City of Huntington Beach to order at 4:30 P.M.

UV 66-45 - CONDITIONAL EXCEPTION - DUTCH HAVEN HOMES INC,
The Clerk presented a transmittal from the Planning Department of Con-
ditional Exception - UV 66-45 - Dutch Haver, Homes, Incorporated -
on property located on the northeast corner of Banning Avenue and
Bushard Street. 'The Planning Commission recommended approval, with
conditions.
On motion by Kaufman, Council sustained the Planning Commission and
directed the City Attorney to prepare a Resolution approving UV 66-47
with conditions as stipulated by the Planning Commission. Motion
carried.

UV 66-46 - CONDITIONALS EXCEPTION - DUTCH HAVEN HOMES INC
The Clerk presented a. transmittal from the Planning Department of Con-
ditional Exception - i:'V 66-46 - Dutch Haven Homes, Incorporated - on
property located on the southeast corner of Graham Street and Warner
Avenue, relative to street right-of-way and rear yard setback. The
Planning Commission recommended approval with conditions.
On motion by Bartlett, Council sustained the Planning Commission and
directed the City Attorney to prepare a Resolution approving UV 66-46,
with conditions as stipulated by the Planning Commission. Motion

The Clerk presented a transmittal from the Planning Department of
Conditional Exception - UV 66-48 - Helen Investment Company - on
property located on the southeast corner of Yorktown Avenue and Bushard
St.reet., reia.tk,�re to setbacks and lot widths. The Planning Commission
recommends approval with conditions.
On motion by Green, Council sustained the Planning Commission and di -
rected the City Attorney to prepare a Resolution approving UV 66-48,
with conditions as stipulated by the Planning Commission. Motion

UV 66-52 - CONDITIONAL EXCEPTION - BUCCOLA INVESTMENT CO
The Clerk presented a transmittal from the Planning Department of
Conditional Exception - UV 66-52 - Buccola Investment Company --
on property located south of Hamilton Avenue, 808 feet east of
Bushard Street, relative to right-of-ways. The Planning Commission
recommended approval with conditions.
On motion by Kaufman, Council sustained the Planning Commission and
directed the City Attorney to prepare a Resolution approving UV 66-52,
with conditions as stipulated by the Planning Commission. Motion
carried.

The Clerk presented a transmittal from the Planning Department of Con-
ditional Exception - UV 66-53 - Sunbeam Homes, Incorporated - on
property located on the east of Bushard Street, 772 feet north of
Adams Avenue, relative to setback and lot widths. The Planning Com-
mission recommended approval with conditions.
On motion by Green, Council sustained the Planning Commission and di-
rected the City Attorney to prepare a Resolution approving UV 66-53,
with conditions as stipulated by the Planning Commission. Motion

ZONE- CASE NO 66 - 51 - P C RESOLUTION OF INTENTION
Mayor Stewart requested and was granted permission to abstain from
consideration of Zone Case No. 66-51, and vacated his place at the
Council table. Mayor Pro-tem Shipley then took the Mayor's chaii%
The Clerk presented Item 4 of Zone Case No. 66-51 for Council's con-
sideration,. The Planning Commission recommended denial of this
portion of the Zone Case on property located east of Beach Boulevard,
between Warner and Heil. Avenue from C2 to Rao
On motion by Kaufman, Council. sustained the decision of the Planning
Commission and denied Item 4 of Zone Case No. 66-51. Motion carried.

The Clerk presented a letter from the Director of Public Works trans-
mitting Resolution No, 2460 - "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF HUNTINGTON BEACH ADOPTING BUDGET FOR EXPENDITURE OF FUNDS
ALLOCATED FROM THE STATE HIGHWAY FUND TO CITIES."
On motion by Green, Council waived further reading of Resolution No,
2460, and passed and adopted same by the following roll call vote:

The Clerk presented a communication from the Director of Public Works
covering reimbursement for a sewer facility per Reimbursement Agree-
ment No. 132, in the ,amount of $240.00 payable to Stanley G. Anderson,
and transmitting Resolution No. 2461 - "A RESOLUTION OF THE CITY
COUNCIL OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM

2462 - "A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF``THE CITY OF
HUNTINGTON BEACH TO VACATE A PORTION OF ALGONQUIN STREET IN SAID CITY
AND GIVING NOTICE OF HEARING ON SAID VACATION."

