BOARD MEMBERS PRESENT: John Mandrell, Richard Harlow,
Sam Ferguson.
BOARD MEMBERS ABSENT: None.
MINUTES: The minutes of September 14 and 21,
1966 meeting were accepted as trans-
cribed.
AREA VARIANCE NO. 66-59
Applicant: Harold S. Muggeridge
To allow a breezeway to be con-
structed between a main building and a detached garage
having a 61 rear yard setback in deviation to the required
10' rear yard setback. Located on the north side of Heil
Avenue, 70.70' east of Clubhouse Lane and legally described
as Lot 13 of Tract 3647.
The hearing was opened to the audience,
there being no comment, the hearing was closed.
Board discussion followed.
It was noted by the Board that the
code is in the process of being amended to allow this type
of request.
A MOTION WAS MADE BY HARLOW AND SECONDED
BY MANDRELL TO APPROVE AREA VARIANCE NO. 66-59 FOR THE FOLLOWING
REASON:
1. The code is in process of being amended to allow this type
of request.

AREA VARIANCE NO. 66-60
Applicant: Star Dust Lands, Inc.
To allow roof overhangs to encroach
into the 30" setback required for architectural features.
Located on the north side of Yorktown Avenue, 510' east of
centerline of Beach Boulevard and legally described as Lots
95 235 375 395 405 43, 45, 52, 573 67 of Tract No. 6239, and
Lots 6, 155 24, 26, 31, 353 40, 435 51, 545 55 of Tract 6302.
The hearing was opened to the audience.
Merle Moler, representing the applicant,
explained the reasons for the request. _He stated that the homes
in,Tract No. 6239 were already under construction and it would
present a hardship if they were required to cut back the roof
overhangs.

It was noted by the Board that the eaves on
Tract No. 6302 should conform to the proposed Code Amendment.
There being no further comment, the hearing was

A MOTION WAS MADE BY FERGUSON AND SECONDED BY
MANDRELL TO APPROVE AREA VARIANCE NO. 66-60 SUBJECT TO THE FOL-
LOWING CONDITION:
1. On Tract No. 6302 the eaves may project to within 18 inches
of the side lot line for a distance of 12 feet measured from
the beginning of the eave return at the front of the house.
FOR THE FOLLOWING REASONS:
1. The encroachment on Tract 6239 does not interfere with the
light and ventilation of the homes and there is a 4 foot
separation between facias of adjoining buildings.

NOES: None.
ABSENT: None.

AREA VARIANCE NO. 66-61
Applicant: Charles S. Geers
To allow 16 off-street parking spaces for a retail
commercial use in deviation to the 19 spaces required in the C-4
zone. Located on the south side of Adams Avenue, 125 feet west
of Huntington Avenue, and legally described as the north 2 of Lot
14, Tract 73.
Mr. Charles Geers, the applicant, explained the
reasons for the request. He stated that he will expland his
development to the east and provide more parking spaces when the
oil wells are removed.
There being no other comment, the hearing was closed
to the audience.

A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL
TO APPROVE AREA VARIANCE NO. 66-61 SUBJECT TO THE FOLLOWING CONDITION:
1. The additional 3 parking spaces shall be provided when the
property to the east is developed.
FOR THE FOLLOWING REASONS:
1. This type of use does not require off-street parking at the
same ratio as a business devoted entirely to retail sales.
2. There are tandem parking spaces available for the employees.
3. Truck and equipment parking is available inside the building.
4. The property to the east is owned by the applicant and will
be used for expansion of this development.

AREA VARIANCE NO. 66-62
Applicant: Air -Vent Aluminum Awning Company
.To allow an addition to a main dwelling
to encroach to within 82 feet of the rear property line in
deviation to the required 10' rear yard setback and to reduce the
required minimum 900 sq. ft. of required open space to 638 sq.ft.
Located on the north side of Redgrove Circle,.380 feet west of
Oakmont Lane and legally described as Lot 22 of Tract 4324.
The hearing was opened to the audience.
Tom Stapp, representing the applicant,
explained the reasons for the request and stated that this was
the only feasible location for the patio due to the location of
the sliding glass doors.
There being no further comment, the
hearing was closed to the audience.

A MOTION WAS MADE BY MANDRELL AND
SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 66-62 SUBJECT
TO THE FOLLOWING CONDITION:
1. The posts shall be set back a minimum of 10 feet of the
rear property line.
FOR THE FOLLOWING REASONS:
1. Although the open space does not have a minimum dimension
of 20 feet, the 16 x 50 foot side yard provides ample yard
area to •offset that requirement.
2. An area of 638 sq. ft. having a minimum dimension of 22 feet
is provided in addition to the 16 x 50 foot area.

