Monday, October 3, 1966
In the absence of Mayor Stewart, Mayor Pro-Tem Shipley called the reg-
ular meeting of the City Council of the City of Huntington Beach to
order at 4:30 P.M.
The Pledge of Allegiance was given by all present in the Council Cham-
ber.
The invocation was given by Reverend Frank Brickley, Minister of the
Nazarene Church.

MINUTES
On motion by Kaufman, the minutes of the regular meeting of September
197 1966, were approved and adopted as prepared by the Clerk and mailed.
Motion carried.

ZONE CASE NO 66-48 - PALMER - STELLRECHT
The Clerk presented a transmittal from the Planning Director of Zone
Case No. 66--48 on property located on the east side of Cameron Street,
1000' south of Slater Avenue, for change of zone from R2 to R5. The
Planning Commission had recommended denial of said Zone Case.
On motion by Kaufman, Council sustained the decision of the Planning
Commission and denied Zone Case 66-48. Motion carried.

CC-036 - NOTICE OF COMPLETION - STEINY & MITCHELL, INC
'On motion by Bartlett, Council accepted the work as completed on Pro-
ject CC-036 - si realization of Brookhurst Street at Hamilton Avenue,
Magnolia Avenue Cannery Street) at Adams Avenue, and Edinger Avenue
at Edwards Street, and directed the City Clerk to file a Notice of
Completion with the Orange County recorder. Motion carried.
CC-038 - NOTICE OF COMPLETION - STEINY & MITCHELL, INC
On motion by Kaufman, Council accepted the work as completed on Pro-
ject CC-038 - signalization of Bolsa Chica Street at °Edinger Avenue
and Bolsa Chica Street at Warner Avenue, and directed the City Clerk
to file a Notice of Completion with the Orange County Recorder. Motion

C6-SCI - PURCHASE -OF -RIGHT-OF-WAY
The Clerk presented a communication from the Director of Public Works,
requesting Council's authorization to proceed with negotiations to pur-
chase a strip of property adjacent to Beach Boulevard between Warner
Avenue and Slater Avenue, for a storm drain channel designated as
C6-SCl, for the amount of $637.00.
On motion by Kaufman, Council approved the purchase of the strip of
property for storm drain purposes, and authorized the Director of Pub-
lic Works to proceed with acquisition of the necessary property.

` REIMBURSEMENT - OFF -SITE SEWER FACILITY - MEREDITH CONSTRICTION CO
The Clerk presented a communication from the Director of Public Works
covering reimbursement for a sewer facility from the Sewer Pump Sta-
tion No. 17 Fund, in the amount of $2,513.47 payable to Meredith Con-
struction Company, and transmitting Resolution No. 2443 - "A RESOLU-
TION OF THE CITY COUNCIL OF HUNTINGTON BEACH AUTHORIZING THE EXPEND-
ITURE OF MONEY FROM THE SEWER PUMP STATION NO. 17 FUND."
On motion by Kaufman, Council waived further reading of Resolution
No. 2443, and adopted same by the following roll call vote:

`�USOUTHERN CALIFORNIA EDISON COMPANY - GRANT OF EASEMENT
The Clerk presented a letter from the Southern California Edison Com-
pany requesting an easement on two strips of land; owe six feet and
one two feet in width, for electric and communication lines ease of
Brookhurst, south of Indianapolis.
On motion by Bartlett, Council granted an easement to Southern Calif-
ornia Edison Company and authorized the Mayor and City Clerk to ex-
ecute the Deed on behalf of the City. Motion carried.

The Clerk presented a request from SDC Incorporated for rescinding of
approval of Final Tract Map. 5500 and. for authorization for refund of
the difference in business license fees applicable when refilled for a
smaller number of lots.
On motion.by Kaufman, Council deferred this matter to a later time and
instructed the City Administr.ator.to study same. Motion carried.
TAX COLLECTOR-S SALE #992
The Clerk presented a letterfromthe Orange.County Tax Collector re-.
questing that the City consent or object.to the sale of property located
on Block 117, Lots 19 and 21 -.northwest corner of Walnut Avenue and
17t Street and designated.T.0 #992, with the condition that the City
must meet a minimum bid of $6,.000.
On motion by Green, Council directed the City Clerk to notify.the
County Tax Collector of. the City's objection to T. C. Sale #992,. and
authorized the Mayor and City Clerk to..exe,cute an%Agreement to Purchase
Lots 19 and 21 in Block 117, far the .minimum bl`d of $6,000. Motion
carried.

