MINES: On motion by Tom and seconded by Lawson, the Minutes of the Huntington Beach Plan- ning Commistion of September 27, 1966, were accepted as transcribed and hailed by the Secretary. COMMISSIONER LARKIN: Commissioner Larkin arrived at 7:40 P.M. and assumed his duties. TENTATIVE TRACT MAP NO. 5500 EXTENSION OF TIME The Secretary read the Subdivision Committee Report. A MOTION WAS MADE BY LAWSON AND SECONDED BY TOM TO APPROVE A ONE YEAR EXTENSION OF TIME UPON THE FOLLOW- ING CONDITIONS: 1. Approval of this Tentative Map shall be null and void unless Use Variance No. 66-49 is approved by the City Council. 2. All conditions of approval of the previous approved tentative map shall be complied with. ROLL CALL VOTE: AYES: Larkin, Miller, Lawson, Tom, Royer. NOES: None. ABSENT: Bazil, Worthy. A MOTION WAS MADE BY LAWSON AND SECONDED BY TOM TO RECOMMEND APPROVAL OF USE VARIANCE NO, 66-49 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS AS AMENDED: 1. All streets shall comply with standards proposed by the Department of Public Works and approved by both the Planning Commission (August 3, 1965) and City Council (September 7, 1965). 2. A tree, equivalent to a 30 inch box tree, as approved by the Park Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. John Horner:, representing the applicant, addressed the Commission and complained about the school district's method of holding out parcels of Land for school purposes. Mr. Horner asked that'the Staff request the school to file condemnation action on property proposed -for school sites prior to Planning Commission action. Commissioner Royer stated that he was concerned about the -design of.subdivisions, minimum lot sizes and the construction of walls along the highways. Mr. Royer suggested that Tentative Tract Map No. 5424-'be continued. Mr. Horner did not agree to a continuance. There being no other comment'the hearing was closed. A MOTION WAS MADE BY. TOM AND SECONDED BY LAWSON TO APPROVE TENTATIVE TRACT MAP NO. 5424 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received October 10, 1966, shall be the approved layout. 2. ROLL CALL VOTE: AYES: Lawson, Tom, Miller NOES: Larkin, Royer ABSENT: Bazil, Worthy THE MOTION DID NOT CARRY Pursuant to the provisions of the Planning Commission By -Laws the matter was automatically continued to November 1, 1966. TENTATIVE TRACT MAP NO. 5923 Applicant - Slater Development Co. The Subdivision Committee Report was read by the Acting Secretary. John Horner, representing the applicant, addressed the Commission, and stated that the property is zoned R-3 which permits high density development. But the subdivider is proposing to construct single family homes. He also stated that the Commission had approved a map with the same type of development, adjacent to the subject property. Warren. Hall, 9381 Nantucket Drive, Huntington Beach addressed the Commission and stated that he was not in favor of the Planning Commission making exceptions for such developments. There being no other comment the hearing was closed. A MOTION WAS MADE BY LARKIN AND SECONDED BY LAWSON TO APPROVE TENTATIVE TRACT MAP NO. 5923 UPON THE FOLLOW- ING CONDITIONS: 1. The Tentative Map received September 13, 1966, shall be the approved layout. 2. Approval of this Tentative Map shall be nulll and void unless Use Variance 66-47 is approved by the City Council. 3. "D" and "C" Avenues shall be 54 ft. wide. "F" Street and "E" Circle shall be 60 ft. wide at the tract entrance. 4. All public streets shall comply with City Standards. 5. A MOTION WAS MADE BY TOM AND SECONDED BY LAWSON TO RECOMMEND APPROVAL OF USE VARIANCE NO. 66-47 TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS: 1. All streets shall comply with standards proposed by the Depart- ment of Public Works and approved by both the Planning Commis- sion (August 3, 1965) and City Council, (September 7, 1965). 2. The minimum front yard shall be 10 ft. except the minimum front yard for garages entered directly from the street shall be 22 ft. This condition of approval is not general in nature and a precise plan shall be submitted to the Planning Department for approval prior to issuance of any building permits. Said plan shall delineate the house location on each lot. 3. A tree, equivalent to a 30 inch box tree, as approved by the Park Supervisor, shall be planted in the front yard of each lot and in the exterior side yard of each corner lot. 4. The minimum lot frontage shall not be less than 50 ft. wide with 5000 sq. ft. of lot area. An average lot width of 60 ft. of frontage with 6000 sq. ft. of lot area shall be provided for each six contiguous lots in a block. -7- 10/18/66. Page No. 8 Minutes: H.B. NO. 66-53 A Resolution of the City Planning Commis- sion Recommending Approval of Zone Case No. 66-53 to the City Council. A MOTION WAS MADE BY TOM AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO. 