MINUTES: On motion by Miller and seconded by Larkin,
the Minutes of the Huntington Beach Planning
Commission of January 4, 1967, were accepted as transcribed and
mailed.by the Secretary.

made a presentation on the subject zone case.

Attorney for Mr. Shulte and Jim Dodds, 317 *. 8th Street, Santa Ana,
Attorney for Mr. Feddieplace, addressed the Commission and requested
that the existing C-4 Zone. be retained.
Tim Talbert, 525 Alabama.St., Hunt-
ington Beach, addressed the Commission and stated that he'has a lease
on the subject property and objected to the removal of the "0" zoning.
Mr. Talbert was informed that there is no 110" zoning on the property.

DIVISION OF LAND NO. 66-6

To allow:
1. Reduction of street rights -of -way from 601 to 50' in accordance
with the intent of the standards recommended by the Director
of Pyblic Works and approved by the City Council on September 7,
1965 as shown on Exhibit "A".
2. Reduction of the minimum lot frontage on cul-de-sac and knuckles
as shown on typical plan, Exhibit "$".
3. Reduction of minimum front yard setbacks to 110" footage on cul-
de-sacs and knuckles and 10' on standard rectangular tots.
4. Reduction of minimum side yard setbacks to "0" footage on one
side and 10' on,the opposite side.
5. Architectur4l,features to encroach into the required setbacks.
6. Construction of an eight foot high wall on rear and side lot
lines, and in the front at a distance of 10 feet back of face
of curb except on cul-de-sac and knuckles where permission is
requested to construct an eight foot high wall on the front
property line as shown on Exhibit B. Also to allow construc-
tion ,of an eight foot high wall 10 feet back of face of curbs
on corner lots.
7. Lots to front on a common area instead of a dedicated street
as shown on Exhibit B.
8. The setback for garages to be measured from the inside edge
of Sidewalk in lieu of the front property line.
9. The 900 sq. ft. of open area to be placed on any portion of
the lot.

Jim Deane, applicant, addressed
the Commission and explained the proposal.
Carole Wall 9382 Nautilus Drive,
and Mrs. John Jeffers, 9402 Nautilus Drive, kuntington Beach,
addressed the Commission and opposed the 8 ft. high block wall that
would be adjacent to their back yards.
There being'no other comment; the
hearing was closed.
Each Commissioner stated his
opinion pertaining to the proposed development.
Bill Hartge, Deputy Director 'of
Public Works, addressed the Commission and discussed the variations
of street standards and sidewalks within the tract. He suggested
that condition #5 be modified pertaining to street standards.
A MOTION WAS MADE BY LAWSON AND.
SECONDED BY MILLER TO RECOMMEND APPROVAL OF USE VARIANCE NO. 66-69
TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS AS MODIFIED:
1. All conditions of approval for Tentative Tract No. 5755 shall
be complied with.
2. All utilities shall be installed underground.
3. A letter shall be submitted to the City requesting street
abandonment for that portion of the street being reverted
back to private property.
4. A parcel map shall be filed with the City and recorded.
5. A five (5) foot sidewalk will be permitted behind the curb
within the street right-of-way. The area between the sidewalk -
and the right -of -way line shall be accepted for perpetual main-
tenance by the homeowners association.
6. Architectural features may encroach into the required 30 inch
setback along a side yard where the setback has been reduced to
zero for initial construction, However, in no case shall ar-
chitectural features project beyond the property line.
7. Front yard setbacks may be reduced to zero on cul-de-sacs and
knuckles and reduced to 10 ft. on standard rectangular lots;
further, the side yard setback may be reduced -to zero on one
side of the house, subject to the following.
a. The minimum setback from all property lines shall be 10 ft.
except as otherwise provided during initial construction
on the approved plot plan.
b. The minimum setback from all lot lines shall be 10 ft.;
however, the setback on one side of the lot may be reduced
to zero at the time of initial construction. Said setbacks
shall be perpetually maintained free and clear from any
obstruction, except for a maximum three (3) ft. eave en-
croachment.
c. -The CC&Rls shall contain an irrevocable provision requiring
that a 10 ft. wide access be provided to the rear portion
of the lot from the street and that said access be perpet-
ually maintained free and clear from any obstruction except
for a maximum three (3) ft. eave encroachment.
d. Section 9106.2 shall prevail.

