TUESDAY, FEBRUARY 7, 1967' COMMISSIONERS'PRESENT: Miller, Worthy, Lawson, Royer,_ Bazil, Tom. -COMMISSIONERS ABSENT: Larkin MINUTES: On motion by Miller and seconded �— by.mom, the Minutes of the Huntington Beach Planning Commission of January 17, 1967, were accepted as transcribed and mailed by the Secretary. COMMISSIONER LARKIN: Commissioner Larkin arrived at 7:40 P.M. and assumed his duties. ZONE CASE NO. 66-65 - Continued Applicant - Andrew L. Holtz ange of zone from'R-A Residential Agricultural District to C-1 Neighbor- hood Commercial District with setback provisions. : The Secretary informed the Commission that the subject zone case was -continued from December 6, 1966 meeting and was discussed at their study session on January 1, 1967. At that time it was discussed whether to revise the C-1 Zone to be more restrictive so as to serve as a zone for neighborhood shopping centers. The Staff Report was read by the Secretary. The hearing was opened to the audience. Robert Raab, representing the applicant, addressed the Commission and gave his reasons for the request. There being no other comment the hearing was closed. It was the consensus of the Commission to continue Zone Case No. 66-65 for 6 months in order to revise the present 0-1 Zone to be more restrictive. A MOTION WAS MADE BY BAZIL AND SECONDED BY LARKIN TO CONTINUE THE HEARING ON ZONE CASE NO. 66-65 TO AUGUST 1, 1967, WITH THE CONSENT OF THE APPLICANT. Munkebv To allow the construction and operation of a commercial use in the R-A Residential Agricultural District. The Staff Report was read by the Secretary. Floyd Belsito, Associate Planner, made a presentation on proposed land uses and street patterns on the subject property and adjacent parcels. The hearing was opened to the audience. Milton Munkeby, applicant, addressed the Commission and explained his request. hearing was closed. There being no further comment the The Commission held a lengthy discussion. A MOTION WAS MADE BY BAZIL AND SECONDED BY TOM TO APPROVE USE VARIANCE NO. 66-68 UPON THE FOLLOWING CONDITIONS: 1. A precise plan shall be submitted to the Board of Zoning Adjustments for approval. 2. All proposed uses shall conform to C-4 Zone requirements. 3. Approval of the proposed commercial use will be restricted to the westerly 180± feet. ROLL CALL VOTE: AYES: Miller, Worthy, Lawson, Bazil, Royer, Tom, Larkin. NOES: None. ABSENT: None. ZONE CASE NO. 66-71 - Continued RESOLUTION OF INTENT Change of zone from R-3 Limited Multiple Family Residence District to M-1 Light Industrial District. the proposal. Each Commissioner stated his opinion pertaining to the proposed zone change. RESOLUTION NO. 66-71 A Resolution of the City Planning �- Commission Recommending Denial of Zone Case No. 66-71 to•the City Council. A MOTION WAS MADE BY TOM AND SECONDED BY MILLER TO ADOPT RESOLUTION NO, 66-71 RECOMMENDING DENIAL OF ZONE CASE NO. 66-71 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. The land owner paid R-3 prices for the property. ROLL CALL VOTE: AYES: Miller, Lawson, Royer, Bazil, Tom, Larkin. NOES: None. ABSENT: None. ABSTAINED: Worthy. THE RESOLUTION WAS ADOPTED. ZONE CASE NO. 67-1 RESOLUTION OF INTENT Change of zone from C-1 Neighborhood Commercial District to R-3 Limited Multiple Family Residence District and C-4 Highway Commercial District with setback provisions. The,Secretary informed the Commission that the subject zone change was required as a condition of approval for Tentative Tract No. 5322; however, the subdivider failed to submit a zone change appli6ation, The hearing was opened to the audience. Don Jones of Paul Jones Realty, addressed the Commission and stated that he has sold property in this tract for an office -professional use; therefore., he objected to the proposal. Allen Klingensmith, City, addressed the Commission and stated that he has bought -property for the purpose of constructing