The Clerk presented a communication from the Public Works Director
requesting authorization to reimburse La Alba Land Company for con-
struction costs of an off -site water main in Sugar Avenue in the
amount of $6,986.40, as per Reimbursement Agreement No. 99.
On motion by Bartlett, Council approved Reimbursement of $6,986.40,
to La Alba Land Company for an off -site water main, per Reimbursement
Agreement No. 99 by the following roll call vote:

The Clerk presented a request from the Director of Public Works of an
expenditure to pay for work to abandon the 12 inch sewer main in Tal-
bert Avenue between Cannery Street and Bushard Street, in the amount
of S31150.00. The Clerk read Resolution No. 2463 by title - "A
RESOLUTION OF THE CITY COUNCIL OF HUNTINGTON BEACH AUTHORIZING THE
EXPENDITURE OF MONEY FROM THE SEWER FUND."
On motion by Gisler, Council waived further reading of Resolution., No.

REQUEST - LICENSE INSPECTOR ATTEND MEETING
The Clerk presented a request for the License Inspector to attend the
Southern California Municipal Business Tax Association meeting, to
be held in Palm Springs, California, on December 2 and 3, 1966.
On motion by Gisler, Council referred this matter to the City Admini-
strator. Motion carried.

BID AWARD - CC-049 - STORM DRAIN CHANNEL
The Clerk read a communication from the Director of Public Works
stating that bids for the construction, concrete lining, and improve-
ments of C5-SC2 Storm Drain Channel from Heil Avenue to 2038.59 feet
northerly, had been opened at 9 A.M. on Monday, November 21, 1966, in
the Council Chamber, by the City Clerk, City Attorney, and the Director
of Public Works, and that Hane Construction Company of Long Beach,
California, was the low bidder with a bid in the amount of $56,142.00.
Mr. Wheeler recommended that the Council award. the bid to Hane Con-
struction Company, and reject all other bids. The bids submitted
were as follows:

On motion by Coen, Council awarded the contract for Project CC-049 to
Hane Construction Company - Long Beach, for the low bid of 856,142.00,
rejected all other bids, and authorized the Mayor and City Clerk to
execute the contract on behalf of the City. Motion carried.

The City Administrator presented a. request from Dutch Haven Homes,
Tneorpora.ted, for a refund of 8100000 of the $404.00 filing fee paid

developed,
On motion by Shipley, Council authorized the refund of $100.00 to
Dutch Haven Homes, Incorporated, Motion carried.
REMOVAL OF P1011 ZONTE, FROM STUDY A.RE.A ULI.CSC
The City Administrator presented a communication from the Urban Land
Institute Citizen Steering Committee recommending that the 110" zone
be removed from the downtown. study Area and from areas of marginal
oil production.
On motion by Kaufman, Coiatkcil referred this matter to the Planning
Commission for study and recommendation. Motion carried.
REQUEST MEETING M CITY STAFF - HUD
On motion by Green, Council i.n8tru:ct.ed the Administrator to contact
the Housing Urban Developmert Committee and Set; a time for a joint.
meeting with the City Staff, Urban Land :In.stitute Committee, and
HUD to discuss the findings of the HUD ;survey and to discuss steps
in waking application for Planning and Survey Funds. A tentative
date was set for December 1 1966, at 7:50 P.M. Motion carried®
INSPECTION OF SCHOOL GYM - E"WLOY BRICK MASON
The City Administrator presented a recommendation of the Recreation.
and Parks Director that the City hire a brick mason to inspect the
gymnasium - pool building of the Huntington Beach Elementary School,
at ,are expenditure not to exceed $500,00.
On motion by Green, Council. deferred this matter to a later date and
requested a letter from the Huntington Beach Elementary School
District stating their intent concerning use of the building. Motion

NATIONAL LEAGUE OF CITIES MEETING

On motion by Shipley, Council authorized the attendance of the Mayor,
Councilman Kaufman, and Director of Building and Safety, Jack.�Cleveland,-
at the National League of Cities Meeting in Las Vegas, Nevada, on
December 2 - 7, 1966, with -reasonable expenses allowed, Motion carried.
RESOLUTION NO 2468 - ADOPTED - EMPLOYEES ORGANIZATIONS
The Clerk read Resolution No. 2468 by title - "A RESOLUTION OF THE
CITY COUNCIL OF THE -CITY OFHUNTINGTON BEACH ADOPTING PROCEDURES OF
RECOGNIZING ORGANIZATIONS WHICH REPRESENT EMPLOYEES OF THE CITY."