HUNTINGTON BEACH ELEMENTARYSCHOOL GYMNASIUM BUILDING.
The Clerk presented a letter from the. Huntington Beach.Elementary
School District .requesting indication from Council as to whether the
City would be interested in taking.over the Gynmasium.Building'
Mr. Al Moffett, Superintendent of.the..School.District, addressed the.
Council and explained the School-Di.strict'.s situatien.and suggested
the Council or the School District not act in haste in the matter.
On motion by Bartlett, Council instructed the.City Administrator to
write the School Board to express...Coune.il's,interest in cooperating
in resolving,the.problem relative t.o.the.:.Gynasium Building ' Motion
carried.
TOWING & IMPOUND SERVICE
The Clerk presented a letter from.Thomas E. Nelson, City, requesting
that Council limit the number of Official Towing and Impounding Serv-
ices operating on behalf of the,City to 'two.
On motion by Green, Council deferred.action on Official Towing &.
Impounding Services until the -next meeting. Motion carried.
CLAIM NO 15-66'- JEANNE ELIZABETH,& HELEN K,HOWARD
The Clerk presented a claim from.Jeanne Elizabeth and Helen K. Howard
for damages caused by alleged dangerous; road conditions in the vicinity
of Bolsa Chi.ca S`t et� and Heil. Avenue, filed. by Attorney Timothy Me
Thornton on behalf of the. cla mrwt.1-s ,
On motion by Coen, Council denied.the.clai.m fi.l.ed by Attorney Timothy
M. Thornton on behalf of Jeanne,, Elizabeth. and Helen K. .Howard, and
referred same to the City Attorney And.the'City'.s insurance carrier.

OIL & GAS LEASE STANDARD OIL COMPANY OF CALIFORNIA
The City Administrator presented.a Subsurface Oil and Gas lease- with
Standard Oil Company of California on various City. Lots in Blocks 812,
911, 813 and 913-Wesley Park Section, Huntington Beach, and known as
Lake Park - for approval,
On motion by Bartlett, Council approved a Subsurface Oil and Gas Lease
with Standard Oil Company of California on said City property, and
authorized the Mayor and City Clerk to execute the lease_ on behalf of
the City. Motion carried.

ULI CITIZENS STEERING COMMITTEE INVITATION
The City Administrator presented an invitation from the Urban Land
Institute Citizens°Steering Committee for the Council, either collec-
tively or individually, to join them on various trips in the Southern
California Area and Fresno to review and investigate redevelopment
projects.
On motion by Kaufman, Council, directed the City Clerk to file the
letter from the ULI Committee. Motion carried..
ULI CITIZENS STEERING COMMITTEE - INCREASE TO SEVEN MEMBERS
The City Administrator presented a letter from the Urban land Institute
Citizens' Steering Committee requesting that they be furnished with a
list of those people who have applied for various City Boards and Com-
missions, so that the Urban Land Institute Committee may recruit two
additional members for their committees.
On motion by'Green, Council directed the City Administrator to furnish
the Urban Land Institute Citizens'Steering Committee with said list.
Motion carried.
ULI CITIZENS STEERING COMMITTEE - REQUEST
The City Administrator presented a letter from the Urban Land Institute
Citizens Steering Committee requesting that Council and Planning Com-
mission agendas and minutes.be mailed to each member of the Steering
Committee.,
On motion by Bartlett, Council authorized the mailing of agendas and
minutes to the Steering Committee members by the Planning Director
and City Clerk, and waived mailing changes therefor, Motion carried

