Council pf the City of Huntington Beach to. order at 4:;30 P.M. The Pledge of Allegiance was.given,by all present in.the Council Chamber The invocation was given -by Father Denoan of SS Simon and Jude Catholic Church. ROLL CALL Councilmen Present: Coen, Bartlett, Gjgj0r, Kaufman, Shipley, Green, Stewart Councilmen Absent: None MINUTES On motion by Bartlett, the. minutes of the., regular.meet.ing.of_January 16, 1967, were approved and adoptedas prepared and mailed by the City Clerk. Motion carried. COMMENDATION Mayor Stewart extended congratulations,;,on..behalf of the Council, to James R. Wheeler, Director of Public Works, for his achievement in obtaining a Master's Degree in.Civil Engineering. ZONE CASE 66-58 - PARCEL, "A" The Clerk presented a communication from .the Planning Department transmitting Zone Case 66-58, subs -item "A". for change of zone from C4 to R3 on property located on. the .northeast corner of Garfield Avenue and Beach Boulevard. The,F}.anning Commission has recommended denial. On motion by Kaufman, Council orde.red,a public hearing for Monday, February 20, 1967, at 7:30 P.M,, or.as.soon thereafter as possible, on Zone Case No. 66-58, Parcel "A", and.directed the City Clerk to publish notice of same. Motion carried. `I CAPITAL IMPROVEMENTS PROGRAM The Clerk presented a transmittal from the Planning Commission of the Capital Improvements Program for the Fiscal Years, from 1967-68 through: 1971-72, for Council's consideration and action. On motion by Bartlett, Council ordered a public hearing for Monday, February 20, 1967, at 7:30 P.M., or as soon thereafter as possible, on the Capital Improvements Program, and directed the City Clerk to publish notice of same. Motion carried. 4 Page # 2 - Minutes, February 6, 1967 //7 UV 66-69 - CONDITIONAL EXCEPTION - DEANNE BROS The Clerk presented a transmittal from the Planning Department of Conditional Exception - UV 66-69 - Deane Brothers - on property located on the west side of Bushard Street,. approximately 1,000 feet south of Adams Avenue. The Planning Commission had recommended approval. On motion by Gisler; Council sustained the recommendation of the :Manning Commission and directed the City Attorney to prepare a Resolution approving UV'66-69, Motion carried. E'1Y C� HUNTINGTON BEACH FREEWAY The Clerk presented a recommendation from the Planning Commission for the adoption of the Green-5-Dashed-Red route as the preferred alignment of the Huntington Beach Freeway. Councilman Green discussed various benefits of other proposed routes - particularly the Red route. On motion by Kaufman, Council sustained the Planning Commission and adopted the Green-5-Dashed-Red route as the preferred alignment of the Huntington Beach Freeway. Motion carried. i (, ` SUBDIVISION AGREEMENT - COVINGTON BROS - TRACT 5894 The Clerk presented a transmittal from the Director of Public Works of Monument Bond, Improvement Bond, and Subdivision Agreement for Tract 5894 - Covington Brothers. On motion by Kaufman, Council accepted Monument Bond No. 3292564, and Improvement Bond No. 3907104 - Hartford Accident and Indemnity Company; approved the Subdivision Agreement for Tract 5894, and directed the Clerk to file same; and authorized the Mayor and City Clerk to execute same on behalf of the City. Motion carried. 1 c '�' SUBDIVISION AGREEMENT - FLALLON CORP - TRACT 5525 The Clerk presented a transmittal from the Director of Public Works of Monument Bond, Improvement Bond, and Subdivision Agreement for Tract 5525 - Flallon Corporation. On motion by Kaufman, Council accepted Monument Bond No. 574968 and Improvement Bond No. 574966 - General Insurance Company of America; approved the Subdivision Agreem�n.t fo.r'Tract 5525, and directed the Clerk to file same'; and authorized the Mayor and City Clerk to execute same on behalf of the City, Motion carried. q 67 REIMBURSEMENT AGREEMENT, No 137 - C-D DEVELOPMENT CO The Clerk presented a transmittal from the Director of Public Works of Reimbursement Agreement No. 137, between C-D Development Company and the City, covering refund for costs incurred in the installation of storm drain facilities. On motion by Kaufman, Council approved Reimbursement Agreement No. 137 between C-D Development Company and the City, and authorized the Mayor and the City Clerk to execute same on behalf of the City. Motion carried. 403 Page #3 - Minutes, February 6, 1967 CC 049- NOTICE OF COMPLETION - HANE CONSTRUCTION CO, INC The Clerk presented a communication from the Director of Public Works stating that work on the C5-SC2 Channel Improvements had been,satisfac- torily completed, and recommending that Council accept the work on Project CC-049. On motion by Kaufman, Council accepted the work on Project CC-049 - 05-SC2 Channel Improvements, and directed the City Clerk to file a Notice of Completion with the Orange County.Recorder. Motion carried. TRACTS 5907 & 5939 - DEDICATION OF IMPROVEMENTS - ESSEX LAND CO The Clerk presented a communication from the Director of Public Works recommending acceptance of dedicated improvements, authorization for release of the Improvement and Monument Bonds, and termination of the Subdividion Agreement in Tracts No. 5907 and 5939 - Essex Land Company. On motion by Kaufman, Council accepted improvements dedicated for