66-53 RECONA`ZENDINGAPPROVAL OF ZONE CASE NO. 66-53 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. Jack Ellsworth, applicant, addressed the Commission and gave his reasons for the request. Commission held a lengthy discussion. It was the consensus to continue Area Variance No. 66-49 to November 1, 1966, in order to further study the parking problems and zoning within the area. Mildred Stoney, applicant, addressed the Commission and stated that there were no objections to the conditions suggested in the Staff Report. There being no other comment the hear- ing was closed. A MOTION WAS MADE BY TOM AND SECONDED BY LARKIN TO APPROVE USE VARIANCE NO. 66-50 WITH THE FOLLOWING CONDITIONS: 1. Use Variance No. 66-50 shall expire October 18, 1971. 2. The applicants shall construct a trash and utility storage area at the north end of the building. Said storage area shall be enclosed with a 6 ft. high masonry wall. USE VARIANCE NO. 66-51 AND DIVISION OF LAND NO. 66-4 Applicant - Herbert D. & Anna Porter To allow a Dimension of Land into two separate parcels one of which does not abut a public street. The Acting Secretary read a letter submitted by the First Western Bank. The hearing was opened to the audience. Fenton Jones, representing the applicant, addressed the Commission and explained the reasons for the request. William Wamhoff, 18341 Pammy Lane, addressed the'Commission and stated that he did not want any streets to stub into Franklin Drive. There being no other comment the hearing was closed. The Acting Secretary informed the Com- mission that the division of land was prompted by separate fore- closure actions by Herbert Porter and the First Western Bank. He stated that the zoning on, the front parcel which is owned by First Western Bank is C-4 and has an approved use permit for an existing service station, and that the rear parcel is owned by Mr. Porter and is zoned C-4 on the front 137 feet and R-3 on the rear 311 feet. The Acting Secretary also informed the Commission that the traffic engineer stated that one access point on the north would suffice if the use of the rear parcel was known but inasmuch as it is unknown a second easement on the south would be preferred; if it is determined at a later date that the south easement was not necessary it could be taken care of when a use permit is issued. The Commission held a lengthy discussion. It was the consensus to continue the hearing on said matter to November 1, 1966, in order for Mr. Jones to consult with the First Western Bank to acquire an additional easement on said parcel. ZONE CASE NO. 66-51 RESOLUTION OF INTENT 1) 0-1 Neighborhood Commercial District to C-4 Highway Commercial District with setback provisions; 2) C.-2 Community Business District to C-4 Highway Commercial District with setback provisions; 3) R-1 Single Family Residence -District to C-4 Highway Commercial District with setback provisions; 4) C-2 Community Business District to R-3 Limited Multiple Family Residence District; 5) C-2 Community Business District to C-4 Highway Commercial District with setback provisions. Floyd Belsito, Associate Planner, addressed the Commission and made a presentation of the proposed zone change. The hearing was opened to the audience. James Booth, attorney for Dick Nerio, addressed the Commission and submitted a petition signed by 46 property owners objecting to one of the proposed zone changes from C-2 to R-3. The following property owners addressed the Commission and opposed the change of zone from C-2 to R-3: George Dedro, Agnes Merchant, T.V. Talbert, Albert Mayeo, Mr. Cedering, Tom Noe, Herbert Peterson and John Cook. There being no other comment the hearing was closed. The Commission held a lengthy discussion. RESOLUTION NO. 66-51 A Resolution of the City Planning Com- mission Recommending ,Approval of Zone Case No. 66-51 on Sub Items 1), 2), 3) and 5) to the City Council and Recommending Denial on Sub Item 4) to the City Council. A MOTION WAS MADE BY LAWSON AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO. 66-51 RECOMMENDING APPROVAL OF SUB ITEMS 1), 2), 3) and 5) TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. INFORMATION The Acting Secretary distributed copies of the location of the Freeway between Route 1 (Coast Highway) in Huntington Beach and Lampson Avenue in Garden Grove. No action was taken, MEMO FROM CITY ADMINISTRATOR The Acting Secretary distributed copies of a memo submitted by the City Administrator pertaining to an assembly committee hearing on government organization which took place on September 12-13 in Los Angeles. It was the consensus of the Commission to continue this item for further study. PROPOSED ORDINANCES The Acting Secretary read a proposed ordinance pertaining to parking in front of dwellings and a proposed ordinance relating to inoperable vehicles parked or stored on private property. -13- 10/18/66.