8. If planters are provided in the center of the cul-de-sacs,
the diameter of said cul-de-sacs shall be approved by the
Department of Public Works. This area shall be perpetually
maintained by the homeowners association. "
9. The 900 sq. ft. of open space may be placed on any portion
of the lot; however, all other provisions of Section 9103.3.1
shall apply.
10. All provisions for a community association and for perpetual
maintenance of the common area shall be approved by the
Planning Director, City Attorney and Director of Public Works.,
Said provisions shall include the following:
a. CC&Rls,articles of incorporation; by-laws and management
contract.
b. Owners and/or tenants shall be required to abide by
association rules and there shall be penalties for vio-
lation of said .rules.
c. Any interest in the common area held by the individual
parcel owner cannot be devised, conveyed, or dedicated
separate and part from the devise conveyance, and/or
dedication of the individual parcel for a life in being
plus 21 years, excepting this may be accomplished under
the same conditions or grounds as are available under
judicial partition.
d. The common areas shall be perpetually maintained by a
single homeowners association..
e. Provision shall be made for maintenance of any walls
constructed on a common -property line.
11. These conditions of approval are not general in nature
and a precise plan shall be submitted to the Planning
Department for approval prior to issuance of building permits.
Said plan shall delineate all structures proposed for initial
construction.
12. All property between the front yard fence and sidewalk plus
any additional front yard indicated on the plot plan at the time
building, permits are issued shall be maintained by the as-
sociation.
13. A feasible solution to the construction of a fence along
the north property line shall be worked out.
AND FOR THE FOLLOWING REASON:
1. The proposal is an experiment and the same exceptions will not
be granted to any other developer fora period of 18 months.
The 18 month period may be reduced if the Planning Commission
has a chance to review the plan at an earlier date.

SECONDED BY MILLER TO RECOMMEND APPROVAL OF DIVISION OF LAND
NO. 66-6 TO THE CITY COUNCIL WITH THE SAME CONDITIONS AS
USE VARIANCE NO. 66-69.

USE VARIANCE NO. 66 -68
Applicant - Milton D. Munkeby
To allow the construction and
operation of a commercial use in the R-A Residential Agri-
cultural District.
The Staff Report was read by the
Secretary.
The hearing was opened to the
audience.
Milton Munkeby, applicant, addressed
the Commission and gave his reasons for the request.
Tom Buck, 18321 Roberta Circle,
Huntington Beach, addressed the Commission, and asked some
questions about development of the property.
There being no other comment, the
hearing was closed.
The Commission held a lengthy dis-
cussion.
It was the consensus to continue
the hearing to February 7, 1967, so the Staff can prepare a
street alignment study.

66-68 TO FEBRUARY 7, 1967, WITH THE CONSENT OF THE APPLICANT.

mitted by the applicant, requesting that the Planning Commisssion
delete condition #5 pertaining to a 7 ft. high block wall to be

INFORMATION: The Secretary informed the Commission
that the City Council approved the
Planning Commission By _Laws as amended and that meetings will begin
at 6:15 P.M.,, February 21, 1967.
INFORMATION: The Secretary informed the Commission -
that the City Council has appointed
-him to serve on the downtown re -development program along with two
Planning Technicians, a Planning -Draftsman and a Secretary. Mr. Rey -a
nolds informed the Commission that Richard Harlow, Associate Planner,
will be taking over the duties of Secretary to the Planning Commission.
CnMMiTNTrATTO : The Secretary read a communication
submitted by Horace Reynolds, archi-
tect, -pertaining to design concepts for block walls along arterial
highways.
TENTATIVE TRACT MAP NO. 5017 - EXTENSION OF TIME

The Secretary read a letter sub-
mitted by Paul Calvo, engineer for the developer, requesting a one
year extension of time on Tentative Tract No. 5017.,

SECONDED BY BAZIL TO APPROVE A ONE YEAR EXTENSION OF TIME ON TENTA_
TIVE TRACT MAP NO. 5017 WITH THE FOLLOWING CONDITIONS:
1. Cameo Lane shall be shifted easterly to line with Cameo Lane
in Tentative Tract No. 6332.
2. All provisions of Article 998 shall be complied with.
3. All conditions of approval of the previously approved tentative
map shall be complied with.

THE MOTION CARRIED.
DISCUSSION: Richard Harlow, Associate Planner,
presented a composite of Final
Tract Maps 6278, 6338 and 6339. He pointed out that as a result
of the Commission's policy to allow lot averaging,many of the lots
have irregular sb apes and shallow depths. He stated that this
presented a problem because after a dwelling is placed on a lot
the remaining rear yard is not large enough for the homeowner to
construct a room addition or patio.
Commission discussion followed.
It was the consensus of the Com-
mission to establish a minimum lot depth of 100 ft. and to set a
limit on the maximum number of units per acre as an additional
condition of approval for all subdivisions for which a request is
made to average lot areas and widths.