FIRE DEPARTMENT FUNDING PROGRAM
On motion by Kaufman, Council instructed the City Administrator to
schedule a meeting on December 1, 1966, at 7:30 P.M., with Stone and
Youngberg of San Francisco, financial consultants, to allow the Council
to hear their presentation concerning the fire department funding pro-
gram. Motion carried,
PROPOSED HELISTOP - SEAL BEACH
On motion by Bartlett, Council instructed the City Administrator to
inform North American Aviation, Incorporated, that it has no objections
to their proposed helistop, to be located in Seal Beach. Motion carried

PACIFIC LIGHTING COMPANY REQUEST
The Administrator presented a request from the Pacific Lighting Company
for permission to install three magnesium cylinders on the south edge
of Murdy Park.
On motion by Gisler, Council referred this matter to the City Attorney
and the Parks and Recreation Commission for further study. Motion
carried.

GOLDENWEST COLLEGE TRAFFIC CONTROL
The Administrator presented a report on the Goldenwest College traffic
control item that had been referred to him from the meeting of November
7, 1966. He recommended the Council should consider an experimental
period of several months with the Police Department working the pro --
gram.
On motion by Kaufman, Council authorized the Police Department to patrol
the Goldenwest College parking lots for an experimental period of two
months. Motion carried.

PAYROLL
On motion by Bartlett, Council authorized the Finance Department to
pay City employees on November 23rd instead of the 25b.. Motion car-
ried.

WEST ORANGE COUNTY WATER BOARD
Councilman Kaufman discussed the proposal from the West Orange County
Water Board on a joint reservoir.
On motion by Kaufman, Council directed the City Clerk to notify the
West Orange County Water Board of the position of the City in this
matter and send copies of the Engineer's report. Motion carried.

AIR POLLUTION CONTROL BOARD
On motion by Green, Council directed the Administrator to request the
Air Pollution Control Board to investigate and locate source of fumes
in the area of Newport West and the Edison Plant. Motion carried.
'�1FENCING OF STANDING WATER
The enforcement of the Ordinance concerning the fencing of areas con-
taining standing water was discussed at some length by the Council.
Mr. 0. C. Cleveland, Director of Building and Safety, gave the Council
a report on this matter.
On motion by Green, Council directed the Building Department to pursue
enforcement of the Ordinance Code with the cooperation of City Attorney,
and to make a cost and feasibility report to Council on the area of
Huntington and Delaware. Motion carried.
RECESS
Mayor Stewart called a recess of the Council at 6:00 P.M. Council was
reconvened at 7:30 P.M. by the Mayor.

�PUBLIC HEARING - U P 66-27 - APPEAL - APPROVED —COUNCILMAN GREEN
Mayor Stewart announced that this was the day and hour set for a public
hearing on an appeal to the granting by the Planning Commission of Use
Permit No. 66-27, on property located on the north side of Edinger
Avenue and 310 feet east of Edwards Street, and directed the Clerk to
read the legal notice.
The Clerk read notice of public hearing on the appeal on Use Permit
No. 66-27 as published in the Huntington Beach News on November,10,
1966, setting the hour of 7:30 P.M., or as soon thereafter as possible,
on Monday, the 21st day of November, 1966, in the Council Chamber of
the Civic Center, Huntington Beach, California, as the time and place
for a public hearing for the purpose of considering an appeal to the
granting by the City Planning'Commission of Use Permit No. 66-27, to
regulations of the Districting Ordinance, to permit a super service
station with a converorized car wash in the C4 Highway Commercial
District
The Clerk read the letter of appeal filed by Councilman N. John V. V.
Green, and stated that he had received no further communications or
protests to the granting of Use Permit No. 66-27, and that notice of
public hearing had been mailed to all residents within 300 feet of the
property involved.
Mayor Stewart declared the hearing open.
Mr. Roger Howell, representing the applicant, addressed the Council
and requested them to sustain the Planning Commission's decision.
Mr. Robert Rickles, representing the adjoining property owners ad-
dressed the Council and discussed the conditions in the area regard-
ing the use permit. He requested that conditions for the establish-
ment of the service station permit no mechanical work, tune ups, tire
changes, lubrications, and services of a similar nature.
There being no one further to speak on the matter, and there being no
further protests filed, either oral or written, the hearing was closed
by the Mayor.
On motion by Kaufman, Council sustained the Planning Commission and
granted Use Permit No. 66-27 with conditions as recommended by that
body and the inclusion of a condition governing permitted services
as requested by adjoining property owner's attorney. Motion carried.