BY MANDRELL TO DENY AREA VARIANCE NO. 66-63 FOR THE FOLLOWING
REASON:
1. The applicant can build the addition and still meet the
standards of the ordinance without a hardship.,

AREA VARIANCE NO. 66-64
Applicant: Neal T. Baker
To allow the following exceptions to
Article..979, Off -Street Parking: (1) the waiver of the required
landscaping adjacent to a public street, (2) placement of the
32" high screen wall adjacent to the property"Line in'deviation
to the required 31 setback and (3) two driveways to be less than
the required 20 feet in width, each drive to be one way. Located
on the northeast corner of 5th Street and Ocean Avenue and legally
described as the west 15 feet of Lots 1, 2 and 3 of Huntington
Beach Tract.
Mr. Neal T. Baker, the applicant, explained
the reasons for''the request. He state & that this is a drive-thru
Taco Restaurant, and although the parallel parking indicated along
5th Street is not required it is desirable. He also hated that
rather than provide one two-way driveway on Ocean Avenue, he is
proposing two one-way drives to facilitate the traffic situation.
The applicant, and the Board discussed
various ways to alter the plot plan to''con£orm to the City Ordi-
nance.
There being no other comment, the hearing
was closed.

A MOTION WAS MADE BY'HARLOW-AND SECONDED
BY MANDRELL TO APPROVE USE PERMIT NO. 66-28 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. Beach Boulevard shall -be fully improved to State
Standards across the entire parcel and across the
20' wide easement. Improvements shall include
street trees, street signs, and street lights.
2. Water supply shall be through the City of Huntington
Beach's water system.
3. The property shall participate in the local drainage
assessment district.
4. Preliminary and final soil reports shall be submitted
by an approved private soils engineer to the City prior
to issuance of a building permit.
5. A plan conforming to the grading ordinance shall be sub-
mitted to the Department of Public Works for approval prior
to issuance of a building permit.
6. All utilities shall be installed undergroud.
7. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
8. Off-street parking facilities including landscaping,
arrangement, access, paving and striping shall conform
to Article 979.
9. A masonry wall shall be constructed along the west property
line. The height of said wall shall be such, that the top
will be six (6) feet above the highest ground surface within
twenty (20) feet of the common property line.
FOR THE FOLLOWING REASON:
1. This is a permitted use in the C-4 zone.

AREA VARIANCE -NO. 66-65
Applicant: Security Tire Company
- To allow 9 off-street parking spaces in
deviation to the 14 spaces required for commercial uses
in the C-4 zone. Located on the west side of Beach Boule-
vard and 262 feet north of Yorktown Avenue. Legal des-
cription on file.
The hearing was opened to the audience.
Carl Shebbondy, the applicant, explained
the request. He stated that there were 4 additional parking
stalls in the building and 4 under the canopy.
Board discussion followed.
It was noted by the Board that this type
of use is similar to a service station therefore it does
not require as much off-street parking as a business devoted
entirely to retail sales.

A MOTION WAS MADE BY HARLOW AND SECONDED BY
FERGUSON TO APPROVE AREA VARIANCE NO. 66-65 FOR THE FOLLOWING
REASONS:
1. This type of use is similar to a service station, thus it
requires less parking spaces than a business devoted
entirely to retail sales.
2. The main portion of the building is used for parking
automobiles.
ROLL CALL VOTE:
AYES: Mandrell, Harlow, Ferguson.
NOES: none
ABSENT: none
THE MOTION CARRIED.
PLOT PLAN AMENDMENT NO. 66-2
Applicant: American Building_ Center
To permit the use of a portion of the parking
lot for the display of landscaping and building materials.
Located on the east side of'Beach Boulevard, 1113 feet north
of Yorktown Avenue. Legal description on file.
The applicant,. Gus Rigoli, gave his reasons
for the request.
It was noted that the materials stored in the
parking lot could be moved to the rear of the property, and
some type of fencing could be used to screen the materials.
There being no further comment, the hearing
was closed to the audience.
Further Board discussion followed.
A MOTION WAS MADE BY FERGUSON AND SECONDED
BY MANDRELL TO APPROVE PLOT PLAN AMENDMENT NO. 66-2 SUBJECT
TO THE FOLLOWING CONDITIONS:
1. The display areas shall be moved behind the main entrance.
2. Fencing shall be installed to screen the stored
materials from the street.
3. The material stored on pallots shall not exceed one pallot
in height and width; shall be relocated along the north
property line behind the main entrance and shall be en-
closed on the top and sides.
4. The display area along the building shall .not extend more
than 20 feet from the building.
5. 3% of the property shall be landscaped.
6. The trailer shall be moved to the rear of the building.
