BOARD MEMBERS ABSENT: None. DIVISION OF LAND NO. 66-24 Applicant: Deane Brothers, Inc. To allow a division of land into 3 ! separate parcels located on the southeast corner of Atlanta Avenue and Beach Boulevard. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Frank Richardson, representing the applicant, explained the reasons for the request. The suggested conditions of approval were reviewed. Mr. Richardson addressed the Board and questioned Condition No. 9 regarding installation of underground utilities. He stated that because of the excessive length and narrow width of the parcel, costs of installing under- ground utilities would be twice as much as it is for a normal commercial installation. He also stated that the State will not allow overhead utility lines along the Beach Boulevard frontage road and that there were several points which have not been worked out between the State and the Edison -Company as to reimbursement for relocating the existing utility lines along Beach Boulevard and until something is worked out the extra costs will be borne by the developer. Jerry King, also representing the applicant, stated that it normally costs $2,000 per acre for underground utilities but in this case it will cost approximately $5,000. Sam Ferguson stated that it is the Planning Commission and City Council's policy to require the installation of underground utilities unless it is not feasible. Gil Covell, representing Deane Brothers, stated that prior to the sale of the property, they checked with the Department of Public Works and were told that the feeder line would not have to be installed underground. It was noted by the Board that the matter regarding underground utilities should be referred to the Planning Commission for consideration at their November lst meeting and if no action is taken it should be reconsidered by the Board on November 2, 1966. 10/26/66 Page No. 2 Minutes: Board of Zoning Adjustments Wednesday, October 26, 1966 There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO REFER DIVISION OF LAND NO. 66-24 TO THE PLANNING COMMISSION TO BE ACTED UPON AT THE NOVEMBER 1, 1966 MEETING AND IF NO ACTION IS TAKEN IT SHOULD BE RECONSIDERED BY THE BOARD OF ZONING ADJUSTMENTS AT THE NOVEMBER 2, 1966 MEETING. DIVISION OF LAND NO. 66-25 Apj3,licant: Shuirman-Rogoway & Associates To allow a division of land into 2 separate parcels located on the south side of Edinger Avenue, 376' east of Sher Lane. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Mr. Eugene A. Kearnin, representing the applicant, reviewed the suggested conditions of approval and stated there were no objections. There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE DIVISION OF LAND NO. 66-25 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Edinger Avenue shall be dedicated and fully improved to City Standards at the time each parcel is developed. Improvements shall include street trees, and street lights. 2. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Streets and Highway Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system., 5. The property shall participate in the local drainage assessment district at the time of development. 6. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 7. A plan conforming to the grading ordinance shall be sub- mitted to the Department of Public Works for approval prior to issuance of a building permit. 8. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 10. A parcel map shall be filed with the City and recorded. 11. The Division of Land shall not be effective,until an agreement is signed and recorded agreeing to the con- ditions listed above. ROLL CALL VOTE: AYES: Mandrell, Ferguson, Harlow. NOES: None. DIVISION OF LAND NO. 66-26 Applicant: Raymond Beem To allow a division of land into 3 separate parcels located on the northwest corner of Warner Avenue and Goldenwest Street and legally des- cribed as being a portion of the SE4, SE4 of Section 22-5-11. Richard Harlow stated that this division of land would supersede DV 66-22 previously approved by the Board. He stated that it was refiled due to confusion caused by Condition No. 10, requiring installation of a block wall along the west property line, and that the applicant has requested that this condition be eliminated. There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY 14ANDRELL TO APPROVE DIVISION OF LAND NO. 66--26 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Warner Avenue and Goldenwest Street shall be -dedicated and fully improved to City Standards at the time each parcel is developed. Tamboleo To allow a home occupation for a mail order and phone business in the R-1 Zone. Located at 16962 Lark Lane and legally described -as Lot 43 of Tract 4243. The