a professional office; therefore, he objected to the change of zone. There being no other comment the hear- ing was closed. RESOLUTION NO. 67-1 A Resolution of the City Planning Commission Recommending Approval of Zone Case No. 67-1 as Modified to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO ADOPT RESOLUTION NO. 67-1 RECOMMENDING APPROVAL OF ZONE CASE NO. 67-1 FOR R-31 R-5 and 0-4 ZONES TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. The proposed R-3 Zone was a condition of approval on Tentative Tract No. 5322. -3- 2/7/67. Minutes: H.B. Planning Commission Tuesday, February 7, 1967 Page No. 4 2. The proposed C-4 zone would conform to zoning already established along Beach Blvd. 3. The three lots fronting on Talbert Avenue are planned and committed for professional uses, ROLL CALL VOTE: AYES: Miller, Lawson, Royer, Worthy, Bazil, Tom, Larkin. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. ZONE CASE NO. 67-2 USE VARIANCE NO. 67-4 Applicant - UNA Investors, Inc. Use Variance Request: To allow the construction of a service station in the R-A-O Residential Agricultural District combined with oil production. The Secretary informed the Commission that Zone Case No. 67-2 can not be heard because of improper notifications; therefore, the public hearing has been rescheduled for February 21, 1967. The Secretary read the Staff Report for Use Variance No. 67-4. The hearing was opened to the audience, there being no comment the hearing was closed. A MOTION WAS MADE BY LAWSON AND SECONDED BY BAZIL TO APPROVE USE VARIANCE NO. 67-4 UPON THE FOLLOWING CONDITIONS: 1. Brookhurst Street shall be dedicated to City Standards. Said dedication shall include a 30' radius at the intersection of Hamilton Avenue and Brookhurst Street. 2. Hamilton Ave. and Brookhurst Street shall be fully improved to City Standards. Improvements shall include street trees,. - street signs, and street lights. 3. All streets shall conform to City of •Huntington Beach Standards. Master Plan.of Arterial Streets and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 4. Water supply shall be through the City of Huntington Beach's water system. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system. 6. The property shall participate in the local drainage assess- ment district. 7. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 8. RESOLUTION NO. 67-4 A Resolution of the City Planning Commission Recommending Denial of Zone Case No. 67-4 to'the City Council. A MOTION WAS MADE BY LAWSON AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO. 67-4 RECOMHENDING DENIAL OF ZONE CASE NO. 6774 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1., The proposed zone change is located in an area that was just recently rezoned to conform with the adopted master plan. 2. This case represents an easterly extension of commercial along Warner Avenue and the property will have local street orientation. ROLL CALL VOTE: AYES: Miller, Lawson, Royer, Worthy, Bazil, Tom, Larkin. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. USE VARIANCE NO. 67-1 Applicant - Paul A. Cooper To permit the continuance of a retail and wholesale business of peat soil and fertilizer in the R-A-O Residential Agricultural District combined with oil production. The Staff Report was read by the Secretary. The hearing was opened to the audience. The applicant addressed the Commission and offered to answer any questions. He further requested that his application be continued for two weeks in order to review the suggested conditions. There being no other comment the hearing was closed. A MOTION WAS MADE BY TOM AND SECONDED BY ROYER TO CONTINUE THE HEARING ON USE VARIANCE NO. 67-1 TO FEBRUARY 21, 1967, AT THE REQUEST OF THE APPLICANT. Planning Commission Tuesday, February 7, 1967 Page No. 7. USE VARIANCE NO. 67-2 Applicant - John Kratz - Robert Mattox To permit the following: 1. Operation of an equestrian stable in the M-1 Light -Industrial Zone. 2. Allowance.for two homesites for caretakers. 