PUBLIC HEARING - ZONE CASE NO 66-52
At this time Mayor Stewart requested and was granted permission to
abstain from consideration of the next Zone Case, and vacated his
place at the Council table. Mayor Pro-tem Shipley then took the
Mayor's chair.
Mayor Pro -tern Shipley announced that this was the day and hour set.for
a public hearing on Zone Case No. 66-52, on eight parcels of property
south of Warner Avenue and east of Beach Boulevard, and directed the
Clerk to read the legal notice.
The Clerk read notice of public hearing on Zone Case No. 66-52, as
published in the Huntington Beach News on November 10, 1966, setting
the hour of 7:30 P.-M., or as soon thereafter as possible, on Monday,
the 21st day of November, 1966, in the Council Chamber of the Civic
Center, Huntington Beach, California, as the time and place for a
public hearing for the purpose of considering a Resolution of Intent
of the City Planning Commission to regulations of the Districting
Ordinance for changes of zone from:
1) Cl Neighborhood Commercial District to C4 Highway Commercial
District, with setback provisions;
2) C1 Neighborhood Commercial District, to C4 Highway Commercial
District, with setback provisions;

There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor Pro-tem.
On motion by Green, Council approved items 1, 2, 3, 4, 5, 6, 8, and
a protion of item 7 in Zone Case 66-52, and directed the City Attorney
to prepare an Ordinance effecting the change in zones.
Councilman Kaufman made a motion to refer the portion of Item 7 of
Zone Case 66-52 on which denial had been recommended, back to the
Planning Commission for study and possible revision--of'the Master
Plan. However, the motion failed when put to a vote.
On motion by Green, Council denied the portion of item 7 of Zone Case
66-52 as recommended by the Planning Commission. Motion carried.
Mayor Stewart resumed his place at the Council table.

lic hearing on Zone Case 66-54, on property located south of Heil
Avenue and east of Goldenwest Street, and directed the Clerk to read
the legal notice.
The Clerk read notice of public hearing on Zone Case 66-54, as pub-
lished in the Huntington Beach News on November 10, 1966, setting the
hour of 7:30 P.M., or as soon thereafter as possible, on Monday, the
21st day of November, 1966, in the Council Chamber of the Civic Center,
Huntington Beach, California, as the time and place for a public hear-
ing for the purpose of considering a petition for a change of zone to
regulations of the Districting Ordinance, from RA Resikdential Agricul-
tural District; and MI Light Industrial District, to R3 Limited Mul-
tiple Family Residence District.
The Clerk informed the Council. that they had been provided with copies
of the Planning Director's transmittal, recommending approval from RA
and M1 to Rl instead of R3 as requested by the applicant. He also
stated that he had received no communications or written protests to
the Zone Case or to the recommendation of the Planning Commission.

Mr. Hugh Blue, Newport Beach, addressed the Council and requested that
they approve the Zone Case with the R3 zoning, but stated the appli-
cant would accept the R1 zoning if the requested zoning was not grant-

by the Mayor.

lic hearing for the purpose of considering an amendment to Division
9 of the Huntington Beach Ordinance Code to provide a clarification
of the minimum open space provision in connection with architectural
features covering eaves and fireplaces in the residential zones.

2) A limit for the height of boundary landscaping;
3) A provision for maintenance of landscaped areas;
4) All required landscaping to be located in the off-street parking

southeast corner of Atlanta Avenue and Beach Boulevard, and directed
the City Clerk to read the legal. notice.
The Clerk read notice of public hearing on an appeal to the granting by
the Planning Commission of Division of Land 66-24, as published in the
Huntington Beach News on November, .1.0, 1966, setting the hour of 7:30 P.M.,
or as soon thereafter as possible, on Monday the 21st day of November,
1.966, in the Council Chamber of the Civic Center, Huntington Beach,
California, as the time and place for a public hearing to consider an
appeal to the decision of the City Planning Commission in approving
Division of Land 66-24, which would allow utility feeder lines above
ground
The Clerk read the letter of appeal filed by Councilman Henry S. Kauf-
MOMI and stated that he had received no further communications or pro-
tests to the granting of Division of Land 66-24, and that notice of.

