The Pledge of Allegiance was.given by all present in the Council Chamber. The invocation w4s given by -Reverend Robert Larson, Minister of the Grace Lutheran Church RgbL . CALL Councilmen Present: Coen, Bartlett, Gisler., Kaufman.; Shipley, Green Councilmen Absent: Stewart (Councilman Stewart arrived at 7:30 P.M.) MINUTES On motion by Green, the minutes.of the regular meeting of September 6, 1966, were approved and.adopted as prepared by the.Clerk and mailed. Motion carried. CEDE AMENDMENT - DIVISION 9 The Clerk.presented a communication from the Planning Director Propos- ing an amendment to Division 9 of the Huntington Beach Ordinance Code.pertaining to Sections 9511 and 9530 and adding.printing plants to uses allowed in MA and Ml Zones. On motion by Kaufman, Council directed the City.Attorney to prepare an Ordinance amending Sections 9511 and 9530 of the Huntington Beach Ordi- nance. Motion carried. 21 �j UV 66-39 - CONDITIONAL EXCEPTION - Security - Fore The Clerk presented Conditional Exception - UV 66-39 - Security - Fore Company on property located north of Hamilton Avenue and east of Newland Street to allow deviations to the Huntington Beach Ordi- nance Code. The Planning Commission had recommended approval, with conditions. On motion by Kaufman, Council sustained the Planning Commission and directed the City Attorney to prepare a Resolution approving UV 66-391 with conditions as"stipulated by the Planning Commission. Motion car- ried. C? CC-043 - NOTICE OF COMPLETION - M L GARTEN On motion by Bartlett, Council accepted the work as completed on Pro- ject CC-043- Eastside Storm Drain - and directed the City Clerk to file a Notice of Completion with.the Orange County Recorder. Motion carried. PETITION FOR ASSESSMENT DISTRICT - NO 6403 The Clerk presented a transmittal from the Director of Public Works, submitting a petition signed by property owners on Newman Avenue, requesting.Assessment District No. 6403 be formed for the construc- tion of streets, curbs and gutters on Newman Avenue, from Beach Boulevard to 1284 feet west of.Beach Boulevard. Councilman Coen made a motion to deny the request for formation of Assessment.District 6403, but withdrew his motion before the vote was. taken. On motion by Coen, Council deferred action on this matter until a future meeting, and instructed the Administrator and the parties in- volved to meet to outline the possiblity of including water in Assess- ment District No. 6403. Page #2 - Minutes, September 19, 1966 {ALGONQUIN STREET IMPROVEMENTS AHFP//359 - CC-04$ The Clerk presented a trasmittal from the Director of Public Works of Plans and Specifications, Resolution and Notice Inviting Sealed Bids for the improvement of Algonquin Street from Davenport Drive to Heil Avenue. On motion by Kaufman, Council approved the Plans and Specifications for Project CC-048 and ordered same filed, and directed the City Clerk to advertise for bids when notified by the Director of Public Works. Motion carried. The Clerk read Resolution No. 2435 by title - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING THE GENERAL PREVAILING RATE OF HOURLY WAGES FOR EACH CRAFT OR TYPE OF WORKMAN OR MECHANIC NEEDED FOR THE CONSTRUCTION, SURFACING AND IMPROVEMENT OF ALGONQUIN STREET FROM DAVENPORT TO HEIL AVENUE, ALL IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA." On motion by Bartlett, Council waived further reading of Resolution No. 2435, and passed and adopted same by the following roll call vote: AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Shipley, Green NOES: Councilmen: None .ABSENT: Councilmen: Stewart DEED ACCEPTED The Clerk presented a transmittal from the Director of Public Works of a deed from Huntington Beach Community Hospital for street widen- ing of Newman Avenue, for acceptance and recording. On motion by Bartlett, Council accepted the deed from Huntington Beach Community Hospital and directed the City Clerk to record same with the Orange County Recorder. Motion carried. r 0 DEEDS ACCEPTED - EDWARDS/SLATER The Clerk presented a transmittal from the City Attorney of grant deeds for acceptance, recording and payment authorization in the Edwards -Slater Condemnation, as follows: Colin G.