MINUTES On motion by Bartlett, the minutes of the regular meeting of December 19, 1966, were approved and -adopted -,as prepared and :mailed by the City Clerk.. Motion carried. ,r. y{, REIMBURSEMENT AGREEMENT NO 133 -.SHEL OIL CO The Clerk presented a transmittal from.the Director of Public Works of Reimbursement.,Agreement No.'133, between Shell Oil'Company and the City;. for. water line construction in Cannery Street and'Garfield Avenue. On motion by Kaufman, Council approved.Rei-mbursement Agreement No. 133 between Shell Oil Company and the City, and authorized the Mayor and City Clerk to execute same on behalf of the .City. Motion carried. REIMBURSEMENT AGREEMENT NO 138 - FASHION HOMES INC The 'Clerk presented a transmittal from the'Di,rector of Public Works ..of Reimbursement Agreem'"ent.No. 138,, between Fashion Homes, Inc. and the City,.for construction..of storm drain facilities in Drainage Area 7G. On motion.by Kaufman, Council approved Reimbursement Agreement No.. 138 between Fashion Homes, Inc. and the City,, and authorized the Mayor and.City.Clerk to execute same on behalf.of the City. Motion carried. REIMBURSEMENT,.AGREEMENT..NO.139-'ESSEX LAND CO The Clerk presented a transmittal'from the Director.of Public Works of Reimbursement.Agreement'No. 139,,laetwween Essex Land Company and the City, for construction of storm drain facilities in Drainage Area 7G. On motion by Kaufman, Council approved Reimbursement Agreement No. 139 between Essex Land Company and the City, and authorized the Mayor and City. Clerk to execute same on behalf of,'the.City. Motion carried. 376 Page #2 - Minutes, January 3, 1967 TRACT 5430 - DEDICATION OF IMPROVEMENTS - FERNHILL HOMES The Clerk presented a communication from the Director of Public Works recommending acceptance of dedicated improvements and authorization for release of the Improvement and Monument Bonds and termination of the Subdivision Agreement in Tract No. 5430 - Fernhill Homes. On motion by Kaufman, Council accepted improvements dedicated for public use in Tract 5430; authorized the release of the Improvement and Monument Bonds and termination of the Subdivision Agreement, and directed that the developer be notified by the City Clerk and the bonding company notified by the City Treasurer. Motion carried. REIMBURSEMENT - STORM DRAIN PUMP STATION - S V HUNSAKER The Clerk presented a communication from the Director of Public Works recommending reimbursement to S. V. Hunsaker and Sons from the Drainage Fund for construction of a pump station in Drainage District No. 7F, as per Reimbursement Agreement No. 135, and transmitting Resolution No. 2490 - "A RESOLUTION OF THE CITY COUNCIL OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE DRAINAGE DISTRICT 7F FUND." On motion by Kaufman, Council waived further reading of Resolution No. 2490, and passed and adopted same by the following roll call vote: AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Green, Stewart NOES: Councilmen: None ABSENT: Councilmen: Shipley REQUEST - INCREASED PARTICIPATION - BEACH BOULEVARD SEWER The City Clerk presented a request from the Director of Public Works for an increase in the City's participation for construction of sewers in Beach Boulevard from Warner Avenue to 2000 feet north. Due to severe conditions imposed by the Division of Highways, final estimate of. costs will be $60,OOO instead of $45,000. On motion by Kaufman, Council authorized the increase in the City's participation for construction of sewers in Beach Boulevard to 501/o of a maximum total cost of $60,000. Motion carried. �J DEEDS ACCEPTED The Clerk presented a transmittal from the Director of Public Works of deeds to the City for acceptance and recording, as follows: Daylin. Motion carried. DEED ACCEPTED - SLATER/EDWARDS CONDEMNATION The Clerk presented a transmittal from the City Attorney of a deed from Helen V. Peterson for acceptance, recording and payment authorization, in the amount of $425.00, in the Edwards/Slater Condemnation, for Lot 55, Block B, Tract 281. *377 Page #3 - Minutes, January 3, 1967 On motion by Kaufman, Council accepted the deed from Helen V. Peterson, and direct ' ed that it be returned to Land Acquisition Service for recordin, and authorized payment in the amount of $425.00 to. -the grantor, when notified by Land Acquisition Service, by the following roll call vote: AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Green, Stewart NOES: Councilmen: None ABSENT: Councilmen: Shipley r CC-052 - CONSTRUCTION - WATER WELL NO 4 - BID AWARD The Clerk read a communication from the Director of Public Works stating that bids for the construction of Water Well #4 at the Peck Reservoir site had been opened at 9 A.M.mon Tuesday, January 3, 1967, in the Council Chamber by the City Clerk, City Attorney, and the Director of Public Works; and that Beylik Drilling, Whittier, California, was the low bidder with a bid in the amount of $30,639.09. Mr. Wheeler recommended that the Council award the bid to Beylik Drilling, and reject all other bids. The bids submitted were as follows: Beylik Drilling Company, Whittier $30,639.00 McCalia Brothers Santa Ana $31,545.00 Rosco Moss Company, Los Angeles $32,282.00 On motion by Gisler, Council awarded the contract for Proect!CC-052 i3O,639.00; to Beylik Drilling Company, Whittier, for the low bid of rejected all other bids; and authorized the Mayor and City Clerk to execute the contract on behalf of the City. Motion carried. ORDINANCE NO 1276 - ADOPTED - ZONE CASE 66-57 The Clerk gave Ordinance No. 1276 a second reading by title - "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO ZONE CASE 66-57; AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY RECLASSIFYING DM�-31 (Sectional.District Map 26--5-11)." Due to the fact that the City Charter requires that a period of five days elapse following the modification of an Ordinance, further action on the Ordinance was deferred until the next regular meeting of the Council. ORDINANCE NO 1284 -DEFERRED - OIL DRILLING The Clerk gave Ordinance No. 1284 a second reading by title - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTIONS AND ADDING SECTIONS TO CHAPTER 23." A motion was made by Councilman Green to waive further reading and adopt Ordinance No.,1284 but the motion was withdrawn before being put to a vote. On motion by Kaufman, Council postponed adoption of Ordinance No. 1284 and,,4irected the Clerk to set a public hearing for January 16, 1967. Motion carried. V PRELIMINARY PLANS - EDISON RIGHT OF WAY & PERRY PARK The City Administrator presented the preliminary plans for the Edison right-of-way and perry Park as prepared by the architect, Mr. Richard Bigler. On motion by.Green, Council accepted the preliminary plans presented by Mr. Bigler for the Edison Right -of -Way. Motion carried. On motion by Kaufman, Council accepted the preliminary plans presented by Mr. Bigler for Perry'Park. Motion carried. REFUND REQUEST - SECURITY FORE CORP - TRACT 6020 The City.Administrator presented a request from the Security Fore Corporation, for a refund of the $9300 subdivision license fees paid to the City in October, 1966, for 93 lots to be developed in Tract Map 6020, because of withdrawal of the map. On motion by Kaufman, Council authorized the refund of the $9300 subdivision license fee to Security Fore Corporation,, subject to their surrender of the final tract map to the City of Huntington Beach. Motion carried. INRORMAL.MEETING —CONCESSIONAIRES Mayor Stewart called an informal meeting of the Council as a Committee -of -the -Whole for January 9, 1967, at 7:00 P.M. in the Council Chamber, to meet with the beach concessionaires, and asked that a report and staff recommendation be ready at that time for Council .consideration.