public use in Tracts No. 5907 and 5939; authorized the release of Improvement and Monument Bonds and termination of the Subdivision Agreement, and directed that the developer be notified by the City Clerk and the bonding company be notified by the City Treasurer. Motion carried. TRANSFER OF FUNDS - GAS TAX FUND FROM SEWER FUND The Clerk read Resolution No. 25.08 by title - "A RESOLUTION OF THE CITY COUNCIL OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE SEWER FUND." On motion by Bartlett, Council waived further reading of Resolution No. 2508, and passed and adopted same by the following roll call vote: AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Shipley, Green, Stewart NOES: Councilmen: None ABSENT: Councilmen: None . IMPROVEMENTS — WATER MAINS VARIOUS STREETS - CC-054 The Clerk presented a transmittal from the Director of Public Works of Plans and Specifications, Resolution and Notice Inviting Sealed bids for the improvement of water mains In various.streets in the City. On motion by Kaufman, Council approved the Plans and Specifications for the water main project and ordered same filed; and directed the City Clerk to advertise for bids when notified by the Director of Public Works. Motion carried. Clark - St R/W - Ocean Avenue and 18th Street On motion by Kaufman, Council accepted the deeds as listed, and directed the City Clerk to record same with the Orange County Recorder, Motion carried, CLAIM NO .3-67 - FRANKLIN D BRYANT The Clerk presented a claim from Franklin D. Bryant for alleged damages to his automobile in an accident with.a City vehicle. On motion by Coen, Council denied the claim filed by Franklin D. Bryant, and referred same to the City Attorney and the City's insurance carrier. Motion carried, AGREEMENT - JR CHAMBER OF COMMERCE.- JULY 4th PARADE The Clerk presented an Agreement between the City and the Huntington Beach Junior Chamber of Commerce for services in promoting the 1967 Fourth of July Parade, for an.amount not to exceed $10,000. On motion by Coen, Council approved the Agreement between the City and the Jr. Chamber of Commerce for the Fourth of July Parade, and authorized the Mayor and City Clerk to execute same on behalf of the City. Motion carried. 05 Page # 5 - Minutes, February 6, 1967 4� AGREEMENT —STONE & YOUNGBERG The Clerk presented an Agreement between the City .'and Stone `& Youngberg, authorising their employment as consultants, to plan for the financing of a Capital Improvement Program. On motion by Shipley, Council approved the Agreement between the City and the firm of.Stone & Youngberg relative to'the`Capital Improvements Program, and authorized the Mayor ai d'City Clerk`to execute same on behalf of the City. Motion carried. W.O.C.W.B. BUDGET The Clerk presented a transmittal from the'llirectors of the West Orange County Water Board of their proposed 1967-68 Budget. On motion by Green, Council accepted'the'1967-68 Budget of the 'lest Orange County Water Board and referred sane to the'City Finance''Director. Motion carried. EXCHANGE OF PROPERTY - OCEAN VIEW SCHOOL'DISTAICT The.Clerk presented a transmittal of Escrow Instructions No. 440398-VH and an Agreement to exchange certain property with the Ocean View School District. On motion by Bartlett, Council approved the Agreement and Escrow Instructions No. 440398-VH with the Ocean View School District, and authorized the Mayor and City Clerk to execute same on behalf of the City. Motion carried. �i LEASE AGREEMENT - HUNTINGTON DRIFTWOOD ,-INC The Clerk presented.a lease agreement betvieen the City and Huntington Driftwood, Inc., to incorporate abandoned State Highway land at Huntington Avenue and U.S. Highway 101 into the Master Lease with Huntington Driftwood, Inc. On motion by Bartlett, Council approved the lease agreement between the City and Huntington Driftwood, `Inc., authorized the Mayor and City Clerk to execute said Agreement, and directed the Clerk to record same. Motion carried. ORDINANCE NO 1277 - ADOPTED ZONE.CASE N©.,.66-58 The Clerk. gave Ordinance No. 1277 a second reading by title - "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO ZONE CASE NO.•66-58; AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY RECLASSIFYING DM-40 (Sectional District Map 26-5-11) and PRtZONING AND RECLASSIFYING PARCEL 'C' OF ZONE CASE No. 66-58." On motion by Shipley, Council ordered a public hearing for Monday„ February 20, 1967, at 7:30 P.M., or as soon thereafter as possible, on Ordinance No. 1302, and directed the City Clerk to publish notice of same. EXPENDITURE - LIFEGUARD BOAT On motion by Kaufman, Council authorized the expenditure of additional funds of $1500 from the budget, for the replacement of a small outboard boat for the patrol of Huntington Harbour, by the following roll call vote: AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Shipley, Green, Stewart NOES: Councilmen: None ABSENT: Councilmen: None EXPENDITURE - AUTOMATIC GATES AT BEACH PARKING LOT On motion by Gisler, Council authorized the expenditure of approximately $5000 for the installation of automatic gates at the City beach parking lot between Huntington Street and the Highway 39 intersection, by the following roll call vote: AYES: Councilmen: Coen•, Bartlett, Gisler, Kaufman, Shipley, Green, Stewart NOES: