Richard Harlow.
BOARD MEMBERS ABSENT: None.
MINUTES: The minutes of November 23 and
30 and December 7 were accepted
as transcribed.
AREA VARIANCE NO. 66-89
Applicant: Security Tire Co., Inc,
To permit a canopy sign for a com-
mercial building to be 316" thick in deviation to the maximum
thickness of 18 inches within the front 50' setback. Located
on the west side of Beach Boulevard, approximately 262 feet
north of Yorktown Street. Legally described as the south
100 feet of the west 125 feet of the east 145 feet of Block
C. Tract 837.
The hearing was opened to the audience,
Carl Sherbondy, representing the appli-
cant, explained the request to the Board. He stated that the
building setback would be the same as is provided on the ad-
joining property.
There being no other comment, the
hearing was closed.

A MOTION WAS MADE BY HARLOW AND
SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 66-89 FOR
THE FOLLOWING REASONS:
1. The canopy setback will be the same as is provided on
the adjoining building.
2. The building is setback 10 feet from the north property
line allowing for sufficient sight clearance for the
buildings to the north. y

AREA VARIANCE NO. 66-90
Applicant: Harry S Okuda, D D S,
To allow -side yard setbacks to be
reduced to 0 in deviation to the required 5 ft. in the R-5
District and to allow off-street parking to be arranged as
shown on the submitted plot plan in deviation to the require-
ments of_Article 979. Located on the north side of Warner
Avenue, approximately 225 feet east of Golden West Street
and legally described as Lots 31 and 32 of Block C. Tract 392.

spoke in favor of the request.
Harry S. Okuda, the applicant, explained
the reasons for -the request.
Mi, Paul Davis, adjoining property owner,
asked questions regarding dedication of Warner Avenue and
Winters Street.
There being no other comment, the hearing
was closed.

A MOTION WAS MADE BY FERGUSON AND SECONDED,
BY HARLOW TO APPROVE AREA VARIANCE 66-90 SUBJECT TO THE
FOLLOWING CONDITIONS:
1. Off-street parking shall comply with the provisions of
Article 979.
FOR THE FOLLOWING REASONS:
1. There is no need for a 5' sideyard setback because the
intent was to separate professional buildings from resi-
dential buildingsand residential uses are no longer
permitted in the R-5 Zone.
2. The Planning Commission previously approved the same
request but the application has since expired.

AREA VARIANCE NO. 66-91
Applicant: Stanley G. Anderson
To allow the following exceptions to Article
979, Off -Street Parking: (1) waiver of tb e 3' setback for
landscaping purposes, (2) placement of the 32" high screen
wall adjacent to the front property line in deviation to the
required 3' setback. The subject property is located on the
north side of Warner Avenue, 360 feet west of Bolsa Chica St.
Legally described as Lot 3 of Block 16 of Tract 86.
The hearing was opened to the audience.
Mel Chase, representing the applicant, explained
the request to the Board. He stated that the block wall was
constructed in the wrong location because of an error made by
the contractor at the time of construction.

BY HARLOW TO DENY AREA VARIANCE NO. 66-91 FOR THE FOLLOWING
REASON:
1. The applicant can comply with the provisions of the
ordinance and has not demonstrated a hardship.

ABSENT: None.

AREA VARIANCE NO. 66-92
Applicant: Jack -In -The -Box
To allow a roof overhang. with 91611 of ground
clearance to encroach into the required 50' setback in
deviation to the required ground clearance of 12 feet.
Located on the south side of Edinger Avenue, 140 feet east
of Springdale Street and legally described as the north 2
acres of the west 16 acres of the NW-4 of the NA of Section
22-5-11.
The hearing was opened to the audience.
Dick Pomeroy, representing the applicant,
explained the request to the Board.
There being no other comment, the hearing
was closed to the audience.
It was noted by the Board that this request
is within the intent of the ordinance.