& Ann E. Rose - Lot 112, Blk E, Tract 281 $450 L. Latshaw - Lot 11_, Blk E, Tract 281 $450 Clara Totten - Lot 53, Blk B, Tract 281 $500 On motion by Green, Council accepted the deeds as listed and directed that they be returned to Land Acquisition Service for recording, and authorized payment to the grantors in the amounts as listed when notified by Land Acquisition Service, by the following roll call vote AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Shipley, Green NOES: Councilmen: None ABSENT: Councilmen: Stewart CITIZEN'S ,STEERING COMMITTEE - ULI The Clerk presented a communication from the ULI Citizens' Steering. Committee requesting indication from Council of its intention to sup- port the Citizens' Steering Committee's effort to form an inter- viewing body to retain the service of a General Consultant. On motion by Kaufman, Council approved the formatign body to retain the service of a General Consultant in the ULI Citizen Steering Committee. Motion carried. of an interviewing connection with. Page #3 - Minutes, September 19, 1966 `17 FAITH BAPTIST CHURCH - REQUEST USE OF TENTS The Clerk presented a letter from the Faith Baptist Church requesting permission to use three tents on church property at 609 - llth Street,. to be used for Sunday School classes for a period of 6 to 9 months® Mr. Earl T. Irby, Chairman of the Board of Trustees of Faith Baptist Church, addressed the Council and explained the reason for the request. On motion by Gisler, Council approved the use of three tents as tem- porary Sunday School classrooms by the Faith Baptist Church. Motion carried. RESOLUTIONS. Fg- RESUBMITTING BOND ISSUE TO VOTERS The Clerk presented resolution s.from the cities of Garden Grove, Fountain Valley, and Orange requesting the City's support in urging the Orange County Board of Supervisors to.resu:bmi.t the Orange County Flood Control District Bond issue to the voters. On motion by Kaufman, Council directed the City Attorney to prepare a Resolution urging the Orange County Board of Supervisors to resubmit the Orange County Flood Control District Bond issue to.the voters. Motion carried. RESOLUTION RE: FIELD ACT -- SCHOOL BUILDINGS The Clerk presented a resolution from the City of Santa Maria re- questing the City''s support in entreating the.Governor and Legislature to take steps to modify or amend the Field Act on School Buildings. A motion was made by Bartlett to direct the City Attorney'to prepare a Resolution entreating the Governor and Legislature to take steps to modify or amend the Field Act - School Buildings. The motion failed on a tie vote. �_ W CLAIM -- ETTA CORFF The Clerk presented a claim.from Mrs. Etta Corff for alleged personal injuries received.in a fall on August 18, 1966, in the vicinity of 120 Main Street, City. �On motion by Coen; Council denied the claim filed by Mrs. Etta Corff, and.referred same to the City Attorney and'the City'.s insurance girrier. Motion carried. LIGHTING - MINICIPAL BEACH - MAIN STREET The City Administrator reported that the estimated cost for lighting on Main Street and in the Beach area would be $56,000.00 and recommended that improvements be postponed until a master plan of improvements for the beach area�and the downtown area is completed. . On motion by Bartlett, Council deferred action on the matter of down- town street lighting until a master plan of improvements for the beach area and the downtown area has been..completed. Motion carried. LUCIA LANE PEDESTRIAN -EASEMENT.- TRACTS 3440 & 3506 The City Administrator presented:a report on a walkway adjacent to Park— er Circle, across a Southern California Edison Company Easement, to accommodate children attending'Pleasant View School. The Clerk informed the Council of a petition received with 95 signatures, requesting Council to.expedite the construction of'a walkway across the Edison right of way. A petition was also presented with 68 signatures from property owners on Parker Circle protesting the proposed walkway. 2781 Page #4 - Minutes, September 19, 1966 On motion by Bartlett, Council instructed the Administrator to make a study and recommendation after contacting representatives of the people relative to the proposed walkway across the Edison right-of-way. Motion carried. 