ULI CITIZENS STEERING COMMITTEE - PROPOSED STUDY AREA
The City Administrator�pres.ented a letter from the Urban Land In-
stitute Citizens Steering.Committee submitting the Study.Ar.ea for
downtown redevelopment. Mr. John Costello, Administrative Liaison
to the Steering Committee gave a resumelof the study area.
On motion by Kaufman, Council approved the Study Area for downtown
redevelopment and directed that same be forwarded to the Department
of Housing and Urban Development with the letter requesting the
Preliminary Survey® Motion carried.
REQUEST .ENACTMENT OF ORDINANCE
The City Administrator presented a.letter from the Villa Pacific Com-
munity Association, requesting Council to enact an Ordinance which
would allow the Police Department to'enter their pr•ivate�streets and
issue citations.
Mr. Jack Jackson, President Villa'Pacific Community Association, ad
dressed the Council and asked Councils approval of this matter.
On motion 'by Gisler, Council ref Erred the request from Villa Pacific
Community to the Chief of Police to study and report back to Council.
Motion carried.
SOUTHERN CALIFORNIA EDISON COMPANY - GRANT OF EASEMENT
The City .Administrator presented a letter from the Southern California
Edison Company requesting an easement on one strip of land six feet
in width, for underground utilities. on Lot A in Tract 6302.
On motion by Gisler, Council granted an easement to Southern Calif-
ornia Edison Company, and authorized the Mayor and City Clerk to ex-
ecute the easement on behalf.of the City. Motion carried.

OFFER OF BUILDING TO CITY
The City Administrator presented an offer from Mr. Sol Sher, of a two
year old, 1200 square foot building, providing:'the City can move it
off the property by November 30, 1966. An'inspection by the Building
Department and Library revealed it to be adequate for a temporary
neighborhood library..
On motion by Green, Council.accepte'd the offer .of Mr. Sol Sher of the
1200 square foot building, with .appr.eciat.ion from the City, and di-
rected the City Administrator to have the building moved by November
30,. 1966. Motion carried.
BEACH.AND PIER CONCESSION.LEASES
On motion by Bartlett,Council directed the City Administrator to
notify each. leaseholder of beach and Maier concession leases of a
series of meeting dates in November to discuss lease :amendments..
Motion carried. The Mayor Pro-Tem appointed a.Committee of the
Council consisting of Councilmen Green,'Bartl:ett.,-and Coen.

PROPOSED -OIL SEVERANCE TAX
The Administrator informed the-C-ouncil.'that :sufficient research had
been.completed to seriously consider a new ordinance establishing an
oil production tax. Council deferred action on this matter until a
study session.be held on October .1.0,1966.
WESTMINSTER AMBULANCE.SERVICE
On motion by Gisler, Council.directed.the Police Department to dis-
continue use of service of the WestMinst6r�Ambutance'Service and in-
structed the Administrator to report on same at .the next study session.
Motion carried.
LUCIA LANE PEDESTRIAN EASEMENT
The City Administrator preg.ented the:prob'lem of the Lucia Lane Pedes-
trian Easement. Council determined that no action should be
until they had a chance to view the problem;. Council set the time of
6:30 P.M. on:Monday, October 10., 1966, to visit the site.
SUNSET BEACH SANITATION COMMITTEE
Because of the absence of.Mayor Stewart,:Mayor.Pr'o-Tem Shipley requested
Councilman Green to attend:with Councilman -Bartlett, a -meeting with the
Sunset Beach Sanitation Committee, to be held October 4, 1966 at 8:00
P.M., in the Firehouse in Sunset Beach.
HUNTINGTON BEACH FREEWAY
The City Administrator informed the Council of a meeting to be held by
the State Highway Commission at their offices in Los Angeles on October
11, 1966 at 10:00 A.M., in regard to the:propos-ed Huntington Beach Free-
way
ARCHITECTURAL REVIEW BOARD
On motion by Green, Council authori-ed.:the.following appointments to
the Architectural Review Board:

POLICE RECOMMENDATION - BEER BARS
On motion by Coen, Council directed the City Administrator to review
the Police Department's report on "beer, bars" with the intent of im-
plementink their recommendations aimed at controlling "beer bars" and
other businesses which create a police problem. Motion carried..
RECESS
Mayor Pro-Tem Shipley called a recess of the Council at 6.:00 P.M.
Council was reconvened at 7:40 P.M� by Mayor Pro-Tem. Shipley.
�'�AWARD PRESENTATIONS
Mayor Pro-Tem Shipley presented a Resolution of Commendation to the
Ocean View Little League All Star Baseball Team, for obtaining the
Southern California Little League Championship.
4�'PAVALON LEASE
Mr. J. T. French, leasee of the Pavalon Building, addressed the Council
to inquire if the City planned to repair damages to the Pavalon caused
by fire, and asked if the City would send his Attorney:copies of the
Insurance Policy and the Adjustor's Report relative to the building.
No action was taken on this matter.