Councilmen; None ABSENT: Councilmen., None EXPENDITURE - OFFICE FURNITURE - PLANNING DEPARTMENT On motion by Kaufman, Council authorized the expenditure of an amount not to exceed $1700 for the necessary additional office furniture and supplies required by the Planning Department to establish an office for the master planning of the downtown area, by the!fol:lowing roll call vote: AYES: Councilmen: Coen, Bartlett, Gisler, Kaufman, Shipley, Green, Stewart NOES: Councilmen: None ABSENT: Councilmen.: None AGREEMENT - SUNSET BEACH-SURFSIDE WATER COMPANY The City Administrator presented an Agreement which stipulates before the Public Utilities Commission that the City will sell the Sunset Beach- Surfside Water Company to the people of that area, if and when they are successful in creating and financing a Water District. On motion by Gisler, Council deferred action on said Agreement until notification has been received from the Attorney representing the City. Motion carried. CROSS -COMPLAINT - HENRY BRUDERLIN On motion by Bartlett, Council authorized the City Attorney to file a cross complaint against Mr. Henry Bruderlin for the recovery of money owed the City of Huntington Beach for water service. Motion carried. Al-0 Page # 10 - Minutes, February 6, 1967 a ULI COMMITTEE - COMPENSATION On motion by Bartlett, Council directed the Administrator to study and report back to Council on the various Boards and Commissions of the City, including the Urban Land Institute Committee; and the compensation arrangements for each. Motion carried. t y GRANT APPLICATION m PLANNING The City Administrator informed the Council that planning grants are available, and that Federal funds are administered through the State and require twenty five per cent matching moneys from the City. On motion by Kaufman, Council instructed the Administrator and the Staff to prepare a survey, and to complete the application for such Federal grant. Motion carried. 0`i _. '7 '5 MUNICIPAL COURT FACILITIES - MOBILE UNIT The Administrator informed the Council of a communication from Richard Matheny of the Orange County Property Department requesting permission for the County to install a portable classroom -type mobile unit on the lawn adjacent to the old fire station building fronting on Main Street at the south end of the Library. The term of the temporary agreement would be through October 31, 1967. On motion by Gisler, Council granted the request of. the County of Orange to install a temporary mobile unit for use by the Courts, and directed the City Administrator to execute the agreement. Motion carried, r�T t RECOMMENDATION - PARALLEL PARKING - H B SAFETY COUNCIL The Clerk presented a letter from the Huntington Beach Safety Council recommending that Council investigate the possibIlity of changing the parking on Sixth Street from diagonal to parallel, between Orange Avenue and MAin Street. On motion by Kaufman, Council directed the Staff to study the parking on Sixth Street between Orange Avenue and Main Street and report back to Council. Motion carried. REQUEST - MODEL HOME DISPLAY The Clerk presented a letter from Barker Bros., Corporation, requesting permission to display a model home in the parking lot at Huntington Center. On motion by Shipley, Council granted permission to Barker_ Bros. to display a model home in the parking lot at Huntington Center for sixty days, subject to the posting of the required bonds. GARDEN GROVE RESOLUTION NO 3280-67 The City Clerk presented a communication from Garden Grove transmitting Resolution No. 3280-67 supporting the Central corridor for Route 39 Freeway alignment. On motion by Kaufman, Council received the Resolution from Garden Grove and ordered it filed by the City Clerk. Motion carried. 17111 STANDING WATER - CLARIFICATION The Clerk presented a letter from William Miles, owner of 66 acres on the corner of Goldenwest Street and McFadden Avenue on which a temporary standing water condition exists, requesting that fencing of standing water be limited to permanent year-round standing water and not to a temporary condition. A report from the Director of Public Works recommended that each situation have individual consideration by the Council. On motion by Gisler, Council referred the matter of fencing standing water to the Building Department, Department of Public Works, Attorney and the Administrator for study and a report back to Council. Motion carried. REQUEST - HOME VISIT COMMITTEE The Clerk presented a letter from the Home Visit committee of the Church Councils of Orange County requesting the adoption by the Council of a resolution endorsing their project. On motion by Coen, Council directed the City Attorney to prepare a resolution endorsing the Home Visit Committee's project. Motion carried, FEDERAL HIGHWAY BEAUTIFICATION ACT OF 1965 The Clerk presented a communication from the California Roadside Council transmitting a suggested Resolution opposing payment of compensation for removal of certain outdoor advertising signs, for Council consideration and action. On motion by Kaufman, Council approved the suggestion of the California Roadside Council in opposing payment of compensation for removal of certain outdoor advertising signs, and directed the City Attorney to prepare a similar resolution.
