1966 meeting were accepted
as transcribed.
PLOT PLAN AMENDMENT NO. 66-4
Applicant: Dell Hatch
To permit a plot plan amend-
ment for Use Variance No. 66-20 for the purpose of
constructing a 4' x 8' lighted sign and a 25' high
flag pole in the R2 Two Family Residence District.
Located at 7801 Garfield Avenue and legally described
as the west 75 ft. of Lot 14, Block G of Tract No. 7.
The hearing was opened to
the audience.
There was no one to speak
for or against the matter.
It was noted that when the
applicant applied for permission to use his build-
ing for a day nursery he failed to request permission
to erect a sign in the front yard.
It was also noted that this
type sign is normally permitted for this type of use.
Dan McFarland, Building
Department, explained that the City Attorney took
the applicant to court for installing three signs,
in violation of the zoning ordinance and that this
application pertains to the on -site sign. He stated
that the case was dismissed by the Judge upon the
condition that the applicant remove the off -site
signs and apply for permission to allow the on -site
sign to remain.
There being no other comment,
the hearing was closed to the audience.
Board discussion followed.
A MOTION WAS MADE BY FERGUSON
AND SECONDED BY HARLOW TO APPROVE PLOT PLAN AMENDMENT
NO. 66-4.

AREA VARIANCE NO. 66-94
Applicant: Rex L. Hodges Realty
To permit
an addition to a single family residence to encroach
to within 6 feet of the rear property line in
deviation to the required 10 ft. rear yard set-
back in the R1 Single Family Residence District.
Located at 18322 Thomas Circle and legally
described as Lot 13 of Tract 2558.
The hearing was opened
to the audience.
Mr. L. J. Daly, repre-
senting the applicant, explained the request to
the Board. He stated that the property owner hired
a contractor to add the room on the house three
years ago and thought he applied for a building
permit. It was not until recently that she
learned that he failed to do so. Mr. Daly stated
that he felt the owner had acted in good faith
and did not try to circumvent any required
ordinances.
There being no other
comment, the hearing was closed to the audience.
Board discussion followed.
It was noted that members
of the Board investigated the site and did not see
any problems with surrounding properties.
A MOTION WAS MADE BY HARLOW
AND SECONDED BY MANDRELL TO APPROVE AREA VARIANCE
NO. 66-94 FOR THE FOLLOWING REASONS:
1. The room was constructed approximately three
years ago.
2. The property owner acted in good faith thinking
that a building permit had been applied for and
that the building conformed to all ordinances.
3. The lot is extremely large allowing for a maxi-
mum amount of open space in the rear yard.
4. An on -site investigation of the property did
not reveal any problems with surrounding
properties.

AREA VARIANCE NO. 66-95
Applicant - Dal B. Rhoads
To permit an addition to
a single family residence to encroach to within 5 ft.
of the rear property line in deviation to the required
10 ft. rear yard setback and to allow a minimum open
space of approximately 600 sq. ft. in deviation to
the required 900 sq. ft. in the R1 Single Family
Residence District. Located at 17081 Hague Lane
and legally described as Lot 147 of Tract 3862.

The hearing was opened to the audience.
Mrs. Rhoads, the applicant, explained
the request to the Board. She stated that the rear
yard area had been figured incorrectly and that it
exceeds the required 900 sq. ft. of open space.
She also stated that her property backs up to a
Flood Control Channel.
There being no other comment, the
hearing was closed to the audience.
Board discussion followed.
A MOTION WAS MADE BY FERGUSON AND
SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO.
66-95 FOR THE FOLLOWING REASONS:
1. The subject property backs up to a Flood Control
Channel.
2. The open area in the rear yard meets the re-
quirements of the City.
