HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS

BOARD MEMBERS PRESENT: John Mandrell, Sam Ferguson
Richard Harlow.
BOARD MEMBERS ABSENT: None.
MINUTES: The minutes of January 25, 1967
were accepted as amended.
DIVISION OF LAND N0. 67-3
Applicant: Holm, Tait & Associates, Inc.
To allow a division of land into 3
separate parcels located on the southeast corner of Springdale Street
and Edinger Avenue. Legal on file in the Planning Department Office.
The hearing was opened to the audience.
Mr. McClard, representing Holm, Tait,
& Associates, Inc., explained the reasons for the request.
The suggested conditions of approval
were reviewed.
A MOTION WAS' MADE BY MANDRELL AND
SECONDED BY FERGUSON TO APPROVE DIVISION OF LAND NO. 67-3 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. Edinger Street and Springdale Street shall be fully improved to City
Standards. Improvements shall include street trees, street signs,
and street lights.
2. Water supply shall be through the City of Huntington Beach's water
system at the time each parcel is developed.,
3. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time each parcel is developed.
!t. The property shall participate in the local drainage assessment
district at the time each parcel is developed.
5. Preliminary and final soil reports shall be subnitted by an approved
private soils engineer to the City prior to issuance of building
permits.
6. All utilities shall be installed underground at the time each parcel
is developed.
.7. The water, sewer, and fire hydrant system shall be approved by the
Department of Public Works and Fire Department.
8. A parcel map shall be filed with the city and recorded.
9. The Division of Land shall not be effective until an agreement is
signed and recorded agreeing to the conditions listed above.

AREA VARIANCE NO. 67-6
Applicant: Holm, Tait & Associates, Inc.
To allow construction of a
service station within the required 50 ft. building setback in the C-2
Community Business District. Located at the southeast corner of Springdale
Street and Edinger Avenue. Legal description on file in the Planning Depart-
ment Office.
The hearing was opened to the
audience.
Mr. McClard, representing the
applicant, explained the reasons for the request. He stated that encroachment
into the setback was needed to allow better arrangement of the islands for
better service to the customer and to have better utilization of the land.
It was noted that this would be
a 142 ft. encroachment into the required setback on Springdale Street.
There being no other comment,
the hearing was closed to the audience.

A MOTION WAS MADE BY HARLOW AND
SECONDED BY MANDRELL TO DENY THAT PORTION OF THE REQUEST TO ALLOW THE BUILDING
TO ENCROACH INTO THE REQUIRED SETBACK AREA FOR. THE FOLLOWING REASONS:
1. The building can be arranged on the lot to meet the setback requirements.
2. The applicant failed to show sufficient justification for the request.
AND TO APPROVE THAT PORTION OF
THE REQUEST FOR A 6' HIGH BLACK WALL TO BE CONSTRUCTED 25' FROM THE FRONT
PROPERTY LINE SUBJECT TO THE FOLLOWING CO�SDITION:
1. The fence shall not project closer to the front property line than the
setback of the church on the adjacent property.

AREA VARIANCE N0. 67-7
Applicant: Jack Chernoff, AIA
To permit a 5 ft exterior side
yard setback in deviation to the required 10 ft. setback and to permit an 18 ft.
minimum dimension for the required open space in deviation to the required 20 ft.
Located at the northeast corner of Thor Drive and Springdale Street and legally
described as Lot #1, Tract No. 5525.
The hearing was opened to the
audience.
Mr. Adler, representing the applicant,
explained the reasons for the request. He stated that a 5' side yard setback was
approved by FHA because the lot abuts a city wall. He also stated that this is
the only model that will fit on the lot.
It was noted that the 5 ft, set-
back only occured at the rear corner of the house and that there was a 12 ft.
setback from the side property line at the front of the house thereby providing
adequate sight clearance.

It was also noted that there was
860 sq. ft. of open space with a minimum dimension of 20 ft. within
the rear 2/3 of the lot and although this was hO, sq. ft. less than
the required minimum open space there is an additional 558 sq. ft.
of open space with a minimum dimension of 18 ft. behind the house.
There being no other comment,
the hearing was closed to the audience.

A MOTION WAS MADE BY FERGUSON
AND SECONDED BY MANDRELL TO APPROVE AREA VARIANCE NO. 67-7 AND
ALLOW THE 860 S0. FT. OF OPEN SPACE, TO SATISFY THE MINIMUM OPEN
SPACE REQUIREMFNTS FOR THE FOLLOWING REASONS:
1. There is sufficient open area within the rear yard.
2. The exterior side .yard is separated from the Arterial Highway
by a city perimeter wall.
3. The'5 ft. setback on the exterior side yard setback only occurs
at the rear corner of the house.

AREA VARIANCE NO. 67-8
Applicant: Armour Development Co.
To permit a zero side yard setback
on one side of a lot having at least a 10 ft. side yard setback on
the opposite side. Located on the north side of Atlanta Avenue, east
of Magnolia Street and legally described as Tentative Tract No. 6283.
The hearing was opened to the audience.
Mr. Bruns and Mr. Samson, representatives
of the applicant, displayed various sketches of the proposal.
It was noted by the Board that the
concept of the proposed development was approved by the Planning
Commission on February 7, 1967.
Lengthy discussion followed.
There being no other comment, the
hearing was closed to the audience.

A MOTION WAS MADE BY HARLOW AND
SECONDED BY FERGUSON TO APPROVE AREA VARIANCE NO. 67-8 SUBJECT TO
THE FOLLOWING CONDITIONS:
1. A precise plan shall be submitted to the Board prior to issuance
of building permits.
2. The CC&R shall contain an irrevocable provision requiring that a
10 ft. wide access be provided to the rear portion of the lot
from the street and that said access be perpetually maintained
free and clear from any obstruction except for a maximum three
(3) ft. eave encroachment.
This section shall not apply to garden walls or fences crossing
such access provided such fence or wall is equipt with a gate
and does not exceed a height of 6 ft.

3. Provision shall be made for maintenance of any walls constructed on a
common property line.
WITH THE FOLLOWING CRITERIA AS GUIDELINES FOR THE PRECISE PLAN:
1. The 2 story portion of any dwelling shall be setback from the property line.
2. The house wall along the arterial highways shall be setback on private
property.
3. Walls along arterial highways shall be approved by the Department of
Publid Works.
4. The required 10 ft. setback along one side of the house shall provide
access to the rear of the lot.
5. Architectural features may encroach into the required 30 inch setback along
the side yard where the setback has been reduced to zero for initial con-
struction. However, in no case shall architectural features project beyond
the property line.
6. The wall along commercial area may be increased to 8 ft. in height. Pro-
visions for such wall shall be included in the precise development plan.

No. 6123, 860 feet east of Beach Boulevard, south of Garfield Avenue and legally
described as Lots 9, 21, 37, 51, 52, 56 and 57 of Tract 6123.
