BOARD MEMBERS ABSENT: None MINUTES: The Minutes of January 11, 1967 were accepted as transcribed. DIVISION OF LAND NO. 67-2 Applicant: Holm, Tait & Associates To allow a division of land into 2 separate parcels bounded on the north by Garfield Ave., on the south by Yorktown, on the west by Newland Street and on the east by Magnolia (Cannery). Legal description on file in the Planning Department Office. The hearing was opened to the audience There being no one present to speak for or against the matter, the hearing was closed. Richard Harlow explained to the other Board members that this request encompassed the same property included in Division of Land No. 66-32. He stated that the applicant filed this new Division of Land because they wanted to increase the size of parcel 2 to accomodate a service station. Board discussion followed. A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO APPROVE DIVISION OF LAND NO. 67-2 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Garfield Avenue and Cannery Street shall be dedicated and fully improved to City Standards at the time each parcel is developed. Improvements shall include street trees, street signs, and street lights. 2. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Streets and High- way�Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Hunting- ton each's sewage system at the time each parcel is developed. 5. The property shall participate in the local drainage assessment district at the time each parcel is developed. 6. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. __ - 1/18/67. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. The Edison Company Right -of -Way shall be fenced to City Standards. 9. Division of Land No. 66-32 shall be null and void. ROLL CALL VOTE: AYES: Mandrell, Harlow, Ferguson. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 67-2 Applicant: Robert H. Grant & Co. To allow a 10' x 20' roof structure to encroach to within 1 ft. of the side property line in deviation to the required 5 ft. side yard setback. Located at 8211 Dartmoor -Drive and legally described as Lot 46 of Tract 6302. The hearing was opened to the audience. Merrill Moltz, representing the applicant, explained the reasons for the request to the Board. He stated that the roof structure would be used to shelter, a boat. He explained further that there will be sufficient separation from the adjoining property because -of a public easement between the two lots, also the posts supporting' the roof will be setback one ft. from the wall on the edge of the easement. Bob Kay, representative of'the applicant, stated that the architecture of the structure will add to the aesthetical value of the house and surrounding neighbor- hood, also it will provide a place to store a boat instead of having it parked in front of the dwelling. It was noted by the Board that the boat - could not be stored in the rear yard because the steps leading to the service door of the house encroach into the side yard. Sam Ferguson stated that this would be one way of solving the City's problems regarding storage of inoperable vehicles and trailers in front of dwellings. There being no further comment, the hearing was closed to the audience. Board discussion followed. A MOTION WAS MADE _BY MANDRELL AND SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 67-2 SUBJECT TO THE FOLLOWING CONDITION: 1. The addition shall be constructed,of a -material which will be compatible with the existing building. FOR THE FOLLOWING REASONS: 1. It is not possible to get the boat into the rear yard. -2- 1/18/67. Due to a 8' walkway abutting the side property line, there will be sufficient separation from the adjoin- ing property. ROLL CALL VOTE: AYES.: Mandrell, NOES: None. ABSENT: None. THE MOTION CARRIED. Harlow, Ferguson. AREA VARIANCE NO. 66-96 - continued Applicant: Alco Pacific Construction To allow a dwelling with a side entry garage to be setback 10-ft. from the front property line in deviation to the required 15 ft. setback. Located on the northwest corner of Mariposa Drive and Lido Lane and legally described as Lot 88 of Tract_5601. The hearing was opened to the audience. Mrs. Robert Paxton and Margaret Severn, adjacent.property owners, spoke in opposition to the proposed request and submitted a, petition signed by 23 property owners objecting to the subject request. Mrs. Paxton explained that the extension of the garage into the front yard setback would present ,a safety hazard. John Mandrell stated that the Board observed the site and there is sufficient front yard setback which did not appear to cause a safety hazard. Mrs. Paxton also -indicated that she did not care for the type of floor plan that is to be constructed on the subject property. Vern Davis, representingg the applicant, explained the reasons for the request. He stated that this lot was the only one that did not have a variance for a reduced front yard setback. He also stated that this floor plan was one of their best sellers and it would be impossible to put another model on the property because of the cost and time involved. There being no further comment, the hearing was closed to the audience. Board discussion followed. A MOTION WAS MADE BY HARLOW TO DENY AREA VARIANCE NO. 66-96 FOR THE FOLLOWING REASON: 1. Reduction of the front yard setback was intended to provide for a variation in front yard setbacks, but in this case all the houses on this block are set back 22 f t ., also if this floor plan is placed on the lot it will not maintain the continuity which has already been estalished. A MOTION WAS MADE BY MANDRELL AND SECONDED BY FERGUSON TO APPROVE AREA -VARIANCE NO. 66-96 FOR THE FOLLOWING REASONS: 1. This request is the same as other requests in this tract. 2. Continuity is broken on the street at the lot approximately 5 houses further down.the street. 3. This does not present a safety problem. 4. The portion of the house projecting in the front yard is of a construction compatible with the front of the house. 5. The reduced front yard setback will not block the vision from the adjacent house.