103 BID :AWARD '- CC-045 - SIGNALIZATION The Clerk read a communication from the Director of Public Works, in- forming Council that bids for the construction of street improvements, channelization, and signalization of Bolsa Avenue at Graham Street, and Goldenwest Street at McFadden Avenue, had been opened at 9 A.M. on Monday, September 19, 1966, in the Council Chamber, by the City Clerk, City Attorney, Assistant City Administrator; and the Deputy Director of Public Works. He stated that Paul Gardner Corporation of..Ontario, California, was the lour bidder with a bid in the amount of $46,585.80. The Director of Public Works recommended that the Council award the bid to Paul Gardner Corporation, and reject all other bids. The bids submitted were as follows: Paul. Gardner Corporation - Ontario $46,585.80 R. J. Noble Company —Orange 47,188.60 Sully Niller - Orange 47,986.36 Hurley Contractors - Garden Grove 48,004.45 Smithe Electric Supply - Anaheim 50,944.55 Industrial Contracting Company - Stanton 52,051.45 On motion by Green, Council awarded the contract for Project CC-045 to Paul Gardner Corporation - Ontario, California, for the low bid in the amount of 346,585.80, and authorized the Mayor and City Clerk to execute same on behalf of the City. Motion carried. y ZONE CASE NO 66-37 APPROVED On motion by Kaufman, Council approved Zone Case 66-37 and directed the City Attorney to prepare an Ordinance effecting the change of zone in Zone Case 66-37. Motion carried. ARCHITECTURAL REVIEW BOARD INTERVIEWS Council set the time of Wednesday, September 28Lh, 1966; at 9:00 P.M. to interview the six applicants for the Architectural Review Board, POLICY PROCEDURE.- MUNICIPAL PROJECTS The Administrator presented..a report on the need for an official policy establishing the proper sequence for the development and approval of plans and specifications for municipal projects. He recommended ap- proval of the proposed policy as.recently forwarded to each Council- man. On motion by Kaufman, Council adopted the policy as submitted by the City Administrator and authorized the City Administrator to be re- sponsible for the administration of said policy. Motion carried. y STATE EMPLOYEES' RETIREMENT CONTRACT On motion by Green, Council authorized the execution of a contract with the State Employees' Retirement System for Actuaries performed from June 30, 1966 through.September 30, 1970, by the Mayor and City Clerk. Motion carried: PRELIMINARY SURVEY - . SLA.TTERY On motion by Kaufman,.Council, directed the Administrator to contact Mr.. Waiter Slattery and request that a the survey be conducted to determine deficiencies in the downtown area. Motion carried. .OIL IN RESIDENTIAL AREAS On motion by=Kaufman,,Council directed. the Planning Commission to study oil zones in resi,dential,areas,not being used for oil purposes, with the thought of deleting said .zoning. 'a. letter ;f"m' the 'funt ngton•- Harbour Property Owners Association, Incorporated, recommending greater enforcement of Section 9106.5 of the Huntington Beach Ordinance Code relative to the Parking of trucks, trailers, campers and boats in front of prop- erty. On motion by Gisler, Council deferred action on this matter until the next meeting. Motion carried. RECONSIDERATION - DEDICATION OF STREETS The Clerk presented a letter from the Board of Directors of Surfside Association No. 1 requesting permission to address Council and asking for reconsideration of their offer to dedicate streets to the City in Tract 5581. No action was taken on this matter, as there were no representatives of the Association present to discuss the request. `�L -COMPLAINT - WESTMINSTER-AMBULANCE SERVICE The Clerk presented a letter from Mrs. Jean Chastain, City, protest- ing business ethics used by the Westminster Ambulance Service. On motion by Coen, Council instructed the Administrator and Staff to investigate the business practices of the Westminster Ambulance Service and report back to Council. Motion carried.' .NOISE ORDINANCE - CLARIFICATION The Clerk presented a letter from Mr. J. H. Satterwhite, American Stone Products, 19731 Beach Boulevard, City, regarding complaints from neighbors to noise emanating from the conduct of his business. Mr. Satterwhite addressed the Council and discussed the problem with them. 06,.motion by Shipley, Council directed the City Clerk to file the litter from Mr. Satterwhite. Motion carried. � �ALIC HEARING - ZONE CASE 66-39 - APPEAL - DOYLE DEV CO Mayor Stewart announced that this was the day and hour set for a public hearing on Zone Case 66-39, on property located on the south- east corner of Goldenwest Street and Edinger Avenue, and directed the Clerk to read the legal notice. The Clerk read notice of public hearing on Zone Case 66-39, as pub- lished in the Huntington Beach News on August 18, 1966, setting the hour of 7:30 P.M. or as soon thereafter as possible, on Monday, the 19th day of September, 1966, in the Council Chamber of the Civic Center, Huntington Beach, California, as the