The Secretary read a letter submitted by James F. Croul, representing the applicant, requesting a continuation to October 18, 1966. Planning Commission Tuesday, September 20, 1966 RESOLUTION NO. 66-48 A Resolution of the City Planning Commission Recommending Denial of Zone Case No. 66-45 to the City Council. A MOTION WAS MADE BY TOM AND SECONDED BY LARKIN TO ADAPT RESOLUTION NO. 66-48 RECOMMENDING DENIfiL OF'ZONE CASE,NO. 66-48 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Approval of this request would constitute spot zoning. 2. This request does not conform to the Master Plan of Land Use. 3. The property included in this zone change is located approximately mid -block on a residential street. ROLL CALL VOTE: AYES: Miller, Bazil, Worthy, Larkin, Tom, Royer. NOES: None. ABSENT: None. ABSTAINED: Lawson THE RESOLUTION WAS ADOPTED. USE VARIANCE NO, 66-35 , Continued To allow construction of a nursing Applicant - James L. Rubel home in the R-2 District. The Secretary informed the Commission that they had referred this agenda item to the Hospital Planning Association of Southern California for a determination of need and necessity. There being no other comment, the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 66-35 WITH THE FOLLOWIN CONDITIONS: 1. Newman Street shall be dedicated and fully improved to City Stand . Additional right-of-way shall be provided through an easement agree - went at the east end of the cul-de-sac. Said easement agreement shall be approved by the Department of Public Works and it shall provide for a future street extension to the north, when required. 2. Drainage fees shall be paid. 3. All provisions of Title 19 of the Fire Prevention Code shall be complied with. 5. All walls shall comply with Section 9730.17. 6. All utilities shall be installed underground. 7. A new plot plan,i,ncgrporating the foregoing conditions shall be submitted for Planning Department approval prior to issuance of any building permit. AND FOR THE FOLLOWING REASONS: I. The proposed nursing home is located near the Huntington Inter - Community Hospital. 2. The property is adjacent to a church site and cemetery. 3. There being no other comment, the hearing was closed. The Secretary informed the Commis- sion that the applicant has expanded his operation into a trailer and wants Planning Commission approval because the'Huntington Beach Ordinance Code prohibits this type of temporary use. He further pointed out that a temporary use of this nature has never been granted in the past and decision to do so would be very unfair to all other property owners that have been required to stand the expense of street improvements and construction of permanent structures. -3- 9/20/66. ROLL CALL VOTE: AYES: Larkin, Worthy, Bazil, Lawson, Tom. NOES: Royer, Miller, ABSENT: None. THE MOTION CARRIED. USE VARIANCE NO. 66-42 Applicant - Darold W. Baker submitted by Harold V. Bragg, California, objecting to Use the Secretary. To permit a day nursery in the C-2 Community Business District. The Secretary read a letter 5540 East 6th Street, Long Beach, Variance No. 66-42. The following adjacent property owners addressed the Commission and objected to the proposal: Mrs. Vena Bragg, 5540 East 6th St., tong'.'Beach, Henry R. and Florence Dabney, 122 Via Ithaca, Newport Beach, Wendell H. Porter, 1893 N. Shaffer, Orange and L. J. Daly, 80 Huntington Street, Huntington Beach. Darold W. Baker, applicant, addressed the Commission and gave his reasons for the request. There being no other comment, the hearing was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE USE VARIANCENO. 66-42 UPON.THE.,. FOLLOWING CONDITIONS: 1.- All provisions of Section 9231.3 shall be complied with. 2. All provisions of 'Title 19 of the Fire Code shall be complied with. 3. All provisions of Article 979 shall be complied with. 4. Drainage fees shall be paid. 5. All utilities shall be installed underground. 6. Aldrich street shall be ,fully improved to City Standards. 7. ABSENT: None. THE MOTION CARRIED. INFORMATION: The Secretary infromed the Commission that the City Council had instructed them to initiate zone changes that would remove the "0" designation from property that does not have oil production on it. CHAIRMAN BAZIL Chairman-Bazil suggested that the Building Department investigate the parking s}tuatioa pertaining to Use Variance,No. 66-25. This variance was granted for a period of 60 days so the applicant could provide the required off-street parking.