3. Substitution of turfed areas for paved parking areas. 4. Waiver of improvements of north side of Talbert Avenue, until such .time as the south side is improved. 5.. Waiver of payment of drainage fees for a period of two years. The Secretary informed the Commission that the Planning Department received 18 letters endorsing the proposal and 2 letters against the request. The Secretary read a letter submitted by the Fire Department requesting a 60 day continuance for the purpose of conducting further fire protection studies on the subject premises and adjacent property.. The Staff Report was read by the Secretary. The hearing was opened to the audience. The following people addressed the Commission and spoke in favor: John Kratz, 16532 Hart Circle, City, Marilyn Guy, 7802 Newman Street, City, Larry Arithor, 2731 W. Lincoln, Anaheim, Earl Katenbach, 1911 Hollytree Lane, Santa Ana, Rev. Anderson and Rev. J. Owens, Los Angeles. Speaking in opposition were the following: Mr. and Mrs. Bill Howell, 9882 Spinnaker Drive, City, and Jack Zukie, 7762 Ronald Rd., City. Norman Worthy, Parks and Recreation Director, addressed the Commission and stated that from a recreational standpoint, it is a good project. There being no other comment the hearing was closed, Lengthy discussion was held by the Commission. A MOTION WAS MADE BY ROYER AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO. 67-2 UPON THE FOLLOWING CONDITIONS: 1. Use Variance No. 67-2 is approved for general location and general concept only. 2. The applicant shall submit a precise development plan and phasing program to the Board of Zoning Adjustments for approval. 3. Commissioner Tom excused himself from further participation. USE VARIANCE NO. 67,3 Applicant - Harold L. Harper " To allow the construction of a drive-in, walk-up restaurant in the 0-1 Neighbor- hood Commercial District. The Staff Report was read by the Secretary. The hearing was opened to the audience, there being no comment the hearing was closed. The Commission held a lengthy discussion. Bud Gorham, representing the applicant, addressed the Commission and explained the request. A MOTION WAS MADE BY BAZIL AND SECONDED BY LAWSON TO APPROVE USE VARIANCE NO. 67-3 UPON THE FOLLOWING CONDITIONS: 1. A change of zone application to C-4 shall be submitted on the entire parcel (Lot 1, Tract 4305). 2. Off-street parking facilities on the entire parcel (Lot 1, Tract 4305) shall conform to all provisions of Article 979. 3. Both Garfield Ave. and Brookhurst Street shall be improved with street trees to Department of Public Works Standards. 4. All utilities shall be installed underground. 5. The 50 ft. front yard setback shall be complied with. AND FOR THE FOLLOWING REASON: 1. The property should be zoned 0-4 and not C-1. ARMOUR DEVELOPMENT The Commission reviewed the plot plan pertaining to Tentative Tract 6283. Larry Armour, developer, addressed the Commission and explained the development concept and proposed modifications in the tentative tract. Earl Kaltenbach, architect, addressed the Commission and displayed various house sketches. A MOTION WAS MADE BY LAWSON AND SECONDED BY BAZIL TO APPROVE THE PROPOSAL TO LOCATE HOUSES ON ONE SIDE PROPERTY LINE (ZERO SIDE YARD), SUBJECT TO APPROVAL OF A PRECISE PLAN BY THE BOARD OF ZONING ADJUSTMENTS. ROLL CALL VOTE: AYES: Miller, Worthy, Lawson, Bazil, Royer. NOES: Larkin ABSENT: Tom. THE MOTION CARRIED. MARINA PARK SITE: Norman Worthy, Director of Parks and Recreation addressed the Commission and displayed a sketch depicting development of Marina Park. Commission reviewed the concept. A MOTION WAS MADE BY BAZIL AND SECONDED BY LARKIN TO APPROVE THE DEVELOPMENT CONCEPT OF MARINA PARK. ROLL CALL VOTE: AYES: Miller, Worthy, Lawson, Bazil, Royer,.Larkin. NOES: None. ABSENT: Tom.