time and place for a pub- lic hearing for the purpose of considering an appeal to Zone Case No. 66-39, as amended by the Planning Commission, for a change of zone to regulations of the Districting Ordinance, from RA Residential Agricultural District to R1. R2, and R3, rather than C2, R3 and Rl, as petitioned for. The Clerk informed the Council that they had been provided with copies of the Planning Director's transmittal, recommending approval of Zone Case 66-39 as amended, and stated that he had received the letter of appeal from Doyle Development Company and had received no further communications or written protests to the Zone Case or to the recom- mendation of the Planning Commission. Mayor Stewart declared the hearing open. On motion by Kaufman, Council continued the public hearing on Zone Case No. 66-39 until the .meeting of October 3, 1966. The Clerk read notice of public hearing on Zone Case 66-44, as pub- lished in the Huntington Beach. News on September 1, 1966, setting the hour of 7:30 P.M., or as soon thereafter as possible, on Monday, the 19th day of September, 1966, in the Council Chamber of the Civic Center, Huntington Beach, California,.as the time and_:place for a public hearing for the purpose of considering an.appeal to the denial by the Planning Commission..of Zone Case No. 66-44, for a change of zone to regulations of the Districting Ordinance from R3 Limited Multiple Family Residence District, to R5 office -Professional District. The Clerk informed the Council that they had been provided with copies of the Planning Director's transmittal-,, recommending denial of Zone Case 66-44. The Clerk then read the letter of appeal from Jerry Nelson, and stated that he had received a communication from Mr. Wilbur W. Lorbeer, an adjacent property owner, -requesting the Council to sustain.the Planning Commissions' denial. Mayor Stewart declared the hearing open. Mr. B. G. Williams, 419 Main Street, City, addressed the Council, and informed them of the applicants use for the property and their need for this zone change. There being no one further_ present to speak on the matter, and there being no further.protests, either oral or written, the hearing was closed by the Mayor. On motion by Green, Council sustained the recommendation of the Planning Commission and denied Zone Case.66-44. Motion carried. The Clerk read notice of. public hearing on Zone Case 66-46, as pub- lished in the Huntington Beach News on September 8, 1966, setting the hour of 7:30 P.M., or as soon thereafter as possible, on Monday, the 19Lh day of September, 1966, in the Council Chamber of the Civic Center, Huntington Beach, California, as the time and place for a public hearing for the purpose of considering a petition for a change of zone to regulations of the Districting Ordinance, from R2 Two Family Residence District, to Cl Neighborhood Commercial Dis- trict, with setback provisions. The Clerk informed the Council that they had been provided with :. a copy of the Planning Director's transmittal recommending denial of Zone Case 66-46, and stated that he had received no communications or written protests to the Zone Case or to the recommendation of the Planning Commission. The Clerk informed the Council that this zone case had been set for public hearing in error, as a public hearing is not required when the Planning Commission has recommended.denial; that he had received, in the meantime, an appeal to the recommendation of the Planning Com- mission filed by the applicants for the zone change. He further in- formed Council that the appeal had been filed in the manner required by-law, and that the necessary fee had been paid. Mayor Pro-tempore declared the hearing open. Following discussion on the appeal filed by Tic Toe Market, Council directed the City Clerk to publish notice of hearing on the appeal to Zone Case No. 66-46. There being no one present to speak on the matter, the hearing was closed by the.M-ayor. On motion by Kaufman, Council sustained the decision of the Planning Commission, pending the hearing on the appeal to Zone'Case 66-46. Motion carried. The Clerk read notice of public hearing on Zone Case No. 66-47, as published in the Huntington Beach News on September 8; 1966, setting the hour of 7:30 P.M., or as soon thereafter as possible, on Monday, the 19th day of September, 1966, in the Council Chamber of the Civic Center, Huntington Beach, California, as the time and place for a public hearing for the purpose of considering a