HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: John Mandrell, Sam Ferguson, Richard
Harlow.
BOARD MEMBERS ABSENT:. None.
AREA VARIANCE NO. 66-67
Applicant: Albert B. Bradbury
To allow an addition to a main dwelling
to encroach to within 616" of the rear property line in deviation
to the required 10' rear yard setback. Located at 17124 Edge-
water Lane, Huntington Beach and legally described as Lot 52
of Tract 4880.
The hearing was opened to the audience.
Mrs. Albert Bradbury, the applicant,
explained the reasons for the request.
Mrs. Florence Wells, adjacent property
owner, addressed the Board and stated that she had no objections
to the request.
It was the consensus of the Board that
since there was an 81 high embankment on the rear of the property
as well as a 61 high fence on top of the slope, there was adequate
separation between the houses.
The hearing was closed to the audience.
Further Board discussion followed.
A MOTION WAS MADE BY MANDRELL AND SECONDED
BY FERGUSON TO APPROVE AREA VARIANCE NO. 66-67 FOR THE FOLLOWING
REASON:
1. The difference in elevation allows adequate separation between
dwellings.
ROLL CALL VOTE:
AYES: Mandrell, Ferguson, Harlow.
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
USE PERMIT NO. 66-29
Applicant: Edward Illi
To allow the construction of a restaurant
in the C-4 zone. Located on the east side of Beach Boulevard,
9441 north of Garfield Avenue. Legally described as a portion
of the south 2 of the north 2 of the NW4 of the SW4 of the SW4
of Section 36-5-11.
The hearing was opened to the audience.
Mr. Robert Johnson, manager of the pro-
posed restaurant, explained the request to the Board.

John Mandrell explained that there is an assessment
district in the process of being formed for that area. He stated that
the drainage will eventually be to the east toward Newland Street, but
due to weather conditions during the winter months, construction will
be delayed for approximately 6 months.
Edward Illig, the applicant, asked various
questions pertaining to the drainage.
It was noted by the Board that a -division of
land would have to be filed.
William G. Dryden, Engineer for the proposed
restaurant, answered various questions asked by the Board.
The suggested conditions of approval were
reviewed.
Mr. Illig found the conditions of approval
acceptable. T.,
Mrs. -Champion, representing A. R. E. Room,
questioned the Board about the width of Constantine Drive.
There being no further comment, the hearing
was closed to the audience.
Further Board discussion followed.
A MOTION WAS MADE BY HARLOW AND SECONDED BY
MANDRELL TO APPROVE USE PERMIT NO. 66-29 SUBJECT TO THE FOLLOWING
CONDITIONS:
1. Constantine Drive shall be improved to City Standards.
2. Beach Boulevard shall be fully improved to State Standards.
-Improvements shall include street trees and street lights.
3. All permanent streets shall conform to City of Huntington
Beach Standards. Master plan of Arterial Streets and High-
ways Standards shall apply where applicable. Street sections
shall be determined by soil 11R1' value and traffic index.
4. Water supply shall be through the City of Huntington Beach's
water system.
5. Sewage disposal shall be through the City of Huntington Beach'
sewage system upon formation of the assessment district.
6. The property shall participate in the local assessment district
6303.
7. Preliminary and final soil reports shall be submitted -by an
approved private soils engineer to the City prior to issuance
of building permits.
8. A plan conforming to the grading ordinance shall be submitted
to the Department of Public Works for approval prior to issuance
of a building permit.
9. All utilities shall be installed underground.
10. The water, sewer, and fire hydrant system shall be approved by
the Department of Public Works and Fire Department.
11. Off -Street parking facilities including landscaping, arrange-
ment, access, paving and striping shall conform to Article 979.
12. A division of land shall be filed prior to issuance of a building
permit.
13. No. structures, other than those shown on the approved plot plant,
shall be constructed within the project.

FOR THE FOLLOWING REASON:
1. This is a permitted use in the C-4 Zone.

AREA VARIANCE NO. 66-68
Applicant: Edward IMP
To permit a canopy for a commercial
building to project 41 into the required 50' setback.
Located on the east side of Beach Boulevard, 9441 north
of Garfield Avenue. Legally described as a portion of
the south 2 of the north 2, NW4, SW4, SW4 of Section
36-5-11.
Mr. William G. Dryden, Engineer for
the applicant, explained the request. He stated that
this is a standard type of building for Sir Georges
Restaurants.
There being no further comment, the
hearing was closed to the audience.
Board discussion followed.
It was noted by the Board that the
building is set back 57 feet from the property line and
encroachment of the canopy occurs for a distance of
16 feet at the center of the property, therefore it
does not cause any obstruction to abutting properties.
A MOTION WAS MADE BY HARLOW AND
SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO. 66-68
FOR THE FOLLOWING REASONS:
1. Encroachment is at the center of the property and
does not interfere with the visibility of abutting
properties.
2. There is adequate ground clearance.
3. The intent of the ordinance will be maintained.
ROLL CALL VOTE:
AYES: Mandrell, Ferguson, Harlow.
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