BY FERGUSON TO APPROVE AREA VARIANCE NO. 66-92 FOR THE
FOLLOWING REASONS:
1. The intent of the ordinance is still maintained.
2. There is sufficient sight clearance to adjoining
properties.

PLOT PLAN AMENDMENT NO. 66-3
A. J . Land Company
To permit the removal of Condition No. 5
of Use Permit No. 66-27, which requires a 7 ft. high block
wall to be constructed on the east and north sides of the
property to City Standards. The subject property is located
on the north side oflEdinger Avenue and 310 ft. east of
Edwards Street and legally described as the Elly 250 feet
of Lot 59, Tract 4277.

The hearing was opened to the audience.
Robert DeGuise, adjacent property owner, spoke
against the proposed request. He felt that the request should
be -denied because it was in conflict with what was agreed upon
by the property owners and A. J. Land Company when the Use
Permit was approved.
There being no further comment, the hearing
was closed to the audience.

A MOTION WAS MADE BY HARLOW AND SECONDED BY
MANDRELL)TO DENY PLOT PLAN AMENDMENT NO. 66-3 FOR THE FOL-
LOWING REASONS:
1. The applicant failed to show sufficient justification
for the request.
2. Construction of the 7-ft high block wall wa primary
consideration when the request was approve by the
Planning Commission and City Council.

DIVISION OF LAND NO. 66-34
Applicant: Shuirman-Ro o�wav &, Associates
To allow a division of land into 3 separate
parcels located on the south side of Edinger Avenue, 376 feet -
east of Sher Lane. Legal description on file in the Planning
Department Office.
The hearing was opened to the audience.
Mr. Eugene Kiernan, representing the applicant,
explained the request to the Board.
The suggested conditions of approval were
reviewed by the applicant.
There being no other comment, the hearing was
closed to the audience.

A MOTION WAS MADE BY HARLOW AND SECONDED BY
FERGUSON TO APPROVE DIVISION OF LAND NO. 66-34 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. Edinger Avenue shall be dedicated and fully improved
to City Standards at the time each parcel is developed.
Improvements shall include street trees, and street
lights.

2. All streets shall conform to;City of Huntington Beach
Standards, Master Plan of Arterial Streets and Highway
Standards shall apply where applicable. Street sections
shall be determined by soil "R" value and traffic index.

3. Water supply shall be through the City of Huntington
Beach's water system.
4. Sewage disposal shall.be through the City of Huntington
Beach's sewage system.
5. The property shall participate in the local drainage
aasessment district at the time of development.
6. Preliminary and final soil reports shall be submitted
by an' -approved private -soils engineer to the'City
prior -to issuance -of building permits.
7. A plan conforming to the grading ordinance shall be sub-
mitted to the Department of Public Works for approval
prior to issuance of a building permit.
8. All utilities shall be installed underground at the time
of development.
9. The water, sewer, and fire hydrant system shall be ap-
proved by the Department of Public Works and Fire
Department.
10. A parcel map shall be filed with the City and recorded.
11. The Division of Land shall not be effective until an
agreement is signed and recorded agreeing to the condi-
tions listed above.

AREA VARIANCE NO. 66-88
Applicant: R. L. Rinehart
To allow an addition to a main dwelling to
encroach to within 313" of the rear property line in devia-
tion to the required 10' rear yard setback. Located at
8162 Lancaster Drive, City and legally described as Lot 50
of Tract 5735.
The hearing was opened to the audience.
R. L. Rinehart, the applicant, explained
the reasons for the request to the Board.
He was informed that the Board sent 'a letter
to the Commission requesting that they study the possibility
of reducing the rear yard setback when abutting open. -land;
but the Commission has not had the opportunity to discuss
the matter.

MISCELLANEOUS
Leonard Shane, President of Mercury Savings,
addressed the Board requesting an interpretation of Condi-
tion No. 8 of Division of Land No. 66-34, which requires
installation of underground utilities.
The Board informed Mr. Shane that the condi-
tion would require all utilities to be installed underground
with the exception of those along Arterial Highways.