Mayor Pro-Tem Shipley announced -that this was the day and hour set for
the continuance of a public hearing on Zone Case-66-39, which had been
previously opened at the meeting -of Septmeber 19, 1966, and continued
to the meeting of October.3, 1966.
On motion by Green,. Council continued action on Zone Case 66-39 to
the meeting of November. 7, 1966. Motion carried.
PUBLIC HEARING - ZONE CASE NO 66 46,- APPEAL TIC-TOC MARKETS,.INC1.
Mayor Pro-Tem Shipley announced that this: was the day.and hour set for
a public hearing on Zone Case 66'-46, on property located north of Heil
Avenue and 110 feet.west of Beach Boulevard, and directed the Clerk to
read the legal notice.
The Clerk read notice of public. hearing on ZoneCase 66-46, as pub-
lished in the Huntington Beach News on September 22, 1966, setting the
hour of 7:30 P.M. or as soon thereafter as possible-, on' Monday, the
3rd day of October, 1966, in the -Council Chamber of the Civic Center,
Huntington Beach, California, as the time..and place for a public hear-
ing for the purpose of considering an appeal to the denial by the City
.Planning Commission of Zone Case No. > 66-46, for a change of zone to
regulations.;vf the Districting Ordinance from R2 Two Family Residence
District, to Cl Neighborhood Commerical District, with setback pro-
visions..
The Clerk informed the Council that they had.been provided Frith copies
of the Planning Director's transmittal recommending denial of Zone
Case 66-46. The Clerk then read the letter.df appeal from Tic--Toc
Markets, .Incorporated., and stated that he had received a communication
and petition from twenty-six property owners in the area requesting -
Council to overrule the Planning Commissions' denial of,Zone Case 66-49.
Mayor Pro-Tem Shipley declared the hearing...open.
Mr. Fred Barbour, Tic-Toc Markets, addressed the Council and presented
the proposed use for the property and requested Council to authorize
the approval of Zone Case 66-46.
There being.no one further to speak on the matter, and there being na _
further protests; either oral or written', the:hearing was closed by the
Mayor.
A motion was made by Gisler that Council overrule the Planning Commis-
sions' decision and approve Zone Case 66�-46. The motion failed by the
following roll call vote:

Mayor Pro-Tem Shipley announced that this was the day and.hour set
for a public hearing on a proposed change of street name from 23rd
Street to Golden West Street, and requested the Clerk tv read the
legal notice.
The Clerk read notice of public hearing on a proposed change of street
name as published in the Huntington Beach News on September 22, 1966,
setting the hour of 7:30 P.M. O'clock P.M., or as soon thereafter as
possible, on Monday, the 3rd of October, 1966, in the Council'Chamber
of the City Hall, Huntington Beach, California, as the time and place
for a public hearing for the purpose of considering a change of street
name from 23rd Street to Golden West Street, in the City of Huntington
Beach, California.
Mayor Pro-Tem Shipley declared the hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor.
On motion by Bartlett, Council directed the City Attorney to prepare
a Resolution effecting the change of street name from 23rd Street to
Golden West Street. Motion carried.

INOPERABLE VEHICLES
Mr. Dave Robison, 6442 Brown Circle, City, addressed the Council and
asked if anything could be done about inoperable vehicles in front
of houses. The Building Director informed Council that notices.of
violation had been issued in this area. Attorney Bush stated that
the proposed Ordinance covering this matter was being prepared by
his office. -No action was taken on this matter.
COMPLAINT
Mr. George Arnold, 421 - 8Lh Street, City, addressed the Council and
informed them that a junked car had been sitting near his residence
for five weeks and nothing had been done to remove it. No action was
taken in this matter.