REQUEST - ` SURFACING= -OF ALLEY
The Clerk presented a.communication from Hulda Williams, 313 Eleventh
Street, City, requesting that the alley behind her home be paved.
On motion by Kaufman, Council received the letter from Hulda: Williams,
and directed it -be filed by the City Clerk. Motion carried.

PETITION - SENIOR CITIZENS
The Clerk presented a petition with 148.signature$ from the Senior
Citizens Club requesting allocation of funds to repair Lake Park Club-
house and to build a new Clubhouse on the Lake Park Grounds for a
Senior Citizens Clubhouse.
On motion by Green, Council directed the Director of Public Yorks to
obtain a report on the plans and estimated costs in the enlargement 9f
the Lake Park Clubhouse. Motion carried.
RECONSIDERATION REQUESTED - USE VARIANCE NO 66-35
The Clerk presented a letter from Lawrence E. Gates requesting Council.
to reconsider their decision of November 7, 1966 in approving UV 66-35
with conditions.
On motion by Coen, Council opened Use Variance No. 66-35 for reconsidera-
tion. Motion carried.
Mr. James Rubble, a representative of Mr. Gates, addressed the Council
and presented some facts concerning this Variance.
Mr. Fred Edmunds, a member of the Hospital Planning Association of
Southern California, addressed the Council and presented reasons for
the approval of the Use Variance.
Mr. Paul White, member of the Hospital Planning Association of Southern
California, Orange County Board, addressed the Council to inform them
of procedure required to obtain approval from the Association. He
stated the Hospital Planning Association gives only recommendations
and not a certificate of approval.
On motion by Kaufman, Council directed to amend the motion of the last
meeting approving UV - 66-35 subject to approval of the Hospital Plan-
ning Association of Southern California, by substituting the word
"recommendation"for the word "approval." Motion carried.
On motion by Kaufman, Council rescinded the previous motion. Motion
carried.
On motion by Kaufman, Council directed that the matter be continued
until the applicant has applied to the Hospital Planning Board for.
a recommendation, and until applicant requests said matter to be
placed upon the agenda by written notice to the City Clerk within a
period of three months. Motion carried.

REQUEST - BUILDING PERMIT - NEAL T BAKER ENTERPRISES
The Clerk presented a request from Neal T. Baker Enterprises to build.
a Drive-Thru Restaurant on the northwest corner of 51h Street and Ocean
Avenue. Area Variance 66--64 was granted on October 5, 1966, but the
Building Department refused to issue the Building Permit.
Mr. Ralph Highsmith, Attorney represented Baker Enterprises, addressed
the Council and questioned the right of the City t6 refuse this permit.
On motion by Kaufman, Council directed the applicant to seek redress
by methods allowed in the withholding zone Ordinance. Motion carried.

REQUEST - BUILDING PERMIT - CHARLES H MAAS
The Clerk presented a request from Mr. Charles H. Maas, 9652 Cornwall
Drive, in the Huntington Continental Town House #2 development, for
the issuance of a building permit for an addition to his residence.
The Clerk informed the Council that the Building Department has ap-
proved Mr. Maas plans, but .issuance of the permit also requires
Council's approval.
On motion by Kaufman, Council referred this request to the Planning
Commission for study. Motion carried.
INTERCOMMUNITY HOSPITAL - INFORMATION
Councilman Green made a motion to direct the City Administrator to
inquire as to when the Inter -community Hospital will open. The
motion failed when put to a vote.
1'�-LIBRARY BUILDING - MARINA PARK
Mr. Carl Wilderman, 15161 Newcastle Lane, City, addressed the Council
and requested Council's consideration in keeping Marina Park as a
sports area.
Following discussion and on motion by Green, Council rescinded minute
action authorizing the Public Works Department to put the library
building on the Marina Park site permanently, and authorized the
Building Department to place this building on the site temporarily.
Motion carried.
MARINA PARK SITE - EMPLOY RICHARD BIGLER
On motion by Kaufman, Council. authorized the City Administrator to
engage Mr. Richard Bigler to prepare a Master Plan for Marina Park,
with payment for his services to be deferred until July 1, 1967.
Motion carried
INFORMAL MEETING
Mayor Stewart called a meeting of the City Council as an informal
Committee -of -the -Whole for Thursday, December 1, 1966, at 7:30 P.M.
in the Council Chamber.
