HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: Sam Ferguson, Richard Harlow,
Charles Spencer.
BOARD MEMBERS ABSENT: None.
USE PERMIT NO. 66-38
AARnlicant: R. M. Galloway & Associates
To allow the construction of 150
single family units on 29.86 acres of land in the R-2 Two
Family Residence District. Located on the northwest corner
of Hamilton Avenue and Bushard Street. Legal description
on file.
The hearing was opened to the
audience.
Robert Galloway and Gene Rosenfeld
addressed the Board and explained the request. They stated
that they needed approval of a use permit to enable them
to apply for building permits prior to adoption of an ordi-
nance regulating the minimum open space in rear yards. They
stated that they originally had 74 lots that would not comply
to the proposed change, but were able to reduce this to ap-
proximately 30 lots.
The Board discussed the situation
with the applicants.
It was noted that the number of lots
which would be in conflict with the proposed ordinance could
be reduced to 17 lots by moving the houses with a side entry
garagge to within 10' of the front property line, thus providing
the rear yard setback.
Richard Harlow stated that he felt the
matter should be referred to the Planning Commission inasmuch
as they initiated the code amendment.
The applicants stated that their models
were built and they had proceeded in good faith when they
plotted the subdivision and did not have any intension of
subverting the new ordinance. They also stated that the
plans are too far along to make any drastic changes.
Further Board discussion followed.
A MOTION WAS MADE BY HARLOW TO REFER
THE MATTER TO THE PLANNING COMMISSION.
The motion did not carry.

A FURTHER MOTION WAS MADE BY FERGUSON
AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 66-38 WITH
THE FOLLOWING CONDITION:
1. All lots except Lots 4 of Tract 6339, Lots 7, 10, 17, 30,
34, 36, 37,45 of Tract 6338 and Lots 6, 8, 18, 20, 215 23,
25, 34 of Tract 6278 shall comply with the proposed code
amendments regarding rear yards.
FOR THE FOLLOWING REASONS:
1. The plans for the tract have already been drawn.
2. Building permits have been issued on a portion of the
tract.
ROLL CALL VOTE:
AYES: Ferguson,Spencer.
NOES: Harlow.
ABSENT: None.
THE MOTION CARRIED.
MISCELLANEOUS:
The Secretary informed the Board that a meeting
was held between Mr. Illig, his engineers, Bill Hartge,
Deputy Director of Public Works and members of the Planning
Department to discuss Condition No. 11 of Division of Land
No. 66-31. He stated that this condition presented a pro-
blem in as much as it required the applicant to participate
in Assessment District No. 6303, but there is a possibility
that the assessment district might not be formed and this
would cloud the title of the property.
In view of this, it is recommended that the
condition be changed to require construction of adequate
drainage and sewage facilities to the satisfaction of the
Department of Public Works.
A MOTION WAS MADE BY HARLOW AND SECONDED BY
SPENCER TO AMEND CONDITION NO. 11 TO READ AS FOLLOWS:
11. No building permit shall be issued on parcel$ 2
or 3 until proper drainage and sewer facilities
are constructed to the satisfaction of the
Department of Public -Works.
ROLL CALL VOTE:
AYES: Spencer, Harlow, Ferguson.
ND ES : None.
ABSENT: None
THE MOTION CARRIED.
There being no further business,
the meeting adjourned.