petition for a change of zone to regulations of the Districting Ordinance , from RA Re- sidential Agricultural District, to C2 Community Business District, with setback provisions. The Clerk informed the Council that -they had been provided with copies' of the Planning Director's transmittal recommending approval of Zone Case 66-47, and stated that he had received no communications or written protests to the Zone Case or to the recommendation of the Planning Commission. On motion by Bartlett, Council directed the City Attorney to prepare an Ordinance effecting the change of zone in Zone Case 66-47. Motion carried. PUBLIC HEARING - MASTER PLAN AMENDMENT NO 66-3 - APPROVED Mayor Stewart announced that this was the ,day and hour set for a pub- , lic hearing on Master Plan Amendment 66-3, and directed the Clerk to read the legal notice. The Clerk read notice of public hearing on Master Plan Amendment 66--3 as published in the Huntington Beach News on September 8, 1966, setting the hour of 7:30 P.M., or as soon thereafter:as possible, on Monday, the 19b day of September, 1966, in the Council Chamber of the Civic Center, Huntington Beach, California, as the time and place for a pub- lic hearing for the purpose of considering an amendment to the Master Plan of Land Use --Study Area 1, which will guide the future develop- ment of that portion of the City lying within the area bounded by Ellis Avenue on the north, Pacific Ocean on the south, Santa Ana River on the east and Beach Boulevard on the west. The Clerk informed the Council that they had been provided with copies of the Planning Director's transmittal recommending approval of the Master Plan Amendment 66-3, and stated that he had received no com- munications or written protests to the Master Plan Amendment or to the recommendation of the Planning Commission. Mayor Stewart declared the hearing open. There being no one present to speak on the matter, and there being no protests filed, either oral or written, the hearing was closed by the Mayor. On motion by Green, Council sustained the recommendation of the Plan- ning Commission and directed the City Attorney to prepare a Resolution effecting the change in Master Plan Amendment 6+6-3. Motion carried ,1/ ULI -- BEAUTIFICATION OF BEACH On motion by Kaufman, Council adopted the Urban Land Institute Citi- zens' Steering Committee's proposed beautification development plan for the 1.04 miles of City beach front. Motion carried. RECESS Mayor Stewart called a recess of the Council at 9:40 P.M. for an exe- cutive session for the purpose of considering applicants for the Plan- ning Commission. Council was reconvened at 10:45 P.M. by the Mayor who announced that it was the unanimous decision of the City Council to appoint Roderick L. Royer to the Planning Commission. On motion by Green, Council con- firmed the appointment of Roderick L. Royer, as a member of the Hunt- ington Beach Planning Commission to fill an unexpired term ending September 7, 1969. Page #12 - Minutes, September 19, 1966 DRAINAGE IN CITY STREETS Councilman Green informed the Council that he had been receiving many telephone calls on the drainage provided on City streets, and he had noted many places where the water sits in depressions and along the curb. He asked the City Administrator to explain how new tracts could be approved by the Engineering Department with drainage that would permit this situation. On motion by Green, Council directed the Administrator to have the staff check this drainage situation with the Public Works Department, and provide information on how to remedy same. Motion carried. BEAUTIFICATION OF CORNER - SPRINGDALE AND EDINGER Councilman Coen brought up a matter of a piece of City owned property at the northwest corner of Springdale street, and Edi er Avenue be- tween the street right--of-way and the flood 'Obntrol ''cannel, and asked that some consideration be given to providing landscaping or beautification in this area. No action was taken by the Council. MAYOR STEWART OUT OF COUNTRY Mayor Stewart requested permission to'be out of the Country for ap- proximately three weeks beginning September 20, 1966. On motion by Shipley, Council approved the request of Mayor Stewart to be out of the Country. Motion carried. INFORMAL MEETING Mayor Stewart called an informal meeting of the City Council as an informal Committee -of -the -Whole for Wednesday, September 28, 1966, at 9:00 F.M., to interview applicants for the Architectural Review Board.
