened to the audience. There was no one present to speak for or against the matter. The suggested conditions of approval were reviewed by the Board. There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE DIVISION OF LAND NO 66-23 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Garfield Ave. and Beach Blvd. shall be dedicated and fully improved to City and/or State Standards at the time each parcel is developed. Improvements shall include street trees, street signs, and street lights. 2. All streets shall conform to City of Huntington Beach Standards. Preliminary and final soil repots shall be sub- mitted by an approved private soils engineer to the City prior to issuance of building permits- 7. A plan conforming to the grading ordinance shall be submitted to the Department of Public Works for approval prior to issuance of a building permit. 8. All utilities shall be installed underground at the time each parcel is developed. 9. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. 11. A parcel map shall be filed with the City and recorded. WITH THE SUGGESTION: That the existing service yard be included on the parcel map as a part of Parcel I. If Parcel 1 is deeded to the Edison Company, to be used in conjunction with their service yard to the east. ROLL CALL VOTE: AYES: Mandrell, Harlow, Ferguson. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 66-49 Applicant: Jack Ellsworth The hearing was opened to the audience. Mr. Ellsworth; the applicant, gave his reasons for the request. Board discussion followed. Mr. John Swanner, adjacent property owner, asked the Board if the request was granted would the surrounding property owners have the same privilege. Mr. Mandrell stated that they would also have to file a variance request. Further Board discussion followed. A MOTION WAS MADE BY FERGUSON AND SECONDED BY HARLOW TO DENY AREA VARIANCE FOR THE FOLLOWING REASONS: 1. The layout of the parking lot is not satisfactory because 2 spaces would not be accessible. 2. Applicant: Patrick Doonan To allow an addition and altera- tion of an existing dwelling to: (1) Use existing 3' side yards and 10' rear yards. (2) Not maintain 900 sq. ft. of open area; (3) Have less than the required parking facilities; all of which are in deviation of the required setbacks and parking requirements in the Rl and R2 zones. Located on the north side of Bay View Drive, 385' south of Broadway. Legally described as the SE1/h of Lot 7 of Tract 412 and Lot 9 of Tract 5829. The hearing was opened to the audience. Mr. Ted Cushman, architector for Mr. Doonan, explained the reasons for the request. Mr. Mate Bilac, adjacent property owner, stated that he did not object to the request. It was noted by the Board that Huntington Harbour had similar rear yard setbacks on lots abutting the waterway. Further Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO 66-50 FOR THE FOLLOWING REASONS: - 1. The 3' side yard setback conforms to the ordinance. 2. The 10' rear yard and reduction of the required open space is in conformance with the policy established by the City for Waterfront lots. 3. The only deviation to the ordinance regarding parking facilities is the reduction of the setback from the street and approval of this is in order because it is caused by conversion of an existing building which will be removed at a later time and rebuilt. ROLL CALL VOTE: AYES: Mandrell, Harlow, Ferguson. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 66-51 Applicant: Deane Brothers To allow the elimination of 7' eave return restriction contained in Area Variance No 66-5 and to permit eaves to encroach within the 30" setback required for architectural features for Tracts #6104, 6105, and 6028. Located on the north side of Atlanta Ave, West of Newland Street and legally described as Tracts 6028, 6104 and 6105. -4- : 8/31/66. r i Page No 5 Minutes: H. B. Board of Zoning Adjustments Wednesday, August 31, 1966. Mr. Gil Covell and Tom Gonzalez, representatives for the applicant, explained the reasons for the request. They stated that Tracts 6104 and 6105 had already been built and were in violation to a condition stated on a previous variance. Board discussion followed. It was noted that members of the Board investigated the property in question and could not find any problems caused by the encroachment. Richard Harlow stated that the Planning Commission will not be approving any subdivisions with three foot side yards so this will probably be the last request of this nature.to come before the Board. It was noted by the Board that a plot plan should be submitted showing the eave line for Tract No 6028. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE THAT PART OF AREA VARIANCE NO 66-51 THAT PERTAINS TO TRACTS 6104 AND 6105 AND TO CONTINUE ACTION ON TRACT 6028 UNTIL, SEPTEMBER 7, 1966. ROLL CALL VOTE: AYES: Mandrell, Harlow, Ferguson. NOES: None. ABSENT: None. THE MOTION CARRIED. THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED.