hearing was opened to the audience. There being no one present to speak for or against the matter, the hearing was closed. It was noted by the Board that the type of occupation proposed had not been stated on the application, therefore, the case should be continued and the applicant contacted to determine the type of occupation. ROLL CALL VOTE: AYES: Mandrell, Ferguson, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 66-72 Applicant: Huntington Harbour Corp. To.allow a 10 foot rear yard setback for houses having less than the required 900 sq. ft. of open space and to allow a 10 foot front yard setback in deviation to the required 15' setback. Located on Lots 3,_ 4, 7, 8, 21, 23, 259 27, 39, 42, 43, 46, 57 and 66 of Tract 5360. The hearing was opened to the audience. -4- 10/26/66 Page No. 5 Minutes: H.B. There being no further comment, Board discussion followed. A MOTION WAS 14ADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 66-72 SUBJECT TO THE FOLLOWING CONDITION:; 1. Lots 4, 8, 23, 27, 42, 46 and 66, which are non -waterfront lots, shall comply with the ordinance. FOR THE FOLLOWING REASON: 1. The 10' rear yard setback on waterfront lots is in conformance with the policy established by the City. ROLL CALL VOTE: AYES: Mandrell, Ferguson, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 66-73 Applicant: John P. Olson To allow a detached garage to be constructed 2_'_6 feet from the side property line in deviation to the required 5' setback; also to allow a 101 driveway width in deviation to the required 20 feet. Located on the east side of Sandra Lee Street, 125 feet south of Orion Street. Legally described as Lot 15, Block M of Tract 475. The hearing was opened to the audience. John P. Olson, the applicant, explained the reasons for the request. He stated that he needed the extra 21 feet for entering his garage withaut difficulty. It was noted that according to the parking standards of the City, there should be sufficient amount of maneuvering room in the 36 feet. hearing was closed. There being no other comment, the Board discussion followed. It was noted by the Board that this case should be continued to November 2, 1966 to allow time to consult with the Traffic Engineer as to whether or not the turning radius is adequate. To allow the following exceptions to Article 979, Off -Street Parking: (1) the waiver of the required landscaping adjacent to a public street, (2) place- ment of the 32" high wall adjacent to the property line in ._ deviation to the required 3' setback. Located on the south- west corner of Beach Boulevard and Holt Street and legally described as Lots 106 and 107 of Tract 417. The hearing was opened to the audience. Phillip Nolen, the applicant, explained the request to the Board. He stated that due to the size of the lot, it presented a hardship on him to meet the required 3' setback for landscaping. He also stated that since there is a requirement to dedicate -an additional 5' for future right of way on Holt Street, the size of his lot has decreased considerably. The Board discussed various ways of altering the plot plan with the applicant. Roger Watson, adjacent property owner, spoke in favor of the request. Bud Higgins, Fire Chief, commented on a critical need for water in that area. hearing was closed. There being no further comment, the Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 66-71 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The driveway to Beach Boulevard shall be deleted and the driveway on Holt Street shall be moved as close to Beach Boulevard as possible. 2. A 3' planter strip shall be provided along Beach Boulevard tapering to 0' at a point 5' from the start of the drive- way on Holt Street. 3. Landscaping shall be provided along Holt Street starting at 0' at the beginning of the parking stalls and tapering to 3' to the end of the stalls. FOR THE FOLLOWING REASONS: 1. The narrow width of the lot limits the area to be utilized for off-street parking. 2. Modification of the landscaping and screen wall requirements enable the applicant to meet the parking requirements. 3. The proposed landscaping exceeds the 3% required by Article 979. Bell To allow a 20' setback for a garage entered directly from a street in deviation to the required 22 foot setback. Located at 16311 Nassau Lane, City and legally described as Lot 43 of Tract 3645. The hearing was opened to the audience. Alan Bell, the applicant, addressed the Board and explained the request. He stated that other garages in the area have a 20' setback. hearing was closed. There being no other comment, the Board discussion followed. A MOTION WAS MADE BY FERGUSON AND SECONDED BY HARLOW TO APPROVE AREA VARIANCE NO. 66-75 FOR THE FOLLOWING REASON: 1.
